Pursuant to the Government Decree No. 30/2004/NĐ-CP dated January 16, 2004, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Pursuant to the Government Decree No. 139/2006/NĐ-CP dated November 20, 2006, detailing and guiding the implementation of certain provisions of the Education Law and the Labor Code on vocational training;
Pursuant to the Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006 of the Minister of Labor, War Invalids and Social Affairs promulgating the "Regulations on Procedures for Establishing and Registering Activities of Vocational Training for Higher Vocational Schools and Secondary Vocational Schools" and Decision No. 06/2006/QĐ-BLĐTBXH dated August 2, 2006 amending and supplementing some articles of Decision No. 05/2006/QĐ-BLĐTBXH;
Pursuant to the Decision No. 07/QĐ-BLĐTBXH dated October 2, 2006 of the Minister of Labor, War Invalids and Social Affairs approving the "Master Plan for Developing the Network of Higher Vocational Schools, Secondary Vocational Schools, and Vocational Training Centers until 2010 and Orientation until 2020";
In accordance with the proposal of the Deputy Chief of General Staff.
DECISION:
Article 1. To establish the 4th Secondary Vocational School - Ministry of National Defense under the Military Region 4 based on upgrading the 4th Vocational Training School/BQP.
Main office: Hoang Van Thai Street, Vinh City, Nghe An Province.
Article 2. The 4th Secondary Vocational School - Ministry of National Defense shall have the following tasks:
- Providing vocational training at two levels: secondary vocational level and primary vocational level according to regulations for demobilized soldiers and social demand for vocational training;
- Enhancing technical skills of workers according to the requirements of production, business, service units and workers;
- Researching and applying technology to improve the quality and efficiency of training; organizing production, business, and services in accordance with the law.
Article 3. The 4th Secondary Vocational School/BQP is a public institution with legal personality, its own seal and separate account; operates in accordance with the charter of secondary vocational schools and current laws on vocational training; has the responsibility to register vocational training activities in accordance with current regulations.
Article 4. The 4th Secondary Vocational School/BQP:
Is allocated seven key positions to command, manage, and operate the school's activities and enjoys the defense budget (in accordance with Decision No. 672/QĐ-TM dated June 28, 2006 of the Deputy Chief of General Staff).
Other positions will be filled through labor contracts and other forms in accordance with the law, self-funding salaries and benefits according to current regulations; not counted in the unit's manpower planning.
Organizational staffing shall be reported to the direct management agency for approval by the General Staff.
Article 5. This Decision takes effect 15 days after publication in the Official Gazette. The Deputy Chief of General Staff, Heads of General Departments, Commander of Military Region 4, Commanders of Units, relevant agencies, Principal of the 4th Secondary Vocational School/BQP are responsible for implementing this Decision.
