On the conditions for organizations and individuals engaged in mineral exploration activities
THE MINISTER OF INDUSTRY
Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 68/CP dated November 1, 1996 of the Government detailing the implementation of the Law on Minerals;
Pursuant to Decree No. 30/2000/NĐ-CP dated August 11, 2000 of the Government regarding the abolition of certain licenses and the conversion of certain licenses into business conditions;
At the proposal of the Director of the Vietnam Geological and Mineral Resources Administration and the Head of the Legal Department,
DECISION:
Article 1. Organizations engaged in mineral exploration must meet the following conditions:
1- Be specialized geological organizations established by competent state authorities, permitted to be established, or other economic organizations established in accordance with the State Enterprise Law, the Enterprise Law, and the Cooperative Law;
2- Have a technical director with at least a bachelor's degree in geology and at least five years of practical work experience (excluding internship periods) in mineral exploration activities, understanding and mastering legal regulations on mineral exploration, capable of leading the preparation of exploration plans, directing the implementation of such plans, compiling documentation, and serving as chief editor of the final report on mineral exploration results;
3- Have technical staff in specialties such as geological exploration, hydrogeological and engineering geological surveys, geophysics, drilling, excavation... ensuring the effective execution of approved or accepted exploration projects by competent authorities;
4- Possess sufficient specialized equipment and tools necessary (including contracts or leases) to carry out mineral exploration works, ensuring quality according to the requirements of the approved or accepted exploration project by competent authorities.
Article 2. Individuals engaged in mineral exploration must meet the conditions for technical directors as stipulated in Clause 2 of Article 1 of this Decision.
Article 3. This Decision shall take effect fifteen days from the date of signature and replace Decision No. 1455/QĐ-ĐCKS dated September 4, 1997 of the Minister of Industry on the issuance of "Regulations on the Conditions for Organizations and Individuals Engaged in Mineral Exploration Activities."
Article 4. The Director of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, Directors of Provincial Industrial Services under the Central Government, and organizations and individuals engaged in mineral exploration activities are responsible for implementing this Decision.
