CIRCULAR
REGULATIONS ON ENERGY LABELING FOR ENERGY-CONSUMING EQUIPMENT UNDER THE MANAGEMENT OF THE MINISTRY OF CONSTRUCTION
Pursuant to the Law on Rational and Efficient Energy Use No. 50/2010/QH12; the Law Amending and Supplementing Certain Provisions of 11 Laws Related to Planning No. 28/2018/QH14; the Law Amending and Supplementing Certain Provisions of the Law on Rational and Efficient Energy Use No. 77/2025/QH15;
Pursuant to the Decree detailing certain provisions and measures for organizing and guiding the implementation of the Law on Rational and Efficient Energy Use;
Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Vietnam Motor Vehicle Inspection Center;
The Minister of Construction issues this Circular regulating energy labeling for energy-consuming equipment under the management of the Ministry of Construction.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular guides the provisions at Clause 3, Article 39 of the Law on Rational and Efficient Energy Use No. 50/2010/QH12 amended and supplemented by Clause 17, Article 1 of Law No. 77/2025/QH15 amending and supplementing certain provisions of the Law on Rational and Efficient Energy Use regarding energy labeling for energy-consuming equipment.
2. This Circular does not apply to:
a) Equipment produced, assembled, or imported within the jurisdiction of the Ministry of National Defense and the Ministry of Public Security;
b) Equipment temporarily imported for re-export; in transit; transfer; equipment of diplomatic and consular agencies.
Article 2. Applicability
This Circular applies to production facilities, import enterprises, distributors, traders of equipment including those operating on e-commerce platforms, and laboratories testing the energy consumption levels of equipment under the management of the Ministry of Construction.
Chapter II
PROVISIONS ON ENERGY LABELING FOR EQUIPMENT
Article 3. General Provisions on Energy Labeling for Equipment
The energy consumption level printed on the energy label of the equipment must be consistent with the energy consumption level in the test report on energy consumption levels according to the regulations of the Minister of Construction on procedures and formalities for quality and technical safety certification and environmental protection for motor vehicles, special-purpose vehicles, and vehicle parts in production, assembly, and import.
Article 4. List of Equipment Required to Have Energy Labels
The list of equipment required to have energy labels is specified in Appendix I attached hereto.
Article 5. Provisions on Content and Format of Energy Labels for Equipment
The content and format of energy labels for equipment are as prescribed in Appendix II attached hereto.
Article 6. Provisions on Laboratories Testing Energy Consumption Levels of Equipment
A laboratory testing energy consumption levels of equipment is a laboratory belonging to a business entity providing testing services that meets the requirements stipulated in Article 5 of Government Decree No. 107/2016/NĐ-CP dated July 1, 2016, on Conditions for Operating Testing Services for Product Quality and Safety, which has been amended and supplemented by Government Decree No. 154/2018/NĐ-CP amending and supplementing certain conditions for investment and operation in the field of state management by the Ministry of Science and Technology and certain provisions on specialized inspections.
Article 7. Guidance and Announcement of Energy Labeling for Equipment
1. Acceptance of Applications for Announcing Energy Labeling for Equipment
Production facilities, import enterprises, distributors, and traders of equipment submit applications for announcing energy labeling directly, through postal services, or via electronic media in accordance with the provisions of the Government's Decree detailing certain provisions and measures for organizing and guiding the implementation of the Law on Rational and Efficient Energy Use to the Vietnam Motor Vehicle Inspection Center.
2. Certificate of Energy Labeling for Equipment as prescribed in Appendix III attached hereto.
3. The Vietnam Motor Vehicle Inspection Center announces information on energy labels for equipment of production facilities, import enterprises, distributors, and traders of equipment on its official website within five working days from the date of receipt of the application for announcing.
4. Guidance on Applying Energy Labels
a) Import enterprises and production facilities print energy labels according to the model prescribed in Appendix II attached hereto and affix them to the equipment.
b) Position of Energy Labels
For equipment with fixed side windows or rear windshields, the energy label must be affixed inside at one of these two positions ensuring easy observation from outside the vehicle.
In cases where there are no side windows or rear windshields or where it is difficult to observe when affixed inside the vehicle, the energy label may be affixed outside the vehicle at a position easily observable.
Article 8. Recognition of Energy Labels for Imported Vehicles
1. The recognition of foreign energy labels for imported vehicles shall be carried out in accordance with the provisions of international treaties to which the Socialist Republic of Vietnam is a member.
2. In cases where the energy label of imported vehicles is recognized according to the provisions of international treaties to which the Socialist Republic of Vietnam is a member, the importing, distributing, and trading enterprises are responsible for affixing supplementary labels displaying the Vietnamese translation of the contents on the foreign energy label, placed adjacent to the foreign energy label.
Article 9. Suspension and Revocation of Energy Label Affixation
1. The Vietnam Registration Agency suspends the affixation of energy labels on vehicles in accordance with the detailed regulations stipulated in the Government's Decree detailing certain provisions and measures to organize and guide the implementation of the Law on Rational and Efficient Energy Use. The suspension shall be made in accordance with the model prescribed in Appendix V issued together with this Circular.
2. The Vietnam Registration Agency requests production facilities, importing, distributing, and trading enterprises to implement the revocation of energy label affixation in accordance with the detailed regulations stipulated in the Government's Decree detailing certain provisions and measures to organize and guide the implementation of the Law on Rational and Efficient Energy Use. The notification of the requirement to revoke energy label affixation on vehicles from the Vietnam Registration Agency shall be made in accordance with the model prescribed in Appendix V issued together with this Circular.
Chapter III
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 10. Responsibilities of Production Facilities, Importing, Distributing, and Trading Enterprises
1. Comply with the regulations on affixing energy labels on vehicles as prescribed in this Circular.
2. Implement reporting procedures as prescribed in the Government's Decree detailing certain provisions and measures to organize and guide the implementation of the Law on Rational and Efficient Energy Use, and submit them to the Vietnam Registration Agency. Reporting forms are prescribed in Appendix IV issued together with this Circular.
Article 11. Responsibilities of the Vietnam Registration Agency
1. Organize the receipt and publication of the Energy Label Declaration Certificate on the Vietnam Registration Agency's electronic portal.
2. Inspect the implementation of testing vehicles for energy label affixation at testing laboratories.
3. Suspend and revoke the affixation of energy labels on vehicles in accordance with the regulations.
Chapter IV
IMPLEMENTING PROVISIONS
Article 12. Implementation Provisions
Clause 1. This Circular takes effect from January 1, 2026.
2. Vehicle types that have been granted energy consumption certification or safety technical and environmental protection certification combined with energy consumption certification before the effective date of this Circular may continue to use energy labels printed according to previous regulations until December 31, 2027.
3. Testing laboratories conducting energy consumption tests for energy-using vehicles under the management of the Ministry of Construction prior to the effective date of this Circular may continue such activities until December 31, 2027.
4. Repeal the following Circulars and certain articles in previously issued Circulars from the date this Circular takes effect, specifically as follows:
a) Joint Circular No. 43/2014/TTLT-BGTVT-BCT dated September 24, 2014, issued by the Minister of Transport and the Minister of Industry and Trade regarding the affixation of energy labels on passenger cars with up to seven seats.
b) Article 16 and Clause 9, Article 19 of Circular No. 54/2024/TT-BGTVT dated November 15, 2024, issued by the Minister of Transport regarding the procedures and formalities for certifying the quality, safety technical standards, and environmental protection of motor vehicles, specialized motor vehicles, and motor vehicle parts in imports.
c) Appendix XIX of Circular No. 54/2024/TT-BGTVT dated November 15, 2024, issued by the Minister of Transport regarding the procedures and formalities for certifying the quality, safety technical standards, and environmental protection of motor vehicles, specialized motor vehicles, and motor vehicle parts in imports.
d) Article 18 of Circular No. 55/2024/TT-BGTVT dated November 15, 2024, issued by the Minister of Transport regarding the procedures and formalities for certifying the quality, safety technical standards, and environmental protection of motor vehicles, specialized motor vehicles, and motor vehicle parts in production and assembly.
