DECISION OF THE MINISTER OF TRANSPORT
Regarding the announcement of national inland waterways
THE MINISTER OF TRANSPORTATION
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decision No. 29/2004/QĐ-BGTVT dated December 7, 2004 of the Minister of Transport promulgating regulations on the registration of inland waterway vessels;
Continue to implement the exchange of Certificates of Registration for inland waterway vessels issued under Decision No. 2056/QĐ-PC dated June 8, 1996 of the Minister of Transport until December 31, 2006.
DECISION:
Article 1. Announce the national inland waterway routes as set out in the attached List pursuant to this Decision.
Article 2. Entrust the Director of the Vietnam Inland Waterways Administration to organize management and maintenance of the national inland waterway routes announced in Article 1 of this Decision in accordance with the provisions of the law.
Article 3
1. This Decision takes effect from April 1, 2006. This Decision replaces Decision No. 1731/QĐ-PC-VT July 10, 1997 of the Minister of Transport on the announcement of the list of rivers and canals under central management and previous regulations that conflict with this Decision.
2. The Director of the Vietnam Inland Waterways Administration shall be responsible for timely transferring to the People's Committees of provinces and centrally-administered cities concerned for announcement and organization of management and maintenance of the inland waterway routes listed in the List which have been specified to become local inland waterway routes.
3. For inland waterway routes where there is a division of management responsibilities between the Vietnam Maritime Administration and the Vietnam Inland Waterways Administration, the Directors of the Vietnam Inland Waterways Administration and the Vietnam Maritime Administration shall base their transfer of non-responsibility management areas on the List of national inland waterway routes issued together with this Decision; the transfer between the Vietnam Inland Waterways Administration and the Vietnam Maritime Administration shall be completed before April 1, 2006.
Article 4. The Head of the Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Inland Waterways Administration, Directors of the Vietnam Maritime Administration, Directors of Provincial Departments of Transport and Public Works, Heads of organizations and individuals concerned shall be responsible for implementing this Decision./.
