RESOLUTION
ON THE ISSUANCE OF CERTAIN MECHANISMS TO ADDRESS DIFFICULTIES AND OBSTACLES
CAUSED BY LEGAL PROVISIONS REGARDING THE DEVELOPMENT OF SOCIAL HOUSING
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;
Pursuant to the Law on Housing No. 27/2023/QH15;
Pursuant to the Land Law No. 31/2024/QH15 amended and supplemented by Laws No. 43/2024/QH15, No. 47/2024/QH15, No. 58/2024/QH15, No. 71/2025/QH15, No. 84/2025/QH15, No. 93/2025/QH15, No. 95/2025/QH15, No. 146/2025/QH15, and No. 147/2025/QH15;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Law on Housing No. 27/2023/QH15, the Law on Real Estate Business No. 29/2023/QH15, and the Law on Credit Organizations No. 32/2024/QH15 dated June 29, 2024;
Pursuant to the Law on Urban and Rural Planning No. 47/2025/QH15;
Pursuant to Resolution No. 201/2025/QH15 of the National Assembly piloting certain special mechanisms and policies for the development of social housing;
Pursuant to Resolution No. 206/2025/QH15 of the National Assembly on special mechanisms to address difficulties and obstacles caused by legal provisions;
At the proposal of the Minister of Construction;
The Government hereby issues this Resolution on the issuance of certain mechanisms to address difficulties and obstacles caused by legal provisions regarding the development of social housing.
Article 1. Scope of Regulation and Applicability
1. This Resolution stipulates certain mechanisms and policies to resolve difficulties and obstacles in the development of social housing.
2. This Resolution applies to state agencies, organizations, and individuals related to the development of social housing.
Article 2. Mechanisms to Address Difficulties and Obstacles
1. The handling of difficulties and obstacles concerning planning for projects to construct social housing and housing for the people's armed forces shall be carried out as follows:
a) Regulations on handling difficulties and obstacles regarding the establishment, adjustment, and approval of district zoning plans in areas forming urban areas when implementing the reorganization of administrative units at all levels and organizing local governments with two levels shall be implemented in accordance with the laws on urban and rural planning;
b) Detailed planning may be established anew or adjusted simultaneously with the process of establishing or adjusting district zoning plans or general plans, provided that there is no requirement to establish a district zoning plan, and it shall be approved after the general plan or district zoning plan has been approved;
c) Approval of investment orientation and assignment of the investor for cases where the location of the land plot does not yet exist or is not suitable for urban and rural planning shall be carried out in accordance with the laws on piloting certain special mechanisms and policies for the development of social housing.
2. In central cities and areas within the administrative boundaries of wards in provinces, social housing and housing for the people's armed forces shall be apartment buildings. For other areas, the People's Councils of provinces shall be responsible for deciding on the type of social housing and housing for the people's armed forces in accordance with the provisions of the law and the actual conditions of the locality.
3. Households and individuals whose land and housing have been expropriated by the State for national defense, security purposes, or economic and social development for the benefit of the nation and public interest, as stipulated by law, but have not yet been compensated by the State with housing or residential land shall be entitled to purchase or lease social housing without having to participate in a lottery and without having to meet the conditions regarding housing and income as prescribed.
4. Contract workers with indefinite-term contracts receiving salaries from the state budget working in public security units shall be entitled to purchase, lease-purchase, or lease housing for the people's armed forces.
The conditions regarding housing and income for these subjects to enjoy housing support policies shall be applied as those prescribed in Clause 5, Article 76 of the Law on Housing.
Article 3. Effectiveness
1. This Resolution shall take effect from February 13, 2026, and be implemented until February 28, 2027.
2. In cases where laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly are amended, supplemented, or newly issued and come into effect after the date of this Resolution but before February 28, 2027, the corresponding provisions issued in this Resolution shall cease to be effective.
3. In cases where the legal normative documents cited in this Resolution are amended, supplemented, or replaced, they shall be implemented in accordance with the corresponding provisions in the amending, supplementing, or replacing documents.
4. During the period in which the provisions of this Resolution are effective, if the provisions on management authority, responsibilities, procedures, and formalities in this Resolution differ from those in relevant legal normative documents, they shall be implemented in accordance with the provisions of this Resolution.
Article 4. Responsibility for Implementation
1. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees shall be responsible for implementing this Resolution.
2. The Ministry of Construction shall advise the Government on reporting to the Standing Committee of the National Assembly and the National Assembly at the nearest session or meeting after the issuance of this Resolution; within its functions and tasks, it shall be responsible for reviewing and proposing amendments and supplements to relevant contents of the Law on Housing to ensure consistency and synchronization.
3. The Ministry of Agriculture and Environment, within its functions and tasks, shall be responsible for reviewing and proposing improvements to the Land Law to ensure consistency and synchronization.
4. Provincial People's Committees shall be responsible for directing the implementation of this Resolution to ensure transparency, efficiency, and prevent loopholes, corruption, negative practices, policy profiteering, waste, and loss.
5. People's Councils, Council Committees, People's Council Deputies, and Vietnam Fatherland Front Committees at all levels, within their duties and powers, shall strengthen supervision over the implementation of this Resolution.
The Ministry of Construction, relevant ministries and sectors, and People's Committees at all levels shall strictly implement the results of the National Assembly's supervision of this Resolution (if applicable).
