CIRCULAR
OF THE MINISTRY OF FINANCE NUMBER 63/2000/TT-BTC DATED JUNE 29, 2000 GUIDING ON THE ISSUANCE OF OPERATING FUNDS TO IMPLEMENT DECISION NUMBER 20/2000/QD-TTg DATED FEBRUARY 3, 2000 OF THE GOVERNMENT PRIME MINISTER ON SUPPORTING PERSONS WHO ENGAGED IN REVOLUTIONARY ACTIVITIES PRIOR TO THE AUGUST REVOLUTION OF 1945 TO IMPROVE THEIR DWELLINGS
Pursuant to the State Budget Law dated March 20, 1996 and the Law Amending and Supplementing Certain Provisions of the State Budget Law dated May 20, 1998.
Pursuant to Decree No. 87/CP dated December 19, 1996 of the Government detailing the decentralization, preparation, implementation, and settlement of the state budget; Decree No. 51/1998/NĐ-CP dated July 21, 1998 of the Government amending and supplementing certain provisions of Decree No. 87/CP dated December 19, 1996 on detailed regulations for decentralization management, preparation, implementation, and settlement of the state budget.
Pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister of the Government on supporting persons who engaged in revolutionary activities prior to the August Revolution of 1945 to improve their dwellings.
The Ministry of Finance guides the balancing and allocation of financial resources to implement Decision No. 20/2000/QĐ-TTg and the method of issuing and settling these financial resources as follows:
I. ON BALANCING AND ALLOCATING FINANCIAL RESOURCES
1. Financial Resources: To be allocated from the state budget in the years 2000, 2001, and 2002.
2. Provincial People's Committees (hereinafter referred to as the Provincial People's Committee) shall use revenues from land use rights transfer fees, land rental fees, and sales proceeds of state-owned housing for payment purposes. In cases where the revenue in the annual budget is insufficient to meet the needs, other sources will be allocated to meet the requirements, and then gradually repaid from this revenue in the subsequent years' budgets.
- For localities with large payment volumes where the revenue from housing and land over three years (2000-2002) is insufficient for payment, they shall report to the Ministry of Finance and the Ministry of Planning and Investment to request support from the central government budget. In the meantime, to ensure timely payments, the Ministry of Finance may temporarily allocate funds to provinces facing difficulties upon request of the Provincial People's Committee.
3. Issuance and Settlement Methods
a. For fixed amount support (VND 20 million and VND 50 million), based on the decision of the Provincial People's Committee, the Department of Finance and Price Control issues a payment order through the State Treasury to pay out once in cash or by bank transfer according to the recipient's request.
b. For support for self-construction, the Department of Finance and Price Control pays out according to the decision of the Provincial People's Committee to the recipient after being allocated land and having all necessary procedures completed. The payment method is the same as stipulated in point 3.1 above.
c. For support in the form of state-organized construction, the Department of Finance and Price Control transfers money through the State Treasury and instructs the State Treasury to settle accounts with the contractor according to the current investment management regulations.
All expenditures mentioned above are recorded under item 122 chapter 160 of the state budget and settled within the current fiscal year. Central government support to local budgets (if any) shall be implemented in the form of targeted subsidies.
II. EXEMPTION AND REDUCTION OF HOUSING PURCHASE AND LAND USE FEES
1. Exemption and reduction of housing purchase and land use fees shall be carried out according to the decisions of the Provincial People's Committee for specific recipients.
2. In cases where individuals eligible for support under Decision No. 20/2000/QĐ-TTg have purchased state-owned housing under Decree No. 61/CP or have been supported through land allocation for housing under Decision No. 118/QĐ-TTg, they shall be refunded any difference between the support level under this decision and the support levels under Decision No. 118/QĐ-TTg and Decision No. 64/1998/QĐ-TTg.
The refund procedure shall be carried out according to the provisions at point 3.1 of section 3 of part I above.
III. IMPLEMENTATION PROVISIONS
This Circular takes effect fifteen days after its date of issuance. Any difficulties encountered during implementation should be promptly reported to the Ministry of Finance by relevant ministries and provincial people's committees for coordination and resolution./.
