CIRCULAR
Regulations on the level of collection, collection system, payment and management of usage fees for the exploitation and use of national remote sensing data
and using national remote sensing data

Pursuant to the Ordinance on Fees and Charges;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 and Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decision No. 81/2010/QĐ-TTg dated December 13, 2010 of the Prime Minister regarding the collection, storage, processing, exploitation, and use of national remote sensing data;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
After receiving the opinion of the Ministry of Natural Resources and Environment in Circular No. 390/BTNMT-TC dated February 23, 2012, the Ministry of Finance hereby stipulates the level of collection, collection system, payment and management of usage fees for the exploitation and use of national remote sensing data as follows:
Article 1. Objects subject to fee payment and collecting agencies
1. Objects subject to fee payment
Vietnamese agencies, organizations, individuals; overseas Vietnamese citizens; organizations and individuals with offices established within the territory of Vietnam must pay the fee for exploiting and using national remote sensing data according to the provisions of this Circular when they exploit and use such data.
No fee will be charged for the exploitation and use of national remote sensing data if it serves direct requirements of Party and State leadership or in emergency situations.
2. Collecting agencies
National remote sensing data providing state management agencies include: The National Remote Sensing Center under the Ministry of Natural Resources and Environment; agencies assigned by ministries, sectors, localities to provide national remote sensing data according to the law shall organize the collection, payment, management, and use of fees for exploiting and using national remote sensing data in accordance with the provisions of this Circular.
Article 2. Level of Collection
Clause 1. Level of fee collection for exploiting and using national remote sensing data is specified in the attached Fee Collection Table.
Clause 2. Fees for exploiting and using national remote sensing data shall be collected in Vietnamese Dong (VND).
Article 3. Organization of Collection, Payment and Management of Use
Clause 1. Agencies responsible for collecting fees for exploiting and using national remote sensing data shall register and declare the payment of fees into the state budget according to Circular No. 63/2002/TT-BTC dated July 24, 2002 and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 issued by the Ministry of Finance guiding the implementation of laws on fees and charges.
Clause 2. Collecting agencies may retain 60% (sixty percent) of the total amount of fees actually collected before paying into the state budget to cover expenses for implementing tasks, collecting fees for exploiting and using national remote sensing data as follows:
a) Expenses for paying individuals directly performing work, services, and collecting fees: salaries, wages, allowances, contributions as prescribed, excluding salary costs for officials and civil servants already receiving salaries from the state budget according to prescribed regulations;
b) Direct expenses for implementing work, services, and collecting fees: materials, raw materials, office supplies, communication, electricity, water according to current standards and norms;
c) Maintenance, repair, and periodic maintenance costs for machinery, equipment, working tools, or outsourcing costs for assets directly serving work, services, and collecting fees. These costs are allocated based on the degree of wear and tear of assets directly serving work, services, and collecting fees;
d) Costs for purchasing equipment, working tools, and other types of equipment serving the collection of fees according to the approved budget by the competent authority;
e) Rewards and welfare benefits for staff directly performing work, services, and collecting fees in the unit, averaged annually, not exceeding three months' actual salary if this year's revenue exceeds last year's, and up to two months' actual salary if this year's revenue is lower or equal to last year's;
g) Other expenses directly related to the implementation of work, services, and collecting fees.
Clause 3. The remaining amount after deducting the retained portion according to the ratio stipulated in Clause 2 of this Article (40%) must be paid into the state budget according to the corresponding chapters, categories, items, sub-items, and minor items of the current State Budget Classification.
Article 4: Implementation:
1. This Circular shall take effect from July 1, 2012.
2. Other contents related to the collection, submission, management, use, and public disclosure of fee collection not specified in this Circular shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002, and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges; Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain provisions of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government detailing the implementation of certain provisions of the Law on Tax Administration.
3. Organizations and individuals subject to payment of fees and relevant agencies are responsible for implementing this Circular. In the course of implementation, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for consideration and guidance.
