CIRCULAR
Amending and supplementing certain articles of several Circulars stipulating fees and charges of the Minister of Finance to encourage the use of online public services

Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Tax Policy,
The Minister of Finance issues the Circular amending and supplementing certain provisions of several Circulars stipulating fees and charges of the Minister of Finance to encourage the use of online public services.
Article 1. Amending and supplementing Article 3 of Circular No. 148/2016/TT-BTC dated October 14, 2016, issued by the Minister of Finance, on the level of collection, collection system, payment, management, and use of fees for the examination and issuance of permits for the use of industrial explosives
"4. Policy banks."
"4. In cases where organizations submit applications for permits to use industrial explosives through an online form:
a) From December 1, 2023 to December 31, 2025, apply a fee level equal to 90% (ninety percent) of the fee level prescribed in Clause 1 of this Article.
b) From January 1, 2026 onwards, apply the fee level prescribed in Clause 1 of this Article."
Article 2. Amending and supplementing Article 4 of Circular No. 245/2016/TT-BTC dated November 11, 2016, issued by the Minister of Finance, on the level of collection, collection system, payment, management, and use of fees for the examination of conditions for business operations in technical safety inspection activities and occupational safety and health training
Amend and supplement Article 4 as follows:
"Article 4. Fee Levels
1. The fee level for the examination of conditions for business operations in technical safety inspection activities and occupational safety and health training shall be implemented according to the fee schedule attached to this Circular.
2. In cases where public institutions or enterprises submit applications for extension of certificates of qualification for technical safety inspection activities through an online form:
a) From January 1, 2024 to December 31, 2025, apply a fee level equal to 90% (ninety percent) of the fee level prescribed at point a of Item 1 of the fee schedule attached to this Circular.
b) From January 1, 2026 onwards, apply the fee level prescribed at point a of Item 1 of the fee schedule attached to this Circular."
Article 3. Amending and supplementing Article 4 of Circular No. 263/2016/TT-BTC dated November 14, 2016, issued by the Minister of Finance, on the level of collection, collection system, payment, management, and use of fees and charges for intellectual property rights
Supplement Clause 4 to Article 4 as follows:
"4. In cases where organizations or individuals submit applications, documents requesting the performance of tasks or services for the protection of intellectual property rights (including filing applications for the protection of intellectual property rights; issuing Certificates of Protection, registering Assignment Contracts of Intellectual Property Rights; maintaining, extending, terminating, or revoking the validity of Certificates of Protection of Intellectual Property Rights; issuing Certificates of Professional Qualification for Intellectual Property Representation Services, announcing, registering Intellectual Property Representation Services) through an online form:
a) From January 1, 2024 to December 31, 2025, apply a charge level equal to 50% (fifty percent) of the charge level prescribed in Section A of the fee and charge schedule for intellectual property rights attached to this Circular.
b) From January 1, 2026 onwards, apply the charge level prescribed in Section A of the fee and charge schedule for intellectual property rights attached to this Circular."
Article 4. Amending and supplementing Article 4 of Circular No. 287/2016/TT-BTC dated November 15, 2016, issued by the Minister of Finance, on the level of collection, collection system, payment, management, and use of fees and charges in the field of atomic energy
Amend and supplement Article 4 as follows:
"Article 4. Fee and Charge Levels
1. The fee and charge levels in the field of atomic energy shall be implemented according to the fee and charge schedule attached to this Circular.
2. In cases where organizations or individuals submit applications for radiation work permits, registration of activities for supporting applications of atomic energy, or approval of provincial or organizational-level emergency response plans for radiation incidents or nuclear accidents through an online form (excluding administrative procedures under the national single window mechanism or ASEAN Single Window):
a) From December 1, 2023 to December 31, 2025, apply a fee level equal to 90% (ninety percent) of the fee level prescribed in Clause 1 of this Article.
b) From January 1, 2026 onwards, apply the fee level prescribed in Clause 1 of this Article."
Article 5. Amend and supplement Article 4 of Circular No. 25/2021/TT-BTC dated April 7, 2021, issued by the Minister of Finance, regarding the level of fees and charges, collection, payment, management, and use in the field of exit, entry, transit, and residence in Vietnam.
Supplement Clause 3 to Article 4 as follows:
"3. In the case where Vietnamese citizens submit applications for passport issuance through online procedures:
a) From January 1, 2024 to December 31, 2025, apply a fee rate equal to 90% (ninety percent) of the fee rate prescribed in Point 1, Part I of the Fee and Charge Schedule attached to this Circular.
b) From January 1, 2026 onwards, apply the fee rate prescribed in Point 1, Part I of the Fee and Charge Schedule attached to this Circular."
Article 6. Amend and supplement Article 4 of Circular No. 38/2022/TT-BTC dated June 24, 2022, issued by the Minister of Finance, regarding the level of fees and charges for construction activity permits, and professional certificates for architects.
Supplement Clause 6 to Article 4 as follows:
"6. In the case where organizations submit applications for construction business capability certificates, individuals submit applications for construction professional practice certificates, and foreign contractors submit applications for construction activity permits through online procedures:
a) From January 1, 2024 to December 31, 2025, apply a fee rate equal to 80% (eighty percent) of the fee rate prescribed in Clause 1 and Clause 3 of this Article.
b) From January 1, 2026 onwards, apply the fee rate prescribed in Clause 1 and Clause 3 of this Article."
Article 7. Amend and supplement Clause 1 of Article 4 of Circular No. 48/2022/TT-BTC dated August 3, 2022, issued by the Minister of Finance, regarding the level of fees and charges for exploiting and using information in the National Population Database.
Amend and supplement Clause 1 of Article 4 as follows:
"1. The level of fees for citizen information verification and exploitation of information results
a) From December 1, 2023 to December 31, 2025, apply a fee rate equal to 50% (fifty percent) of the fee rate prescribed in Part I of the Exploitation and Usage Fee Schedule for Information in the National Population Database attached to this Circular.
b) From January 1, 2026 onwards, apply the fee rate prescribed in Part I of the Exploitation and Usage Fee Schedule for Information in the National Population Database attached to this Circular."
Article 8. Amend and supplement Article 3 of Circular No. 37/2023/TT-BTC dated June 7, 2023, issued by the Minister of Finance, regarding the level of fees and charges for driving license examinations; fees for obtaining certificates to operate various types of vehicles, and registration and license plate fees for special-purpose motorcycles.
Amend and supplement Article 3 as follows:
"Article 3. Level of fees and charges
1. The level of fees for driving license examinations; fees for obtaining certificates to operate various types of vehicles, and registration and license plate fees for special-purpose motorcycles as prescribed in the Fee and Charge Schedule attached to this Circular.
2. In the case where organizations and individuals submit applications for new, replacement, or renewal of driving licenses (national and international) through online procedures:
a) From December 1, 2023 to December 31, 2025, apply a fee rate of VND 115,000 per issuance.
b) From January 1, 2026 onwards, apply the fee rate prescribed in the Fee and Charge Schedule attached to this Circular.
Article 9. Implementation Provisions
1. This Circular takes effect from December 1, 2023.
2. During implementation, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for further guidance and supplementation./.
