- In cases where the mother has a husband or child who joined enemy forces but the mother has strictly followed the policies and guidelines of the Party and State, and there is unanimous agreement from all levels of government to recommend her for the award, and there are no complaints, accusations, suggestions, or reflections from the public, or if there are complaints, accusations, suggestions, or reflections but they have been concluded by competent authorities as being incorrect, she will still be considered for the award of the National Honor Title "Mother Vietnam Heroine".

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE DECREE NO. 56/2013/NĐ-CP OF MAY 22, 2013 ISSUED BY THE GOVERNMENT PROVIDING GUIDELINES FOR IMPLEMENTATION OF LEGAL PROVISIONS ON THE NATIONAL HONOR TITLE "MOTHER HEROINE OF VIETNAM"
On the basis of Law on Government Organization dated February 18, 2025;
On the basis of Law on Residence dated November 13, 2020;
On the basis of 奖励和表彰法 Pursuant to the Law on Forces Participating in Ensuring National Security and Public Order at the Grassroots Level dated November 28, 2023;
On the basis of Identity Card Law November 27, 2023;
On the basis of Ordinance on the National Honor Title "Mother Heroine of Vietnam" August 29, 1994; Ordinance amending and supplementing certain articles of the Ordinance on the National Honor Title "Mother Heroine of Vietnam" October 20, 2012;

THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. 56/2013/NĐ-CP May 22, 2013 of the Government providing detailed guidelines for implementation Ordinance on the National Honor Title "Mother Heroine of Vietnam".
Article 1. Amends and supplements certain articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 issued by the Government providing detailed guidelines for implementation of the Ordinance on the National Honor Title "Mother Heroine of Vietnam"
1. Amends and supplements the last paragraph of Clause 1, Article 2 as follows:
"In cases where a mother has a husband or child who joined the enemy forces but the mother strictly adheres to the Party's and State's policies, and there is unanimous agreement from all levels of government regarding the presentation or posthumous presentation of the title, and there are no complaints, accusations, suggestions, or reflections from the public, or if there are such complaints, accusations, suggestions, or reflections but they have been concluded by competent authorities as being incorrect, then she will still be considered for the presentation or posthumous presentation of the National Honor Title "Mother Heroine of Vietnam"."
2. Amends and supplements Clause 2 and Clause 5 of Article 3 as follows:
a) Amend and supplement Clause 2 as follows:
"2. A mother who is posthumously awarded the National Honor Title "Mother Heroine of Vietnam" shall receive the Certificate and Medal "Mother Heroine of Vietnam" and other benefits in accordance with the laws on commendation and rewards and the laws on preferential treatment for those who have contributed to the revolution."
b) Amend and supplement Clause 5 as follows:
"5. The budget for organizing the ceremony for presenting or posthumously presenting the National Honor Title "Mother Heroine of Vietnam" shall not exceed one month's basic salary for one case; the funeral expenses for "Mother Heroine of Vietnam" shall not exceed two months' basic salary for one case."
3. Amend and supplement Article 4 as follows:
Article 4. Application dossier for presentation or posthumous presentation
1. Application dossier for presentation or posthumous presentation includes:
a) An application form for awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 01/BMVNAH attached to this Decree or an application form for posthumously awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 02/BMVNAH attached to this Decree;
b) A certified copy of the "National Commendation Certificate", a certified copy of the War Invalid Certificate, depending on the type of presentation or posthumous presentation as stipulated in Clause 1, Article 2 of this Decree;
c) Other related documents (if any).
2. Submission dossier for presentation or posthumous presentation includes:
a) A proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 05/BMVNAH attached to this Decree and a list of applications for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 06/BMVNAH attached to this Decree;
b) A record of the results of publicly posting the proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 03/BMVNAH attached to this Decree (if applicable); a record of the review of the proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" according to Model No. 04/BMVNAH attached to this Decree;
c) Documents specified in Clause 1 of this Article.
4. Amends and supplements some clauses and points in Article 5 as follows:
a) Amend and supplement Clause 1 as follows:
"1. The mother or person responsible for the mother's worship shall prepare one application dossier for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" in accordance with Clause 1, Article 4 of this Decree and submit it to the People's Committee of the commune where the mother resides or where she registered her permanent residence or place of residence when alive."
b) Amending and supplementing Point b Clause 2 as follows:
"b) Sign the proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" along with the list of applications for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" and one dossier for each case to be submitted to the Chairman of the People's Committee of the district."
c) Adds point c after point b of Clause 2 as follows:
"c) In cases where a mother has a husband or child who joined the enemy forces, upon receiving the required documents, the People's Committee of the commune shall be responsible for publicly posting the list (information about the mother) and the process of joining the enemy forces by the husband or child of the mother at the village or commune where the mother resides or where she registered her permanent residence or place of residence when alive; the minimum posting period is 40 days; announce on local mass media to seek public opinion; prepare a record of the results of the public posting according to Model No. 03/BMVNAH attached to this Decree. After obtaining the results of the public posting, proceed according to the provisions of points a and b of this clause within 10 working days."
d) Amends and supplements point b of Clause 3 as follows:
"b) Sign the proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" along with the list of applications for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" and one dossier for each case to be submitted to the Chairman of the People's Committee of the province."
đ) Amends and supplements point b of Clause 4 as follows:
"b) Sign the proposal for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" along with the list of applications for awarding or posthumously awarding the National Honor Title "Mother Heroine of Vietnam" and one dossier for each case accompanied by electronic files of the dossier to be submitted."
5. Amend and supplement Point a of Clause 1, Article 7 as follows:
"a) Direct and guide the presentation or posthumous presentation of the National Honor Title "Mother Heroine of Vietnam";"
Article 2. Supplement, replace some forms attached to the Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic"; abolish some provisions of Decree No. 56/2013/NĐ-CP.
1. Supplement Form No. 03/BMVNAH and Form No. 05/BMVNAH attached to this Decree.
2. Replace Form No. 01a/BMAH, Form No. 01b/BMAH, Form No. 03/BMAH, and Form No. 04/BMAH attached to Decree No. 56/2013/NĐ-CP with Form No. 01/BMVNAH, Form No. 02/BMVNAH, Form No. 04/BMVNAH, and Form No. 06/BMVNAH attached to this Decree.
3. Abolish Point a Clause 6 Article 5 and Form No. 02/BMAH attached to Decree No. 56/2013/NĐ-CP.
Article 3. Transitional Provisions
In cases where the application dossier for awarding or posthumously awarding the State Honorary Title "Mother Vietnam Heroic" has been received by the People's Committee of the commune before the effective date of this Decree, it shall be implemented according to the provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government.
Article 4. Effective date
This Decree takes effect from the date of issuance.
Article 5. Responsibilities for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and municipal people's committees directly under the central government shall be responsible for enforcing this Decree./.
