MINISTER OF NATIONAL DEFENSE

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999;

Pursuant to the Law on Enactment of Legal Normative Documents dated November 12, 1996, amended and supplemented on December 16, 2002;

Pursuant to Decree No. 30/2004/NĐ-CP dated January 16, 2004 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Decree No. 26/2002/NĐ-CP dated March 21, 2002 of the Government on reserve officers of the Vietnam People's Army;

Based on the proposal of the Director of the General Political Department.

DECISION:

Article 1. Issuing the "Reserve Officer Card" to be granted to reserve officers of the Vietnam People's Army serving in the reserve rank, aiming to meet the requirements for registration and management of reserve officers by agencies and units both within and outside the military, while facilitating reserve officers when performing military duties at reserve mobilization units.

Article 2. The "Reserve Officer Card" is rectangular, measuring 90mm in length and 60mm in width; both sides are light brown in color; the front side has a faint military emblem pattern with light brown stripes, and the back side has a small circular pattern in light brown color, including the following contents:

1. Front Side: At the top is the title "Vietnam People's Army"; on the left side, above: the Military Emblem, below which is where the photograph is affixed, on the right side, at the top: "Reserve Officer Card" (printed in red), below is the card number, followed by: Full name, rank, officer number, issuing unit, date of issue; at the bottom center is the line: "READY TO DEFEND THE COUNTRY".

2. Back Side: Date of birth, ethnicity, place of origin, first registration at, enlistment, discharge, discharge unit, reserve officer training at, duration, military profession, first registration, identification: height 1m...

Article 3. Each reserve officer during their service in the reserve rank or regular officers transferred to the reserve rank shall be issued and use 01 (one) "Reserve Officer Card" with a unique card number.

Article 4. The "Reserve Officer Card" shall be issued by the commanders of agencies and units under the Ministry of National Defense to the recipients after being conferred the rank of reserve officer by the Minister of National Defense and regular officers transferred to the reserve rank.

Article 5. Responsibilities for managing and using the "Reserve Officer Card".

1. Commanders of agencies and units under the Ministry of National Defense are responsible for inspecting and urging the issuance, management, and use of the "Reserve Officer Card" and have the authority to reclaim the "Reserve Officer Card" within their jurisdiction in the following cases: Death of a reserve officer, demobilization from the reserve officer rank, revocation of the rank of reserve officer, conviction by a court.

2. The commander of the military office of the district (city district, town) temporarily reclaims the "Reserve Officer Card" within their jurisdiction in the case where a reserve officer violates the law to the extent that prosecution is required.

3. The Cadre Department of the General Political Department directly assists the Ministry of National Defense in managing the printing, distribution, issuance, reclamation, and use of the "Reserve Officer Card" and guides the implementation.

4. Reserve officers are responsible for preserving and protecting their own "Reserve Officer Card" and presenting it when performing duties at reserve mobilization units and in situations related to the obligations and rights of reserve officers. In the event of loss or damage, they must immediately report to the military office of the district (city district, town).

Article 6. Strictly prohibited are false declarations, erasures, alterations, lending, misuse, and any other illegal acts in the management and use of the "Reserve Officer Card." If violated, disciplinary action will be taken according to the Regulations of the Military based on the severity of the offense.

Article 7. The new "Reserve Officer Card" will be distributed from July 2004. "Reserve Officer Cards" issued before June 2004 remain valid like the new "Reserve Officer Card."

Reserve officers promoted from sub-officer to major or those who lost their cards for legitimate reasons may be issued new cards.

Article 8. This Decision takes effect fifteen days after its publication in the Official Gazette. Previous regulations concerning the "Reserve Officer Card" that conflict with this Decision are hereby abolished.

The Deputy Chief of General Staff, the Director of the General Political Department, and relevant agencies and units are responsible for implementing this Decision.
