Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 07/2006/QĐ-TTg dated January 10, 2006 of the Prime Minister approving the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority and Mountainous Areas for the period 2006-2010;
Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,

DECISION:
Article 1. Approve the supplementary list of 152 particularly difficult communes, border communes, and safe area communes in 32 provinces to be included in the scope of investment under Phase II of Program 135 (Annex I attached hereto) to implement the tasks of the Program from the 2008 plan.
The state budget will support investment for the 152 supplementary communes included in the scope of investment under the Program:
+ Central budget support for investment: 135 communes;
+ Local budget investment: 17 communes.
Article 2.
1. Transfer three communes of Dao Tu, Bo Ly, and Yen Duong in Tam Dao district, Vinh Phuc province, which are currently supported by the central budget, to be supported by the local budget from 2008.
2. Approve commune Phong Thanh Dong in Gia Rai district, Bac Lieu province, to be included in the scope of investment under Phase II of Program 135 instead of commune Phong Thanh Dong B in Gia Rai district, Bac Lieu province, as specified in Annex II issued together with Decision No. 164/2006/QĐ-TTg dated July 11, 2006 of the Prime Minister approving the list of particularly difficult communes, border communes, and safe area communes to be included in the scope of investment under Phase II of Program 135.
Article 3.
1. Approve the supplementary list of 110 communes (Annex II attached hereto) in 26 provinces to be removed from the scope of investment under Phase II of Program 135 from 2009.
2. Particularly difficult hamlets and villages in commune zone II that have been removed from the scope of investment shall be considered for inclusion in the scope of investment under Phase II of Program 135 from 2009. Delegate the Minister, Head of the Committee for Ethnic Minorities to decide on approving the specific list after coordinating with the Ministry of Planning and Investment and the Ministry of Finance.
Article 4. Poor households according to the poverty standard prescribed in Decisionealth No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister promulgating the poverty standard applicable for the period 2006-2010 (referred to as poor households), individuals belonging to poor households, students, civil servants, military officers, police officers residing and working in communes named in Annex II attached hereto shall enjoy policies as those in communes under Phase II of Program 135 until the end of 2010.
Article 5.
1. The Committee for Ethnic Minorities shall take the lead and coordinate with relevant ministries and sectors to guide, direct, inspect, and urge localities to effectively implement and utilize the investment support funds for communes within the scope of investment under Phase II of Program 135 in accordance with current regulations.
2. The Ministry of Planning and Investment and the Ministry of Finance shall allocate targeted assistance funds for provincial people's committees directly under the central government having particularly difficult communes within the scope of investment under various programs.
3. The Ministries of Agriculture and Rural Development, Transport, and other relevant ministries, sectors, and agencies shall implement based on Article 2 of Decision No. 07/2006/QĐ-TTg dated January 10, 2006, in accordance with their assigned functions and tasks.
4. Provincial people's committees directly under the central government having communes within the scope of investment under Phase II of Program 135 shall direct the preparation, approval, and implementation in accordance with the intended purposes, beneficiaries, and contents of support as stipulated by current regulations.
Article 6. This Decision takes effect 15 days after its publication in the Official Gazette.
Article 7. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
