Regulations on management and use of state budget funds to ensure, support costs for
health examinations and treatment expenses for drug addiction treatment with substitute drugs

Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 90/2016/NĐ-CP dated July 1, 2016 of the Government stipulating drug addiction treatment with substitute drugs (hereinafter referred to as Decree No. 90/2016/NĐ-CP);
At the proposal of the Director of the Department of Administrative and Public Financial Affairs;
The Minister of Finance issues this Circular stipulating management and use of state budget funds to ensure, support costs for health examinations and treatment expenses for drug addiction treatment with substitute drugs.
Article 1. Scope of Regulation
This Circular stipulates management and use of state budget funds to ensure and support costs for health examinations and treatment expenses for drug addiction treatment with substitute drugs, except for specific-purpose and designated support amounts from organizations and individuals within and outside Vietnam, or support amounts that sponsors or their authorized representatives and the Ministry of Finance have agreed upon regarding the content and level of expenditure.
Article 2. Applicability
1. Individuals voluntarily participating in drug addiction treatment with substitute drugs at compulsory rehabilitation centers, prisons, detention centers, compulsory educational facilities, and juvenile correctional schools.
2. Individuals voluntarily participating in drug addiction treatment with substitute drugs at treatment facilities under the management of one of the entities specified in Clause 3, Article 22 of Decree No. 90/2016/NĐ-CP.
3. Agencies, organizations, and individuals related to the process of using state budget funds to ensure and support costs for health examinations and treatment expenses for drug addiction treatment with substitute drugs.
1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.
The funding for supporting health examination costs and treatment expenses shall be guaranteed by the budget level responsible for such costs, allocated in the budgets of agencies and units assigned tasks according to current budget decentralization, specifically:
1. Allocated in the social welfare expenditure budget for treatment facilities managed by the Department of Labor, Invalids, and Social Affairs;
2. Allocated in the defense and security expenditure budget for treatment facilities managed by the Public Security Department;
3. Allocated in the health service expenditure budget for treatment facilities managed by the Health Department and other departments (excluding treatment facilities specified in Clauses 1 and 2 of this Article).
Article 4. Level of State Budget Guarantee and Support for Health Examination Costs and Drug Addiction Treatment Expenses Using Substitute Drugs
1. Fully guarantee all costs for health examinations and drug addiction treatment according to professional guidelines prescribed by the Minister of Health and the prices of medical services and drug addiction treatment services decided by competent authorities for state-owned hospitals and drug addiction treatment facilities (hereinafter referred to as health examination and treatment costs) for the subjects specified in Clause 1, Article 2 of this Circular.
2. Support a minimum of 95% of health examination and treatment costs for the subjects specified in Clause 2, Article 2 of this Circular. In cases where higher support levels than the minimum specified in this Clause are provided, they shall be implemented as follows:
a) For Ministries, ministerial-level agencies, and government agencies: The Ministers, Heads of ministerial-level agencies, and government agencies, within the scope of their assigned budgets and the actual number of voluntary participants in drug addiction treatment at treatment facilities under their management, decide on specific higher support levels to implement appropriately.
b) For localities: Provincial People's Councils base their decisions on the local budget balance capacity and the actual number of voluntary participants in drug addiction treatment at treatment facilities under the management of their locality, deciding on specific higher support levels to implement appropriately.
3. Cease to provide support to the subjects specified in Clauses 1 and 2, Article 2 of this Circular in the following circumstances:
a) Termination of treatment as stipulated in Article 10 of Decree No. 90/2016/NĐ-CP;
b) Receiving support from other sources for the same expenditure item.
Article 5. Establishing budgets, allocating, implementing, and settling accounts for expenses
1. The establishment of budgets, allocation, implementation, and settlement of accounts for expenses related to ensuring and supporting health examination and treatment costs for drug addiction, carried out by agencies and units assigned tasks according to the provisions of the State Budget Law and guiding documents of the Law.
2. Annually, at the time specified for establishing the state budget, agencies and units shall base on the levels of support stipulated in Article 4 of this Circular and the estimated number of people registering to participate in drug addiction treatment as defined in Clause 1 and Clause 2 of Article 2 of this Circular, to establish a budget together with regular expenditures of the agency or unit, to be submitted to the supervising authority for consolidation, then sent to the financial authority at the same level for submission to the competent authority for decision-making according to the provisions of the State Budget Law and guiding documents. For non-public drug addiction treatment facilities, they shall prepare plans for examinations, treatments, and funding needs, to be submitted to the Department of Health for consolidation, then sent to the Department of Finance for submission to the competent authority for consideration and decision-making within the Department of Health's budget.
Article 6. Effectiveness
1. This Circular takes effect from September 1, 2017.
2. In the course of implementation, if there are any difficulties, agencies and units are requested to report to the Ministry of Finance for research, amendment, and supplementation to ensure appropriateness./.
