Details implementing certain Articles of the Law on Fire Prevention and Combating and

 the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Combating

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Fire Prevention and Fighting dated June 29, 2001; the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting dated November 22, 2013;

At the proposal of the Minister of Public Security,

The Government promulgates this Decree to provide details on the implementation of certain provisions of the Law on Fire Prevention and Combating and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Combating.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates activities related to fire prevention and combating, organization of firefighting forces and equipment, investment in fire prevention and combating activities, and responsibilities of Ministries, ministerial-level agencies, agencies under the Government, People's Committees at all levels in fire prevention and combating activities.

Article 2. Applicability

This Decree applies to agencies, organizations, households in fire prevention and combating activities and other agencies, organizations, individuals related to fire prevention and combating activities in Vietnam.

Article 3. Education and Training on Fire Prevention and Combating

The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Public Security to develop content and duration for training knowledge and skills on fire prevention and combating to be integrated into teaching programs and extracurricular activities in schools and other educational institutions suitable for each level and field of study.

Article 4. Appendices

This Decree annexes appendices regarding the list of facilities, projects, works subject to fire prevention and firefighting management, firefighting equipment, and specifications of flags, signs, and bands used in firefighting:

1. Attachment I: List of facilities subject to fire prevention and firefighting management.

2. Attachment II: List of facilities with fire and explosion hazards.

3. Appendix III: List of facilities required to notify the Fire Prevention and Fighting Police Department about ensuring fire safety conditions before operation.

4. Appendix IV: List of projects and works subject to design review for fire prevention and firefighting by the Fire Prevention and Fighting Police Department.

5. Appendix V: List of firefighting equipment.

6. Appendix VI: Specifications of priority signals and signals used in firefighting.

Chapter II

1. Management and monitoring files for fire prevention and firefighting activities of hazardous facilities and residential areas shall be established and retained by the heads of such facilities and areas; the file includes:

Article 5. Facilities Subject to Fire Prevention and Combating Management

Facilities subject to fire prevention and combating management are production sites, business establishments, public buildings, office premises, residential complexes, and independent structures as defined in Clause 1, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Combating attached as Appendix I to this Decree. Agencies and organizations may have one or more such facilities.

Article 6. Facilities with Fire and Explosion Hazards

Facilities with fire and explosion hazards as defined in Clause 4, Article 3 of the Law on Fire Prevention and Combating are those subject to fire prevention and combating management as defined in Article 5 of this Decree but have higher requirements for fire safety as specified in Appendix II attached to this Decree.

Article 7. Fire Safety Conditions for Facilities

1. Facilities with fire and explosion hazards as specified in Appendix II attached to this Decree must ensure the following fire safety conditions:

a) Regulations, internal rules, warning signs, fire safety and evacuation diagrams appropriate to the characteristics and nature of the facility's operations.

b) Regulations and assignment of responsibilities for fire prevention and combating within the facility.

c) Electrical systems, lightning protection, static electricity protection; electrical equipment, heat-producing devices; use of open flames and heat sources must ensure fire safety.

d) Technical safety procedures for fire prevention and combating suitable to the production, business, and service conditions.

đ) A trained firefighting force within the facility or specialized firefighting force ready for immediate firefighting response.

e) Firefighting and evacuation plans approved by competent authorities according to Article 21 of this Decree.

g) Traffic systems, water supply, communication systems for firefighting, fire alarm, firefighting, fire suppression systems, other firefighting equipment, rescue equipment suitable to the nature and characteristics of the facility, ensuring quantity, quality, and compliance with technical standards on fire prevention and combating or as prescribed by the Ministry of Public Security.

h) Documentation of design review and final inspection for fire prevention and combating by the Fire Prevention and Fighting Police Department for works as specified in Appendix IV attached to this Decree.

i) Records of fire prevention and combating activities managed and monitored according to regulations of the Ministry of Public Security.

2. Facilities subject to fire prevention and combating management as specified in Appendix I attached to this Decree but not classified as having fire and explosion hazards must ensure fire safety conditions consistent with their scale and operational nature and comply with technical standards on fire prevention and combating.

3. The fire safety conditions specified in Clause 1 of this Article must be organized and maintained throughout the operational period.

Article 8. Fire safety conditions for residential areas

1. There must be regulations and internal rules on fire prevention and fighting, electricity usage, fire usage, and flammable and explosive materials; warning signs, notices, diagrams, or fire prevention and fighting evacuation guidance signs suitable to the characteristics of the residential area.

2. The design must be prepared and reviewed for fire prevention and fighting for new residential areas.

3. The electrical system must meet fire safety standards.

4. There must be traffic systems, water sources for firefighting, fire spread prevention measures, firefighting equipment meeting the quantity and quality standards set out in technical regulations on fire prevention and fighting or as prescribed by the Ministry of Public Security.

5. There must be firefighting and evacuation plans approved by competent authorities as stipulated in Article 21 of this Decree.

6. There must be civilian defense forces trained in fire prevention and fighting skills and organized to be ready for immediate firefighting operations.

7. There must be management and monitoring files of fire prevention and fighting activities in accordance with the regulations of the Ministry of Public Security.

Article 9. Fire safety conditions for households

1. Cooking areas, worship areas, places using fire sources, heat sources, ignition devices, heating devices, electrical systems, and electrical equipment must ensure fire safety.

2. Assets, materials, and flammable substances must be arranged, stored, and used in compliance with fire safety regulations.

3. There must be firefighting equipment suitable to the characteristics of each household's activities and conditions.

Article 10. Fire safety conditions for motorized transportation vehicles

1. Motorized transportation vehicles with four seats or more, and motorized transportation vehicles transporting dangerous goods that can cause fires or explosions must ensure and maintain the following fire safety conditions:

a) Regulations, internal rules, warning signs, notices, diagrams, or fire prevention and fighting evacuation guidance signs suitable to the characteristics and nature of the vehicle's operation.

b) Vehicle operation procedures; electrical systems, fuel systems; the arrangement and placement of people, materials, and goods on the vehicle must ensure fire safety.

c) Vehicle drivers must study fire prevention and fighting knowledge during the process of obtaining driving licenses according to the regulations of the Ministry of Transport.

d) Drivers of motorized transportation vehicles with responsibility allowances as prescribed by laws on salary and responsibility allowances for civil servants, public officials, employees, and armed forces personnel, and those working, serving on motorized transportation vehicles with thirty seats or more, and specialized motorized transportation vehicles for transporting dangerous goods that can cause fires or explosions must have certificates of fire prevention and fighting training issued by authorized fire prevention and fighting police agencies.

đ) There must be firefighting equipment suitable to the requirements, nature, and characteristics of the vehicle, ensuring quantity, quality, and operational standards in accordance with technical regulations on fire prevention and fighting or as prescribed by the Ministry of Public Security.

2. Special fire safety assurance requirements for motorized transportation vehicles include dedicated ships, trains for passenger transport, transporting gasoline, diesel, flammable liquids, flammable gases, explosives, and hazardous chemicals must ensure and maintain the following fire safety conditions:

a) Conditions as specified in Clause 1 of this Article must be suitable to the characteristics and nature of the vehicle's operation.

b) There must be fire prevention and fighting review and acceptance documents from fire prevention and fighting police agencies.

3. Motorized transportation vehicles transporting dangerous goods that can cause fires or explosions on inland waterways, railways, and roads must have permits for transporting dangerous goods that can cause fires or explosions issued by fire prevention and fighting police agencies according to laws on transporting hazardous goods on inland waterways, railways, and roads (except cases within the jurisdiction of the Ministry of National Defense).

The Ministry of Public Security shall specify detailed models, procedures, and分级授权发放危险货物运输许可证的权限。

Article 11. Fire prevention and firefighting safety conditions for high-rise buildings and steel-framed houses with corrugated iron roofs

High-rise buildings and steel-framed houses with corrugated iron roofs, which are defined in Appendix II issued together with this Decree, in addition to meeting the fire prevention and firefighting safety conditions stipulated in Clause 1, Article 7 of this Decree, must also ensure the following conditions:

1. For high-rise buildings with a height exceeding nine floors or twenty-five meters and above:

a) The building structure must have fire resistance limits appropriate to the nature of use and the height of the building in accordance with technical standards and regulations on fire prevention and firefighting.

b) Walls, partitions, and suspended ceilings of evacuation routes, exit routes, fire escape stairwells, and public rooms where large numbers of people gather may not use interior decoration materials, soundproofing, or thermal insulation materials that are flammable.

2. For steel-framed houses with corrugated iron roofs whose area exceeds the fire compartment size according to technical standards and regulations on fire prevention and firefighting, they must ensure the following conditions:

a) There must be measures to prevent fire spread through construction structures or fire protection systems.

b) Main structural components must have increased fire resistance limits in accordance with technical standards and regulations on fire prevention and firefighting to minimize the risk of collapse during a fire.

Article 12. Requirements for fire prevention and firefighting when planning new construction projects or urban renovation projects, residential areas, industrial zones, export processing zones, and high-tech zones

When planning new construction projects or urban renovation projects, residential areas, industrial zones, export processing zones, and high-tech zones, the following contents must be ensured:

1. The location of construction projects, clusters of projects, and land plots must ensure fire spread prevention and minimize the harmful effects of heat, smoke, and toxic gases from fires on surrounding residential areas and buildings.

2. Traffic systems and open spaces must have sufficient dimensions and load capacity to ensure the deployment of mechanical firefighting equipment.

3. A firefighting water supply system must be provided; communication and power supply systems must ensure support for firefighting activities and fire alarm reporting.

4. Locations for constructing fire prevention and firefighting police units must be established in necessary and suitable locations according to the plan to ensure readiness for combat, training, maintenance, and repair of firefighting equipment as prescribed by the Ministry of Public Security.

5. In the project, there must be a budget estimate for fire prevention and firefighting items.

Article 13. Requirements for fire prevention and firefighting when preparing projects and designing construction works

When preparing projects and designing new constructions, renovations, or changes in the nature of use of construction works requiring design review for fire prevention and firefighting, the following contents must be ensured:

1. The construction site must ensure safe distances for fire prevention and firefighting from surrounding buildings.

2. The fire resistance rating of the construction work must be appropriate to the scale and nature of its operation; measures must be taken to ensure fire separation and fire spread prevention between different parts of the construction work and between this construction work and other construction works.

3. Production technology, electrical systems, lightning protection, static electricity protection, explosion protection of the construction work, and the arrangement of technical systems, equipment, and materials must meet the requirements for fire prevention and firefighting safety.

4. Evacuation routes (doors, walkways, corridors, fire escape stairs), lighting equipment, smoke exhaust ventilation, evacuation route guidance signs, alarm signals; rescue equipment must ensure rapid and safe evacuation.

5. Traffic systems and parking areas for mechanical firefighting equipment operations must ensure dimensions and load capacity; the firefighting water supply system must meet the requirements for firefighting service.

6. Fire alarm, firefighting systems, and other firefighting equipment must ensure quantity; installation positions and technical parameters must be suitable for the characteristics and nature of the construction work's operation as stipulated by technical standards and regulations on fire prevention and firefighting.

7. In the project and design, there must be a budget estimate for fire prevention and firefighting items.

Article 14. Fire Prevention and Extinguishing Costs in Investment and Construction

1. Fire prevention and extinguishing costs in investment and construction include the costs for fire prevention and extinguishing items under Articles 12 and 13 of this Decree and other costs serving the preparation of project designs, review, testing, inspection, construction, and acceptance related to fire prevention and extinguishing.

2. Fire prevention and extinguishing costs in investment and construction and costs to maintain the operation of fire prevention and extinguishing forces and equipment must be allocated immediately during the planning project formulation stage, investment project formulation, and design of works.

Article 15. Design and Review of Fire Prevention and Extinguishing Design

1. The design of urban planning projects, investment projects, new construction designs, renovations, or changes in the nature of use of works or components thereof (hereinafter referred to collectively as projects or works), and special-purpose motor vehicles that require particular safety measures for fire prevention and extinguishing when newly manufactured or modified from all sources of investment capital must comply with the provisions of technical standards and regulations on fire prevention and extinguishing. The establishment of projects and design of works specified in Appendix IV issued together with this Decree and special-purpose motor vehicles requiring particular safety measures for fire prevention and extinguishing must be carried out by consulting units with sufficient capacity and legal personality.

2. Objects subject to review of fire prevention and extinguishing design:

a) Projects and works specified in Appendix IV issued together with this Decree when newly constructed, renovated, or changed in their nature of use.

b) Special-purpose motor vehicles requiring particular safety measures for fire prevention and extinguishing as stipulated in Clause 2, Article 10 of this Decree when newly manufactured or modified.

3. Documents for Review of Fire Prevention and Extinguishing Design

Documents for review of fire prevention and extinguishing design consist of two sets, confirmed by the investor or vehicle owner, if the documents are in a foreign language, they must be accompanied by a Vietnamese translation of the explanatory section, specifically as follows:

a) For urban planning design projects, the documents include:

- A request for consideration and opinion on fire prevention and extinguishing solutions from the approving authority or the investor (if delegated to another unit, a delegation document must be attached);

- The total investment estimate of the urban planning design project;

- Detailed planning drawings at a scale of 1:500 showing the contents required by Clauses 1, 2, 3, and 4 of Article 12 of this Decree regarding fire prevention and extinguishing solutions.

b) For basic design, the documents include:

- A request for consideration and opinion on fire prevention and extinguishing solutions from the investor (if delegated to another unit, a delegation document must be attached);

- A copy of the investment approval document from the competent authority;

- The total investment estimate of the project or work;

- Technical drawings and explanations of the basic design showing the contents required by Clauses 1, 2, 3, 4, 5, and 6 of Article 13 of this Decree regarding fire prevention and extinguishing solutions.

c) For technical design or construction drawing design, the documents include:

- A request for review of fire prevention and extinguishing design from the investor (if delegated to another unit, a delegation document must be attached);

- A copy of the planning approval document from the competent authority;

- The total investment estimate of the project or work;

- Technical drawings and explanations of the technical design or construction drawing design showing the contents required by Clauses 1, 2, 3, 4, 5, and 6 of Article 13 of this Decree regarding fire prevention and extinguishing.

d) For approval of construction site location, the documents include:

- A request for approval of construction site location for fire prevention and extinguishing from the investor (if delegated to another unit, a delegation document must be attached);

- A copy of the document clearly stating the legality of the land intended for construction;

- Drawings and materials clearly showing the current topography of the land related to fire prevention and extinguishing such as the fire resistance rating of the building, the distance from the proposed building to surrounding buildings, wind direction, and height of the building.

e) For technical design of special-purpose motor vehicles requiring particular safety measures for fire prevention and extinguishing, the documents include:

- A request for review of fire prevention and extinguishing design from the investor or vehicle owner (if delegated to another unit, a delegation document must be attached);

- A copy of the document from the competent authority allowing investment, new manufacture, or modification of the vehicle;

- The total investment estimate of the vehicle;

- Technical drawings and explanations of the technical design showing safety measures for fire prevention and extinguishing concerning the operational characteristics and hazardous fire and explosion properties of the vehicle; conditions for preventing fires, stopping fire spread, evacuation, and rescue in case of fire; safety measures for fire prevention and extinguishing concerning the electrical system, fuel system, and engine; fire alarm, extinguishing systems, and other firefighting equipment; systems and devices for detecting and handling leaks of dangerous flammable and explosive gases and liquids.

4. Procedure for Review of Fire Prevention and Extinguishing Design

a) The Fire Prevention and Extinguishing Police Department reviews fire prevention and extinguishing design for technical design documents or construction drawing design documents of projects and works.

For detailed planning drawings at a scale of 1:500 of urban planning design projects and basic design documents of projects and works, the Fire Prevention and Extinguishing Police Department is responsible for providing written responses regarding fire prevention and extinguishing solutions.

b) Works with fire and explosion hazards listed in Sections 14, 16, and 20 of Appendix IV issued together with this Decree must have a written approval of the construction site location from the Fire Prevention and Extinguishing Police Department before proceeding with the design of the work.

c) Special-purpose motor vehicles requiring particular safety measures for fire prevention and extinguishing, the Fire Prevention and Extinguishing Police Department reviews fire prevention and extinguishing design for technical design documents.

5. Time limit for fire prevention and fighting design review

The time limit for fire prevention and fighting design review shall be calculated from the date when all valid documents are received, specifically as follows:

a) Planning design project: Not exceeding 10 working days.

b) Approval of construction site location: Not exceeding 05 working days.

c) Basic design: Not exceeding 10 working days for Group A projects; not exceeding 05 working days for Group B and C projects.

d) Technical design or construction drawing design: Not exceeding 15 working days for Group A projects and constructions; not exceeding 10 working days for Group B and C projects and constructions.

Classification of Group A, B, and C projects and constructions mentioned above shall be carried out in accordance with the Government's regulations on project management for construction works.

e) Technical design of motor vehicles with special requirements for fire safety: Not exceeding 10 working days.

6. Projects and constructions not included in the list specified in Appendix IV issued together with this Decree, when newly built, renovated, or changed in usage, must still ensure fire prevention and fighting requirements according to technical standards and regulations on fire prevention and fighting, but are not required to undergo fire prevention and fighting design review.

7. The content of fire prevention and fighting design review for planning design projects must comply with the provisions of Clauses 1, 2, 3, and 4 of Article 12 of this Decree; for construction designs, it must comply with the provisions of Clauses 1, 2, 3, 4, 5, and 6 of Article 13 of this Decree.

The result of fire prevention and fighting design review is one of the bases for considering and approving projects and issuing construction permits.

9. The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security to formulate regulations on the collection and use of fees for fire prevention and fighting design review. The fee for fire prevention and fighting design review shall be included in the total investment amount of projects, constructions, and motor vehicles.

Article 16. Responsibilities of the project investor, owner of motor vehicles, project consulting units, construction supervision units, design consulting units, construction contractors, project approval authorities, construction permit issuance authorities, and firefighting police agencies in investment and construction

1. Responsibilities of the project investor and owner of motor vehicles:

a) Prepare the design project in accordance with the provisions of Clause 1 of Article 15 of this Decree. Submit the fire prevention and fighting design review documents to the firefighting police agency for motor vehicles with special requirements for fire safety, projects, and constructions specified in Appendix IV issued together with this Decree.

b) Organize construction, inspection, and supervision in accordance with the approved fire prevention and fighting design. In case of changes in the design and fire protection equipment during construction, explanations or supplementary designs must be provided and reviewed again.

c) Organize acceptance of fire prevention and fighting for motor vehicles with special requirements for fire safety, projects, and constructions specified in Appendix IV issued together with this Decree.

d) For facilities specified in Appendix III issued together with this Decree and motor vehicles with special requirements for fire safety before operation, the head of the facility and the vehicle owner must notify the firefighting police agency about ensuring fire safety conditions.

e) Ensure fire safety for construction throughout the construction process until acceptance and handover for use.

2. Responsibilities of project consulting units and construction supervision units:

Bear legal responsibility to the investor for implementing fire prevention and fighting contents as committed in the contract signed between the investor and the consulting unit.

3. Responsibilities of design consulting units:

a) Design to meet fire prevention and fighting requirements; bear responsibility for the quality of design products during construction and use.

b) Supervise the author during the construction process.

c) Participate in acceptance of fire prevention and fighting.

4. Responsibilities of construction contractors:

a) Construct in accordance with the approved fire prevention and fighting design.

b) Ensure fire safety within their management scope throughout the construction process until handover.

c) Prepare completion documents; prepare materials and conditions for acceptance work and participate in acceptance of the construction.

5. Responsibilities of project approval authorities and construction permit issuance authorities:

a) Project approval authorities for projects and constructions specified in Appendix IV issued together with this Decree, before approval, must have a certificate of fire prevention and fighting design review, a document approving the construction site location, and a document on fire prevention and fighting solutions from the firefighting police agency.

b) Construction permit issuance authorities, before issuing a permit, must require the investor to present a certificate of fire prevention and fighting design review from the firefighting police agency for projects and constructions specified in Appendix IV issued together with this Decree.

6. Responsibilities of firefighting police agencies:

a) Review and respond to fire prevention and firefighting solutions for planning design dossier, basic design dossier; approve construction site for projects and works as stipulated in Appendix IV issued together with this Decree and special-purpose motor vehicles requiring specific fire safety measures; examine technical design dossier or construction drawing dossier of projects and works and fire safety equipment.

b) Inspect fire prevention and firefighting equipment; check fire safety during construction process.

c) Acceptance inspection on fire prevention and firefighting for projects, works, and special-purpose motor vehicles requiring specific fire safety measures within the authority's jurisdiction.

Article 17. Fire Prevention and Firefighting Acceptance Inspection

1. Projects, works, and special-purpose motor vehicles requiring specific fire safety measures that have been examined for fire prevention and firefighting must be organized for acceptance inspection on fire prevention and firefighting by the project investor or vehicle owner before being put into use.

Fire prevention and firefighting acceptance inspection includes partial, phased, item-by-item inspections, and handover inspections; specifically, parts of works and special-purpose motor vehicles that require specific fire safety measures and are concealed during construction must be inspected before proceeding with subsequent work.

2. Procedures for fire prevention and firefighting acceptance inspection:

a) The subjects specified in Clause 2, Article 15 of this Decree must organize fire prevention and firefighting acceptance inspection by the project investor or vehicle owner, and prior to putting them into use, the project investor or vehicle owner must notify the Fire Prevention and Fighting Police Department that previously examined the design to conduct the acceptance inspection on fire prevention and firefighting.

b) The dossier for fire prevention and firefighting acceptance inspection includes:

- A copy of the certificate of fire prevention and firefighting design examination issued by the Fire Prevention and Fighting Police Department;

- A copy of the certificate of fire prevention and firefighting equipment inspection installed in the works and special-purpose motor vehicles;

- Test records, partial acceptance inspection records, and overall acceptance inspection records of fire prevention and firefighting items and systems;

- As-built drawings of fire prevention and firefighting systems and related items consistent with the approved design dossier;

- Operating and maintenance manuals for fire prevention and firefighting equipment and systems of works and special-purpose motor vehicles;

- Completion acceptance documents for fire prevention and firefighting-related systems and equipment.

All documents and materials mentioned above must be confirmed by the project investor, vehicle owner, contractor, and design consultancy unit. If the dossier is in a foreign language, it must be translated into Vietnamese.

c) The Fire Prevention and Fighting Police Department will inspect the fire prevention and firefighting acceptance dossier prepared by the project investor or vehicle owner according to the following contents:

- Verify the content and legality of the fire prevention and firefighting acceptance dossier prepared by the project investor or vehicle owner;

- Inspect the installation and construction of fire prevention and firefighting equipment and systems of works and special-purpose motor vehicles according to the approved design;

- Organize practical testing of fire prevention and firefighting equipment and systems of works and special-purpose motor vehicles when deemed necessary.

d) Within seven working days from the date of signing the inspection acceptance record, the Fire Prevention and Fighting Police Department shall be responsible for reviewing and issuing the fire prevention and firefighting acceptance document if all requirements are met.

e) The fire prevention and firefighting acceptance document issued by the Fire Prevention and Fighting Police Department serves as one of the bases for the project investor to accept, settle accounts, and put works and special-purpose motor vehicles requiring specific fire safety measures into use.

Article 18. Fire Prevention and Fighting Safety Inspection

1. The contents of fire prevention and fighting safety inspection include:

a) Fire prevention and fighting safety conditions of facilities, residential areas, households, forests, and motor vehicles in accordance with the Law on Fire Prevention and Fighting, this Decree, and relevant legal provisions.

b) Implementation of fire prevention and fighting responsibilities of each subject as prescribed by the Law on Fire Prevention and Fighting, this Decree, and relevant legal provisions.

c) Compliance with the provisions of the Law on Fire Prevention and Fighting, this Decree, technical standards and regulations, relevant legal provisions, and fire prevention and fighting requirements set forth by the Fire Prevention and Fighting Police Department.

2. Fire prevention and fighting safety inspections shall be conducted regularly, periodically, and unexpectedly as follows:

a) The heads of facilities, Chairpersons of People's Committees at the commune level, owners of motor vehicles, forest owners, and household heads have the responsibility to organize regular, periodic, and unexpected inspections for fire prevention and fighting safety within their management scope.

b) The heads of agencies and organizations, and Chairpersons of People's Committees at the district level or higher have the responsibility to organize periodic and unexpected inspections for fire prevention and fighting safety within their management scope.

c) The Fire Prevention and Fighting Police have the responsibility to conduct quarterly periodic inspections for fire prevention and fighting safety for facilities with fire and explosion hazards and motor vehicles with special fire prevention and fighting safety requirements; every six months or annually for other objects, and conduct unexpected inspections when there are signs of fire and explosion risks, loss of fire prevention and fighting safety, or violations of fire prevention and fighting safety regulations, and when there are special protection requirements.

3. The Ministry of Public Security shall specify detailed procedures for fire prevention and fighting safety inspections.

Article 19. Suspension and Termination of Operations of Facilities, Motor Vehicles, Households, and Individuals Not Ensuring Fire Prevention and Fighting Safety

1. Cases of temporary suspension of operations:

a) In environments with fire and explosion hazards where sources of fire or heat appear, or when sources of fire or heat appear in environments with fire and explosion hazards (hereinafter referred to as direct risk of fire and explosion occurrence).

b) Violations of fire prevention and fighting regulations that, if not promptly prevented, may lead to a direct risk of fire and explosion occurrence and may cause particularly serious consequences.

c) Violations of fire prevention and fighting regulations that have been required to be rectified by the Fire Prevention and Fighting Police but were not rectified, or individuals who have been administratively sanctioned for fire prevention and fighting violations but continue to violate such regulations.

2. Temporary suspension of operations shall be limited to the smallest possible scope and according to the principle that if a direct risk of fire and explosion occurrence appears in a certain area or if violations of fire prevention and fighting regulations occur in a certain area, then operations shall be temporarily suspended in that area.

3. The duration of temporary suspension of operations shall be determined based on the conditions and ability to eliminate the direct risk of fire and explosion occurrence and to rectify fire prevention and fighting violations, but shall not exceed thirty days.

4. If facilities, motor vehicles, households, and individual activities suspended temporarily under Clause 1 of this Article have not been rectified or cannot be rectified after the expiration of the temporary suspension period and pose a serious risk of fire and explosion causing serious consequences, their operations shall be terminated. The termination of operations may be implemented for individual parts or the entire facility, motor vehicle, household, and individual activity.

5. Decisions on temporary suspension and termination of operations shall be made in writing; in urgent cases, decisions on temporary suspension may be made orally and must be recorded in writing immediately thereafter.

The heads of facilities, agencies, organizations, household owners, drivers or owners of motor vehicles, and individuals upon receiving a decision on temporary suspension must comply immediately and have the responsibility to eliminate the direct risk of fire and explosion occurrence or rectify violations of fire prevention and fighting regulations within the shortest time possible.

6. The authority to suspend and terminate operations is defined as follows:

a) The Minister of Public Security or the person authorized by him has the right to decide on the temporary suspension and termination of operations of parts or all of facilities, motor vehicles, households, and individual activities nationwide.

b) Chairpersons of People's Committees at various levels have the right to decide on the temporary suspension and termination of operations of parts or all of facilities, motor vehicles, households, and individual activities within their management responsibility.

c) Directors of the Fire Prevention, Firefighting, Rescue, and Relief Bureau, and Heads of local Fire Prevention and Fighting Police Departments within their jurisdiction have the right to decide on the temporary suspension and termination of operations of parts or all of facilities, motor vehicles, households, and individual activities.

d) Fire Prevention and Fighting Police officers have the right to temporarily suspend operations in cases specified in Point a of Clause 1 of this Article and must report to the directly responsible manager with the authority to decide on temporary suspension as soon as possible after the temporary suspension.

7. The Ministry of Public Security shall specify detailed models of decisions and procedures for temporary suspension and termination of operations.

Article 20. Restoration of Operations of Premises, Motor Vehicles, Households, and Individuals

1. Within the period of temporary suspension of operations, if the direct risk of fire or explosion has been eliminated or violations of fire prevention and firefighting regulations have been rectified, a written application must be submitted to the authority that issued the decision on temporary suspension for review and decision on restoration of operations.

2. Premises, motor vehicles, households, and individuals whose operations have been suspended, if they subsequently meet all safety conditions regarding fire prevention and firefighting and wish to resume operations, must submit a written application to the authority that issued the suspension decision for review and decision on restoration of operations.

3. The decision to restore operations shall be made in writing; however, in cases where the authority verbally decided on temporary suspension and the direct risk of fire or explosion or violations of fire prevention and firefighting regulations have been eliminated or rectified, the decision to restore operations may be made verbally.

4. The authority that decides on temporary suspension or cessation of operations has the right to decide on restoration of operations.

5. The Ministry of Public Security shall specify the format of the decision and procedures for restoration of operations.

Chapter III

FIRE FIGHTING

Article 21. Firefighting Plan

1. The firefighting plan must satisfy the following basic requirements and contents:

a) It must describe the nature, characteristics, and dangers of fire, explosion, toxicity, and related conditions affecting firefighting activities.

b) It must propose the most complex fire scenario and other specific fire scenarios that could occur, along with the potential development of fires at different levels.

c) It must outline plans for mobilizing and utilizing resources, organizing command, technical measures, tactical firefighting methods, and support tasks suitable for each stage of each fire scenario.

2. Responsibilities for developing firefighting plans:

a) The Chairman of the People's Committee of the commune, the head of the premises, the village chief, the forest owner, and the owner of special-purpose motor vehicles responsible for ensuring fire prevention and firefighting safety must organize the development of a firefighting plan using local forces and equipment within their management scope (hereinafter referred to as the premises' firefighting plan). The head of the nuclear facility must develop a firefighting and rescue plan for fire and explosion scenarios causing nuclear accidents as stipulated in Points a, b, and c, Clause 2, Article 82 of the Atomic Energy Law.

The Chairman of the People's Committee of the commune, the head of the premises, and the residential area under the list specified in Point b, Clause 2 of this Article must cooperate with the Fire Prevention and Fighting Police Department to develop a firefighting plan for the residential area and premises under their management according to the guidelines of the Ministry of Public Security.

b) The Fire Prevention and Fighting Police Department is responsible for developing a firefighting plan for premises and residential areas requiring mobilization of its own forces and equipment, as well as those from multiple agencies, organizations, and localities (hereinafter referred to as the Fire Prevention and Fighting Police Department's firefighting plan).

The Ministry of Public Security shall specify the list of premises and residential areas for which the Fire Prevention and Fighting Police Department is responsible for developing firefighting plans.

c) The Chairman of the Provincial People's Committee in border areas between two provinces or centrally-administered cities is responsible for coordinating and directing the development and approval of firefighting plans to mobilize and organize forces and equipment to participate in firefighting when large fires or fires with severe risks of casualties and property damage occur in border areas between two provinces or centrally-administered cities.

d) The Chairman of the Provincial People's Committee where there is a nuclear facility is responsible for organizing the development of a firefighting and rescue plan for fire and explosion scenarios causing nuclear accidents as stipulated in Point d, Clause 2, Article 82 of the Atomic Energy Law; and is responsible for developing a coordination plan and organizing forces to participate in firefighting for premises and forests in communes in border areas between two provinces or centrally-administered cities.

đ) The Ministry of Public Security, in collaboration with the Ministry of Science and Technology, the Ministry of Industry and Trade, the Ministry of Health, the Ministry of National Defense, the Provincial People's Committee where there is a nuclear facility, and relevant agencies and organizations, is responsible for developing a firefighting and rescue plan for fire and explosion scenarios causing nuclear accidents as stipulated in Point đ, Clause 2, Article 82 of the Atomic Energy Law.

e) The firefighting plan must be promptly supplemented and revised when there are changes in the nature, characteristics, and dangers of fire, explosion, toxicity, and related conditions affecting firefighting activities.

3. Firefighting plans developed in accordance with Points a and c, Clause 2 of this Article shall be managed at the premises and copies sent to the Fire Prevention and Fighting Police Department managing the area; firefighting plans developed in accordance with Points b and d, Clause 2 of this Article shall be managed at the Fire Prevention and Fighting Police Department and copies sent to the premises and the People's Committee of the commune where the firefighting plan was developed. Agencies and organizations participating in the firefighting plan shall be informed of the contents related to their responsibilities.

4. System and responsibility for organizing drills of firefighting plans:

a) Firefighting plans developed in accordance with Point a, Clause 2 of this Article shall be organized for drills at least once a year and ad hoc drills when required.

b) Firefighting plans developed in accordance with Points b, c, and d, Clause 2 of this Article shall be organized for drills when required.

c) The head of the agency or organization, and the Chairman of the People's Committee of the commune shall be responsible for organizing drills of firefighting plans. For firefighting plans developed in accordance with Points b, c, and d, Clause 2 of this Article, before organizing drills, there must be a unified discussion with the Fire Prevention and Fighting Police Department to mobilize forces and equipment to participate.

d) Forces and equipment included in the firefighting plan, when mobilized for drills, must fully participate.

5. The Fire Prevention and Fighting Police Department shall be responsible for guiding, inspecting the development, drills, management, and use of firefighting plans.

6. The Ministry of Public Security shall prescribe the model fire extinguishing plan for facilities and the model plan for Fire Prevention and Fighting Police; specify the approval authority, the practice period of the fire extinguishing plan; specify the specific responsibilities of agencies, organizations, households, and individuals related to when the Fire Prevention and Fighting Police organizes the development of a fire extinguishing plan; prescribe the practice system of the Fire Prevention and Fighting Police's fire extinguishing plan.

Article 22. Responsibilities for Reporting Fires, Extinguishing Fires, and Participating in Firefighting

1. A person who discovers a fire must immediately report it to surrounding people by all means, to one or all of the following units:

a) The civilian defense team or the fire prevention and firefighting team at the location where the fire occurs.

b) The nearest Fire Prevention and Fighting Police unit.

c) The local government authority or the nearest public security agency.

2. Agencies and units specified in Clause 1 of this Article, upon receiving information about a fire occurring within their assigned management area, must quickly organize firefighting activities, while reporting to other necessary agencies and units to provide support for firefighting; in cases where the fire occurs outside their assigned management area, they must promptly report the fire information to the management agencies of the area where the fire occurred for handling, and simultaneously report to their superiors.

3. People present at the fire location and in good health must take every measure to rescue people, prevent the spread of fire, and extinguish the fire; those participating in firefighting must comply with the orders of the firefighting commander.

4. The police force, military, self-defense forces, healthcare agencies, power supply, water supply, urban environment, transportation, and other relevant agencies have the duty to participate in firefighting according to the provisions of Clauses 2, 3, and 4 of Article 33 of the Law on Fire Prevention and Fighting.

Article 23. Mobilizing Priority Vehicles, Personnel, and Equipment of the Military, International Organizations, Organizations, and Foreign Individuals in Vietnam to Participate in Firefighting

1. Personnel and equipment of the military that are not engaged in urgent tasks may be mobilized for firefighting and firefighting support. When the unit commander receives an order to mobilize personnel and equipment for firefighting and firefighting support, he/she must immediately comply or report to the competent authority to organize implementation.

The Ministry of Public Security shall lead and coordinate with the Ministry of National Defense to provide detailed guidance on mobilizing personnel and equipment of the military for firefighting and firefighting support.

2. The following types of vehicles shall not be mobilized for firefighting and firefighting support:

a) Military vehicles, public security vehicles performing urgent tasks.

b) Ambulances performing emergency medical services.

c) Flood control vehicles, vehicles currently performing disaster relief or emergency response tasks as prescribed by law.

d) Convoy with traffic police escort.

đ) Funeral convoy.

e) Other priority vehicles as prescribed by law.

3. Personnel and equipment of international organizations, organizations, and foreign individuals in Vietnam may be mobilized for firefighting and firefighting support except for international organizations, organizations, and foreign individuals enjoying privileges and immunities under the law.

The Ministry of Foreign Affairs shall notify the Ministry of Public Security of international organizations; organizations, and foreign individuals in Vietnam enjoying privileges and immunities.

Article 24. Authority to Mobilize Forces, Means, and Assets for Firefighting

1. The authority to mobilize forces, means, and assets for firefighting shall be as follows:

a) The fire fighting commander who is a member of the Fire Prevention and Fighting Police, the head of an agency or organization, and the Chairman of the People's Committee at the commune level or higher have the right to mobilize forces, means, and assets of agencies, organizations, households, and individuals within their management scope; in cases where it is necessary to mobilize forces, means, and assets outside their management scope, they must report to the person with the authority to mobilize for a decision.

b) The head of the local Fire Prevention and Fighting Police agency has the right to mobilize forces, means, and assets of agencies, organizations, households, and individuals within the management area. After mobilization, they must notify the person responsible for managing those forces, means, and assets.

c) The Director of the Fire Prevention, Firefighting, and Rescue Service Bureau has the right to mobilize forces, means, and assets of agencies, organizations, households, and individuals throughout the country. After mobilization, they must notify the person responsible for managing those forces, means, and assets.

2. The Ministry of Public Security shall specify the form, management regime, and usage of the mobilization order for forces, means, and assets for firefighting, and the procedures for mobilization.

Article 25. Return and Compensation for Damages to Means and Assets Mobilized for Firefighting

Means and assets of agencies, organizations, households, and individuals mobilized for firefighting and firefighting support must be returned immediately after the firefighting is completed. In cases where the mobilized means and assets are lost or damaged, or buildings and structures are demolished according to Points c and d Clause 1 Article 38 of the Law on Fire Prevention and Fighting, compensation shall be provided in accordance with the provisions of the law.

The compensation budget shall be allocated from the state budget.

Article 26. Priority and Assurance of Priority Rights for Persons and Means Mobilized for Firefighting and Participating in Firefighting

1. Vehicles, ships, aircraft, and other traffic means of the Fire Prevention and Fighting Police force when going to firefighting and firefighting support may use priority signals, priority traffic rights, and other priority rights as prescribed by law.

Motorized traffic means of agencies, organizations, and individuals mobilized for firefighting tasks enjoy the priority rights stipulated in Point b Clause 2 Article 36 of the Law on Fire Prevention and Fighting and are given priority passage over bridges and ferries and exempted from traffic fees on roads.

2. When presenting the mobilization order, persons mobilized for firefighting tasks shall be immediately allowed to proceed by the owner of the means of transport or the driver or relevant persons responsible.

Article 27. Flags, Signs, and Strips Used in Firefighting

Flags, signs, and strips used in firefighting include:

1. Firefighting flags, firefighting command flags.

2. Command strips for firefighting.

3. Warning signs and strip barriers delineating the firefighting area.

4. No-go signs for the firefighting area.

Specifications for flags, signs, and strips used in firefighting are specified in Appendix VI promulgated together with this Decree.

Article 28. Firefighting Commander

1. For firefighting forces of the Fire Prevention and Fighting Police, the firefighting commander must be the highest-ranking officer of the Fire Prevention and Fighting Police unit present at the fire site.

2. In cases where the Fire Prevention and Fighting Police have not yet arrived at the fire site, and the fire spreads from one facility to another or from a facility to a residential area and vice versa, the firefighting commanders of the affected facilities and residential areas shall have the responsibility to coordinate in directing firefighting operations.

3. In cases where a motor vehicle catches fire within the premises of a facility, village, or forest, and the Fire Prevention and Fighting Police have not yet arrived, the firefighting commander of the motor vehicle must cooperate with the local firefighting commander responsible for directing firefighting operations.

4. When the highest-ranking officer of the Fire Prevention and Fighting Police unit arrives at the fire site, the firefighting commander specified in Clause 2, Article 37 of the Law on Fire Prevention and Fighting shall participate in the firefighting command post and comply with the assignments of the firefighting commander of the Fire Prevention and Fighting Police force.

Article 29. Tasks of Commanding and Directing Firefighting

1. Tasks of commanding firefighting:

a) Mobilizing firefighting forces, equipment, assets, water sources, and firefighting materials.

b) Determining the firefighting area, formulating and organizing the implementation of technical and tactical firefighting measures.

c) Proposing requirements for traffic control and public order.

d) Organizing logistics support, firefighting services, and medical care.

đ) Organizing communication services for firefighting.

e) Organizing political and ideological work during firefighting.

g) Providing information about the fire incident.

h) Proposing other requirements to serve firefighting.

2. The task of directing firefighting is to organize the mobilization of firefighting forces, equipment, devices, tools, materials, water sources, and firefighting materials; ensuring conditions for firefighting such as traffic control, public order, communication services, logistics support, medical care, and political and ideological work during firefighting.

3. When the Fire Prevention and Fighting Police have not yet arrived at the fire scene, the head of the agency or organization, or the Chairman of the People's Committee at the commune level or higher shall be responsible for performing the tasks stipulated in Clause 1 and Clause 2 of this Article. When the Fire Prevention and Fighting Police arrive at the fire scene, the firefighting commander of the Fire Prevention and Fighting Police unit shall be responsible for performing the tasks stipulated in Clause 1 of this Article; the head of the agency or organization, or the Chairman of the People's Committee at the commune level or higher shall be responsible for participating in firefighting command and performing the tasks of directing firefighting stipulated in Clause 2 of this Article.

Article 30. Emergency Situations Justifying the Exercise of Authority to Demolish Buildings, Structures, Obstacles, and Move Assets During Firefighting

The firefighting commander of the Fire Prevention and Fighting Police force may exercise the authority to demolish buildings, structures, obstacles, and move assets as provided in Point d, Clause 1, Article 38 of the Law on Fire Prevention and Fighting in the following emergency situations:

1. There are people trapped in the fire or the fire directly threatens the lives of many people.

2. The fire poses a direct risk of explosion, toxicity; adverse impact on the environment; serious consequences for people and property; potential negative political impact if timely preventive measures are not taken.

3. Buildings, structures, or obstacles hinder firefighting efforts and there is no other way to achieve more effective firefighting.

Article 31. Firefighting at diplomatic mission premises, consular offices, international organization representative offices, and residences of their members

1. The fire prevention and firefighting forces of Vietnam are permitted to enter the premises of the following agencies for firefighting upon request or with the consent of the head or authorized representative of those agencies:

a) Premises of diplomatic missions.

b) Premises of consular offices of countries that have concluded consular agreements with Vietnam which stipulate that the fire prevention and firefighting forces of Vietnam may enter for firefighting upon request or with the consent of the head or authorized representative of those consular offices.

c) Premises of international organization representative offices belonging to the United Nations system.

d) Premises of international organization representative offices outside the United Nations system, and international organization delegations, if the treaties concluded between Vietnam and these organizations provide that the fire prevention and firefighting forces of Vietnam may enter for firefighting upon request or with the consent of the head or authorized representative of those representative offices.

2. The fire prevention and firefighting forces of Vietnam may enter the premises of consular offices and international organization representative offices not specified in Clause 1 of this Article for firefighting without requiring a request or consent from the head or authorized representative of the office.

3. The fire prevention and firefighting forces of Vietnam are permitted to enter the residences of the following individuals for firefighting upon request or with their consent:

a) Residences of foreign diplomatic officials, family members of foreign diplomatic officials who are not Vietnamese citizens; administrative, technical staff and their family members who are not Vietnamese citizens or are not permanent residents in Vietnam.

b) Residences of foreign consular officials who are not Vietnamese citizens or are not permanent residents in Vietnam; if the consular agreement between Vietnam and the sending country provides that the fire prevention and firefighting forces of Vietnam may enter for firefighting upon request or with the consent of those individuals.

4. The fire prevention and firefighting forces of Vietnam may enter the residences of members of consular offices and international organization representative offices not covered by Clause 3 of this Article for firefighting without requiring a request or consent from those members.

5. The Ministry of Foreign Affairs shall notify the Ministry of Public Security about the entities specified in Points b, c, and d of Clause 1 and Point b of Clause 3 of this Article.

Chapter IV

ORGANIZATION OF FIRE PREVENTION AND FIGHTING FORCES

Article 32. Organization and management of civilian defense teams and fire prevention and firefighting teams at grassroots and specialized levels

1. The village head has the responsibility to propose the establishment and directly maintain the operation of the civilian defense team in the village. For villages with a wide area, the civilian defense team may consist of multiple civilian defense groups. The Chairman of the People's Committee at the commune level has the responsibility to decide on the establishment, issue regulations on operations, ensure funding, equip equipment, and ensure conditions for maintaining the operation of the civilian defense team.

2. The head of the entity has the responsibility to establish or propose the establishment of a fire prevention and firefighting team at the entity level and directly maintain its operation under either a full-time or part-time system. The head of the entity specified in Clause 3 of Article 44 of the Law on Fire Prevention and Fighting has the responsibility to establish or propose the establishment and maintain a specialized fire prevention and firefighting team operating under a full-time system. The investor of infrastructure in industrial zones, export processing zones, and high-tech parks has the responsibility to establish and directly maintain the operation of a fire prevention and firefighting team at the entity level operating under a full-time system.

The head of the agency or organization directly managing the entity has the responsibility to decide on the establishment, issue regulations on operations, ensure funding, equip equipment, and ensure conditions for maintaining the operation of the fire prevention and firefighting team at the entity level and the specialized fire prevention and firefighting team.

3. The Fire Prevention and Fighting Police Department has the responsibility to direct and inspect professional activities related to fire prevention and firefighting for civilian defense teams, fire prevention and firefighting teams at the grassroots and specialized levels.

4. Organization and staffing of civilian defense teams, fire prevention and firefighting teams at the grassroots and specialized levels:

a) A civilian defense team is staffed with 10 to 30 people, including a team leader and 1 to 2 deputy team leaders.

b) A fire prevention and firefighting team at the grassroots level is staffed with 10 to 25 people, including a team leader and 2 to 3 deputy team leaders.

c) The organization and staffing of specialized fire prevention and firefighting teams are carried out in accordance with the provisions of the Ministry of Public Security.

Article 33. Voluntary Fire Prevention and Fighting

1. Individuals voluntarily participating in fire prevention and fighting activities must register with the People's Committee of the commune where they reside or the agency or organization where they work, which has the responsibility to accept, compile a list, and send it to the local Fire Prevention and Fighting Police Department for management.

Organizations voluntarily participating in fire prevention and fighting activities must register with the local Fire Prevention and Fighting Police Department.

2. Organizations and individuals who have registered to voluntarily participate in fire prevention and fighting activities must perform tasks and be under the direction of the Head and Deputy Head of the Civil Defense Team, the Fire Prevention and Fighting Team at the grassroots level and specialized units, or other authorized persons as prescribed.

Article 34. Training and Capacity Building for Fire Prevention and Fighting for Civil Defense Officers and Members, Grassroots Fire Prevention and Fighting Teams, and Specialized Units

1. Civil Defense Officers and Members, Fire Prevention and Fighting Team Members at the grassroots level and specialized units shall be trained and provided capacity building on fire prevention and fighting according to the following contents:

a) Legal knowledge and fire prevention and fighting knowledge suitable for each category.

b) Methods of propaganda and construction of mass movements for fire prevention and fighting.

c) Preventive measures against fires.

d) Methods of developing and practicing firefighting plans; measures, tactics, and techniques for firefighting.

e) Methods of preserving and using firefighting equipment.

f) Methods of inspecting safety in fire prevention and fighting.

2. The Head of the specialized Fire Prevention and Fighting Team must have a minimum qualification of a junior college degree in fire prevention and fighting and be trained in specialized knowledge appropriate to their field of activity.

3. The Ministry of Public Security shall provide detailed guidance on the program and content, time for training and capacity building in fire prevention and fighting; specify the issuance and format of certificates of training in fire prevention and fighting skills, and organize capacity building according to the content and program for the subjects specified in Clause 1 of this Article.

Article 35. Benefits and Policies for Participants in Firefighting and for Civil Defense Officers and Members, Grassroots Fire Prevention and Fighting Teams, and Specialized Units

1. Individuals directly mobilized and called upon to participate in firefighting and support services according to the summons or mobilization order of an authorized person shall enjoy the following benefits:

a) If the firefighting time is less than two hours, they will be compensated with an amount equal to half a day's basic salary.

b) If the firefighting time is from two to less than four hours, they will be compensated with an amount equal to three-quarters of a day's basic salary.

c) If the firefighting time is four hours or more, or if firefighting continues over multiple days, they will be compensated with an amount equal to one day's basic salary for every four hours. If firefighting occurs during nighttime from 10 PM to 6 AM, the compensation will be doubled based on the above calculation method.

d) In cases of accidents resulting in injury, medical examination and treatment costs will be reimbursed; if the injury results in a reduction in working capacity as determined by the Medical Appraisal Board, they will be considered for disability benefits according to the degree of reduced working capacity; if death occurs, they will receive survivor's pension and funeral expenses. These benefit expenditures will be covered by social insurance and health insurance organizations according to regulations; if the individual has not participated in social insurance and social security, the local budget or managing agency will ensure coverage.

e) In cases of injury falling within the provisions of the Ordinance on Preferential Treatment for Persons with Meritorious Service to the Revolution, they will be considered for disability benefits or equivalent to those of disabled veterans.

f) In cases of death falling within the provisions of the Ordinance on Preferential Treatment for Persons with Meritorious Service to the Revolution, they will be recognized as martyrs.

2. Based on specific conditions of each locality, the Chairman of the Provincial People's Committee or the People's Committee of a centrally governed city shall submit to the People's Council at the same level for decision on the regular support levels for the positions of Head and Deputy Head of the Civil Defense Team, but not lower than twenty-five percent of the basic salary.

3. The Head and Deputy Head of the non-specialized Grassroots Fire Prevention and Fighting Team, in addition to receiving their full salary and other allowances (if applicable), also receive regular support paid by the managing agency or organization. Based on actual conditions, the head of the agency or organization decides the support level for each position, but not lower than a coefficient of thirty percent of the basic salary.

4. When Civil Defense Officers and Members participate in training and capacity building in fire prevention and fighting, they will receive a daily allowance equal to one and a half days' basic salary; Fire Prevention and Fighting Team Members at the grassroots level and specialized units during their participation in such training and capacity building will be granted leave with full pay and other allowances (if applicable) and will receive a daily allowance equal to half a day's basic salary.

5. For the subjects specified in Clause 4 of this Article, if they suffer an accident, health damage, or death while participating in training and capacity building in fire prevention and fighting, they will receive social insurance benefits; if they have not participated in mandatory social insurance, the local budget or managing agency will ensure coverage.

6. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Public Security, the Ministry of Finance, and related agencies to provide detailed guidance on Points d, đ, and e of Clause 1 and Clauses 4 and 5 of this Article.

Article 36. Mobilization of Civil Defense Forces, Fire Prevention and Fighting Forces to Participate in Fire Prevention and Fighting Activities

Clause 1. The authority to mobilize Civil Defense Forces, Fire Prevention and Fighting Forces at the grassroots level and specialized units to participate in fire prevention and fighting activities shall be regulated as follows:

Point a) The Chairpersons of People's Committees at all levels and heads of agencies and organizations may mobilize Civil Defense Teams, Fire Prevention and Fighting Teams at the grassroots level and specialized units under their management.

Point b) Heads of local Fire Prevention and Fighting Police Departments may mobilize Civil Defense Forces, Fire Prevention and Fighting Forces at the grassroots level and specialized units within their administrative areas.

Point c) The Director of the Fire Prevention, Firefighting, and Rescue Service may mobilize Civil Defense Forces, Fire Prevention and Fighting Forces at the grassroots level and specialized units nationwide.

Clause 2. When receiving a mobilization decision for fire prevention and fighting activities, those authorized to manage Civil Defense Forces, Fire Prevention and Fighting Forces at the grassroots level and specialized units must comply with it.

Clause 3. The Ministry of Public Security shall specify the format, management and usage regulations for mobilization decisions for Civil Defense Forces, Fire Prevention and Fighting Forces at the grassroots level and specialized units to participate in fire prevention and fighting activities, and the procedures for mobilization.

Article 37. Treatment and Policies for Officers, Non-commissioned Officers, and Soldiers Belonging to the Fire Prevention and Fighting Police Force

Officers, non-commissioned officers, and soldiers belonging to the Fire Prevention and Fighting Police Force, in addition to enjoying treatment and policies stipulated for officers, non-commissioned officers, and soldiers of the People's Public Security, also enjoy higher meal allowances, training subsidies, firefighting subsidies, and benefits according to the list of particularly arduous, dangerous, and toxic occupations as prescribed by the State. Workers and staff members of the Fire Prevention and Fighting Police Force shall enjoy treatment and policies equivalent to those for workers and staff members of the Public Security.

Chapter V

FIRE PREVENTION AND FIRE FIGHTING EQUIPMENT

Article 38. Fire Prevention and Firefighting Equipment

Clause 1. Fire Prevention and Firefighting Equipment includes motorized equipment, devices, machinery, tools, chemicals, and special-purpose support tools for fire prevention, firefighting, rescue operations, and asset protection as specified in Appendix V attached to this Decree.

Clause 2. Motorized firefighting equipment of the Fire Prevention and Fighting Police Force includes firefighting vehicles, firefighting boats, and firefighting aircraft.

Clause 3. Firefighting vehicles of the Fire Prevention and Fighting Police Force include firefighting water spray vehicles, firefighting personnel and equipment transport vehicles, water transport vehicles, firefighting ladder vehicles, and other motorized transportation vehicles used for firefighting purposes and firefighting support.

Clause 4. Fire Prevention and Firefighting Equipment produced domestically or imported must meet the following requirements:

Point a) Ensuring technical parameters according to design specifications for fire prevention and firefighting.

Point b) Complying with Vietnamese technical standards and regulations or foreign and international standards permitted for application in Vietnam.

Clause 5. New Fire Prevention and Firefighting Equipment produced domestically or imported must be inspected for quality, type, and model according to the regulations of the Ministry of Public Security.

Clause 6. Assembled or modified Fire Prevention and Firefighting Equipment domestically must have permission from authorized Fire Prevention and Fighting Police Departments and must be inspected for quality, type, and model according to the regulations of the Ministry of Public Security.

Article 39. Equipment for Fire Prevention and Fighting Police Force

The Fire Prevention and Fighting Police Force shall be equipped with fire prevention and fighting equipment and other means and devices in sufficient quantity and quality, in a coordinated and modern manner, to meet the requirements of fire prevention, firefighting, and rescue in all situations and fields, in accordance with the state budget capacity.

The Ministry of Public Security shall stipulate the standards and criteria for equipping fire prevention and fighting equipment for the Fire Prevention and Fighting Police Force.

Article 40. Management and Use of Fire Prevention and Fighting Equipment

1. Fire prevention and fighting equipment must be managed, maintained, and repaired in accordance with regulations and ensure readiness for firefighting. Mechanical firefighting equipment may also be used for the following purposes:

a) Participating in security and political assurance work.

b) Participating in social order and safety assurance work.

c) Rescuing victims; handling urgent accidents.

d) Preventing natural disasters and mitigating their consequences.

2. The Minister of Public Security or the person authorized by him/her, and the Chairman of the People's Committee at the provincial level within their respective management scope have the authority to mobilize mechanical firefighting equipment for the purposes specified in Clause 1 of this Article.

3. The Director of the Fire Prevention and Fighting and Rescue Service Bureau, the Director of the Provincial Fire Prevention and Fighting Service, and the Head of the Fire Prevention and Fighting and Rescue Service Department under the Provincial Public Security Department within their respective management scope have the authority to mobilize mechanical firefighting equipment for the purposes specified in Points b, c, and d of Clause 1 of this Article.

4. The head of an agency or organization within their respective management scope has the authority to mobilize mechanical firefighting equipment for the purposes specified in Points c and d of Clause 1 of this Article.

5. The Ministry of Public Security shall stipulate the management, storage, maintenance, and usage system for fire prevention and fighting equipment and guide relevant ministries, sectors, and localities in implementation.

Chapter VI

BUSINESS OF FIRE PREVENTION AND FIREFIGHTING SERVICES

Article 41. Conditions for Enterprises and Business Establishments Providing Consulting Services on Design, Review, Supervision, Inspection, and Technical Appraisal for Fire Prevention and Firefighting

1. The head of the enterprise and the legal representative of the establishment must hold a certificate or diploma in fire prevention and firefighting knowledge training.

2. The enterprise or establishment must have individuals qualified to provide fire prevention and firefighting services, specifically:

a) At least one individual holding a certificate for consulting on design, review, supervision, inspection, and technical appraisal for fire prevention and firefighting as stipulated in Point b and c of Clause 3 of Article 47 of this Decree.

b) At least one individual responsible for leading the design, review, supervision, inspection, and technical appraisal for fire prevention and firefighting as stipulated in Clause 4 of Article 47 of this Decree.

3. Have a place of operation; means and equipment ensuring the provision of consulting services on design, review, supervision, inspection, and technical appraisal for fire prevention and firefighting.

Article 42. Conditions for Enterprises and Business Establishments Engaged in Consulting Services on Technology Transfer for Fire Prevention and Firefighting; Training and Guidance on Fire Prevention and Firefighting Operations

1. The head of the enterprise and the legal representative of the establishment must hold a certificate or diploma in fire prevention and firefighting knowledge training.

2. At least one person with a bachelor’s degree in fire prevention and firefighting or a related field, who has completed at least six months of fire prevention and firefighting knowledge training.

3. Have a place of operation; means and equipment ensuring the provision of consulting services on technology transfer; means and equipment for training and guidance on fire prevention and firefighting operations, and a location for organizing such training and guidance.

Article 43. Conditions for enterprises and construction sites installing fire prevention and firefighting systems

1. The head of the enterprise and the legal representative of the establishment must hold a certificate or diploma in fire prevention and firefighting knowledge training.

2. Have at least one construction site commander for fire prevention and firefighting.

3. Have a place of operation and material facilities, means, equipment, machinery ensuring the installation and setup of fire prevention and firefighting systems.

Article 44. Conditions for enterprises and production sites manufacturing fire prevention and firefighting equipment and devices

1. The head of the enterprise and the legal representative of the establishment must hold a certificate or diploma in fire prevention and firefighting knowledge training.

2. At least one person with a bachelor’s degree in fire prevention and firefighting or a related field, who has completed at least six months of fire prevention and firefighting knowledge training.

3. Have a place of operation; have workshops, means, equipment ensuring production and assembly of fire prevention and firefighting equipment and devices.

Article 45. Conditions for enterprises and business establishments dealing in fire prevention and firefighting equipment, materials

1. The head of the enterprise and the legal representative of the establishment must hold a certificate or diploma in fire prevention and firefighting knowledge training.

2. Have at least two persons with certificates for fire prevention and firefighting knowledge training suitable for their business activities.

3. Have a place of operation and material facilities, means, equipment ensuring the business activities of fire prevention and firefighting equipment, materials.

Article 46. Conditions for individuals practicing fire prevention and firefighting services

Individuals are permitted to practice fire prevention and firefighting services when meeting the following conditions:

1. Hold a vocational certificate on fire prevention and firefighting suitable for their business activities.

2. Operate for an enterprise or business establishment providing fire prevention and firefighting services.

Article 47. Certificates on fire prevention and firefighting and conditions for assuming the position of leading designer, reviewer, inspector, technical tester on fire prevention and firefighting

1. Certificates on fire prevention and firefighting include:

a) Bachelor's degree in fire prevention and firefighting.

b) Associate's degree in fire prevention and firefighting.

c) Diploma in fire prevention and firefighting.

2. Certificates on fire prevention and firefighting include:

a) Certificate for fire prevention and firefighting knowledge training.

b) Certificate for consulting design on fire prevention and firefighting.

c) Certificate for consulting review on fire prevention and firefighting.

d) Certificate for consulting supervision on fire prevention and firefighting.

đ) Certificate for consulting inspection and technical testing on fire prevention and firefighting.

e) Certificate for training construction site commanders on fire prevention and firefighting.

3. Conditions for issuing certificates on fire prevention and firefighting:

a) Individuals to be issued a certificate for fire prevention and firefighting knowledge training must complete a fire prevention and firefighting knowledge training course of at least six months.

b) Individuals to be issued a certificate for consulting design, consulting review, consulting inspection, and technical testing on fire prevention and firefighting must meet the following requirements:

- Hold a bachelor's degree in fire prevention and firefighting or a relevant bachelor's degree and have been issued a certificate for fire prevention and firefighting knowledge training;

- Have at least five years of experience in consulting design, consulting review, or consulting inspection and technical testing on fire prevention and firefighting and have participated in designing at least five projects.

c) Individuals to be issued a certificate for consulting supervision on fire prevention and firefighting must meet the following requirements:

- Hold a diploma in fire prevention and firefighting or higher or a relevant specialized degree and have been issued a certificate for fire prevention and firefighting knowledge training;

- Have at least three years of experience in design, construction, or supervising construction and installation of fire prevention and firefighting systems, having completed a construction supervision skills training course.

d) Individuals to be issued a certificate for training construction site commanders on fire prevention and firefighting must meet the following requirements:

- Hold a diploma in fire prevention and firefighting or higher or a relevant specialized degree and have been issued a certificate for fire prevention and firefighting knowledge training;

- Have at least five years of experience in constructing and installing fire prevention and firefighting systems.

4. Individuals assuming the position of leading designer, reviewer, inspector, supervisor, technical tester on fire prevention and firefighting must meet the following conditions:

a) Hold a certificate for consulting design or consulting review, consulting inspection, supervision, and technical testing on fire prevention and firefighting as stipulated in Point b Clause 3 of this Article.

b) Have carried out consulting design, consulting review, consulting inspection, supervision, and technical testing on fire prevention and firefighting for at least three projects.

Article 48. Documents and procedures for confirming eligibility to operate fire prevention and firefighting services

1. The application documents for confirming eligibility to operate fire prevention and firefighting services include:

a) A request for confirmation of eligibility to operate fire prevention and firefighting services.

b) A copy of the business registration certificate or the certificate of operation of the enterprise or establishment.

c) A list of individuals with certificates in fire prevention and firefighting appropriate to the enterprise's or establishment's fire prevention and firefighting service business, accompanied by copies of their certificates and copies of their employment decisions or labor contracts.

d) Copies of diplomas certifying the professional qualifications of individuals.

đ) Documentation proving the material conditions, means, and equipment ensuring the operation of the business.

2. Within seven working days from the date of receiving complete and valid documents, the competent Fire Prevention and Fighting Police authority must complete the process of confirming eligibility to operate fire prevention and firefighting services for enterprises and establishments. In cases where the conditions for confirmation are not met, the Fire Prevention and Fighting Police authority must issue a response document clearly stating the reasons.

3. Enterprises and establishments may only conduct fire prevention and firefighting service business activities after being issued a certificate of eligibility to operate fire prevention and firefighting services by the Fire Prevention and Fighting Police authority.

Article 49. Management, use, replacement, reissue, and revocation of certificates of eligibility to operate fire prevention and firefighting services

1. The heads of enterprises and the legal representatives of establishments operating fire prevention and firefighting services are responsible for managing the certificates of eligibility to operate fire prevention and firefighting services. It is strictly prohibited to alter, erase, sell, lend, or lease such certificates.

2. When an enterprise or establishment ceases operations or no longer engages in fire prevention and firefighting services, the certificate of eligibility to operate fire prevention and firefighting services becomes invalid; if operations are suspended, within five days from the date of suspension, the certificate must be returned to the Fire Prevention and Fighting Police authority that issued it previously; in cases of temporary suspension of operations, a notification must be sent to the Fire Prevention and Fighting Police authority that issued it previously regarding the reasons and duration of the temporary suspension.

3. If the certificate of eligibility to operate fire prevention and firefighting services is lost or damaged, or if there are changes in the name, head, legal representative, or location and type of fire prevention and firefighting service business of the enterprise or establishment, the enterprise or establishment must submit a request to the Fire Prevention and Fighting Police authority that issued the certificate previously to apply for a new certificate or replacement.

4. The certificate of eligibility to operate fire prevention and firefighting services will be revoked in the following cases:

a) The enterprise or establishment has gone bankrupt or no longer operates fire prevention and firefighting services.

b) Failure to meet the conditions for operating fire prevention and firefighting services after having been issued a certificate of eligibility to operate fire prevention and firefighting services as stipulated in this Decree.

Article 50. Handling for businesses and facilities currently operating fire prevention and firefighting services and individuals who have been issued a professional practice certificate for fire prevention and firefighting before this Decree takes effect.

Clause 1. From the date this Decree takes effect, businesses and facilities currently operating fire prevention and firefighting services must go to the Fire Prevention and Fighting Police Authority to be confirmed and issued a certificate confirming they meet the conditions for operating fire prevention and firefighting services.

Clause 2. After thirty-six months from the date this Decree takes effect, if businesses and facilities do not meet the conditions for operating fire prevention and firefighting services as stipulated in this Decree, they must cease operations in this field.

Clause 3. Individuals who have been issued a fire prevention and firefighting certificate not by the Fire Prevention and Fighting Police Authority must complete procedures to obtain a new fire prevention and firefighting certificate in accordance with Clause 3, Article 47 of this Decree.

Chapter VII

INVESTMENT FOR FIRE PREVENTION AND FIREFIGHTING ACTIVITIES

Article 51. Utilization of financial resources for investment in fire prevention and firefighting activities

Clause 1. Financial resources for investment in fire prevention and firefighting activities shall be used for the following purposes:

a) Investment in activities, material infrastructure, equipment for fire prevention and firefighting, and devices of the Fire Prevention and Fighting Police Force.

b) Support for the activities of civilian defense forces and grassroots fire prevention and firefighting forces.

c) Support for fire prevention and firefighting propaganda and mass movements.

d) Support for rewards in fire prevention and firefighting work.

đ) Support for other fire prevention and firefighting activities.

Clause 2. Financial resources for investment in fire prevention and firefighting activities shall be managed and utilized in accordance with the State Budget Law.

Article 52. Budget for investment in fire prevention and firefighting activities

Clause 1. The budget for ensuring fire prevention and firefighting activities of the Fire Prevention and Fighting Police Force, state agencies, public service units, armed forces, and other entities benefiting from the state budget at central and local levels shall be guaranteed by the state budget according to the current budget decentralization.

Annually, the state guarantees and allocates a separate budget for the activities of the Fire Prevention and Fighting Police Force; the Ministry of Public Security prepares a budget plan for investment in fire prevention and firefighting activities and assigns the Fire Prevention, Firefighting, Rescue, and Salvage Bureau to implement it; People's Committees at all levels must prepare a national defense and security budget plan to ensure fire prevention and firefighting activities in their respective areas.

Clause 2. Agencies, organizations not benefiting from the state budget, households, individuals, and foreign organizations operating within the territory of Vietnam must self-fund their fire prevention and firefighting activities in accordance with regulations.

Clause 3. The state budget for investment in the activities of the Fire Prevention and Fighting Police Force shall be used for the following purposes:

a) Regular activities of the Fire Prevention and Fighting Police Force.

b) Equipment, modernization, and upgrading of fire prevention and firefighting tools and technical infrastructure; scientific research and technological development on fire prevention and firefighting as prescribed.

Clause 4. Contents of expenditure for fire prevention and firefighting activities in the national defense and security budget of People's Committees at all levels include:

a) Regular activities of civilian defense forces; regular support for Civil Defense Team Leaders and Deputy Team Leaders.

b) Purchase of protective equipment and fire prevention and firefighting tools for civilian defense forces.

Article 53. Encouraging Investment for Fire Prevention and Fighting Activities

1. The State encourages and creates conditions for domestic agencies, organizations, individuals, overseas Vietnamese, foreign organizations and individuals, and international organizations to invest and sponsor in the following areas:

a) Fire prevention and fighting activities.

b) Equipping fire prevention and fighting equipment.

c) Training and enhancing knowledge on fire prevention and fighting.

d) Applying scientific and technological progress to fire prevention and fighting activities.

2. The State encourages research, production, and domestic assembly, export of fire prevention and fighting equipment.

3. Agencies, organizations, and individuals producing, assembling fire prevention and fighting equipment domestically, exporting, and importing fire prevention and fighting equipment shall enjoy preferential tax policies as prescribed by the State.

Chapter VIII

RESPONSIBILITIES OF MINISTRIES, GOVERNMENT-LEVEL AGENCIES, AND PEOPLE'S COMMITTEES AT ALL LEVELS IN FIRE PREVENTION AND FIGHTING ACTIVITIES

Article 54. Responsibilities of Ministries, Government-Level Agencies, and Government-Affiliated Agencies

Within their respective tasks and authorities, ministries, government-level agencies, and government-affiliated agencies shall coordinate with the Ministry of Public Security to organize the implementation of fire prevention and fighting work and have specific responsibilities as follows:

1. Issuing legal normative documents and regulations on fire prevention and fighting within their management scope and authority.

2. Coordinating with the Ministry of Public Security to implement legal provisions on fire prevention and fighting.

3. Organizing propaganda, legal education, guiding knowledge on fire prevention and fighting; directing the construction and maintenance of mass movements for fire prevention and fighting.

4. Directing investment funding for fire prevention and fighting activities and equipping fire prevention and fighting equipment.

5. Directing firefighting operations and remedying aftermaths of fires.

6. Deploying forces to perform fire prevention and fighting duties; compiling statistics and reporting to the Government and the Ministry of Public Security on fire prevention and fighting.

Article 55. Responsibilities of the Ministry of Public Security

The Ministry of Public Security is responsible for unified state management of fire prevention and fighting nationwide and performs the following tasks:

1. Proposing and implementing strategies, planning, and plans for fire prevention and fighting throughout the country.

2. Proposing issuance or issuing legal normative documents on fire prevention and fighting; guiding, organizing implementation, and inspecting compliance with fire prevention and fighting regulations.

3. Guiding and directing propaganda, legal education, knowledge on fire prevention and fighting, building mass movements participating in fire prevention and fighting activities.

4. Implementing inspection and audit work on fire prevention and fighting; resolving complaints and denunciations related to fire prevention and fighting within their jurisdiction.

5. Conducting review and acceptance work on fire prevention and fighting for construction projects, buildings, and special-purpose motor vehicles requiring fire safety assurance; inspecting, testing, and certifying compliance for fire prevention and fighting equipment, fire-resistant materials.

6. Implementing investigation, handling of fire incidents, and dealing with violations of fire prevention and fighting regulations.

7. Directing and guiding the organization of permanent readiness for firefighting, developing and practicing firefighting plans; performing rescue and relief tasks.

8. Developing and implementing investment projects for equipping fire prevention and fighting equipment for the Fire Prevention and Fighting Police Force; issuing and implementing regulations on equipping and using fire prevention and fighting equipment.

9. Building the Fire Prevention and Fighting Police Force; organizing training of specialized personnel in fire prevention and fighting.

10. Organizing research, dissemination, and application of scientific and technological progress in the field of fire prevention and fighting.

11. Organizing a management and command information system for fire prevention and fighting activities.

12. Inspecting insurance activities related to fire and explosion in conjunction with fire prevention and fighting activities.

13. Submitting to the Government proposals for participation in international organizations, signing or joining international treaties on fire prevention and fighting activities; implementing international activities related to fire prevention and fighting within their authority.

Article 56. Responsibilities of People's Committees at all levels

1. Within their respective tasks and powers, the People's Committee of the province and district shall have the responsibility to perform state management functions regarding fire prevention and fighting in their localities and shall undertake specific tasks as follows:

a) Issuing regulations on fire prevention and fighting in the locality.

b) Directing, inspecting, and organizing the implementation of legal provisions on fire prevention and fighting in the locality; administratively handling violations of fire prevention and fighting regulations within their authority.

c) Guiding and directing the dissemination, education of laws and knowledge on fire prevention and fighting for the people; building mass movements for fire prevention and fighting.

d) Investing budget funds for fire prevention and fighting activities; equipping fire prevention and fighting equipment.

đ) Planning locations, proposing land allocation, and constructing barracks for the Fire Prevention and Fighting Police force.

e) Directing the construction and practice of firefighting plans that require mobilization of multiple forces and means.

g) Directing the organization of firefighting and the mitigation of fire consequences.

h) Statistics and reporting to higher-level People's Committees, the Government, and the Ministry of Public Security on fire prevention and fighting.

2. Within their respective tasks and powers, the People's Committee of the commune shall have the responsibility to perform state management functions regarding fire prevention and fighting in their localities and shall undertake specific tasks as follows:

a) Directing, inspecting, and organizing the implementation of legal provisions on fire prevention and fighting in the locality; ensuring fire safety conditions for residential areas; administratively handling violations of fire prevention and fighting regulations within their authority.

b) Organizing the dissemination, guidance, and education of laws and knowledge on fire prevention and fighting; building mass movements for fire prevention and fighting.

c) Managing civilian defense teams in villages.

d) Investing funds for fire prevention and fighting activities; equipping fire prevention and firefighting equipment for civilian defense teams in accordance with regulations.

đ) Ensuring conditions for fire alarm information, traffic routes, and water sources for firefighting.

e) Directing the construction and practice of firefighting plans.

g) Organizing firefighting and the mitigation of fire consequences.

h) Statistics and reporting on fire prevention and fighting to the People's Committee of the district.

Chapter IX

IMPLEMENTING PROVISIONS

Article 57. Effective Date

This Decree takes effect from September 15, 2014, and replaces Decree No. 35/2003/NĐ-CP dated April 4, 2003, detailing the implementation of certain articles of the Law on Fire Prevention and Fighting, and Point 1 of Decree No. 46/2012/NĐ-CP dated May 22, 2012, amending and supplementing certain articles of Decree No. 35/2003/NĐ-CP dated April 4, 2003, detailing the implementation of certain articles of the Law on Fire Prevention and Fighting.

Article 58. Guidance on Implementation

1. The Ministers of the Ministries of Public Security, Finance, Construction, Labor - Invalids and Social Affairs, Education and Training shall guide the implementation of this Decree within their respective functions and tasks.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-run city People's Committees, and related organizations and individuals are responsible for implementing this Decree./.
