Decree No. 83/2024/ND-CP amends and supplements some articles of Decree No. 123/2016/ND-CP dated September 1, 2016, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies which have been amended and supplemented by some articles according to Decree No. 101/2020/ND-CP dated August 28, 2020, of the Government; Decree No. 10/2016/ND-CP dated February 1, 2016, of the Government stipulating agencies under the Government which have been amended and supplemented by some articles according to Decree No. 47/2019/ND-CP dated June 5, 2019, of the Government and Decree No. 120/2020/ND-CP dated October 7, 2020, of the Government stipulating the establishment, restructuring, and dissolution of public service units.

Article 1. Amend and supplement some articles of Decree number 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating functions, tasks, duties and organizational structure of Ministries and ministerial-level agencies which have been amended and supplemented with some articles pursuant to Decree number 101/2020/NĐ-CP dated August 28

Pursuant to the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration Organization dated November 22, 2019;

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

At the request of the Minister of Home Affairs,

Article 1. Amend and supplement some articles of Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies which have been amended and supplemented by some articles pursuant to Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government; Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government stipulating agencies under the Government which have been amended and supplemented by some articles pursuant to Decree No. 47/2019/NĐ-CP dated June 5, 2019 of the Government and Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating establishment, reorganization, and dissolution of public service organizations.

Article 1. Amend and supplement some articles of Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies which have been amended and supplemented some articles according to Decree No. 101/2020/NĐ-CP dated August 28

1. Supplement Point c to Clause 2 Article 18b added at Clause 7 Article 1 of Decree No. 101/2020/NĐ-CP as follows:

"c) The Minister or Head of a ministry-level agency decides or delegates the decision on the number of deputy heads of the head of a branch office, ensuring an average of not more than three people per branch office when the branch office meets one of the following criteria:

Implementing administrative procedures 24/7 according to the law, must arrange civil servants (including the head of the branch office) to work in three shifts per day and be allocated at least 60 civil servant positions;

Managing a regional area spanning multiple provinces or districts and having nine departments or equivalent organizations within the organizational structure of the branch office as prescribed by law;"

2. Amend Points a and b Clause 5 Article 22 of Decree No. 123/2016/NĐ-CP which has been amended and supplemented at Clause 12 Article 1 of Decree No. 101/2020/NĐ-CP as follows:

"a) A department under a general administration with 15 to 20 civil servant positions, an inspection body, or an office under a general administration with less than four organizations may be arranged with no more than two deputy heads;

b) A department under a general administration with more than 20 civil servant positions; an inspection body or an office under a general administration with four or more organizations, the Minister or Head of a ministry-level agency shall decide the number of deputy heads for each unit, ensuring an average of not more than three people per unit;"

Article 2. Amend and supplement Point a Clause 6 Article 4 of Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government stipulating agencies under the Government which have been amended and supplemented at Clause 2 Article 1 of Decree No. 47/2019/NĐ-CP dated June 5, 2019 of the Government

"a) A board and office with 15 to 20 staff members who are civil servants or officials may be arranged with no more than two deputy heads; a board or office with more than 20 staff members who are civil servants or officials, the Head of an agency under the Government shall decide the number of deputy heads for each unit, ensuring an average of not more than three people per unit;"

Article 3. Amend and supplement Point c Clause 2 Article 6 Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, reorganization, and dissolution of public service units.

"c) For public service units that self-finance part of their regular expenses, and public service units whose regular expenses are fully covered by the state budget:

The number of deputy positions in units within the organizational structure of ministries and ministerial-level agencies shall not exceed three persons per unit.

Units specified in Point a Clause 1 (excluding units within the organizational structure of ministries and ministerial-level agencies), Clause 2, and Point a Clause 4 of Article 2 of this Decree with twenty or fewer staff members being civil servants shall be allocated no more than two deputy positions; those with more than twenty staff members being civil servants shall be allocated no more than three deputy positions.

Units specified in Points b, c, d, đ Clause 1, Clause 3, Points b, c, d Clause 4, and Clause 5 of Article 2 of this Decree shall be allocated no more than two deputy positions. For hospitals of Class I or higher; public health service units performing disease surveillance and prevention tasks at provincial level of Class I or higher; general education schools with multiple levels and a scale of forty classes or more, no more than three deputy positions may be allocated."

Article 4. Implementation provisions

1. This Decree takes effect from September 1, 2024.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and related agencies, organizations, and individuals are responsible for implementing this Decree.
