Regulations on the functions, tasks, powers, and organizational structure of the Crop Cultivation Department

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 19 of Decree No. 82/2002/NĐ-CP dated November 5, 2002, issued by the Government, regarding the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decision No. 254/2005/QĐ-TTg dated October 13, 2005, issued by the Prime Minister, adjusting some subordinate organizations under the Ministry of Agriculture and Rural Development;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. Position and Function

1\. The Crop Cultivation Department is established based on the restructuring of the Agricultural Department according to Clause 1 of Article 1 of Decision No. 254/2005/QĐ-TTg dated October 13, 2005, issued by the Prime Minister, adjusting some subordinate organizations under the Ministry of Agriculture and Rural Development.

2\. The Crop Cultivation Department is a subordinate agency under the Ministry of Agriculture and Rural Development, performing specialized state management functions for crop cultivation throughout the country.

3\. The Crop Cultivation Department has legal personality, receives funding for its operations, uses its seal, and opens a separate account at the State Treasury in accordance with the provisions of the law.

The headquarters of the Crop Cultivation Department is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Crop Cultivation Department is assigned by the Minister to perform state management tasks in the specialized field of crop cultivation within the scope of the Ministry's management as follows:

1\. Drafting projects for laws, ordinances, and draft regulatory legal documents within the scope of the Department’s management and submitting them to the Minister.

2\. Submitting strategies, plans, policies, annual and long-term programs, projects, proposals, standards, procedures, norms, and economic and technical quotas related to crop cultivation within the scope of the Department’s management, as assigned by the Minister.

3\. Issuing documents on business management and providing professional guidance within the specialized field according to the division of authority by the Minister.

4\. Directing, guiding, inspecting, and being responsible for implementing regulatory legal documents, plans, programs, projects, standards, procedures, norms, and economic and technical quotas that have been approved, and promoting, disseminating, and educating about policies and laws within the scope of the Department’s management.

5\. Regarding agricultural crop seeds:

a\. Managing state affairs concerning agricultural crop seeds in accordance with the law;

b\. Developing strategies, plans, and programs for the development of agricultural crop seeds in line with the overall national socio-economic development plan and that of each locality;

c\. Organizing surveys and statistics on seed usage; developing procedures, norms, techniques, and technologies for agricultural crop seeds;

d\. Managing the quality and activities of testing and inspecting the quality of agricultural crop seeds; conducting trials and recommending the recognition of new crop varieties; organizing selection, recognition of mother gardens and mother plants; protecting new crop varieties;

đ\. Issuing and revoking permits and certificates for agricultural crop seeds within the scope of authority;

e\. Submitting to the Minister for issuance of the list of agricultural crop seeds permitted for production and trade in Vietnam;

g\. Managing the system of breeding, testing, inspecting, producing, and trading agricultural crop seeds;

h\. Building and managing a database of agricultural crop seeds;

i\. Managing the export and import of agricultural crop seeds;

6\. Regarding cultivation (specialized technical aspects of crop cultivation):

a\. Uniformly managing planting seasons, planting techniques, care, and harvesting;

b\. Uniformly managing planning, utilization, protection, and enhancement of soil fertility in agriculture; participating in the review of land use plans and changes in land use purposes in agriculture;

7\. Managing fertilizers:

a\. Uniformly managing the quality and use of organic fertilizers;

b\. Managing the registration, testing, and recommendation for the recognition of new fertilizers;

c\. Submitting to the Minister for issuance of the list of fertilizers permitted for production and trade in Vietnam;

d\. Building and managing a database on fertilizers;

8\. Directing crop cultivation production:

a\. Building and directing the implementation of annual crop cultivation production plans;

b\. Reviewing investment projects for raw material regions related to crop cultivation linked to agricultural product preservation and processing according to planning; participating in management of agricultural product preservation and processing; proposing measures to mitigate natural disasters and pests in crop cultivation nationwide;

c\. Managing state affairs concerning agricultural extension services in crop cultivation;

d\. Statistics, reporting on production progress, and building a database on crop cultivation;

đ\. Summarizing and evaluating annual production situations;

e\. Reviewing and managing the implementation of basic investigation projects on crop cultivation;

g\. Managing and monitoring national reserves of agricultural crop seeds;

9\. Regarding science and technology:

a\. Uniformly managing state affairs concerning plant gene banks;

b\. Building and submitting to the Minister programs, plans, and research topics on applying scientific and technological advancements within the scope of the Department’s management; managing and organizing the implementation of research results and technological advancements within the scope of the Department’s management;

c\. Submitting to the Minister for issuance of quality standards for agricultural crop seeds, crop products, organic fertilizers, and specialized materials serving crop cultivation within the scope of authority of the Ministry;

d\. Managing information on crop cultivation science and technology;

đ\. Establishing and managing a specialized scientific council to review the results of trials on new agricultural crop seeds and fertilizers, and submitting them to the Minister for issuance to include in the list of agricultural crop seeds and fertilizers permitted for production and trade in Vietnam;

10\. Participating in the management of training and professional development in crop cultivation as assigned by the Ministry;

11\. Regarding promotion of agricultural products:

a\. Participating in building forecasts and directions for the development of export markets for agricultural products, replacing imports, and domestic consumption;

b\. Participating in building policies for developing markets for crop products and international integration;

c\. Directing the organization of exhibitions and fairs on crop cultivation;

12\. Building programs and projects for international cooperation in crop cultivation; participating in negotiations to sign and join international treaties and organizations in crop cultivation; organizing the implementation of international treaties and cooperative projects according to the division of authority by the Minister;

13\. Managing and directing certain public service units and public services under the Ministry in crop cultivation as assigned by the Minister.

14. Participate in managing the activities of associations, unions, and non-governmental organizations in the field of crop production according to the division of labor by the Minister.

15. Conduct inspections and checks; resolve complaints and denunciations; combat corruption and handle violations in the field of crop production within the scope of authority.

16. Develop and implement the administrative reform program of the Bureau in accordance with the objectives and content of the Ministry's administrative reform program.

17. Perform tasks and manage the Office for the Protection of New Crop Varieties.

18. Manage the organization, staffing, and establishment of the Bureau in accordance with regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for civil servants and officials under the Bureau's jurisdiction.

19. Manage finances, assets, and other resources assigned; organize the implementation of the budget allocated according to regulations.

20. Carry out other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Leadership of the Bureau:

The Bureau leadership consists of the Director and Deputy Directors appointed by the Minister of Agriculture and Rural Development in accordance with regulations.

The Director oversees the operations of the Bureau, is responsible to the Minister of Agriculture and Rural Development, and to the law regarding the Bureau's activities.

Deputy Directors assist the Director, are responsible to the Director, and to the law regarding the performance of assigned tasks.

2. Management Structure of the Bureau:

a) Administrative and General Affairs Department,

b) Planning and Finance Department;

c) Legal and Inspection Department;

d) Food and Feed Crops Department;

đ) Industrial and Fruit Trees Department;

e) Land Use and Fertilizer Department;

g) Permanent Office in Ho Chi Minh City.

h) Permanent Office in Binh Dinh:

3. Subordinate units:

a) Central Seed Testing and Inspection Center.

b) Subordinate units managed according to the decision of the Minister.

The Director of the Crop Production Bureau stipulates the functions, tasks, appoints staff for departments, sections, and subordinate units; establishes the Bureau's operational regulations to be submitted to the Minister for approval.

Civil servants of the Bureau are part of the administrative establishment and receive salaries from the state budget.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette and abolishes previous regulations that conflict with this Decision.

Article 5. Responsibilities for Implementation

1. The Director of the Agricultural Bureau shall transfer duties and related matters to the Director of the Crop Production Bureau.

2. The Heads of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Director of the Agricultural Bureau, and the Heads of relevant agencies and units under the Ministry, the Chairpersons of People's Committees of provinces and centrally-administered cities, and the Director of the Crop Production Bureau are responsible for implementing this Decision./.
