Ministry of Labor - Invalids and Social Affairs, Ministry of Finance guiding the implementation of Decision No. 142/2008/QD-TTg

on the implementation of benefits for military personnel of the Prime Minister participating in the resistance war against America to save the country with less than

20 years of servicein the military who have been demobilized and discharged back to their home regions

Pursuant to Clause 3, Article 4 of Decree No. 23/2011/NĐ-CP dated April 4, 2011 of the Government adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres (hereinafter referred to as Decree No. 23/2011/NĐ-CP);

Pursuant to Decision No. 257/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating regulations on frequency band allocation for economic and social purposes, national defense, and security;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on the implementation of benefits for military personnel participating in the resistance war against America to save the country with less than 20 years of service in the military who have been demobilized and discharged back to their home regions (hereinafter referred to as Decision No. 142/2008/QD-TTg);

Pursuant to Decision No. 38/2010/QD-TTg dated May 6, 2010 of the Prime Minister amending and supplementing Decision No. 142/2008/QD-TTg,

The Ministry of National Defense, Ministry of Labor - Invalids and Social Affairs, Ministry of Finance guide the adjustment of monthly allowances for military personnel participating in the resistance war against America to save the country with less than 20 years of service in the military who have been demobilized and discharged back to their home regions, as follows:

Article 1. Supplementing at the end of point a, Clause 1, Article 2 of Circular Jointly Issued No. 110/2010/TTLT-BQP-BLDTBXH-BTC as follows:

"-From May 1, 2011 onwards, the monthly allowance will be increased by 13.7%, specifically as follows:

+ From 15 years to under 16 years, the allowance is VND 925,079/month;

+ From 16 years to under 17 years, the allowance is VND 971,332/month;

+ From 17 years to under 18 years, the allowance is VND 1,017,586/month;

+ From 18 years to under 19 years, the allowance is VND 1,063,840/month;

+ From 19 years to under 20 years, the allowance is VND 1,110,094/month."

This Circular takes effect from July 31, 2011.

Article 2. Effective Date

1. The Ministry of National Defense shall take the lead, coordinating with the Ministry of Labor - Invalids and Social Affairs, Ministry of Finance to direct, guide, and inspect agencies, units, and localities in implementing this Circular.

Article 3. Implementation Organization

2. For those who have already received decisions on benefit allowances before the effective date of Decree No. 23/2011/NĐ-CP, the competent labor - invalids and social affairs authorities shall be responsible for adjusting the level of benefits according to the guidance in this Circular. For those currently being considered for benefits, the Ministry of National Defense shall be responsible for adjusting the level of benefits according to the guidance in this Circular.

3. During the implementation process, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the relevant ministries to examine and resolve them./.
