THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to Decision No. 257/2003/QĐ-TTg dated December 3, 2003 of the Prime Minister on supporting investment in building essential infrastructure for particularly difficult communes in coastal areas and islands;
After reaching consensus with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Agriculture and Rural Development, and the Ministry of Fisheries,
After reaching consensus with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Agriculture and Rural Development, and the Ministry of Fisheries,

DECISION:

Article 1. Issuing criteria for particularly difficult communes in coastal areas and islands (hereinafter referred to as coastal communes) to implement support for investment in building essential infrastructure according to Decision No. 257/2003/QĐ-TTg dated December 3, 2003 of the Prime Minister, with the following conditions:

1. Being a commune located in a coastal area or a sandbar, lake, peninsula, or island adjacent to the sea; having harsh natural conditions, constantly affected by tidal floods, droughts, barren and infertile land, difficult farming; lying outside the Program for Economic and Social Development of Particularly Difficult Communes in Mountainous Areas and Remote Areas (Program 135);

2. Being a poor commune according to the criteria stipulated in Decision No. 587/2002/QĐ-BLĐTBXH dated May 22, 2002 of the Ministry of Labor, Invalids and Social Affairs, specifically as follows:

- The poverty rate of households is 25% or more;
- Lacking (not having enough) three out of six essential infrastructure works (including: roads; schools; health stations; clean water supply; electricity supply; markets), specifically:
+ Less than 30% of households have access to clean water;
+ Less than 50% of households have access to electricity;
+ There is no road accessible by motor vehicles to the commune center or motor vehicles cannot travel throughout the year;
+ The number of classrooms (as prescribed by the Ministry of Education and Training) only meets less than 70% of students' needs or temporary classrooms made of bamboo, reeds, or leaves;
+ There is no commune health station or it is a temporary structure;
+ There is no market or it is a temporary facility.

3.Additionally lacking essential infrastructure serving production, depending on specific conditions of each commune, including: flood protection embankments; retaining walls; irrigation works; pumping stations for seawater for aquaculture or salt production; roads to fishing ports; fish markets.

Article 2. Based on the criteria stipulated in Article 1 of this Decision, the Chairman of the People's Committee of coastal provinces and cities shall direct investigations to identify coastal communes within their jurisdiction and report to the Ministry of Labor, Invalids and Social Affairs for consolidation and submission to the Prime Minister.

Article 3. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
