Joint Circular No. 7-TTLB/VH/NgT stipulates the scope of import and export business and foreign currency collection services in the cultural sector.

CIRCULAR

JOINT MINISTRY OF CULTURE AND FOREIGN TRADE DECREE NO. 7-TTLB/VH/NGT
EFFECTIVE DATE: JANUARY 17, 1985 REGULATING THE SCOPE OF EXPORT AND IMPORT BUSINESS AND FOREIGN CURRENCY EARNING SERVICES IN THE CULTURAL SECTOR
Pursuant to Decision No. 113-HĐBT dated July 10, 1982 of the Council of Ministers on certain measures for developing export goods and strengthening management of import and export activities, and Resolution No. 159-HĐBT dated December 19, 1983 of the Council of Ministers on cultural information work during the immediate period, the Ministry of Culture and the Ministry of Foreign Trade hereby regulate the scope of export and import business and foreign currency earning services in the cultural sector as follows:

1. The organizations engaged in export and import business and foreign currency earning services directly under the Ministry of Culture include: - Vietnam Book and Cultural Product Import-Export Company (XUNHASABA),

- Vietnam Film Import-Export and Distribution Company (FAFIM),

- Vietnam Art Performance Company (VINACONCERT).

The list of export and import goods and services of these units is specified in Appendices 1, 2, and 3 attached hereto.

2. In order to concentrate the main channels and strengthen unified management over economic activities related to culture, the Joint Ministries stipulate:

a) Units under the Ministry of Culture that engage in imports are the sole entities authorized to conduct import and export of various types of printed materials, music products, artistic works in painting, sculpture, antiques, film reels, and pre-recorded video cassettes.

b) The Vietnam Art Performance Company is the central unit organizing and signing contracts with foreign countries regarding performances of various art forms and theatrical shows.

c) Other central units engaged in export and import business shall not operate within the scope assigned to units directly under the Ministry of Culture.

d) Localities have the authority to conduct import and export of cultural products from their localities outside the categories specified in paragraph a, point 2 above, after approval by the Ministry of Culture on cultural aspects and the Ministry of Foreign Trade on commodity plans.

e) Localities may implement cultural and artistic services earning foreign currencies at the local level after approval by the Ministry of Culture on cultural content, and abroad through the central unit designated by the Vietnam Art Performance Company.

3. Units engaged in foreign trade directly under the Ministry of Culture are allowed to supplement their targets beyond those set forth in state regulations and enjoy the right to use foreign currencies according to the prescribed regime of the state.

This Circular takes effect from the date of signature. All previous regulations issued by the Joint Ministry of Culture and Foreign Trade that conflict with this Circular are hereby abolished.

A. EXPORT AND SERVICES:
1. Various types of publications: books, newspapers, magazines, photo newspapers, postcards, prints...
2. Acceptance of overseas printing orders.
3. Various types of artistic works, including paintings, sculptures, comprising:
- Original artworks and reproductions signed by the author in all materials.
- Postcards painted on paper, silk, embroidered on silk,

- Dong Ho folk paintings, Hang Trong folk paintings.

- Sculptures and ceramic artworks including new creations, reproductions, and adaptations in all materials.

4. Postal stamps of all kinds (temporarily still handled by the Stamp Company under the General Post Office Administration according to the decision of the Council of Ministers).

5. Recorded music discs and tapes.

6. Musical instruments and parts thereof.

7. Artistic stone products, excluding precious stones (according to Decision No. 38-CP dated February 9, 1979 of the Council of Ministers).

8. Implementation of exhibition services about books, newspapers, and fine arts products both domestically and internationally within the business scope of Xunhasaba with foreign currency earnings.

B. IMPORTS:

1. Various types of publications (details as in the export section).

2. Collectible stamps.

3. Recorded music discs and tapes.

4. Musical instruments and parts thereof.

5. Realgar, cinnabar.

6. Disc engraving machines and master discs.

7. Import of specialized equipment and materials for cultural product production and artistic performance using own capital.

Within the scope of foreign currency that Vinacert is entitled to use according to the prescribed regime of the state, Vinacert is permitted to import specialized technical equipment for artistic performances according to plans approved by the Ministry of Culture and accepted by the Ministry of Foreign Trade.

8. Providing film screening services for foreigners in Vietnam.
