Pursuant to the Law on Border Defense of Vietnam dated November 11, 2020; the Law Amending and Supplementing Certain Provisions of 11 Laws on Military and National Defense dated June 27, 2025;

Pursuant to Resolution No. 76/2025/UBTVQH dated April 14, 2025 of the Standing Committee of the National Assembly on the reorganization of administrative units in 2025;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; and Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain provisions of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Commander of the Border Guard Force;

The Minister of National Defense issues this Circular stipulating the reporting and notification system for restricting or suspending activities in border zones and areas, and crossing the border at border gates and land border crossings.

Article 1. Scope of Regulation

This Circular stipulates the reporting and notification system for restricting or suspending activities in border zones and areas, and crossing the border at border gates and land border crossings.

Article 2. Applicability

This Circular applies to agencies and units of the Border Guard Force, provincial military command departments, relevant agencies, organizations, and individuals.

Article 3. Principles of Reporting and Notification

1. Compliance with the principles of executing border defense missions as prescribed by law, international treaties to which the Socialist Republic of Vietnam is a member, and agreements on borders and border gates.

2. Maintaining security, public order, and social safety in border areas and border gates as prescribed by law; not hindering the lawful activities of organizations and individuals operating in border zones, border areas, and border gates.

3. Ensuring centralized and unified management as prescribed by law and the Ministry of National Defense; being proactive, flexible, timely, effective, and accountable to superiors.

Article 4. Reporting and Notifying Decisions to Restrict or Suspend Activities in Border Zones

The reporting and notifying of decisions to restrict or suspend activities in border zones and areas, as provided for in Point a, Clause 3, Article 11 of the Law on Border Defense of Vietnam, shall be carried out as follows:

1. Prior to deciding to restrict or suspend activities in border zones under their jurisdiction, the Commander of the Border Guard Post must report to the Chief of the Border Guard Command or the Head of the Border Guard Command in charge. In case of disagreement, they have the right to make their own decision and bear responsibility before the Chief of the Border Guard Command and their Party Committee and Command.

2. In cases of border disputes, territorial conflicts; armed conflicts; enemy incursions; other activities threatening national sovereignty, territory, and border integrity; riots, terrorism, hostage-taking, armed criminal pursuits; natural disaster prevention; based on actual circumstances, the Commander of the Border Guard Post makes decisions within their authority and bears responsibility before the Chief of the Border Guard Command and under the law.

3. After deciding to restrict or suspend activities in border zones under their jurisdiction, the Commander of the Border Guard Post must immediately report to the Chief of the Border Guard Command (or the Head of the Border Guard Command in charge); simultaneously notify the local foreign affairs agency, the local commune-level government, organizations, and individuals in border areas; and inform the border management and protection forces of neighboring countries.

Article 5. Reporting and Announcing Decisions to Restrict or Temporarily Suspend Activities in Border Areas

The reporting and announcing of decisions to restrict or temporarily suspend activities in border areas as stipulated in point b, Clause 3, Article 11 of the Law on Border Defense shall be carried out as follows:

1. Prior to making a decision to restrict or temporarily suspend activities in border areas under their management, the Commander-in-Chief of the Border Guard Command must immediately report to the Commander-in-Chief of the Provincial Military Command or the Head of the Provincial Military Command directly in charge.

2. In cases where disputes over borders and territories occur; armed conflicts arise; enemies invade; other activities threaten national sovereignty, territory, and border security; riots, terrorism, hostage-taking, pursuit of armed criminals; natural disaster prevention measures are taken; based on actual circumstances, the Commander-in-Chief of the Border Guard Command shall make a decision within his authority and bear responsibility before the Commander-in-Chief of the Provincial Military Command and before the law.

3. After making a decision to restrict or temporarily suspend activities in border areas under their management, the Commander-in-Chief of the Border Guard Command must immediately report to the Commander of the Border Guard Force (or the Head of the Border Guard Force directly in charge), the Commander-in-Chief of the Provincial Military Command (or the Head of the Provincial Military Command directly in charge), the Chairman of the Provincial People's Committee; inform the Ministry of Foreign Affairs, provincial public security organs, organizations, and individuals in border areas; inform the border management and protection forces of neighboring countries.

Article 6. Reporting and Announcing Decisions to Restrict or Temporarily Suspend Cross-Border Movements at Secondary Border Gates and Open Passages

The reporting and announcing of decisions to restrict or temporarily suspend cross-border movements at secondary border gates and open passages as stipulated in points a and b, Clause 4, and points a and b, Clause 5, Article 11 of the Law on Border Defense shall be carried out as follows:

1. After deciding to restrict or temporarily suspend cross-border movements at secondary border gates and open passages, the Station Chief of the Border Guard Station must immediately report to the Commander-in-Chief of the Border Guard Command (or the Head of the Border Guard Command directly in charge); simultaneously inform the local authorities of the commune where the station is located, organizations, and individuals in border areas, and the border management and protection forces of neighboring countries.

Before the expiration of the period for restricting or temporarily suspending cross-border movements at secondary border gates and open passages, if it is deemed necessary to continue such restrictions, the Station Chief of the Border Guard Station must immediately report and obtain direct approval from the Commander-in-Chief of the Border Guard Command (or the Head of the Border Guard Command directly in charge) to extend the time for restricting or temporarily suspending cross-border movements at secondary border gates and open passages; simultaneously inform the local foreign affairs agencies, the Ministry of Foreign Affairs; organizations, and individuals in border areas; inform the border management and protection forces of neighboring countries.

2. After deciding to restrict or temporarily suspend cross-border movements at secondary border gates and open passages, the Commander-in-Chief of the Border Guard Command must immediately report to the Commander of the Border Guard Force (or the Head of the Border Guard Force directly in charge); the Commander-in-Chief of the Provincial Military Command (or the Head of the Provincial Military Command directly in charge); the Chairman of the Provincial People's Committee; simultaneously inform the border management and protection forces of neighboring countries.

Before the expiration of the period for restricting or temporarily suspending cross-border movements at secondary border gates and open passages, if it is deemed necessary to continue such restrictions, the Commander-in-Chief of the Border Guard Command must immediately report and obtain direct approval from the Commander of the Border Guard Force (or the Head of the Border Guard Force directly in charge) to extend the time for restricting or temporarily suspending cross-border movements at secondary border gates and open passages; simultaneously report to the Commander-in-Chief of the Provincial Military Command (or the Head of the Provincial Military Command directly in charge); inform the local foreign affairs agencies, the Ministry of Foreign Affairs; organizations, and individuals in border areas; inform the border management and protection forces of neighboring countries.

Article 7. Reporting and Announcing Decisions to Limit or Temporarily Suspend Border Crossings at Main or Bilateral Border Gates

The reporting and announcing of decisions to limit or temporarily suspend border crossings at main or bilateral border gates as stipulated in Points b and c, Clause 4, and Points b and c, Clause 5, Article 11 of the Law on Border Defense of Vietnam shall be carried out as follows:

1. The Commander-in-Chief of the Border Guard Command, upon deciding to limit or temporarily suspend border crossings at main or bilateral border gates, shall immediately report to the Commander of the Border Guard Force (or the Head of the Border Guard Force Command directly in charge); the Commander of the Provincial Military Command (or the Head of the Provincial Military Command directly in charge); the Chairman of the People's Committee of the province; and simultaneously inform the local authorities of the commune where the border gate is located, agencies, organizations in the border area, and border management and protection forces of the neighboring country.

Before the expiration of the period for limiting or temporarily suspending border crossings at main or bilateral border gates, if it is deemed necessary to continue such limitations or suspensions, the Commander-in-Chief of the Border Guard Command shall immediately report and obtain direct approval from the Commander of the Border Guard Force (or the Head of the Border Guard Force Command directly in charge) to extend the time for limiting or temporarily suspending border crossings at main or bilateral border gates; and simultaneously report to the Commander of the Provincial Military Command (or the Head of the Provincial Military Command directly in charge); inform the local foreign affairs agency, Ministry of Foreign Affairs; agencies, organizations, and individuals in the border area; and inform the border management and protection forces of the neighboring country.

2. The Chairman of the People's Committee of the province, upon deciding to limit or temporarily suspend border crossings at main or bilateral border gates, must immediately report to the Prime Minister and inform the local authority of the neighboring country.

Before the expiration of the period for limiting or temporarily suspending border crossings at main or bilateral border gates, if it is deemed necessary to continue such limitations or suspensions, the Chairman of the People's Committee of the province must immediately report and obtain direct approval from the Prime Minister to extend the time for limiting or temporarily suspending border crossings at main or bilateral border gates; and simultaneously inform the Ministry of Foreign Affairs and the local authority of the neighboring country.

Article 8. Implementation clause

1. This Circular takes effect from July 1, 2025.

2. Enforcement Responsibility

a) The Chief of General Staff, Director of the Political General Department, and commanders of related agencies and units are responsible for implementing this Circular;

b) The Commander of the Border Guard Force is responsible for inspecting and supervising the implementation of this Circular./.
