Pursuant to the Forest Protection and Development Law dated December 3, 2004;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

On the basis of Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on the implementation of the Forest Protection and Development Law;

Pursuant to Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister promulgating the Forest Management Regulations;

The Ministry of Agriculture and Rural Development amends and supplements certain contents of Circular No. 35/2011/TT-BNNPTNT dated May 20, 2011 on guiding the implementation of logging and harvesting timber and non-timber forest products; Circular No. 87/2009/TT-BNNPTNT dated December 31, 2009 on guiding the design for selective logging of natural forests as follows:

Article 1. Amending and supplementing certain contents of Circular No. 35/2011/TT-BNNPTNT dated May 20, 2011 of the Ministry of Agriculture and Rural Development on guiding the implementation of logging and harvesting timber and non-timber forest products

1. Point c Clause 1 Article 4 is amended and supplemented as follows:"

"1. Natural forests and mixed forests with bamboo and rattan are natural forests. The minimum diameter of trees to be logged (except in cases where trees must be felled when felling adjacent trees during logging) shall be determined according to the type of tree as prescribed by the Ministry of Agriculture and Rural Development. In the absence of such regulations, the following general provisions apply:

c) The minimum diameter at breast height (1.3 meters above ground level, hereinafter referred to as D1.3m) for trees to be logged is: Group I and II: 45 cm, Groups III to VI: 40 cm, Groups VII and VIII: 35 cm. For oil trees in deciduous forests (dipterocarp forests) and teak trees (Group II), it is 35 cm."

2. Clause 5 Article 4 is amended and supplemented as follows:"

"5. Objects for harvesting:

Are dead, decayed, hollowed-out, burnt wood; branches, tops, roots, and bark of trees; logs, sections of trees, and other non-timber forest products still within and outside the forest (excluding strictly protected zones of special-use forests)."

3. Clause 2 Article 12 is amended and supplemented as follows:

"2. Prepare a table of expected products to be harvested:

Based on the forest management design documents, forest production projects, research project proposals, or training plans approved by competent authorities, the forest owner conducts or hires consultants to conduct field surveys to collect data, mark trees with stakes for natural trees permitted for selective logging with D1.3m of 25 cm or more; prepare a table of expected products to be harvested."

4. Point a Clause 1 Article 23 is amended and supplemented as follows:

"a) Prepare a table of expected logging: The forest owner conducts or hires consultants to build forest management design documents or forest production projects; mark trees with stakes for natural trees permitted for selective logging with D1.3m of 25 cm or more; prepare a table of expected products to be harvested. After completion, the local forest rangers or forestry officials from the commune confirm."

Article 2. Amending and supplementing certain contents of Circular No. 87/2009/TT-BNNPTNT dated December 31, 2009 of the Ministry of Agriculture and Rural Development on guiding the design for selective logging of natural forests

1. Clause 1 Article 10 is amended and supplemented as follows:

"1. All forest compartments designed for logging, after dividing the compartments and determining their areas, shall conduct a forest resource survey on standard plots of 500 square meters (20 x 25 meters) using typical plot methods."

2. Clause 2 of Article 10 is amended and supplemented as follows:

"2. The minimum sampling rate is 2% of the compartment area. If there are fewer than three standard plots, at least three standard plots must be established. Standard plots are independently arranged for each compartment."

3. Clause 4 Article 17 is amended and supplemented as follows:

"4. The design of transport routes shall be carried out by organizations or individuals with the function of designing forest roads and bridges."

Article 3. Implementation Provisions

1\. This Circular takes effect forty-five days from the date of issuance.

2. The Director of the Ministry's Office, the General Director of the Forestry General Department, the Director of the Legal Department, the Heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular./.
