Regarding State ceremonies and welcoming foreign guests
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister of Foreign Affairs;
DECREE:
PART I
GENERAL PROVISIONS
Article 1. This Decree stipulates the main activities to commemorate major holidays and State ceremonies for welcoming high-level foreign guests with the aim of fostering patriotism, national pride, and contributing to enhancing and expanding cooperation and friendly relations with other countries and International Organizations.
Article 2. In the work of welcoming high-level foreign guests, the leading agency must pay attention to political requirements and apply the principle of equality and reciprocity to propose an appropriate level of reception.
Article 3. The Ministry of Foreign Affairs will propose the level of reception for foreign delegations not covered by this Decree on a case-by-case basis.
Article 4. In this Decree, some terms are understood as follows::
1. Even year, round year, odd year refers to the number of years commemorating (the occasion).
"Even year" is the commemorative year ending in the digit "0".
"Round year" is the commemorative year ending in the digit "5".
"Odd year" is the commemorative year ending in any other digits.
2. "Diplomatic Delegation" includes heads of foreign diplomatic missions in Vietnam.
3. "International Organizations in Hanoi" include International Organizations within the United Nations system and intergovernmental International Organizations outside the United Nations system that have representative offices in Hanoi.
Chapter II
COMMEMORATION OF MAJOR HOLIDAYS
Article 5. National Day of the Socialist Republic of Vietnam (September 2nd).
1. Odd year.
Leaders of the Party, State, National Assembly, Government, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y Central Committee of the Vietnam Fatherland Front and representatives of leaders of central agencies of political-social organizations (hereinafter referred to as mass organizations) place wreaths, visit the Mausoleum of President Ho Chi Minh and place wreaths at the Monument to Martyrs (hereinafter referred to as the Monument).

The determination of odd years, even years, and full years for organizing the day of worshiping the ancestors of King Hung shall be calculated according to the Gregorian calendar year.

Chapter III
RECEIVING DELEGATIONS OF FOREIGN HIGH-LEVEL OFFICIALS VISITING FOR OFFICIAL PURPOSES
Article 11. Welcoming the Head of State.
1. Welcoming at the airport.
The welcoming party includes the Director or Deputy Director of the President's Office, the Escorting Official, a Deputy Minister of Foreign Affairs, the Vietnamese Ambassador to the host country, the Director of the External Affairs Department of the President's Office, the Director of the Protocol Department, the Director of the Regional Department of the Ministry of Foreign Affairs, and the Ambassador of the host country.
2. Welcoming Ceremony at the Presidential Palace..
a) The President shall preside over the welcoming ceremony.
b) The attendees at the welcoming ceremony include the First Lady (or First Gentleman) of the President, if the First Lady (or First Gentleman) of the visiting Head of State accompanies them, a Deputy Prime Minister if the visiting Head of State is also the head of government, the Director of the President's Office, the Chairman of the People's Committee of Hanoi City, the Escorting Official, a Deputy Minister of Foreign Affairs, the Vietnamese Ambassador to the host country, Vietnamese officials with positions corresponding to the official members of the visiting delegation, the Ambassador, and diplomatic staff from the Embassy of the host country. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).c) The ceremonial procedures are as follows:
The President and the First Lady (or First Gentleman) welcome the visiting Head of State and their spouse (or partner) at the vehicle parking area. Two rows of honor guards stand before the steps.
Present flowers to the visiting Head of State and their spouse (or partner).
Both Heads of State stand on the honor platform.
Military bands play the national anthems of both countries (the host country's anthem first).
The Honor Guard Commander salutes, reports, and invites the visiting Head of State to inspect the Honor Guard of the Vietnam People's Army, which includes representatives from the three branches: naval, ground, and air forces.
The President and the visiting Head of State inspect the Honor Guard.
The Honor Guard wishes good health to the visiting Head of State.
The President introduces Vietnamese officials to the visiting Head of State. The visiting Head of State introduces members of the delegation to the President.

The Vietnamese delegation attending the farewell ceremony at the Presidential Palace and the farewell at the airport shall be the same as for the welcoming ceremony.
Article 12. Welcoming the Head of State or the Head of Government who is also the Head of the Ruling Party having formal relations with the Communist Party of Vietnam shall be conducted under the name of the Party-State Delegation or the Party-Government Delegation.
The level and protocol of welcoming shall be applied as for a formal visit by the Head of State.
The General Secretary and the President or the General Secretary and the Prime Minister shall host the welcoming, farewell, talks, and banquet. The General Secretary and the Head of the delegation shall inspect the Honor Guard.
Welcoming the delegation at the airport includes, in addition to the components for welcoming the Head of State, the Deputy Director of the Central External Relations Department of the Party. The welcoming ceremony, farewell ceremony, talks, and banquet shall include representatives from Party and State agencies corresponding to the official members of the visiting delegation.
Article 13. Welcoming the Head of Government.
1. Welcoming at the airport.
The welcoming party includes the accompanying officials, a Deputy Minister of Foreign Affairs, the Ambassador of Vietnam to the host country, the Director of the Protocol Department, the Director of the Regional Department of the Ministry of Foreign Affairs.
2. Welcoming Ceremony.
The Prime Minister shall host the welcoming ceremony.
The attendees at the welcoming ceremony include the Spouse (or Husband) of the Prime Minister, if the Spouse (or Husband) of the Head of Government of the visiting country is present, Ministers, Heads or Deputy Heads of the Government Office, the Chairman of the People's Committee of Hanoi City, the accompanying officials, a Deputy Minister of Foreign Affairs, the Ambassador of Vietnam to the host country, Vietnamese officials with equivalent positions to the official members of the visiting delegation, Ambassadors and diplomatic staff of the Embassy of the visiting country.
The welcoming ceremony protocol shall be applied as stipulated in point c, Clause 2, Article 11 of this Decree.

The Ministry of Defense shall stipulate the protocol for welcoming the Minister of Defense and Chief of Defense Staff of the visiting country in accordance with international practice and Vietnam’s actual situation.
2. Welcoming Chairpersons of Committees of the National Assembly (or equivalent rank):
The Director of the Foreign Affairs Department of the National Assembly welcomes the delegation at the airport.

WELCOMING AND SEEING OFF HIGH-LEVEL DELEGATIONS FROM FOREIGN COUNTRIES FOR VISITS AND WORK
Article 18For high-level delegations from foreign countries for visits and work, the level of welcoming and seeing off at the airport, talks, banquets, and receptions is applied as for official visits; no welcoming or farewell ceremonies will be organized; at the banquet, there will be no speeches, only toasts; the city will not be decorated; the wreath-laying ceremony, visit to Ho Chi Minh Mausoleum, and wreath-laying at the Monument will be arranged according to agreement with the visiting side.
Chapter V
WELCOMING AND SEEING OFF HIGH-LEVEL DELEGATIONS FROM FOREIGN COUNTRIES FOR PERSONAL VISITS AND TRANSIT VISITS
Article 19. Welcoming Heads of State, Heads of Government, and Speakers of National Assembly.
1. Personal Visit.
The Director of the Protocol Department or the Regional Department of the Ministry of Foreign Affairs will welcome and see off the Head of State and Head of Government at the airport. There will be no formal welcoming and official meeting procedures. The President will host a social reception and invite the Head of State to a private dinner; the Prime Minister will host a social reception and invite the Head of Government to a private dinner.
The Director of the International Relations Office of the National Assembly will welcome and see off the Speaker of the National Assembly of the visiting country at the airport. There will be no formal welcoming and official meeting procedures. The Speaker of the National Assembly will host a social reception and invite the Speaker of the National Assembly of the visiting country to a private dinner.
2. Transit.
The Deputy Minister of Foreign Affairs will welcome and see off the Head of State and Head of Government at the airport. If the delegation requests to stay, we will arrange meals, accommodation, and transportation for them. If the delegation transits through a locality, the Chairman of the People's Committee of the province or centrally governed city (hereinafter referred to as provincial level) will welcome the delegation.
The Chairman or Vice-Chairman of the Foreign Affairs Committee of the National Assembly or the Chairman or Vice-Chairman of the Office of the National Assembly will welcome and see off the Speaker of the National Assembly of the visiting country at the airport. If the delegation requests to stay, we will arrange meals, accommodation, and transportation for them. If the delegation transits through a locality, the Chairman of the People's Council at the provincial level will welcome the delegation.

WELCOMING SOME OTHER DELEGATIONS
Article 22.
1. The level of welcoming the Chairman of the Senate, the Chairman of the House of Representatives, the Chairman of the World Parliamentary Union (IPU), and the Chairman of the Southeast Asian Inter-Parliamentary Organization (AIPO) shall be applied as when welcoming the Speaker of the National Assembly; the level of welcoming the Deputy Chairman of the Senate and the Deputy Chairman of the House of Representatives shall be applied as when welcoming the Deputy Speaker of the National Assembly. A 2. The level of welcoming the heir to the throne or the heir to the queen, who is a guest of the Vice-President, shall be applied as when welcoming the Deputy Head of State.
3. The leadership of the Ministry of Foreign Affairs will host and entertain other members of the Royal Family who are guests of the Ministry of Foreign Affairs. The Vice-President or Deputy Prime Minister will host a social reception if the guest wishes.
4. The leader of the ministry or sector leading the economic, cultural, and social delegation headed by a member of the Royal Family will host and entertain the delegation.
5. The level of welcoming the Secretary-General of the United Nations, who is a guest of the Minister of Foreign Affairs, shall be applied as when welcoming the Minister of Foreign Affairs.
6. The Ministry of Foreign Affairs will host and entertain former Heads of State, Heads of Government, Deputy Heads of State, and Deputy Prime Ministers of the visiting country upon invitation by the President, Prime Minister, Vice-President, or Deputy Prime Minister.
7. The National Assembly Office will host and entertain former Speakers of the National Assembly, Deputy Speakers of the National Assembly, the Secretary-General of AIPO, IPU, and inter-parliamentary organizations upon invitation by the Speaker of the National Assembly or Deputy Speaker of the National Assembly.
8. If a former Head of State, Head of Government, Speaker of the National Assembly, Deputy Head of State, Deputy Prime Minister, or Deputy Speaker of the National Assembly is invited by an agency, that agency will host the welcoming. If the guest wishes, the hosting agency will request high-level leaders to meet.

OTHER PROVISIONS ON WELCOMING AND ACCOMMODATING FOREIGN HIGH-LEVEL DELEGATIONS
Article 23. Wreath-laying ceremony, visiting Ho Chi Minh Mausoleum, and wreath-laying at the Monument.
1. For State Leaders, Heads of Government, Speakers of National Assembly, Deputy State Leaders on official visits:
At Ho Chi Minh Mausoleum, the Management Board of Ho Chi Minh Mausoleum will welcome and guide the delegation to lay wreaths and visit Ho Chi Minh Mausoleum.
At the Monument, the Management Board of Ho Chi Minh Mausoleum will welcome and guide the delegation to lay wreaths; there will be two rows of honor guards. During the moment of silence, military music will play "Recall the Souls of Soldiers".
2. For other foreign delegations from Ministerial level or equivalent on official visits: A representative of the Management Board of Ho Chi Minh Mausoleum will guide the delegation to lay wreaths and visit Ho Chi Minh Mausoleum and lay wreaths at the Monument. At the Monument, "Recall the Souls of Soldiers" music will be played.
Article 24. Accompanying personnel and position of the Ambassador of Vietnam in the host country.
1. Accompanying personnel:
One Minister or Director of the President's Office will accompany the Head of State of the guest country on official visits, working visits.
One Minister or Deputy Minister will accompany the Head of Government of the guest country on official visits, working visits.

In diplomatic activities, the position of the Ambassador of Vietnam in the host country is ranked immediately after the positions of government members.
Article 25. Flag-raising and decoration.
1. For State Leaders, Heads of Government on official visits: Flags of both countries and welcoming slogans will be hung at the airport; before the Presidential Palace gate and some points along major routes that the delegation passes through, clusters of flags of both countries and welcoming slogans in Vietnamese and the language of the guest country or English/French will be displayed; flags of both countries will be hung at the residence and on the vehicle of the head of the delegation.
For State Leaders, Heads of Government on working visits, flags of both countries will be hung at the airport, reception site, residence, and on the vehicle of the head of the delegation.
2. For Speakers of National Assembly, Deputy State Leaders on official visits, flags of both countries will be hung at the airport, reception site, residence, and on the vehicle of the head of the delegation.
3. For Deputy Prime Ministers, Deputy Speakers of National Assembly, Ministers of Foreign Affairs on official visits, working visits: flags of both countries will be hung at the reception site and on the vehicle of the head of the delegation.
4. When welcoming or seeing off State Leaders, Heads of Government, Speakers of National Assembly, and Deputy State Leaders on official visits, working visits, red carpets will be laid from the bottom of the aircraft stairs to where the vehicle of the head of the delegation is parked.
Article 26. Escort vehicles, lead vehicles.
1. The vehicle of the Head of State on an official visit will have 8 motorcycles as escorts; there will be a police car leading the way. The vehicle of the Head of Government on an official visit will have 6 motorcycles as escorts; there will be a police car leading the way. Motorcycles as escorts apply only to official activities in Hanoi and Ho Chi Minh City.
2. Delegations for working visits, personal visits, transit do not have motorcycle escorts.
3. Delegations from Ministerial level, Director of Committees of the National Assembly and above on official visits, working visits, personal visits, transit will have a police car leading the way during official activities. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).For foreign delegations at the level of Deputy Speaker of Parliament and above visiting officially, working, individually, or transiting with official activities, there shall be police escort vehicles.
Article 27. Hospitality.
Hospitality for foreign delegations visiting Vietnam shall be applied according to international practice and on a reciprocal basis. The Ministry of Finance and the Ministry of Foreign Affairs shall provide guidance on the implementation of this provision.
Article 28. Gifts.
Gifts shall be presented to the Heads of Delegations, Spouses (or Partners) of delegations for official visits, working visits, and personal visits. In special cases, gifts may also be presented to members of the delegation and accompanying officials. The gifts must be domestically produced products that reflect the national cultural identity.
Article 29. Welcoming and seeing off high-level foreign delegations arriving and departing by road, rail, or waterway.
Welcoming and seeing off high-level foreign delegations arriving by road, rail, or waterway shall be carried out similarly to those arriving by air but shall be implemented based on actual capabilities.
Article 30. Welcoming high-level foreign delegations visiting localities.
When heads of state, government leaders, or deputy heads of state from foreign countries visit localities, representatives of provincial leadership Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).shall welcome and see off the delegation at the airport if traveling by air, at the provincial border if traveling by road, and at the port if traveling by water.
When welcoming high-level foreign delegations visiting localities, it is necessary to ensure respect, thoroughness, and economy; there shall be no honor guard parade or welcoming rally organized; only flags and slogans shall be displayed at the welcoming venue if it is an official visit. A banquet or dinner reception shall be organized; on the Vietnamese side, those directly working with the delegation shall be invited; on the guest side, formal members and some accompanying officials shall be invited.
The agency responsible for welcoming the delegation shall have the responsibility to guide the locality on appropriate reception measures and programs for the delegation.
Chapter VIII
SEEING OFF AND WELCOMING OUR NATIONAL DELEGATIONS TO FOREIGN COUNTRIES
Article 31. There shall be no farewell or welcoming ceremonies for our national delegations going abroad. Representatives from the following agencies shall go to the airport to see off and welcome the delegation:
1. The Secretary-General or Deputy Secretary-General of the Central Party Office and the Director or Deputy Director of the Central Party's External Relations Department shall see off and welcome the General Secretary.
2. The Director or Deputy Director of the President's Office shall see off and welcome the President and Vice President.
3. The Minister, Director-General or Deputy Director-General of the Government Office shall see off and welcome the Prime Minister.
4. The Director or Deputy Director Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of the National Assembly's External Relations Department and the Director or Deputy Director of the National Assembly's Office shall see off and welcome the Chairman of the National Assembly.
Chapter IX
SOME CEREMONIES FOR FOREIGN DIPLOMATIC DELEGATIONS AND INTERNATIONAL ORGANIZATIONS IN HANOI
Article 32. Presentation of Credentials by Ambassadors.
1. The Ambassador shall present credentials to the President at the Presidential Palace. The ceremony shall be attended by the Director or Deputy Director of the President's Office, the Deputy Minister of Foreign Affairs, the Director of the Protocol Department, and the Director of the Regional Department of the Ministry of Foreign Affairs.
2. The Director of the Protocol Department of the Ministry of Foreign Affairs shall meet with the Ambassador to receive a copy of the credentials and introduce the ceremony for presenting credentials.
3. The Deputy Director of the Protocol Department of the Ministry of Foreign Affairs shall escort the Ambassador to present credentials. The vehicle transporting the Ambassador shall display the flags of both countries and be accompanied by four motorcycles.
Article 33. Diplomatic Visits for Presentation of Credentials and Farewell.
The Ministry of Foreign Affairs shall arrange for Ambassadors to pay a courtesy call on the Prime Minister of the Government, the Chairman of the National Assembly, the Minister of Foreign Affairs after presenting their credentials, and to bid farewell to the State President, the Prime Minister, and the Minister of Foreign Affairs before the end of their term of service in Vietnam. For visiting Ambassadors, the arrangement for courtesy calls and farewells to senior leaders shall be applied similarly to resident Ambassadors but shall depend on specific time and circumstances.
Article 34. Receptions for Heads of International Organization Missions.
The Prime Minister shall host a joint reception for the Heads of International Organization Missions in Hanoi on the occasion of United Nations Day, October 24th each year.
Other meetings shall be considered and recommended by the Ministry of Foreign Affairs and the respective agencies in charge for leadership approval.
Article 35. Attendance at National Day Receptions of Foreign Countries in Hanoi.
1. Odd and Even Years.
A Minister or Deputy Minister shall be the main guest at the National Day receptions of foreign countries in Hanoi. The main guest shall correspond to the level of the leader from the guest country attending the National Day reception of our country. The main guest shall give a short toast.
2. Even Years.
A Deputy Prime Minister or a Minister shall be the main guest at the National Day receptions of foreign countries in Hanoi. The main guest shall correspond to the level of the leader from the guest country attending the National Day reception of our country. The main guest shall give a short toast.
Article 36. Attendance at the Opening Session of the National Assembly by Diplomatic Corps and Heads of International Organization Missions in Hanoi.
Annually, invitations shall be extended to the Diplomatic Corps and Heads of International Organization Missions in Hanoi to attend the opening session of the National Assembly's sessions.
Article 37In addition to the reception arrangements with the Diplomatic Corps as stipulated in this Decree, if any agency, locality, or individual requests a meeting or invites the Diplomatic Corps to participate in activities, they must consult and reach agreement with the Ministry of Foreign Affairs.
Chapter X
IMPLEMENTING PROVISIONS
Article 38. To ensure uniform management of high-level receptions for foreign guests, the responsible agency shall arrange for guests to greet Party leaders through the Central Party's External Relations Board; greet the President and Vice Presidents of the State through the Office of the President; greet the Prime Minister and Deputy Prime Ministers through the Office of the Government; and greet the Chairmen and Vice Chairmen of the National Assembly through the Office of the National Assembly.
The Ministry of Foreign Affairs shall serve as the lead agency, coordinating with the Central Party's External Relations Board, the Office of the President, the Office of the National Assembly, and the Office of the Government to arrange for Party, State, National Assembly, and Government leaders to meet with the Diplomatic Corps and Heads of International Organization Missions in Hanoi.
Article 39.
1. The Ministry of Foreign Affairs shall take the lead and coordinate with the Ministry of Culture and Information to guide the implementation of this Decree.
2. Relevant agencies shall have the responsibility to cooperate and create favorable conditions to ensure that the organization of major anniversaries and the reception of high-level foreign guests achieve good results.
3. The organization of major anniversaries shall be carried out according to the provisions of Chapter II of this Decree. In special cases, the Government will issue specific directives. For provinces and centrally-administered cities not mentioned in this Decree, the organization of major anniversaries shall be conducted in accordance with local conditions.
Article 40. EFFECTIVE DATE
1. This Decree shall take effect fifteen days after its signing date and shall replace the relevant provisions on the commemoration of major anniversaries and the reception of foreign guests in Decree No. 186-HĐBT dated June 2, 1992 issued by the Council of Ministers on "Certain State Ceremonies and Reception of Foreign Guests."
2.
