Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008;

Pursuant to Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on the Implementation of the Law on Forest Protection and Development;

Pursuant to Decree No. 117/2010/ND-CP dated December 24, 2010 of the Government on the organization and management of special-use forests;

Pursuant to Decision No. 186/2006/QĐ-TTg dated June 14, 2006 of the Government on the Issuance of the Forest Management Regulations;

Considering the proposal of the General Department of Forestry at Proposal No. 317/TTr-TCLN-BTTN dated March 21, 2012 regarding the request for approval of the master plan for conservation and sustainable development of Yok Don National Park for the period 2010-2020,

DECISION:

Article 1. Approve the "Master Plan for Conservation and Sustainable Development of Yok Don National Park for the Period 2010-2020" comprising the following main contents:

1. Name: Yok Don National Park

2. Location:

- From 12045' - 13010' North Latitude

- From 107029' - 107048' East Longitude

3. Total area of Yok Don National Park: 113,853.95 hectares including:

a) The forest land area: 113,288.95 hectares.

b) Other land areas: 565.00 hectares.

4. Functional zones:

a) Strictly protected zone: 72,006.95 hectares.

b) Ecological restoration zone: 35,501.00 hectares.

c) Administrative service zone: 6,346.00 hectares.

5. Objectives and Tasks

a) Protecting the integrity and increasing the forest coverage area to ensure conservation and sustainable development goals of the national park; protecting and developing forest animal and plant genetic resources contributing to the management strategy of special-use forests in Vietnam; conserving biodiversity, protecting the environment, and promoting sustainable development;

b) Utilizing biological diversity and environmental services reasonably. Linking economic and social development activities of localities through ecotourism to improve the living standards of local people and preserve and promote ethnic cultural identity;

c) Investing in forest protection and management, natural conservation, and ecotourism development consistent with the natural landscape of the national park;

d) Conducting scientific research experiments to serve natural conservation, biodiversity, and sustainable resource development of the national park;

đ) Enhancing management capacity for conservation and sustainable development. Gradually creating revenue for the national park through tourism services and leasing of the forest environment.

6. Content of the Master Plan for Forest Conservation and Sustainable Development from 2010 to 2020:

a) Planning construction programs: office buildings, scientific research facilities, seminar halls, guesthouses, ranger stations, staff housing, sports complexes, water supply systems; ecotourism areas, resorts, and facilities serving ecotourism.

b) Planning transportation systems serving patrolling and forest protection work, providing a basis for ecotourism, resort, scientific research, and socio-economic development activities in the locality, ensuring national defense security including: upgrading and improving provincial roads leading to Border Guard Post 743, the route from the National Park Office to Phat Khe Falls extending to the foot of Mount Yok Don, the route from the National Park Office to Seven Branch Falls to Ea Ril Stream, Route 6B leading to Border Guard Post 751; constructing protective fences; internal roads within semi-wild animal breeding areas and botanical gardens; maintaining and repairing 55 kilometers of patrol roads.

c) Planning infrastructure construction at seedling nurseries and botanical gardens including administrative offices, operational houses, fencing systems, power and water supply systems.

d) Planning rescue centers and semi-wild animal breeding areas.

đ) Planning forest planting areas and encirclement nurturing for forest recovery.

e) Planning irrigation and ecological lake systems serving fire prevention, habitat improvement, forest development. Providing drinking water for ranger stations, scientific research, ecotourism, and resorts. Simultaneously planning drainage systems; waste treatment and environmental sanitation.

g) Planning ecotourism sites, resorts, and areas for leasing the forest environment to develop ecotourism.

h) Planning buffer zone development with a scale including seven communes with related and adjacent areas to the national park, a total natural area of 133,890 hectares. Building investment projects to develop the seven buffer zone communes to restore and manage forests sustainably; constructing transportation and irrigation works; providing forestry and agricultural technical consulting and services; producing forest tree seedlings, fruit trees, and models for cultivation and livestock farming.

i) Investing in equipment, machinery, and communication and travel means to serve forest patrolling work and ecotourism services.

7. Programs of Activities

a) Forest protection, natural conservation, and biodiversity preservation through forest protection contracts; afforestation and care of planted forests, encirclement nurturing for natural regeneration, encirclement nurturing for enhanced regeneration, establishing grasslands; establishing green and white firebreaks; building forest protection regulations boards, fire lookout towers, and boundary fence lines of the national park and conducting publicity.

b) Scientific research and application of science in forest management, conservation, development, and botanical garden construction.

c) Training to enhance conservation and forest development capabilities, environmental education, and ecotourism services.

d) Investment and joint investment in building resorts and ecotourism areas in administrative and service zones. Leasing special-use forest environments in ecological restoration zones to develop ecotourism, resorts, and environmental education.

đ) Infrastructure construction.

e) Socio-economic development of buffer zone communes.

8. Main Solutions

a) Regarding policy and institutional framework: publicly announce the planning on mass media to promote natural conservation work and attract domestic and foreign investment; study and propose the trial and expansion of joint venture and cooperative investment models and environmental leasing for the exploitation of ecotourism, leisure, and entertainment potential.

b) Regarding science and technology: apply biotechnology in seed production (especially native tree species) to meet afforestation needs; research and apply techniques to improve poor forests and forest regeneration measures; enhance investment in equipment to adopt modern technology for research purposes, while improving the technical and management staff's capacity.

c) Regarding human resource development: including prioritizing the recruitment of formally trained officers and specialized training; high specialization for the cadre force in various fields of operation; encourage postgraduate studies, doctoral research, and participation in other training programs to enhance professional expertise.

d) Regarding finance: the state budget ensures investment in infrastructure projects for conservation, forest development, and scientific research; trunk roads, patrol routes, ecological dams. Attract investment from other economic sectors to build resort areas, tourism infrastructure, conference centers, and entertainment facilities in the Administrative and Tourism Service Zone, prioritizing the restoration and construction of new tourism facilities on old villa foundations. Encourage businesses to participate in afforestation and forest protection in scenic forests, botanical gardens, and along roadways.

đ) Implementation of planning and monitoring - In the Strict Protection Zone: establish investment projects for construction and forestry works. - In the Ecological Restoration Zone: establish investment projects for construction and forestry works to lease special-use forests for ecotourism. - In the Administrative and Tourism Service Zone: develop detailed planning (scale 1/2,000) on the determined project area. Monitor compliance with environmental protection regulations. Implement measures to minimize negative impacts on the environment as identified in the planning.

9. Estimated Investment Summary

The total estimated investment capital required is: 397,085 billion VND, including:

a) Program for biodiversity conservation, sustainable forestry development: 7,491 billion VND.

b) Scientific research programs: 7,400 billion VND

c) Botanical garden construction investment program: 17,791 billion VND

d) Human resource training and environmental education program: 720 billion VND.

đ) Ecotourism development infrastructure, equipment, and personnel investment program: 46,508 billion VND.

e) Infrastructure construction investment program for transportation, forest ranger stations, office facilities, and equipment: 100,275 billion VND.

g) Construction investment program for water reservoirs, ecological lakes, and pumping stations for conservation work: 82,070 billion VND.

h) Wildlife breeding program: 38,525 billion VND.

i) Construction investment program for wildlife rescue center: 19,585 billion VND.

k) Economic and social development support program for some buffer zone villages and Drang Pok village: 6,720 billion VND.

Investment phases as follows:

- Phase 2010-2013: 41,583 billion VND.

- Phase 2014-2015: 203,842 billion VND.

- Phase 2016-2020: 151,660 billion VND.

Source of investment:

- State budget funds 292,467 billion VND (73.65%) for forest protection programs, encirclement and regeneration, afforestation, forest care, enrichment planting, botanical gardens, firebreaks, scientific research topics, office buildings, environmental education houses, community cultural activity houses, road systems, power systems, waste collection and treatment, fire watchtowers, forest protection rules boards, boundary fences, water dams.

- Mobilize investors and international support 104,618 billion VND (26.35%) for semi-wild animal breeding zones, wildlife rescue centers, and ecotourism development.

Article 2. Implementation

The Director General of the Forest Administration approves detailed planning schemes and planning maps.

The Forest Administration is tasked with directing and guiding the annual investment plan formulation for Yok Don National Park according to the approved investment tasks and specific projects of each investment program; effectively implementing the planning in accordance with the provisions of Article 1 of this Decision and the content of the approved planning report, adhering to current regulations of the Ministry of Agriculture and Rural Development and the State regarding special-purpose forest management planning and administration.

Article 3. This Decision takes effect from the date of signature.

Article 4. The Head of the Ministry’s Office, Heads of relevant Departments: Planning, Finance; Director of the Investment and Construction Management Department; Director General of the Forest Administration, Ministry of Agriculture and Rural Development; Director of Yok Don National Park and Heads of related agencies and units are responsible for enforcing this Decision.
