Regulations on the implementation of health insurance for officers, non-commissioned officers, soldiers, and students of the People's Public Security

On the basis of Law Bhealth insurance Law number 25/2008/QH12 November 14, 2008 amended and supplemented by Law number 46/2014/QH13 and Law number 51/2024/QH15 (hereinafter referred to as the Health Insurance Law as amended and supplemented);
Pursuant to Decree number 02/2025/NĐ-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security which has been amended and supplemented by Decree number 11/2025/NĐ-CP dated July 1, 2025 of the Government;
Pursuant to Decree number 70/2015/NĐ-CP dated September 1, 2015 of the Government detailing and guiding the implementation of certain provisions of the Health Insurance Law for the People's Army, the People's Public Security, and personnel engaged in confidential work which has been amended and supplemented by Decree number 74/2025/NĐ-CP dated March 31, 2025 of the Government (hereinafter referred to as Decree number 70/2015/NĐ-CP as amended and supplemented);
At the proposal of the Director of the Cadre Organization Department;
The Minister of Public Security issues this Circular regulating measures for implementing health insurance for officers, non-commissioned officers, soldiers, and students of the People's Public Security.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates measures for implementing health insurance for officers, non-commissioned officers, soldiers, and students of the People's Public Security, including: Contribution levels, responsibility for contributions, methods of contribution to health insurance; budgeting and finalizing expenses for health insurance contributions; health insurance cards, issuance, and management of health insurance cards; payment of medical examination and treatment costs; organization of health insurance medical examinations and treatments; management and use of medical examination and treatment funds and administrative costs for health insurance; responsibilities of organizations and individuals in implementing health insurance.
Article 2. Applicability
1. Personnel participating in health insurance include:
a) Officers and non-commissioned officers in business affairs and technical officers and non-commissioned officers in technical professions currently working in the People's Public Security force;
b) Non-commissioned officers and soldiers currently performing their duties in the People's Public Security;
c) Students of the People's Public Security receiving living allowances while studying at schools within and outside the People's Public Security in Vietnam;
d) Foreign students of public security receiving living allowances (excluding foreign students studying at the Public Security Cultural School).
2. Units under the Ministry of Public Security, provincial and municipal public security agencies (hereinafter collectively referred to as public security units and localities); organizations and individuals related to the implementation of health insurance for the subjects specified in Clause 1 of Article 2 of this Circular.
PART II
CONTRIBUTION LEVELS, RESPONSIBILITY FOR CONTRIBUTIONS, BUDGETING AND FINALIZING EXPENSES FOR HEALTH INSURANCE CONTRIBUTIONS
Article 3. Contribution levels, responsibility for contributions, methods of contribution to health insurance
1. The monthly contribution level for health insurance of the subjects specified in Clause 1 of Article 2 of this Circular shall be implemented according to the provisions of Clause 1 of Article 4 of Decree number 70/2015/NĐ-CP as amended and supplemented, wherein:
a) 4.5% of the monthly salary for the subjects specified in Point a of Clause 1 of Article 2 of this Circular;
b) 4.5% of the reference level for the subjects specified in Points b, c, and d of Clause 1 of Article 2 of this Circular;
c) 4.5% of the reference level when the subjects specified in Point a of Clause 1 of Article 2 of this Circular take leave due to illness for 14 working days or more in a month or when taking maternity leave for 14 working days or more in a month according to the laws on social insurance.
2. The state budget ensures the full funding for health insurance contributions for the subjects specified in Clause 1 of Article 2 of this Circular according to the current budget allocation. When the Government adjusts the health insurance contribution rate or the reference level, the amount of state budget funding for health insurance contributions will be adjusted from the date the new contribution rate or reference level takes effect.
3. Before the last day of the first month of each quarter, public security units and localities must transfer the full health insurance contribution funds for the previous quarter to the accounts of officers and soldiers for the dedicated collection of health insurance contributions of the Planning and Finance Bureau. By the latest December 15th of each year, public security units and localities must complete the health insurance contributions for that year.
4. By the latest December 31st of each year, the Planning and Finance Bureau must compile the total amount of health insurance contributions as specified in Point c of Clause 1 of Article 3 of this Circular and report to the Vietnam Social Security to ensure the funding for health insurance contributions.
5. Subjects specified in Point a and Point c of Clause 1 of Article 2 of this Circular who are sent abroad for study or work for more than 14 working days in a month are exempt from health insurance contributions, and the time spent working or studying abroad counts as participation in health insurance.
6. In cases where the subjects specified in Clause 5 of this Article are on leave, summer vacation, or sick leave in Vietnam, they are issued health insurance cards with usage periods as specified in Point d of Clause 3 of Article 5 of this Circular, and the state budget covers the contributions according to the provisions of Clause 1 of this Article.
Article 4. Preparation of Budget Estimates and Final Accounts for Health Insurance Premiums
1. Annually, public security units and localities shall prepare budget estimates for health insurance premiums for the subjects specified in Clause 1 of Article 2 of this Circular under their management and submit them to the Financial Planning Department in accordance with the provisions of the State Budget Law and related guiding documents.
2. The health insurance premium funds for the subjects specified in Clause 1 of Article 2 of this Circular shall be allocated and assigned by the Financial Planning Department to public security units and localities within the regular expenditure budget.
3. Annually, after comparing the health insurance premium payment data, public security units and localities shall prepare final accounts reports on health insurance premium expenditures and submit them to the Financial Planning Department for consolidation and finalization in accordance with the provisions of the State Budget Law and related guiding documents.
4. Annually, the Financial Planning Department shall be responsible for reporting the final accounts of the revenue and payment of health insurance premiums for the subjects specified in Clause 1 of Article 2 of this Circular to the Vietnam Social Security.
Chapter III
ISSUANCE AND MANAGEMENT OF HEALTH INSURANCE CARDS
Article 5. Health Insurance Cards
1. Health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular shall be issued in paper and electronic form by the Vietnam Social Security for Public Security Officers, both having equal validity. The Director of the Cadre Organization Department and the Director of the Vietnam Social Security for Public Security Officers shall report to the Minister of Public Security to decide on the issuance of electronic health insurance cards for officers and soldiers in compliance with regulations on state secrets protection in national security and social order and safety fields, and consistent with the characteristics of the Public Security force.
2. The format and blank forms of health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular shall comply with the provisions of point a and point b of Clause 1 of Article 6 of Decree No. 70/2015/NĐ-CP as amended and supplemented.
3. Health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular shall be issued by the Vietnam Social Security for Public Security Officers and shall be valid for use in accordance with the provisions of Clause 2 of Article 6 of Decree No. 70/2015/NĐ-CP as amended and supplemented, specifically:
a) For the subjects specified in point a of Clause 1 of Article 2 of this Circular who have more than 60 months of service in the Public Security Force, the maximum duration of validity of the card issued at one time shall be 60 months. In cases where the period of service in the Public Security Force is less than 60 months, the validity period of the card issued shall run until the last day of the month when they cease serving in the Public Security Force.
If the authorized authority extends the age limit for service or assigns them for training, the validity period of the card will continue from the day following the expiration date of the previous card to the end of the extended service period or the training period.
If the authorized authority resolves to temporarily suspend retirement benefits and switch to receiving sickness benefits from the social security fund, the health insurance card may be extended for up to 12 months at one time.
b) For the subjects specified in point b of Clause 1 of Article 2 of this Circular, the validity period of the card runs from the date of joining the Public Security Service to the last day of the month when they cease serving with a fixed term in the Public Security Force. If the service period is extended, the validity period of the card will be extended to the last day of the extended service period.
c) For the subjects specified in point c of Clause 1 of Article 2 of this Circular, the validity period of the card issued runs from the date of enrollment to December 31 of the graduation year but not exceeding 60 months.
d) For the subjects specified in point d of Clause 1 of Article 2 of this Circular, the validity period of the card issued runs from the date of enrollment to the end of the study period at Public Security Schools.
đ) For the subjects specified in points a and c of Clause 1 of Article 2 of this Circular who are assigned to work or study abroad and return to Vietnam during leave, summer vacation, or medical treatment, health insurance cards with validity periods matching the leave, vacation, or medical treatment period shall be issued.
e) When the subjects specified in points a, b, and c of Clause 1 of Article 2 of this Circular cease serving in the Public Security Force or transfer to another subject not included in points a, b, and c of Clause 1 of Article 2 of this Circular according to the decision of the authorized authority, the health insurance card remains valid until the last day of the month when they cease serving or transfer to another subject.
4. Information on health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular shall be integrated into identity cards or electronic identification accounts to facilitate health examination and treatment using identity cards or electronic identification accounts.
Article 6. Issuance, reissuance, and replacement of health insurance cards
1. The dossier, procedure, and process for issuing health insurance cards for subjects specified in Clause 1 of Article 2 of this Circular shall be implemented according to the provisions of Clause 4 of Article 7 of Decree No. 70/2015/ND-CP, which has been amended and supplemented, specifically as follows:
a) Within five working days from the date when the subject becomes eligible for health insurance, the direct managing unit of officers and soldiers shall guide such officers and soldiers to fully and accurately fill out the Health Insurance Participation and Information Adjustment Form according to Model No. 2 issued together with Decree No. 188/2025/NĐ-CP dated July 1, 2025 of the Government detailing and guiding the implementation of certain articles of the Health Insurance Law (hereinafter referred to as Decree No. 188/2025/NĐ-CP), and submit it to the organizational personnel agency of the police unit or locality.
In cases where the direct managing unit is authorized, it shall prepare the dossier and send it to the Social Insurance of the People's Public Security, following the regulations stipulated in point b of this Clause, while simultaneously sending it to the organizational personnel agency of the police unit or locality for reporting purposes;
b) Within ten working days from the date of receiving the Health Insurance Participation and Information Adjustment Form, the organizational personnel agency of the police unit or locality shall be responsible for preparing the dossier to request issuance of the health insurance card and send it to the Social Insurance of the People's Public Security. The dossier requesting issuance of the health insurance card shall be sent directly, through postal service, or via internal electronic channels, including: Request letter, list of health insurance card issuance accompanied by electronic data;
c) For the second and subsequent issuances of health insurance cards: Prior to thirty days from the expiration date of the health insurance card of officers and soldiers, the police unit or locality shall be responsible for reviewing and updating information and implementing the provisions stipulated in point b of this Clause. In cases where officers and soldiers have a need to change their initial healthcare registration for health insurance or personal information, they shall follow the regulations stipulated in points a and b of this Clause;
d) Within five working days from the date of receiving the complete dossier as stipulated in point b of this Clause, the Social Insurance of the People's Public Security shall issue the health insurance card, transfer it to the police unit or locality for handover to the officers and soldiers for management and use; if the health insurance card is not issued, there must be a written response stating the reasons;
đ) In cases where the subjects participating in health insurance belong to other groups transitioning to participate in health insurance under the subjects specified in Clause 1 of Article 2 of this Circular, the police unit or locality shall implement the regulations stipulated in points a and b of this Clause along with the old health insurance card (if any) to recover and issue a new health insurance card. The new health insurance card shall be valid from the date of recruitment, transfer, acceptance, or assignment by the competent authority;
2. Reissuance and replacement of health insurance cards for subjects specified in Clause 1 of Article 2 of this Circular shall be carried out according to the provisions of Article 8 of Decree No. 70/2015/ND-CP, which has been amended and supplemented, specifically as follows:
a) When officers and soldiers have a need for reissuance or replacement of health insurance cards, the direct managing unit shall guide them to fill out the Health Insurance Participation and Information Adjustment Form along with the paper copy of the previously issued health insurance card (in case of replacement) and submit it to the organizational personnel agency of the police unit or locality;
b) The police unit or locality or the direct managing unit (if authorized) shall be responsible for preparing a list accompanied by electronic data and a request letter to send to the Social Insurance of the People's Public Security;
c) Within five working days from the date of receiving the complete dossier as stipulated, the Social Insurance of the People's Public Security must reissue or replace the health insurance card; if reissuance or replacement is not possible, a written response must be provided with the reasons stated clearly.
Article 7. Management, use, recovery, temporary detention, or temporary suspension of the value of health insurance card usage
1. Management and use of health insurance cards
The health insurance card of the subjects specified in Clause 1 of Article 2 of this Circular shall be managed and preserved by individuals themselves and can only be used for medical examination and treatment for their own benefit. If lending the card to others for medical examination and treatment or using it for other purposes, or using it instead of other identity papers to violate the law or affect the reputation of the People's Public Security force, they will be handled according to the nature and degree of violation, must compensate for medical examination and treatment costs (if any), and be disciplined according to the regulations of the Minister of Public Security.
2. Recovery of health insurance cards
a) The health insurance card of the subjects specified in Clause 1 of Article 2 of this Circular with remaining validity period will be recovered if it falls under any of the cases stipulated in Clause 1 of Article 9 of Decree No. 70/2015/ND-CP as amended and supplemented, including: ceasing service in the People's Public Security force (discharged from military service, transferred to another profession, retired, expelled from school, deprived of the title of Public Security officer); transferring to a different service system not falling within the scope of subjects specified in Clause 1 of Article 2 of this Circular; issuing duplicate health insurance cards with the same number or same subject; issuing health insurance cards to incorrect subjects as specified in Clause 1 of Article 2 of this Circular.
b) Upon discovering duplicate issuance of health insurance cards with the same number or same subject, or incorrect issuance to subjects as specified in Clause 1 of Article 2 of this Circular, the directly managing unit shall immediately recover the health insurance card and report to the organizational cadre department of the Public Security unit or locality along with the health insurance card to inform the Social Insurance of the Public Security Force (or send directly to the Social Insurance of the Public Security Force if authorized).
c) For cases where service in the People's Public Security force is ceased or transferred to a different service system not falling within the scope of subjects specified in Clause 1 of Article 2 of this Circular, the provisions of point b of this Clause shall be implemented, at the latest on the last day of the month when service is ceased or transferred.
3. Temporary detention or temporary suspension of the value of health insurance card usage for the subjects specified in Clause 1 of Article 2 of this Circular shall be carried out according to the provisions of Clauses 3, 4, 5, 6, and 7 of Article 12 of Decree No. 188/2025/ND-CP.
Chapter IV
SCOPE AND LEVEL OF HEALTH INSURANCE BENEFITS; DIRECT PAYMENT OF MEDICAL EXAMINATION AND TREATMENT COSTS UNDER HEALTH INSURANCE
Article 8. Scope and level of health insurance benefits
1. The scope of health insurance benefits for the subjects specified in Clause 1 of Article 2 of this Circular shall be implemented according to the provisions of Article 10 of Decree No. 70/2015/ND-CP as amended and supplemented.
2. The level of health insurance benefits includes medical examination and treatment costs under health insurance and transportation costs for the subjects specified in Clause 1 of Article 2 of this Circular, which shall be implemented according to the provisions of Article 11 of Decree No. 70/2015/ND-CP as amended and supplemented.
Article 9. Direct payment of medical examination and treatment costs under health insurance
1. Cases eligible for direct payment of medical examination and treatment costs under health insurance shall be implemented according to the provisions of Clause 2 of Article 31 of the Health Insurance Law as amended and supplemented, Clause 1 of Article 19 of Decree No. 70/2015/ND-CP as amended and supplemented, and Article 54 of Decree No. 188/2025/ND-CP.
2. Documentation for direct payment of medical examination and treatment costs under health insurance shall be implemented according to the provisions of Clause 2 of Article 19 of Decree No. 70/2015/ND-CP as amended and supplemented, and Article 55 of Decree No. 188/2025/ND-CP.
3. The level of direct payment of medical examination and treatment costs under health insurance shall be implemented according to the provisions of Clause 4 of Article 19 of Decree No. 70/2015/ND-CP as amended and supplemented.
4. Procedure
a) Officers and soldiers falling under the cases stipulated in Clause 1 of this Article shall prepare the documentation as stipulated in Clause 2 of this Article and submit it to the directly managing unit (if officers and soldiers have passed away, their relatives shall prepare the documentation);
b) Public Security units or localities or directly managing units (if authorized) shall accept the documentation, prepare a request letter along with two copies of the documentation (copies) and send them to the Social Insurance of the Public Security Force;
c) Within thirty working days from the date of receiving all documentation, the Social Insurance of the Public Security Force shall review or coordinate with the Social Insurance of the province or city to review and notify the results to the Public Security unit or locality to make payments to officers and soldiers; simultaneously, notify the Department of Planning and Finance to allocate funds to the Public Security unit or locality. In case of non-payment, the Social Insurance of the Public Security Force shall reply in writing and specify the reasons;
d) Annually, Public Security units or localities shall settle the budget for direct payment of medical examination and treatment costs under health insurance for officers and soldiers in the unit with the higher-level finance authority or with the Department of Planning and Finance according to the authorization.
CHAPTER V
ORGANIZATION OF HEALTH INSURANCE MEDICAL EXAMINATION AND TREATMENT
Article 10. Primary Health Insurance Medical Examination and Treatment Facilities
1. Primary health insurance medical examination and treatment facilities outside the public security healthcare system shall be implemented in accordance with Article 6 of Circular No. 01/2025/TT-BYT dated January 1, 2025, issued by the Minister of Health detailing and guiding the implementation of certain provisions of the Health Insurance Law (hereinafter referred to as Circular No. 01/2025/TT-BYT).
2. Primary health insurance medical examination and treatment facilities within the public security healthcare system are those medical examination and treatment facilities under the Ministry of Public Security that have been classified according to their technical expertise level as prescribed by the Minister of Public Security, and have signed contracts for primary health insurance medical examination and treatment with social insurance agencies.
Article 11. Registration for Primary Health Insurance Medical Examination and Treatment
1. Officers and soldiers registering for primary health insurance medical examination and treatment at medical examination and treatment facilities under the Ministry of Public Security shall comply with the provisions of Article 3 of Circular No. 99/2024/TT-BCA dated December 31, 2024, issued by the Minister of Public Security on registration for primary health insurance medical examination and treatment and patient transfer between medical examination and treatment facilities under the Ministry of Public Security (hereinafter referred to as Circular No. 99/2024/TT-BCA).
2. Officers and soldiers registering for primary health insurance medical examination and treatment at medical examination and treatment facilities outside the public security healthcare system shall comply with the provisions of Article 7 of Circular No. 01/2025/TT-BYT.
3. Before October 31 each year, the Social Insurance Agency of the Public Security System shall provide information on the actual number of people participating in health insurance who have registered for primary medical examination and treatment facilities to the Department of Health of the province/city and the Social Insurance Agency of the province/city for the purpose of compiling information to serve as a basis for considering and organizing the allocation of health insurance cards to primary health insurance medical examination and treatment facilities under the management of the province/city.
Article 12. Transfer of Patients Between Health Insurance Medical Examination and Treatment Facilities
1. In cases where patients are transferred between health insurance medical examination and treatment facilities under the Ministry of Public Security for the subjects specified in Clause 1 of Article 2 of this Circular, they shall be implemented in accordance with the provisions of Article 4 of Circular No. 99/2024/TT-BCA.
2. In cases where patients are transferred between health insurance medical examination and treatment facilities not under the jurisdiction of the Ministry of Public Security; between health insurance medical examination and treatment facilities under the jurisdiction of the Ministry of Public Security and health insurance medical examination and treatment facilities not under the jurisdiction of the Ministry of Public Security for the subjects specified in Clause 1 of Article 2 of this Circular, they shall be implemented in accordance with the provisions of Articles 9 and 10 of Circular No. 01/2025/TT-BYT.
3. In cases where patients are transferred due to confirmed diagnosis, treatment of rare diseases, serious illnesses, or surgeries requiring high-level techniques as stipulated in Article 5 of Circular No. 01/2025/TT-BYT, the level of health insurance benefits shall be implemented in accordance with point a, Clause 4, Article 22 of the Health Insurance Law as amended and supplemented.
Article 13. Procedures for Health Insurance Medical Examination and Treatment
The procedures for health insurance medical examination and treatment for officers and soldiers specified in Clause 1 of Article 2 of this Circular shall be implemented in accordance with Article 15 of Decree No. 70/2015/NĐ-CP as amended and supplemented and Articles 37 and 38 of Decree No. 188/2025/NĐ-CP, including:
1. Participants in health insurance belonging to other categories who are transferred to the category specified in Clause 1 of Article 2 of this Circular, during the period waiting for issuance of the health insurance card, must present identity documents with photos, decisions, or confirmation documents from competent authorities proving their eligibility for the category specified in Clause 1 of Article 2 of this Circular and shall enjoy full health insurance benefits as prescribed.
2. Officers and soldiers going for medical examination and treatment during the period waiting for reissue or replacement of the health insurance card must present a certificate from their direct managing unit clearly stating the information about the health insurance card and the primary medical examination and treatment facility registered on the card most recently issued by the Social Insurance Agency of the Public Security System to enjoy full health insurance benefits as prescribed.
3. In emergency cases, officers and soldiers may seek medical examination and treatment at any medical examination and treatment facility and must present the required documents before the end of the treatment period to enjoy full health insurance benefits.
CHAPTER VI
MANAGEMENT AND USE OF FUNDS FOR MEDICAL EXAMINATION AND TREATMENT AND HEALTH INSURANCE ADMINISTRATION COSTS
Article 14. Management and use of funds for medical examination and treatment under health insurance
1. The allocation and management of health insurance revenue for the subjects specified in Clause 1 of Article 2 of this Circular shall be carried out in accordance with the provisions of Article 20 of Decree No. 70/2015/ND-CP, which has been amended and supplemented, including:
a) 92% of the health insurance premium paid shall be allocated for medical examination and treatment (hereinafter referred to as the medical examination and treatment fund of the Ministry of Public Security) and managed and used by the Financial Planning Department.
b) 08% of the health insurance premium paid shall be transferred to the Vietnam Social Security for the reserve fund, organizational and operational costs of health insurance, of which at least 04% of the health insurance premium paid shall be allocated to the reserve fund.
Quarterly, the Financial Planning Department shall transfer the health insurance revenue of the local public security agencies based on the revenue collected, according to the regulations.
2. The use of the medical examination and treatment fund of the Ministry of Public Security shall be implemented in accordance with the provisions of Article 21 of Decree No. 70/2015/ND-CP, which has been amended and supplemented, including:
a) In cases where the medical examination and treatment fund of the Ministry of Public Security exceeds the expenditure on medical examination and treatment and transportation costs for the year, after being reviewed and settled by the Vietnam Social Security, the unused portion of the budget shall be used in accordance with the provisions of Clause 2 of Article 21 of Decree No. 70/2015/ND-CP, which has been amended and supplemented.
Based on the unused budget for medical examination and treatment under health insurance for the year, the Financial Planning Department shall take the lead in coordinating with the Cadre Organization Department, the Health Department, and related units to develop a plan for using the above budget, to be submitted for approval by the leadership of the Ministry of Public Security.
Medical examination and treatment facilities within the People's Public Security or local public security agencies that have been allocated funds shall be responsible for managing, using, and settling accounts with the Financial Planning Department in accordance with the regulations.
b) In cases where the expenditure on medical examination and treatment and transportation costs exceed the medical examination and treatment fund of the Ministry of Public Security for the year, after being reviewed and settled by the Vietnam Social Security: The Financial Planning Department shall take the lead in coordinating with the Cadre Organization Department, the Health Department, and related units to report to the leadership of the Ministry of Public Security to request the Vietnam Social Security to supplement the insufficient budget according to the provisions of Clause 3 of Article 21 of Decree No. 70/2015/ND-CP, which has been amended and supplemented.
Article 15. Conditions, contents of expenditures, payment, and settlement of primary healthcare funding
1. Conditions for allocating primary healthcare funding
Local public security agencies with their own health departments or medical examination and treatment facilities assigned the task of providing primary healthcare services according to the decision of the Minister of Public Security shall be eligible to receive funding from the health insurance fund to implement medical examinations and treatments in primary healthcare when they meet the following conditions:
a) Having at least one person who meets the conditions to work full-time or part-time in primary healthcare services as stipulated in Article 19 of the Law on Medical Examination and Treatment.
b) Having a health room or separate workspace to provide initial first aid and preliminary treatment for officers and soldiers when they suffer accidents or common illnesses during study or work at the unit.
2. Primary healthcare funding shall be implemented in accordance with the provisions of Clause 1 of Article 21 of Decree No. 70/2015/ND-CP, which has been amended and supplemented, specifically: Annually, the Financial Planning Department shall allocate a budget of 12% of the total health insurance revenue of the subjects under the management of local public security agencies to the local public security agencies to implement primary healthcare services at their health departments, medical examination and treatment facilities assigned the task of providing primary healthcare services by the competent authority.
3. Contents of expenditures as stipulated in Clause 1 of Article 21 of Decree No. 70/2015/ND-CP, which has been amended and supplemented.
4. Payment and settlement of primary healthcare funding
Local public security agencies or medical examination and treatment facilities receiving primary healthcare funding shall be responsible for using the allocated funding for primary healthcare services and shall not use it for other purposes. Any unspent funding at the end of the year may be carried over to the next year for continued use.
Annually, the financial department of the local public security agency shall review, audit, and confirm the settlement of these expenditure items; compile and submit a final settlement report to the Financial Planning Department.
Article 16. Advance payment, settlement, and finalization of medical examination and treatment expenses under health insurance
1. Quarterly, within three working days from the date of receiving the notification from the Vietnam Social Security on the cost of multi-level medical examination and treatment in the previous quarter, the Cadre and Civil Servant Organization Department shall notify the Planning and Finance Department.
2. Within two working days from the date of receiving the notification from the Cadre and Civil Servant Organization Department, the Planning and Finance Department shall make a single advance payment equal to ninety percent of the cost of multi-level medical examination and treatment in the previous quarter for the Vietnam Social Security to implement an advance payment of medical examination and treatment expenses under health insurance for officers and soldiers with healthcare facilities that have signed contracts for medical examination and treatment under health insurance with the social security agency.
3. Within seven working days from the date of receiving the notification from the Cadre and Civil Servant Organization Department, the Planning and Finance Department shall transfer the full cost of medical examination and treatment in the previous quarter to the Vietnam Social Security to implement the settlement and finalization of medical examination and treatment expenses under health insurance for officers and soldiers with healthcare facilities that have signed contracts for medical examination and treatment under health insurance with the social security agency.
4. Annually, the Cadre and Civil Servant Organization Department shall coordinate with the Planning and Finance Department to complete the payment of medical examination and treatment expenses under health insurance for officers and soldiers with the Vietnam Social Security.
Chapter VII
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS IN IMPLEMENTING HEALTH INSURANCE
Article 17. Responsibilities of the Cadre and Civil Servant Organization Department
1. To take the lead and coordinate with functional agencies in researching, advising, and proposing health insurance policies; guiding the organization and implementation of health insurance; promptly addressing any difficulties encountered during the implementation of health insurance; disseminating and popularizing health insurance policies and laws; promptly resolving complaints and reports related to health insurance.
2. To sign contracts with healthcare facilities within the People's Public Security Force for medical examination and treatment under health insurance for officers and soldiers of the People's Public Security Force when they meet the conditions regarding human resources and a system for connecting and sharing medical examination and treatment data with the Vietnam Social Security (signed with the title of the Vietnam Social Security of the People's Public Security Force).
The procedures, files, and formalities for signing contracts, annexes to contracts, contents of contracts, conditions for signing contracts, suspension, termination, and liquidation of contracts for medical examination and treatment under health insurance with healthcare facilities; rights and responsibilities of the Vietnam Social Security of the People's Public Security Force in implementing contracts for medical examination and treatment under health insurance shall be carried out in accordance with the provisions of Chapter V of Decree No. 188/2025/NĐ-CP.
3. To manage individuals participating in health insurance; organize printing and managing health insurance card blanks; implement issuance, reissuance, and replacement of health insurance cards in accordance with regulations; apply information technology in health insurance work.
4. To develop forms and templates for business operations on the social security software of the People's Public Security Force to serve the issuance and management of health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular, ensuring compatibility with the management of cadres by the Ministry of Public Security.
5. To take the lead and coordinate with the Planning and Finance Department and the Industrial Security Bureau to produce health insurance card blanks for distribution to the subjects specified in Clause 1 of Article 2 of this Circular.
Article 18. Responsibilities of the Planning and Finance Department
1. Implement the preparation of budget estimates and final accounts for health insurance costs of the subjects specified in Clause 1, Article 2 of this Circular with the Ministry of Finance in accordance with the State Budget Law, Health Insurance Law, and guiding documents.
2. Guide police units and localities to prepare budget estimates and final accounts for costs of cases specified in Point c, Clause 1, Article 3 of this Circular.
3. Coordinate with the Organization and Cadre Affairs Department to inspect the management and use of state budget funds for health insurance for the subjects specified in Clause 1, Article 2 of this Circular; manage and use medical examination and treatment costs under health insurance at police units and localities and medical facilities under the Ministry of Public Security.
4. Prepare annual plans for revenue and expenditure of health insurance funds for officers and soldiers for approval by the leadership of the Ministry of Public Security to submit to the Ministry of Finance (through the Vietnam Social Security).
Article 19. Responsibilities of the Health Department
1. Take the lead in researching, advising, and proposing technical classification levels in medical examinations and treatments for medical facilities within the People's Public Security. Coordinate in promoting, disseminating, and inspecting the implementation of laws on health insurance in the field of health within the People's Public Security.
2. Propose improvements to the network of medical facilities within the People's Public Security to meet conditions regarding human resources, infrastructure, medical equipment, and other legal requirements serving medical examinations and treatments under health insurance for officers and soldiers and the public.
3. Propose competent authorities to approve the list of techniques in medical examinations and treatments implemented at medical facilities and healthcare agencies within the People's Public Security.
4. Guide medical examinations and treatments and health care services for officers and soldiers when they undergo medical examinations and treatments under health insurance.
Article 20. Responsibilities of the Administrative Management Police Department
Coordinate with the Social Security of the People's Public Security to build, establish, and manage electronic health insurance cards; integrate health insurance card information of officers and soldiers onto digital identity accounts to serve officers and soldiers when seeking medical examinations and treatments under health insurance, ensuring compliance with regulations on protecting state secrets in national security and social order, and being suitable to the characteristics of the People's Public Security force.
Article 21. Responsibilities of Police Units and Localities
1. Organize the promotion and dissemination of policies and laws on health insurance and the implementation of health insurance policies for officers and soldiers in accordance with regulations.
2. Fully and promptly implement regulations on health insurance systems and policies for officers and soldiers; manage subjects and collect health insurance; issue health insurance cards; strictly manage allocated health insurance funds and use them for their intended purposes; timely and properly prepare budget estimates, payments, and reports on final accounts for revenues and expenditures.
3. By the last day of each month, report to the Social Security of the People's Public Security and the Planning and Finance Department on changes in the number of subjects participating in health insurance that have increased or decreased during the month (if any).
Article 22. Responsibilities of People's Police Officers
1. Fully implement regulations on declaring, reissuing, and exchanging health insurance cards; using health insurance cards for their intended purposes; returning health insurance cards (paper copies) to directly managing units when falling under the cases specified in point a, Clause 2, Article 7 of this Circular.
2. Install the national identification application, update health insurance card information to facilitate medical examination and treatment with citizen identity cards or electronic identification accounts.
3. Adhere to procedures, formalities, and guidelines of social insurance agencies and healthcare facilities when seeking medical examination and treatment covered by health insurance. Upon completion of each medical examination and treatment session, officers must report to their direct unit leaders about the process, health condition, and treatment duration, serving health monitoring and management.
Chapter VIII
IMPLEMENTING PROVISIONS
Article 23. Effectiveness and Transitional Provisions
1. This Circular takes effect from October 13, 2025, and replaces Circular No. 43/2016/TT-BCA dated October 25, 2016, issued by the Minister of Public Security regarding measures for implementing health insurance for officers, non-commissioned officers, and soldiers of the People's Public Security Forces.
2. Abolish Clause 4, Article 2 of Circular No. 57/2019/TT-BCA dated November 11, 2019, issued by the Minister of Public Security guiding the implementation of health insurance for workers, students, and relatives of police officers and workers serving in the People's Public Security Forces.
3. In cases where subjects specified in Clause 5, Article 3 of this Circular take leave, summer vacation, or sick leave in Vietnam before this Circular takes effect but conclude such leave after it takes effect, they shall be issued health insurance cards according to Clause 6, Article 3 of this Circular.
4. Police officers who enter healthcare facilities for medical examination and treatment before this Circular takes effect but conclude such activities after it takes effect shall have their expenses covered by the health insurance fund within the scope and level of benefits stipulated in Article 8 of this Circular.
5. Where legal normative documents cited in this Circular are replaced or amended, the cited content shall be applied according to the replacing or amended legal normative documents.
Article 24. Implementation Responsibilities
1. The Cadre and Civil Servant Department is responsible for guiding, inspecting, urging, and reporting to the Ministry of Public Security on the implementation of this Circular. The organization of health insurance for police officers performing special tasks shall be decided by the Minister of Public Security based on the proposal of the Cadre and Civil Servant Department.
During the implementation of this Circular, if any difficulties arise, local police units, relevant agencies, organizations, and individuals should report to the Ministry of Public Security (through the Fire Prevention, Firefighting, and Rescue Police Department) for timely guidance./.
During implementation, if there are any difficulties, local public security units shall report to the Ministry of Public Security (through the Cadre and Civil Servant Department) for timely guidance./.
