DECREE

Regulations on Importing and Scrapping Used Seagoing Vessels

||| Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to the Environmental Protection Law on June 23, 2014;

Pursuant to the Investment Law on November 26, 2014 and the Law Amending and Supplementing Article 6 and Appendix 4 on the List of Business Fields for Investment with Conditions of the Investment Law;

Based on the Enterprise Law dated November 26, 2014;

At the proposal of the Minister of Transport;

The Government promulgates this Decree stipulating regulations on importing and scrapping used seagoing vessels.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates the objects, conditions for permission to import used seagoing vessels for scrapping and management of activities related to scrapping used seagoing vessels in Vietnam.

2. The provisions on importing and scrapping seagoing vessels set forth in this Decree also apply to the importation and scrapping of floating storage units and mobile platforms.

Article 2. Applicability

This Decree applies to organizations and individuals both within and outside Vietnam involved in the activities of importing used seagoing vessels for scrapping and activities related to scrapping used seagoing vessels.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Scrapping seagoing vessels is the activity of dismantling the entire structure of seagoing vessels at ship scrapping facilities.

2. Ship scrapping facility is a specialized area for scrapping seagoing vessels.

3. Ship scrapping plan is a plan established by the owner of the ship scrapping facility to carry out the scrapping of each individual vessel.

Article 4. Principles for Importing and Scrapping Used Seagoing Vessels

1. The activities of importing and scrapping used seagoing vessels must ensure maritime safety, maritime security, labor safety, fire and explosion prevention safety; protect human health and the environment.

2. The scrapping of used seagoing vessels can only be carried out at ship scrapping facilities that have commenced operations in accordance with the regulations.

3. Used seagoing vessels imported for scrapping must be delivered to the ship scrapping facility within thirty days from the completion of customs procedures but not exceeding ninety days from the date the vessel arrives at the first Vietnamese port; the scrapping period of seagoing vessels shall not exceed one hundred eighty days from the start of scrapping.

4. Enterprises engaged in importing and scrapping used seagoing vessels must purchase insurance and fulfill their obligations regarding liability insurance for environmental damage related to the activities of importing and scrapping used seagoing vessels in accordance with the regulations.

Article 5. Types of Used Seagoing Vessels Permitted for Importation for Scrapping

Used seagoing vessels with hulls made of non-metallic materials are permitted for importation for scrapping, including:

1. Dry cargo ships, including: General cargo, bulk cargo, equipment cargo, wood chips, logs, grains, bagged cargo, steel cargo.

2. Container ships.

3. Ore carriers.

4. Liquid cargo ships, including: Crude oil, petroleum products, vegetable oils.

5. Gas carriers, liquefied gas carriers.

6. Roll-on/Roll-off ships, passenger ships, ocean barges, ferries.

Article 6. Regulations on Scrapping Vietnamese Seagoing Vessels and Foreign Seagoing Vessels Wrecked in Vietnam

1. The scrapping of Vietnamese seagoing vessels and foreign seagoing vessels flying flags of other countries wrecked in Vietnam shall be carried out in accordance with the provisions of Government Decree No. 05/2017/NĐ-CP dated January 16, 2017 on the handling of sunken assets on inland waterways, port waters, and border areas of Vietnam and other relevant laws.

2. In cases where foreign seagoing vessels flying flags of other countries are wrecked in Vietnam and scrapped in Vietnam, the import procedures must be carried out in accordance with the law.

Chapter II

MANAGEMENT OF ACTIVITIES AT SHIP SCRAPPING FACILITIES

Article 7. Conditions for putting ship dismantling facilities into operation

Ship dismantling facilities must meet the following conditions:

1. Having wharves and maritime channels that have been announced in accordance with the provisions of Government Decree No. 58/2017/NĐ-CP dated May 10, 2017 detailing certain articles of the Vietnam Maritime Code on managing maritime activities.

2. Meeting environmental protection conditions for ship dismantling facilities that have been used in accordance with the provisions of Government Decree No. 40/2019/NĐ-CP dated May 13, 2019 amending and supplementing certain articles of decrees detailing and guiding the implementation of the Environmental Protection Law.

3. Having human resources, procedures to control hazardous factors, harmful factors, and technical accident handling plans causing serious occupational safety and health hazards in accordance with the provisions of Government Decree No. 39/2016/NĐ-CP dated May 15, 2016 detailing the implementation of certain articles of the Labor Safety and Health Law.

4. Meeting fire prevention and firefighting safety conditions, and firefighting plans in accordance with the provisions of Government Decree No. 79/2014/NĐ-CP dated July 31, 2014 detailing the implementation of certain articles of the Fire Prevention and Fighting Law and the Law Amending and Supplementing Certain Articles of the Fire Prevention and Fighting Law.

Article 8. Competence to decide on putting ship dismantling facilities into operation

The Minister of Transport decides to put ship dismantling facilities into operation based on the proposal of the Director of the Vietnam Maritime Administration.

Article 9. Procedures for deciding on putting ship dismantling facilities into operation

1. The owner of the ship dismantling facility submits directly to the Vietnam Maritime Administration or sends through the postal service or electronic portal or by other appropriate means one set of application documents for putting the ship dismantling facility into operation.

2. The application documents for putting the ship dismantling facility into operation include:

a) A request document for putting the ship dismantling facility into operation according to Model No. 01 prescribed in the Appendix issued together with this Decree (one copy);

b) Decision approving the accompanying Environmental Impact Assessment Report of the ship dismantling facility owner (one certified copy or one copy accompanied by the original for verification);

c) Environmental management system documentation according to national standard TCVN ISO 14001 (one certified copy or one copy accompanied by the original for verification);

d) Completion documents of material and technical infrastructure for environmental protection (one original or one certified copy);

đ) Procedures to control hazardous factors, harmful factors, and technical accident handling plans causing serious occupational safety and health hazards (one original or one certified copy);

e) Fire prevention and fighting inspection and acceptance documents from the Fire Prevention and Fighting Police Department (one certified copy or one copy accompanied by the original for verification).

3. Procedure for receiving and processing the dossier:

a) The Vietnam Maritime Administration receives the application documents, if the documents are not valid, it guides the ship dismantling facility owner to complete the documents in accordance with this Decree;

b) Within three working days from the date of receiving complete and valid documents, the Vietnam Maritime Administration reviews and reports in writing to the Ministry of Transport about the review results of the documents. During the review process, the Vietnam Maritime Administration may conduct activities such as surveying and verifying information and data about the material infrastructure of the ship dismantling facility;

c) At the latest two working days from the date of receipt of the request document from the Vietnam Maritime Administration, the Ministry of Transport issues a decision to put the ship dismantling facility into operation according to Model No. 02 prescribed in the Appendix issued together with this Decree; in case of non-approval, a reply document with reasons must be provided.

Article 10. Procedure for Re-Deciding to Put Ship Recycling Facilities Back into Operation

1. Re-decision to put ship dismantling facilities into operation when changing contents recorded in the Decision already issued.

2. The owner of ship recycling facilities shall submit to the Vietnam Maritime Administration a request for reissuing the Decision on Putting Ship Recycling Facilities Back into Operation according to Form No. 03 stipulated in the Appendix accompanying this Decree (one original copy) and related documents concerning the changed content (one certified copy or one copy accompanied by the original for comparison).

3. The procedure for receiving and processing the file shall be carried out in accordance with Clause 3 of Article 9 of this Decree.

Article 11. Decision to Immediately Cease Operations of Ship Recycling Facilities

1. The Ministry of Transport decides to immediately cease operations of the facility in cases where ship recycling facilities cause serious accidents or incidents affecting people and the environment, based on the proposal of competent state agencies.

2. Based on the recommendations and suggestions of competent state agencies, within one working day from the date of receipt of the request, the Ministry of Transport will consider and decide to cease operations of ship recycling facilities.

3. The Ministry of Transport shall notify relevant agencies and publish the decision to immediately cease operations of ship recycling facilities on the Ministry of Transport's electronic portal.

Article 12. Decision to Cease Operations of Shipbreaking Facilities

1. The Ministry of Transport decides to cease operations of ship recycling facilities in the following cases based on the proposal of competent state agencies:

a) Ship recycling facilities do not meet the operating conditions prescribed in Article 7 of this Decree;

b) For reasons of ensuring national defense and security;

c) In case of epidemics, natural disasters, catastrophes, and other cases as prescribed by law.

2. Based on the recommendations and suggestions of competent state agencies, within five working days from the date of receipt of the request, the Ministry of Transport will consider and decide to cease operations of ship recycling facilities; if it does not cease operations of used ship recycling facilities, the Ministry of Transport must provide a written response stating the reasons.

3. The Ministry of Transport shall notify relevant agencies and publish the decision to cease operations of ship recycling facilities on the Ministry of Transport's electronic portal.

Article 13. Ship Recycling Plan

1. Prior to commencing the dismantling of each ship, the owner of ship recycling facilities must establish and approve the ship recycling plan in accordance with Clause 2 of this Article.

2. The ship recycling plan includes the following main contents:

a) General information: Name and address of the enterprise importing used ships for dismantling; name and address of the ship recycling facility; ship to be dismantled (ship name, nationality; technical characteristics of the ship);

b) Dismantling information: Dismantling technology process (order of ship sections to be dismantled accompanied by general layout drawings of the ship to be dismantled, position drawings of the ship within the overall site of the ship recycling facility); equipment, manpower for dismantling; start and completion dates of dismantling;

c) Measures regarding: Labor safety, environmental hygiene; fire prevention, explosion prevention, and environmental pollution prevention.

Article 14. Authority and Procedure for Approving Ship Recycling Plans

1. The maritime port authority where the ship recycling facility is located has the authority to approve the ship recycling plan based on the application of the ship recycling facility.

2. The owner of ship recycling facilities shall submit to the maritime port authority one set of application files for approval of the dismantling plan for each ship.

Application files for approval of the dismantling plan for each ship include:

a) Request for approval of the ship recycling plan according to Form No. 04 stipulated in the Appendix accompanying this Decree (one original copy);

b) Ship recycling plan (one original copy).

3. Processing procedure:

a) Within two working days from the date of receipt of valid files, the maritime port authority area shall be responsible for soliciting opinions from relevant agencies on the ship recycling plan.

Within five working days from the date of receipt of the request for opinion from the maritime port authority area, relevant agencies must provide written responses.

b) Within three working days from the date of receipt of opinions from relevant agencies, the maritime port authority area must issue a decision to approve the ship recycling plan according to Form No. 05 stipulated in the Appendix accompanying this Decree and send it to the ship recycling facility; if it does not approve, the maritime port authority area must provide a written response stating the reasons.

Article 15. Implementation of the ship dismantling plan

1. The owner of the ship dismantling facility must carry out ship dismantling in accordance with the approved ship dismantling plan.

2. The maritime port service area shall take the lead and coordinate with relevant agencies to organize inspections and supervision of the implementation of the dismantling plan for each ship in accordance with the provisions of the law.

Chapter III

IMPORT OF USED SHIPS FOR DISMANTLING

Article 16. Conditions for importing used ships for dismantling

1. Enterprises importing used ships for dismantling must meet the following conditions:

a) It is a Vietnamese enterprise held 100% by Vietnamese organizations or individuals;

b) It is the owner or manager of the ship dismantling facility that has been put into operation in accordance with the provisions of the law.

2. Used ships imported for dismantling must meet the following conditions:

a) Belonging to one of the cases prescribed in Article 5 of this Decree;

b) The ship owner must provide a confirmation document and be responsible for committing that the ship is not in a mortgage or maritime dispute status;

c) They may not be converted, upgraded, changed in purpose, or transferred, sold, or resold.

Article 17. Procedures for purchasing used ships for dismantling

1. The purchase of used ships for dismantling using state capital shall be carried out according to the following procedures:

a) Selecting ships, estimating the purchase price and related transaction costs;

b) Preparing, reviewing, and approving the project for purchasing used ships for dismantling.

The ship purchase project includes contents on the necessity of investment, type of ship, quantity, basic technical specifications of the ship, estimated ship price, source of ship purchase funds, form of ship purchase, economic and environmental benefits;

c) Deciding to purchase used ships for dismantling.

2. The purchase of used ships for dismantling using other capital shall be decided by enterprises, organizations, or individuals themselves.

Article 18. Authority to decide on purchasing used ships for dismantling

The authority to decide on projects for purchasing used ships for dismantling shall be implemented in accordance with the provisions of the law on investment.

Article 19. Procedures for issuing an Import Permit for used ships for dismantling

1. Application documents include:

a) A request for issuing an Import Permit for used ships for dismantling in the format specified in Appendix 6 issued together with this Decree (one original copy);

b) Decision on putting the ship dismantling facility into operation (one certified copy or one copy with the original for comparison);

c) Enterprise decision on purchasing used ships for dismantling (one certified copy or one copy with the original for comparison).

2. Processing procedure:

a) The Vietnam Maritime Administration receives and checks the application documents; if the documents are incomplete, it guides the enterprise to complete the documents in accordance with regulations;

b) Within three working days from the date of receiving all required documents, the Vietnam Maritime Administration reviews and reports to the Ministry of Transport for consideration and decision;

c) Within two working days from the date of receipt of the Vietnam Maritime Administration's request, the Ministry of Transport issues an Import Permit for used ships for dismantling in the format specified in Appendix 7 issued together with this Decree; in case of refusal to issue the Import Permit for used ships for dismantling, the Ministry of Transport must provide a written response stating the reasons.

Article 20. Procedures for Importing Used Ships for Recycling

1. When handling procedures for importing used ships for recycling, enterprises must submit to the customs authority in the relevant area one set of documents, including:

a) A permit for importing used ships for recycling (one certified copy or one copy with the original for comparison);

b) The enterprise's decision on purchasing used ships for recycling (one certified copy or one copy with the original for comparison);

c) The purchase and sale contract for used ships for recycling (one certified copy or one copy with the original for comparison);

d) The handover record of used ships signed between the transferor and transferee (one certified copy or one copy with the original for comparison).

2. Based on the import documents specified in Clause 1 of this Article, the regulations of the Customs Law and other related laws, the customs authority shall be responsible for handling the import procedures for used ships for recycling.

Chapter IV

IMPLEMENTING PROVISIONS

Article 21. Responsibility for Implementation

1. The Ministry of Transport is responsible for organizing state management over the importation and recycling of used ships; leading and coordinating with relevant ministries, sectors, and provincial/municipal people's committees under central jurisdiction to implement this Decree.

2. The Ministry of Natural Resources and Environment is responsible for organizing state management over environmental protection in ship recycling activities according to the law; leading and coordinating with relevant ministries and sectors to guide insurance for environmental damage compensation; reviewing and perfecting legal provisions on environmental protection in ship importation and recycling activities and other waterborne vessels in Vietnam.

3. The Ministry of Finance is responsible for leading and coordinating with relevant ministries and sectors to guide the implementation of taxes, fees, and charges related to the importation of used ships for recycling and customs procedures for imported used ships for recycling.

4. Ministries and provincial/municipal people's committees under central jurisdiction shall organize state management over the importation and recycling of ships based on their functions, tasks, and authorities as prescribed.

5. Owners of ship recycling facilities have the responsibility to strictly comply with the provisions of this Decree; when carrying out the dismantling of other types of waterborne vessels, they must comply with environmental protection laws and other relevant laws applicable to production, business, and service establishments.

Article 22. Effective Date

1. This Decree takes effect from December 30, 2019, and replaces Government Decree No. 114/2014/NĐ-CP dated November 26, 2014, which stipulates the objects and conditions permitted to import and recycle used ships.

2. Abolish the provisions at Article 4 of Government Decree No. 147/2018/NĐ-CP dated October 24, 2018, which amends and supplements certain articles of decrees regulating business conditions in the maritime sector.

3. In cases where the legal normative documents cited in this Decree are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replaced legal normative documents.

Article 23. Implementation Organization

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial/municipal people's committees under central jurisdiction, organizations, units, and individuals concerned are responsible for implementing this Decree./.

Article 2. The Maritime Port Control Authority shall have the following responsibilities:

  1. To manage the specialized maritime sector within port areas and collect fees and charges as prescribed by law.

Based on the actual conditions of the shipbreaking facility, water depth limits, channel depths at ports, and relevant legal provisions, it permits ships with appropriate technical specifications to enter for dismantling, ensuring maritime safety, maritime security, and environmental pollution prevention.

Article 3. Shipbreaking facilities shall organize and implement dismantling activities in accordance with this Decision and other relevant legal provisions to ensure they are carried out for their intended purpose, guaranteeing maritime safety, maritime security, labor safety, fire prevention and control, and protection of human health and the environment.

Article 4. Relevant state management agencies shall organize and implement professional activities according to their assigned responsibilities based on this Decision and other relevant legal provisions.
