DECREE

Regulations on teaching and learning the spoken language and writing system of ethnic minorities in general education institutions and continuing education centers These regulations stipulate the teaching and learning of the spoken language and writing system of ethnic minorities (hereinafter referred to collectively as the ethnic minority language), including: conditions, content, methods, and forms of organization for teaching; teacher training and development; and policies and benefits for teachers and learners of the ethnic minority language.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law dated June 14, 2005;

Considering the proposal of the Minister of Education and Training,

DECREE:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

These regulations apply to those teaching the ethnic minority language and ethnic minorities learning the ethnic minority language with a writing system at general education institutions and continuing education centers within the national education system. The State focuses investment and prioritizes the teaching and learning of the ethnic minority language for ethnic minorities with small populations.

Article 2. Applicability

Chapter II

CONDITIONS, CONTENT, METHODS AND FORMS OF EDUCATIONAL ORGANIZATION

VOF CONDUCTING STUDIES

Article 3. Conditions for organizing teaching and learning

1. Ethnic minorities have the desire and need to learn the ethnic minority language.

2. The script of the ethnic minority language taught and learned in schools must be the traditional script used by the community, recognized by specialized agencies, or a script that has been approved by competent authorities.

3. Programs and textbooks for the ethnic minority language are compiled and reviewed according to the provisions of the Minister of Education and Training.

4. Teachers teaching the ethnic minority language must meet the required training standards for their respective educational levels, having been trained to teach the ethnic minority language at colleges of education, universities of education, or education faculties.

5. Material resources and equipment for teaching the ethnic minority language must comply with the regulations of the Minister of Education and Training.

Article 4. Procedures for introducing the ethnic minority language into teaching and learning

1. Based on the wishes of ethnic minorities and the conditions for organizing teaching and learning of the ethnic minority language in localities, the People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial-level People's Committees) shall propose to the Ministry of Education and Training regarding the teaching and learning of the ethnic minority language in their areas.

2. The Ministry of Education and Training shall examine the conditions for teaching and learning the ethnic minority language based on the proposals of the provincial-level People's Committees; notify the conclusions in writing to the provincial-level People's Committees within thirty days from the date of receipt of the proposal for teaching and learning the ethnic minority language.

3. The provincial-level People's Committee shall issue a decision on teaching and learning the ethnic minority language in their areas.

Article 5. Content and Methods of Teaching and Learning

The content, methods, and plans for teaching and learning the ethnic minority language are specified in each specific ethnic minority language program decided by the Minister of Education and Training.

Article 6. Forms of Organization for Teaching and Learning

1. The ethnic minority language is a subject in general education institutions and continuing education centers.

2. The teaching and learning of the ethnic minority language are carried out according to the organizational forms of teaching and learning in general education institutions and continuing education centers.

Article 7. Issuance of Certificates

Issuing certificates to individuals who complete the ethnic minority language program is regulated by the Minister of Education and Training.

Chapter III

TRAINING AND DEVELOPMENT OF TEACHERS AND POLICIES AND BENEFITS

Article 8. Training and Capacity Building for Teachers

1. Teachers teaching ethnic minority languages shall be trained at training institutions assigned the task of training teachers.

2. Capacity building for teachers teaching ethnic minority languages shall be conducted in accordance with the guidelines of the Ministry of Education and Training.

Article 9. Policies and Benefits

1. Teachers teaching ethnic minority languages shall receive a duty allowance equivalent to 0.3 times the general minimum wage; this allowance shall not apply to those who have already received a duty allowance under Article 13 of Decree No. 61/2006/NĐ-CP dated June 20, 2006 of the Government on policies for educators and educational management staff working in specialized schools and areas with extremely difficult socio-economic conditions.

2. Students shall be guaranteed textbooks and reference materials in ethnic minority languages suitable for their respective categories. Students who are civil servants, public officials, or state employees shall enjoy training and capacity-building benefits for civil servants, public officials, and state employees according to regulations.

3. Each year, general education schools and continuing education centers assigned the task of teaching ethnic minority languages shall be allocated additional teacher positions corresponding to the number of ethnic minority language classes as stipulated.

Chapter IV

IMPLEMENTATION

Article 10. Ministry of Education and Training

1. Managing, directing, and inspecting the teaching and learning of ethnic minority languages.

2. Specifying specific conditions, contents, programs, methods, and organizational forms for teaching ethnic minority languages.

3. Taking the lead and coordinating with the Ministry of Home Affairs and relevant ministries and sectors in formulating and promulgating staffing norms for educational services and policies and benefits for teachers of ethnic minority languages.

Article 11. Ministry of Home Affairs

Coordinating with the Ministry of Education and Training and relevant ministries and sectors in formulating and promulgating staffing norms for educational services and policies and benefits for teachers of ethnic minority languages.

Article 12. Ministry of Finance

Taking the lead and coordinating with the Ministry of Education and Training and relevant ministries and sectors in guiding the management and use of financial resources for teaching and learning ethnic minority languages in accordance with current laws.

Article 13. Committee for Ethnic Minorities

Coordinating with relevant ministries, sectors, and localities to inspect and supervise the implementation of regulations, policies, and benefits related to teaching and learning ethnic minority languages.

Article 14. Provincial People's Committees

1. Selecting scripts and determining organizational conditions for teaching ethnic minority languages, and proposing to the Ministry of Education and Training regarding ethnic minority language teaching in localities.

2. Managing and directing the teaching and learning of ethnic minority languages in localities.

3. Annually allocating and ensuring resource and financial conditions in compliance with current regulations on budget decentralization for teaching and learning ethnic minority languages.

Chapter V

IMPLEMENTING PROVISIONS

Article 15. Effective Date

This Decree takes effect from August 31, 2010. All previous provisions contrary to this Decree are abolished.

Article 16. Responsibility for Implementation

1. The Ministry of Education and Training, the Ministry of Home Affairs, and the Ministry of Finance are responsible for guiding the implementation of the provisions of Articles 3, 4, 5, 6, 7, 8, and Article 9 of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and relevant agencies are responsible for implementing this Decree./.
