when violating management and operation of the level of allowances and subsidies

and preferential regimes for persons who have contributed to the revolution

 

Government Decree No. 75/2021/NĐ-CP dated 24 the 7 day1 of the Government stipulating the level of allowances and subsidies and preferential regimes for persons who have contributed to the revolution, effective from September 15, 2021, amended and supplemented by:

Government Decree No. 55/2023/NĐ-CP on 21 the 7 the year 2023 by the Government amending and supplementing some articles of Decree No. 75/2021/NĐ-CP dated 24 the 7 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;21 of the Government stipulating the level of allowances and subsidies and preferential regimes for persons who have contributed to the revolution, effective from the date 05 September 2023.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

On the basis of Ordinance on Preferential Treatment for Persons Who Have Contributed to the Revolution dated December 9, 2020;

Chapter 1. Scope of Regulation the level of allowances and subsidies and preferential regimes for persons who have contributed to the revolution[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation[2]

This Decree stipulates the levels of allowances and preferential subsidies for persons who have contributed to the revolution, relatives of such persons, and preferential regimes for persons who have contributed to the revolution funded from the central budget, implemented according to the Ordinance on Preferential Treatment for Persons Who Have Contributed to the Revolution allocated in the annual regular state budget estimate of the Ministry of Labor - Invalids and Social Affairs, the Ministry of National Defense, and the Ministry of Public Security.

Article 2. Applicability

Recipient applied in accordance with regulations at Article 2 Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 by the Standing Committee of the National Assembly, Session XIV on Preferential Treatment for Persons Who Have Contributed to the Revolution.

Chapter II. LEVELS OF ALLOWANCES AND SUBSIDIES

Article 3. Standard allowance preferential[3]

1. Standard allowance preferential for persons who have contributed to the revolution are 2.055VND 1,000,000 (hereinafter referred to as the standard level).

2. The standard level prescribed in Clause 1 of this Article serves as the basis for calculating the level of allowances and subsidies and preferential regimes for persons who have contributed to the revolution and their relatives. The levels specified according to the standard level in this Decree shall be adjusted when the standard level is adjusted and rounded to the nearest thousand dong.

Article 4. Level of allowances and preferential subsidies[4]

1. Level entitlement monthly allowances and subsidies for persons who have contributed to the revolution and relatives of such persons amended and supplemented by Law No. 87/2025/QH15; prescribed in the Appendix I issued together with this Decree.

2. Level entitlement allowance preferential monthly for war invalids and persons treated like war invalids is prescribed in Appendix II issued together with this Decree.

3. The level of preferential monthly allowance for Class B war invalids is prescribed in Appendix III issued together with this Decree.

4. The level of one-time preferential allowance for persons who have contributed to the revolution and their relatives is prescribed in Appendix IV issued together with this Decree. In cases where the one-time allowance is calculated based on years of service, after rounding up the number of years of participation in the resistance war, any remaining months will be rounded up according to the principle: from six months to less than twelve months is counted as one year, and less than six months is counted as six months. In cases where the start date of the resistance war cannot be determined, it will be counted from July 1 of that year. PREFERENTIAL REGIMES FOR PERSONS WHO HAVE CONTRIBUTED TO THE REVOLUTION

Chapter III. Article 5. Health insurance

1. The subsidy amount for attending preschool education institutions: 0.2 times the standard level/01 beneficiary/01 year.

2. The subsidy amount for attending general education institutions, continuing education institutions, preparatory universities, specialized schools, classes for persons with disabilities: 0.4 times the standard level/01 beneficiary/01 year.

3. The subsidy amount for attending boarding schools for ethnic minorities, vocational education institutions, higher education institutions: 0.4 times the standard level/01 beneficiary/01 year.

Article 9. Support for visiting烈士墓地

1. Financial support for travel and meals for the relatives of martyrs (Maximum 03 people) or those who worship martyrs once a year measures to visit and Law No. 47/2024/QH15 martyrs.

2. The amount of financial support for travel and meals is calculated based on the distance from the place of residence to the location of the martyr's grave: 3VND 3,000/km/person.

Article 10. Support for relocating the remains of martyrs

1. Relatives of martyrs, persons authorized by relatives of martyrs, those who worship martyrs shall be supported financially once when relocating the remains of martyrs:

a) The amount of support for exhuming the remains of martyrs: VND 4,000,000/per set of remains;

b) The amount of support for travel and meals (maximum 03 people) calculation according to distance from the place of residence to the location of the martyr's grave: VND 3,000/km/person.

2. Relatives of martyrs or those who worship martyrs who do not wish to bury the remains of martyrs in martyrs' cemeteries then shall be supported financially once for building a grave for martyrs. The amount of support VND 10,000,000/01 grave.

Article 11. Support for martyrs' graves maintenance work, memorials for martyrs

1. Support for constructing new martyrs' graves including memorial stones inscribed with the names of martyrs: maximum VND 10,000,000/01 grave (not associated with construction projects to build or upgrade cemeteries); support for renovating, upgrading, repairing, maintaining martyrs' graves including memorial stones inscribed with the names of martyrs: maximum equal to 70% of the cost of new construction.

Support for renovating, upgrading, repairing, maintaining martyrs' memorials, martyrs' temples, houses inscribed with the names of martyrs: the central budget will support a maximum of VND 150 billion for provincial-level projects; VND 10 billion for district-level projects; VND 2 billion for commune-level projects, where the central budget supports localities according to the principle:

7.[13] of revolutionary contributors

Reimbursement based on invoices, including passenger transport tickets for public transportation, lawful receipts or receipts according to the law; the ticket price does not include other service costs such as sightseeing tours, special services upon request; for air travel, the reimbursement is capped at the standard economy class fare and baggage fees (if the ticket does not include baggage fees) according to the baggage rate of the trip and weight but not exceeding the usual baggage allowance of other types of tickets; meal allowance of 100,000 VND/person/trip.

In cases where the support recipient is provided through a lump-sum method, they will be supported at a rate of 3,000 VND/km/person based on the distance traveled, but not exceeding 5,000,000 VND/per recipient and their relatives/year.

5. Workers at care facilities who serve persons with meritorious service for treatment at medical examination and treatment facilities, disability assessment, and visiting family members shall be reimbursed travel expenses according to current regulations.

6. Supportfor accompanying relatives of persons with meritorious service: implemented according to current domestic hospitality expense regulations. visiting revolutionary merit holders being cared for at care facilities (Support maximum: three people/01 beneficiary/01 time, two times/year, three days/time): Implement according to the current level of domestic guest reception expenses and ensure legal invoices and expenditure receipts.

10. Material support serving for care, rehabilitation, and welcoming revolutionary merit holders:

a)[14] Support for renovation, upgrading, repair, and maintenance of material infrastructure according to projects or economic technical reports approved by competent authorities. The maximum support shall not exceed 15 billion VND per project, including a maximum of 100% of the project value for care and rehabilitation facilities managed by central and local authorities that have not yet achieved budget self-balancing, and a maximum of 70% of the total project value approved by competent authorities for care and rehabilitation facilities managed by local authorities that have achieved budget self-balancing.

b) Support for purchasing equipment, means, tools, and utensils up to 15 million VND/01 per beneficiary/year, and not exceeding 1.5 billion VND/year for care facilities; up to 25 million VND/per rehabilitation bed/year, and not exceeding 2.5 billion VND for rehabilitation and welcoming facilities for revolutionary merit holders.

11.[15] Gift regulations for care facilities for revolutionary merit holders, revolutionary merit holders, and families of revolutionary merit holders:

b) Article 24Gift for revolutionary merit holders and their relatives: Expense level 500,000 VND/person;

c) In case of hosting a friendly meal for the delegation of revolutionary merit holders: implement according to the current regulations on domestic guest reception expenses.for a friendly meal with a delegation of persons with meritorious service: carried out according to current domestic hospitality expense regulations.

 

Chapter IV. IMPLEMENTATION AND EFFECTIVE PROVISIONS[16]

Article 14. Implementation Organization

1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Information and Communications and relevant ministries and agencies to organize propaganda on the work of revolutionary merit holders.

2. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Finance to guide the implementation of allowances, subsidies, and preferential policies for revolutionary merit holders to ensure correct target groups, full coverage, timely payment, and compliance with current regulations.

3. The Ministry of Labor, Invalids, and Social Affairs authorizes the Departments of Labor, Invalids, and Social Affairs to perform the central budget tasks at the local level.

4.[17] Allocate management costs equal to 1.7% of the total funds from the central budget to implement the Ordinance on Preferential Treatment for Revolutionary Merit Holders in the annual state budget estimate (excluding funding for care facilities, rehabilitation facilities, and expenses for烈士公祭和烈属接待的赠品:每人费用500,000越南盾;.

Article 15. Effectiveness

This Decree takes effect from September 15, 2021.

2. The provisions stipulated in Article 4, 5, and 12 of this Decreeshall be implemented from July 1, 2021.Effective from July 1, 2021.

The provisions stipulated in Article 6, 7, 8, 9, 10, 11 and 13 of this Decree shall be implemented from January 1, 2022.

The corresponding systems stipulated in this clause currently implemented under Decree No. 58/2019/NĐ-CP dated July 1, 2019 of the Government on the levels of allowances and preferential subsidies for revolutionary merit holders, Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of some articles of the Ordinance on Preferential Treatment for Revolutionary Merit Holders, and other related documents shall continue to be implemented until December 31, 2021.

4. Decree No. 58/2019/NĐ-CP of the Government dated July 1, 2019 on the levels of allowances and preferential subsidies for revolutionary merit holders shall cease to be effective from the date this Decree takes effect, except for the systems stipulated in Clause 3 of this Article.

5. Persons injured belonging to one of the cases stipulated inArticle 23 of Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 of the Standing Committee of the National Assembly of the Fourteenth Term on Preferential Treatment for Persons with Meritorious Service to the Revolution who have a percentage of bodily impairment from 5% to 20% shall be entitled to receive a one-time preferential allowance as prescribed in Appendix VI attached to this Decree.Minister of Labor, Invalids and Social Affairs, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities

[1] Decree No. 55/2023/ND-CP dated July 21, 2023 of the Government amending and supplementing certain articles of Government Decree No. 75/2021/NĐ-CP dated July 24 2021 of the Government stipulating the level of allowances, subsidies, and preferential policies for persons with meritorious service to the revolution (hereinafter referred to as Decree No. 55/2023/ND-CP), which takes effect from September 5, 2023, is based on the following grounds:

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

On the basis of Ordinance on Preferential Treatment for Persons Who Have Contributed to the Revolution dated December 9, 2020;

THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. 75/2021/NĐ-CP dated July 24 2021 of the Government stipulating the level of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution.”.

[2] This is amended and supplemented according to the provisions of Clause 1 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[3] This is amended and supplemented according to the provisions of Clause 2 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[4] This is amended and supplemented according to the provisions of Clause 3 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[5] This point is amended according to the provisions of Point a Clause 4 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[6] This Clause is amended according to the provisions of Point The Standing Office of the Council for International Cooperation on Non-Governmental Organizations (Vietnam Friendship Association) is the agency responsible for receiving registration dossiers, leading, and coordinating with member agencies of the Council to examine dossiers and return results of reviews of registration dossiers of foreign non-governmental organizations in Vietnam. Clause 4 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[7] This Clause is amended according to the provisions of Point of Clause 4 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[8] Amount This is amended and supplemented according to the provisions of Point d Clause 4 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[9] This Clause is amended according to the provisions of Point đ Clause 4 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[10] Currency Exchange Agent No. 1 This is amended and supplemented according to the provisions of Point a Clause 5 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[11] This Clause is amended and supplemented according to the provisions of Point b Clause 5 Article 1 provisions of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[12] This Clause is dated January 25, according to the provisions of Point c Clause 5 Article 1 provisions of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[13] Amount This is amended and supplemented according to the provisions of Point d Clause 5 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[14] Currency Exchange Agent No. 1 This is amended and supplemented according to the provisions of Point đ Clause 5 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[15] This Clause is amended pursuant to the provision at Point e Clause 5 Article 1 of Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023.

[16] Article 2 and Article 3 of Government Decree No. 55/2023/NĐ-CP dated July 21, 2023 issued by the Government, taking effect from September 5, 2023 is stipulated as follows:

Article 2. Implementation clause

1. This Decree takes effect from September 5, 2023.

2. The level of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution as prescribed in Appendices I, II, III, and IV attached hereto and the level of allowances prescribed in Article 8, Appendix VI attached to Decree No. 75/2021/NĐ-CP dated July 24, 2021 of the Government on levels of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution shall be implemented according to the standards set forth in this Decree and shall take effect from July 1, 2023.

3. The level of expenses for recuperation benefits as prescribed in Article 6 of Decree No. 75/2021/NĐ-CP dated July 24, 2021 of the Government on levels of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution shall be implemented according to the standards set forth in this Decree and shall take effect from January 1, 2024.

4. Cases prescribed in Clause 5 Article 184 of Decree No. 131/2021/NĐ-CP dated December 30, 2021 of the Government detailing and providing implementation measures for the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution shall be supported with medicine, treatment, and health recovery allowances; welfare homes under the management of the Ministry of Labor, Invalids, and Social Affairs shall be supported in caring for these cases. The content and level of support shall be implemented according to the provisions of Clauses 4 and 5 Article 13 of this Decree. This Clause is amended and supplemented according to the provisions of Clause 6 Article 1 of Decree No.
