RESOLUTION
Temporarily suspending the effectiveness of Decree No. 46/2026/NĐ-CP
dated January 26, 2026 and Resolution No. 66.13/2026/NQ-CP
dated January 27, 2026 of the Government
Based on the Law on Organization of the Government No. 63/2025/QH15;
Based on the Law on Issuing Normative Legal Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;
In accordance with the proposals of the Ministers of: Health, Agriculture and Environment, Industry and Trade, and Justice;
The Government issues this Resolution to temporarily suspend the effectiveness of Decree No. 46/2026/NĐ-CP dated January 26, 2026, which details the implementation of certain provisions and measures for organizing and guiding the enforcement of the Food Safety Law, and Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, which regulates food product declaration and registration.
Article 1. Temporary suspension of the application of documents
The temporary suspension shall apply until the Food Safety Law (amended) and the Decree guiding the Food Safety Law (amended) come into force for the following documents:
1. Decree No. 46/2026/NĐ-CP dated January 26, 2026, which details the implementation of certain provisions and measures for organizing and guiding the enforcement of the Food Safety Law.
2. Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, which regulates food product declaration and registration.
Article 2. Application during the period of temporary suspension
During the period of temporary suspension as provided in Article 1 of this Resolution, Decree No. 15/2018/NĐ-CP dated February 2, 2018, which details certain provisions of the Food Safety Law and related documents and guidelines shall continue to be effective.
Article 3. Implementation responsibilities
1. Ministries: Health, Industry and Trade, Agriculture and Environment
a) Actively guide the implementation of this Resolution according to the fields under their management.
b) Strengthen the implementation of inspection plans, monitoring, regular and surprise inspections, supervision, guidance, handling of violations related to food safety during production, export, import, and sale of food products, tasks assigned and delegated under their management.
c) Actively review, amend, supplement, and issue normative legal documents, National Standards (QCVN), professional guidelines, internal procedures within the scope of their management in the field of food safety.
d) Actively review the Food Safety Law 2010 to propose amendments and supplements according to functions and tasks for submission to the Ministry of Health for consolidation into the Amended Food Safety Law; participate in drafting the Amended Food Safety Law, Decree guiding the Amended Food Safety Law, and related documents.
d) Regularly promote awareness and dissemination of normative legal documents and technical guidelines in the field of food safety to associations, enterprises, and relevant parties to know and implement.
2. In addition to the responsibilities mentioned in paragraph 1, other ministries have the following responsibilities:
a) Ministry of Health: Inspect, monitor, supervise, and handle violations related to product registration declarations and advertising for products, goods, and services under their management; production conditions for facilities that have been granted a Certificate of Compliance with Good Manufacturing Practices (GMP) for health food and other facilities meeting the Good Manufacturing Practices for medicinal herbs and traditional medicines involved in producing health foods.
b) Ministry of Industry and Trade: Inspect, review, monitor, supervise, handle violations in food business activities, counterfeit, banned, smuggled food products, and other commercial frauds related to food on e-commerce platforms; promptly identify and handle violations according to regulations.
c) Ministry of Science and Technology: Strengthen inspections, monitoring, supervision of the activities of organizations that have registered for accreditation (including accreditation testing laboratories); coordinate with Ministries: Health, Industry and Trade, Agriculture and Environment in reviewing, completing, ensuring full national standards (TCVN) related to food.
d) Ministry of Culture, Sports and Tourism: Strengthen management of advertising according to functions and tasks related to food under Article 24 of Decree No. 342/2025/NĐ-CP dated December 26, 2025, which details certain provisions of the Advertising Law.
3. People's Committees of Provinces and Cities
a) Regularly promote awareness and dissemination of normative legal documents and technical guidelines in the field of food safety to local authorities, associations, enterprises, and relevant parties to know and implement.
b) Strengthen the implementation of regular inspection plans; conduct surprise inspections, monitoring, supervision, guidance, promptly identify and handle violations related to food safety, counterfeit, banned, smuggled goods on their territory, and other commercial frauds related to food on e-commerce platforms according to regulations and tasks assigned and delegated, with a focus on preventing street food poisoning, school canteen poisoning, and collective dining.
c) Publicize publicly and update information about testing, inspection, certification organizations as per paragraph 4 of Article 67 of Decree No. 22/2026/NĐ-CP dated January 16, 2026, which details certain provisions and measures for organizing and guiding the implementation of the Standards and Technical Regulations Law.
d) Bear responsibility and implement the assignment or delegation of tasks to state food safety inspection agencies and testing facilities serving government management on food safety according to assignments and delegations; publicly list these entities; ensure adequate resources for implementation and preparation conditions in line with the time when the Amended Food Safety Law is established and submitted. and prepare the necessary conditions for implementation together with the timing of construction and submission of the Project Law on Food Safety (Amendment).
d) Directing the agency receiving declarations to register product declarations, arranging for sampling inspections of quality and safety indicators for products circulating in the market; focusing on groups of products used by high-risk individuals such as children, elderly people, pregnant women, and patients. Based on inspection results, conducting inspections at production and business premises, and handling violations according to regulations.
4. Responsibilities for Coordination
Ministries: Health, Agriculture and Environment, Industry and Trade, Finance, People's Committees of provinces and cities shall ensure the completion of data connectivity and sharing with the National E-Government Portal to handle administrative procedures and food safety management; unify food safety management data from central to local levels; and promote artificial intelligence applications in food product management.
Article 4. Transitional Provisions
For documents submitted before the effective date of this Resolution, they shall continue to be processed according to the provisions of Decree No. 15/2018/NĐ-CP dated February 2, 2018, which details the implementation of certain articles of the Food Safety Law and related regulations and guidelines.
Article 5. Effective Date
1. This Resolution shall take effect from the date of issuance and replace Resolution No. 09/2026/NQ-CP dated February 4, 2026, of the Government, which temporarily suspended its effectiveness and adjusted the application period for Decree No. 46/2026/NĐ-CP dated January 26, 2026, and Resolution No. 66.13/2026/NQ-CP dated January 27, 2026.
2. Ministries, agencies at the same level, People's Committees of provinces and cities shall be responsible for implementing this Resolution.
