CIRCULAR

REGULATIONS ON PROCEDURES AND FORMALITIES IN THE MANAGEMENT, USE, AND EXPLOITATION OF INFRASTRUCTURE ASSETS OF PARKS AND GREEN SPACES FUNDED AND MANAGED BY THE STATE

Pursuant to the Law on Management and Use of State Property No. 150/2017/QH14 amended and supplemented by Laws No. 64/2020/QH14, No. 07/2022/QH15, No. 24/2023/QH15, No. 31/2024/QH15, No. 43/2024/QH15, No. 56/2024/QH15, and No. 90/2025/QH15 90/2025/QH15;

Pursuant to Decree No. 258/2025/NĐ-CP dated October 9, 2025 of the Government on the management of parks, green spaces, and water surfaces; Government on the management of parks, green trees, and water surfaces;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction; The Government shall specify the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Infrastructure Construction Department;

The Minister of Construction issues this Circular regulating procedures and formalities in the management, use, and exploitation of infrastructure assets of parks and green spaces funded and managed by the State as prescribed in Clause 5, Article 36, Clause 7, Article 39, Clause 7, Article 40, and Clause 5, Article 41 of Decree No. 258/2025/NĐ-CP dated October 9, 2025 of the Government on the management of parks, green spaces, and water surfaces.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates procedures and formalities in the management, use, and exploitation of infrastructure assets of parks and green spaces funded and managed by the State as prescribed in Clause 5, Article 36, Clause 7, Article 39, Clause 7, Article 40, and Clause 5, Article 41 of Decree No. 258/2025/NĐ-CP dated October 9, 2025 of the Government on the management of parks, green spaces, and water surfaces, including: procedures and formalities for transferring management of infrastructure assets of parks and green spaces; procedures and formalities for handling infrastructure assets of parks and green spaces; procedures and formalities for preparing and approving lease exploitation plans for infrastructure assets of parks; procedures and formalities for preparing and approving transfer exploitation plans with a time limit for infrastructure assets of parks.

2. This Circular applies to agencies, units, organizations, and individuals related to the implementation of procedures and formalities in the management, use, and exploitation of infrastructure assets of parks and green spaces funded and managed by the State as prescribed in Clause 1 of this Circular.

Article 2. Interpretation of Terms

1. The specialized agency for parks and green spaces under the provincial People's Committee is the Department of Construction.

2. The specialized agency for parks and green spaces under the district People's Committee is the Economic Office or the Economic, Infrastructure, and Urban Development Office.

3. The competent People's Committee is the provincial People's Committee or the district People's Committee authorized to transfer management, approve exploitation plans, and handle infrastructure assets of parks and green spaces according to Article 35 of Decree No. 258/2025/NĐ-CP dated October 9, 2025 of the Government on the management of parks, green spaces, and water surfaces.

Article 3. General Provisions on the Implementation of Procedures and Formalities in the Management, Use, and Exploitation of Infrastructure Assets of Parks and Green Spaces Funded and Managed by the State

1. The implementation of procedures and formalities in the management, use, and exploitation of infrastructure assets of parks and green spaces funded and managed by the State as prescribed in this Circular shall be carried out through direct or online methods on electronic platforms.

2. Priority shall be given to implementing procedures and formalities in the management, use, and exploitation of infrastructure assets of parks and green spaces funded and managed by the State on electronic platforms. Electronic files and results have the same legal effect as paper versions.

3. Agencies and units preparing application files shall be responsible under the law for the legality, accuracy, and truthfulness of the content of the files and documents sent to the competent People's Committee. Application documents and file components required to be submitted online on electronic platforms according to this Circular must be authenticated in accordance with the law on electronic transactions.

4. The time limit for examination and decision-making by the competent People's Committee specified in this Circular does not include holidays when the number of holidays during the examination and decision-making period exceeds three days.

Chapter II

PROCEDURES AND FORMALITIES IN THE MANAGEMENT, USE, AND EXPLOITATION OF INFRASTRUCTURE ASSETS OF PARKS AND GREEN SPACES FUNDED AND MANAGED BY THE STATE

Article 4. Procedures and formalities for transferring management of park and green space infrastructure assets

1. Procedures and formalities for transferring management of park and green space infrastructure assets:

a) The project investor developing parks and green spaces (for new park and green space infrastructure assets invested in by the State) or the unit currently managing the assets (for existing park and green space infrastructure assets or those transferred to State management) shall take the lead and coordinate with relevant agencies to prepare the asset management transfer proposal file in accordance with Clause 2 of this Article and submit it to the competent People's Committee for consideration and decision;

b) Within thirty days from the date of receiving all necessary documents, the competent People's Committee shall issue a decision on transferring management of park and green space infrastructure assets in accordance with Clause 3 of this Article or provide a response letter in cases where the asset transfer request is not appropriate;

c) Within thirty days from the date of the People's Committee's asset transfer decision, the handover and acceptance of park and green space infrastructure assets shall be recorded in a handover and acceptance record in Form No. 01 of the Appendix attached hereto and implemented in accordance with Clause 4 of Article 36 of Decree No. 258/2025/NĐ-CP dated October 9, 2025 of the Government on the management of parks, green spaces, and water surfaces.

2. Documents for requesting asset management transfer include:

a) A document requesting the transfer of management of park and green space infrastructure assets (clearly identifying the entity to manage the assets): One original copy;

b) List of assets proposed for management transfer according to the Appendix in Form No. 01 of the Appendix attached hereto: One original copy;

c) Legal documents of the assets proposed for management transfer (Decision on asset transfer, asset reallocation; Decision establishing public ownership; Handover and acceptance records or other documents proving management, usage, temporary management rights of the assets - if applicable): One certified copy;

d) Other related documents concerning the assets proposed for management transfer (if applicable): One certified copy.

đ) Draft Decision on asset transfer in accordance with Clause 3 of this Article: One certified copy.

3. Main contents of the asset transfer decision:

a) Name of the unit currently managing the assets (if applicable); Name of the unit to which the assets will be transferred;

b) List of assets to be transferred;

c) Responsibilities for implementation organization.

Article 5. Procedures and formalities for handling park and green space infrastructure assets

1. Procedures and formalities for handling assets:

a) The unit managing the assets shall prepare a document requesting asset handling in accordance with Clause 2 of this Article and submit it to the competent People's Committee for consideration and decision;

b) Within forty-five days from the date of receiving all necessary documents, the competent People's Committee shall consider and decide on asset handling in accordance with Clause 3 of this Article or provide a response letter in cases where the asset handling request is not appropriate;

c) Within sixty days from the date of the People's Committee's asset handling decision, the unit managing the assets shall be responsible for organizing the auction of the assets in accordance with the law on asset auctions in cases of selling assets or organizing the receipt and transfer of assets in cases of asset reallocation or organizing a tender to select organizations or individuals to carry out demolition and disposal simultaneously with the sale of recovered materials or demolition and disposal of assets in cases where the assets have no further use value.

2. Documents for requesting asset handling include:

a) Document requesting asset handling by the unit managing the assets: One original copy;

b) List of assets proposed for handling according to Form No. 02 of the Appendix attached hereto: One original copy;

c) Proposal for asset handling method; starting price for auctioning assets for sale (if applicable); plan for managing and using proceeds from asset handling (if applicable) and estimated budget for handling the assets: One original copy;

d) Related legal documents:

- Document requesting asset handling by the asset operating unit in cases of voluntarily returning assets: One original copy;

- Document requesting receipt of assets by the receiving unit in cases of asset reallocation: One original copy;

- Record confirming lost or destroyed assets and supporting documents proving lost or destroyed assets in cases of lost or destroyed assets: One certified copy;

đ) Opinions of relevant agencies and other related documents (if applicable): One certified copy;

e) Draft Decision on asset handling in accordance with Clause 3 of this Article: One certified copy.

3. Main contents of the asset handling decision:

a) Name of the unit managing the assets;

b) Name of the unit expected to receive assets in cases of asset reallocation;

c) Handling method and reason (cause) for handling;

d) Starting price for auctioning assets for sale (if applicable); management and use of proceeds from asset handling (if applicable); budget for handling the assets;

đ) List of assets to be handled;

e) Responsibilities for implementation organization.

Article 6. Procedures and formalities for establishing and approving plans to lease the right to exploit infrastructure assets in parks

1. The procedures and formalities for establishing and approving plans to lease the right to exploit infrastructure assets in parks are as follows:

a) The unit entrusted with managing the assets shall be responsible for preparing the application file for approval of the plan to lease the right to exploit infrastructure assets in parks in accordance with Clause 2 of this Article and submitting it to the competent People's Committee for consideration and approval.

b) Within 45 days from the date of receiving all necessary documents, the competent People's Committee shall examine and decide on the approval of the plan to lease the right to exploit assets in accordance with Clause 3 of this Article, or issue a response letter in case the plan does not meet the requirements.

2. The application file for approval of the plan to lease the right to exploit infrastructure assets in parks includes:

a) The request document of the asset management unit: 01 original copy;

b) The plan to lease the right to exploit assets according to Model No. 03 attached to this Circular: 01 original copy;

c) Other related documents (if any): 01 copy;

d) Draft Decision on approval of the plan to lease the right to exploit assets in accordance with Clause 3 of this Article: 01 copy.

3. Main contents of the decision to approve the plan to lease the right to exploit assets:

a) Name of the unit managing the assets;

b) List of assets to be leased;

c) Duration and method of implementing the lease of the right to exploit assets;

d) Conditions for organizations participating in auctioning the lease of the right to exploit assets;

đ) Duration and method of payment for leasing the right to exploit assets;

e) Management and use of revenue from leasing the exploitation of assets;

g) Rights and responsibilities of the unit entrusted with managing the assets;

h) Responsibilities for organizing implementation.

Article 7. Procedures and formalities for establishing and approving plans to transfer the right to exploit infrastructure assets in parks for a limited period

1. The procedures and formalities for establishing and approving plans to transfer the right to exploit infrastructure assets in parks for a limited period are as follows:

a) The unit entrusted with managing the assets shall be responsible for preparing the application file for approval of the plan to transfer the right to exploit infrastructure assets in parks for a limited period in accordance with Clause 2 of this Article and submitting it to the competent People's Committee for consideration and approval.

b) Within 60 days from receipt of all necessary documents, the competent People's Committee shall examine and decide on the approval of the plan to transfer the right to exploit assets for a limited period in accordance with Clause 3 of this Article, or issue a response letter in case the plan does not meet the requirements.

2. The application file for approval of the plan to transfer the right to exploit infrastructure assets in parks for a limited period includes:

a) The request document of the asset management unit: 01 original copy;

b) The plan to transfer the right to exploit assets for a limited period according to Model No. 03 attached to this Circular: 01 original copy;

c) Other related documents (if any): 01 copy;

d) Draft Decision on approval of the plan to transfer the right to exploit assets for a limited period in accordance with Clause 3 of this Article: 01 copy.

3. Main contents of the decision to approve the plan to transfer the right to exploit infrastructure assets for a limited period:

a) Name of the unit managing the assets;

b) List of assets to be transferred for a limited period;

c) Basic content of construction projects planned to be invested in and upgraded, and other necessary contents;

d) Duration and method of implementing the transfer of the right to exploit assets for a limited period;

đ) Conditions for organizations participating in auctioning the transfer of the right to exploit assets for a limited period;

e) Duration and method of payment for transferring the right to exploit assets for a limited period;

g) Management and use of revenue from transferring the right to exploit assets for a limited period;

h) Rights and responsibilities of the unit entrusted with managing the assets;

i) Responsibilities for organizing implementation.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Transitional Provisions

For infrastructure assets of parks and greenery invested in and managed by the State, which were under the management of the People's Committee at the district level before July 1, 2025, and have not been transferred to management by the time this Circular takes effect, the People's Committee at the provincial level shall assign the Department of Construction to organize the preparation of documents for asset management transfer and submit them to the People's Committee at the provincial level for examination and decision on asset management transfer in accordance with point b and c, Clause 1, Article 4 of this Circular.

Article 9. Effective Date

1. This Circular takes effect from the date of signature.

2. In cases where legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the corresponding provisions of the amended, supplemented, or replacing documents./.

b) Content of approved investment projects for upgrading and expanding existing assets (for exploitation plans using the transferring exploitation rights with a term method).

c) Term of asset exploitation.

d) Basis and method for determining the initial price for leasing or transferring exploitation rights with a term.

đ) Auction implementation plan. e) Payment method.

g) Principles for handling upon expiration of the asset exploitation term or termination of the contract before the term.

2.2. Preliminary assessment of the effectiveness of the asset exploitation plan

a) The necessity and appropriateness of the exploitation plan in relation to assigned functions and tasks, legal regulations on the management and use of public assets, and related laws.

b) Expected results of park infrastructure asset exploitation: income, expenses related to asset exploitation (clarifying the basis and method for determining income and expenses);

c) Expected amount of state budget contribution;

d) Expected amount of funds prioritized for allocation from the state budget contributions (from asset exploitation) in the public investment plan and state budget expenditure estimate for new construction, upgrading, renovation, and development of park infrastructure assets.
