Decree No. 73/2018/ND-CP on the lists of narcotic drugs and precursor chemicals

DECREE
Regulations on Lists of Narcotic Drugs and Precursors

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Prevention and Control of Narcotics dated December 9, 2000 and the Law Amending and Supplementing Certain Articles of the Law on Prevention and Control of Narcotics dated June 3, 2008; đPursuant to the Law Amending and Supplementing Certain Articles of the Penal Code dated June 20, 2017;

The Government promulgates this Decree stipulating lists of narcotic substances and precursor chemicals.

Pursuant to the Chemicals Law on November 21, 2007;

Pursuant to the Medicine Law dated April 6, 2016;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

Attached to this Decree are the following lists of narcotic substances and precursor chemicals: t sList I: Narcotic substances absolutely prohibited for use in medicine and social life; their use for analysis, testing, scientific research, and criminal investigation shall be subject to special regulations by competent authorities.

Article 1. Lists of narcotic drugs and precursors

List II: Narcotic substances limited for use in analysis, testing, scientific research, criminal investigation, or in the medical field according to regulations by competent authorities.

List III: Narcotic substances for use in analysis, testing, scientific research, criminal investigation, or in the medical and veterinary fields according to regulations by competent authorities.

List IV: Precursor chemicals.

Precursor chemicals used for national defense and security purposes shall be managed and licensed for export and import by the Ministry of Public Security. Precursor chemicals used in the veterinary field shall be managed and licensed for export and import by the Ministry of Agriculture and Rural Development.

2. The Decree No. 82/2013/NĐ-CP dated July 19, 2013 of the Government promulgating lists of narcotic substances and precursor chemicals and the Decree No. 126/2015/NĐ-CP dated December 9, 2015 of the Government amending and supplementing the lists of narcotic substances and precursor chemicals promulgated with Decree No. 82/2013/NĐ-CP dated July 19, 2013 of the Government promulgating lists of narcotic substances and precursor chemicals shall cease to be effective from the date this Decree takes effect.

3. Organizations and individuals engaged in trading the two precursor chemicals N-Phenethyl-4-piperidinone (NPP) and 4-ANPP shall comply with the management regulations for precursor chemicals stipulated in this Decree and related documents from July 1, 2018.

Article 2. Effective Date

1. This Decree takes effect from the date of issuance.

1. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the central government shall be responsible for implementing this Decree.

2. The Ministry of Agriculture and Rural Development shall be responsible for managing veterinary drugs containing narcotic substances and precursor chemicals in accordance with the Decree No. 58/2003/NĐ-CP dated May 29, 2003 of the Government on the control of import, export, and transit through Vietnam of narcotic substances, precursor chemicals, addictive drugs, and psychotropic drugs, and the Decree No. 80/2001/NĐ-CP dated November 5, 2001 of the Government guiding the control of legitimate activities related to narcotics within the country.

Article 3. Implementation Organization

3. When new substances not included in the lists of narcotic substances and precursor chemicals promulgated with this Decree are discovered in relation to the production, synthesis, or use of narcotic substances or as provided for in the three United Nations Conventions on Narcotics, the Ministry of Public Security shall be responsible for coordinating with the Ministry of Health, the Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Development, and other relevant agencies to review and submit to the Government for amendment and publication of these lists./.

2. The Ministry of Agriculture and Rural Development shall be responsible for managing veterinary drugs containing narcotic substances and precursor chemicals in accordance with the provisions of Decree No. 58/2003/NĐ-CP dated May 29, 2003 of the Government on the control of import, export, and transit through the territory of Vietnam of narcotic substances, precursors, addictive drugs, psychotropic drugs, and Decree No. 80/2001/NĐ-CP dated November 5, 2001 of the Government guiding the control of lawful activities related to narcotics within the country.

3. When new substances not included in the lists of narcotic substances and precursors issued together with this Decree, which are related to the production, manufacture, or use of narcotic substances, or as provided for in the three United Nations Conventions on Narcotic Drugs, the Ministry of Public Security shall take the lead and coordinate with the Ministry of Health, the Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Development, and other relevant agencies to examine and submit to the Government for amending, supplementing, and announcing those lists./.
