Circular No. 65/2022/TT-BCA Abolishes in Whole or in Part Certain Legal Normative Documents Issued by the Minister of Public Security

CIRCULAR

Repealing in whole or in part certain legislative regulatory documents issued by the Minister of Public Security

 Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Pursuant to the Law amending and supplementing some articles of the Law on Legislative Regulatory Documents issued on June 18, 2020:

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Legislative Regulatory Documents,

Pursuant to Decree No. 134/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated March 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Department of Legal Affairs and Administrative Reform and Justice;

The Minister of Public Security issues this Circular to repeal in whole or in part certain legislative regulatory documents issued by the Minister of Public Security.

Article 1. Repeal all regulatory legal documents issued by the Minister of Public Security

Repeal all the following regulatory legal documents issued by the Minister of Public Security:

1. Circular No. 08/TT-BNV(X13) dated November 12, 1991 of the Minister of Home Affairs guiding the salary level of the rank of Senior Lieutenant Colonel, seniority allowance system, and salary increase system for People's Police officers.

2. Circular No. 13/2003/TT-BCA(V22) dated August 28, 2003 of the Minister of Public Security guiding the financial management system for state-owned enterprises operating public services under the Ministry of Public Security.

3. Circular No. 04/2008/TT-BCA(H11) dated March 17, 2008 of the Minister of Public Security guiding the implementation of the payment system for medical examination and treatment expenses within the People's Police force.

4. Circular No. 19/2010/TT-BCA dated June 7, 2010 of the Minister of Public Security stipulating the management and use of funds contributed from mandatory fire and explosion insurance business for firefighting activities.

5. Circular No. 54/2010/TT-BCA dated December 10, 2010 of the Minister of Public Security detailing the implementation of some articles of Decree No. 97/2006/NĐ-CP dated September 15, 2006 and Decree No. 15/2009/NĐ-CP dated February 13, 2009 regarding the application of administrative penalties in the form of deportation according to administrative procedures.

6. Circular No. 15/2012/TT-BCA dated March 26, 2012 of the Minister of Public Security stipulating the process of placing orders, assigning plans or tasks for producing and supplying public service products to limited liability companies directly owned by the State serving national defense and security in the People's Police force.

7. Circular No. 39/2012/TT-BCA dated July 4, 2012 of the Minister of Public Security stipulating the management and detention of individuals sentenced to death.

8. Circular No. 42/2014/TT-BCA dated September 25, 2014 of the Minister of Public Security stipulating forms to be used in the People's Police force when applying and enforcing administrative education measures at commune, ward, town levels.

9. Circular No. 47/2014/TT-BCA dated October 17, 2014 of the Minister of Public Security detailing the implementation of some articles of Decree No. 115/2013/NĐ-CP dated October 3, 2013 on managing and preserving items, means of transport seized or confiscated according to administrative procedures.

10. Circular No. 48/2014/TT-BCA dated October 17, 2014 of the Minister of Public Security detailing the implementation of some articles of Decree No. 111/2013/NĐ-CP dated September 30, 2013 on the system of applying administrative education measures at commune, ward, town levels.

11. Circular No. 21/2016/TT-BCA dated June 15, 2016 of the Minister of Public Security stipulating the implementation of unemployment insurance for laborers under contract in the People's Police force.

12. Circular No. 06/2017/TT-BCA dated February 17, 2017 of the Minister of Public Security amending and supplementing some articles in several Circulars of the Ministry of Public Security concerning the time limit for administrative procedures in the organizational cadre field and internal political security protection of the People's Police force.

13. Circular No. 05/2018/TT-BCA dated February 7, 2018 of the Minister of Public Security stipulating the collection of materials and establishment of files for proposing the application of administrative measures to be placed in compulsory drug rehabilitation centers.

14. Circular No. 07/2019/TT-BCA dated March 20, 2019 of the Minister of Public Security stipulating forms to be used for imposing administrative violations within the jurisdiction of the People's Police force.

15. Circular No. 30/2019/TT-BCA dated September 5, 2019 of the Minister of Public Security stipulating the evaluation and classification of cadres in the People's Police force.

Article 2. Repeal part of the regulatory legal document issued by the Minister of Public Security

1. Repeal Section II, Section IV, Section V of Circular No. 30/2008/TT-BCA-X11 dated November 3, 2008 of the Minister of Public Security guiding the implementation of Decree No. 160/2007/NĐ-CP dated October 30, 2007 of the Government on traditional flags, police insignia, rank insignia, badge insignia, and uniforms of the People's Police force.

2. Repeal point b Clause 1 Article 7 of Circular No. 31/2015/TT-BCA dated July 6, 2015 of the Minister of Public Security guiding some contents on issuing visas, temporary residence cards, entry-exit permits, and permanent residence registration for foreigners in Vietnam.

3. Repeal the phrase "or Household Registration Book" stipulated in Clause 1 Article 9; the phrase "Temporary Residence Book or Household Registration Book or" stipulated in Clause 2 Article 9 of Circular No. 58/2020/TT-BCA dated June 16, 2020 of the Minister of Public Security stipulating the procedure for issuing, revoking registration certificates, and license plates for motor vehicles.

Article 3. Implementation Organization

1. This Circular takes effect from January 1, 2023.

2. The Director of the Legal System and Administrative Reform Department, Heads of units under the Ministry, Directors of Public Security Departments of provinces and centrally-administered cities, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
