PRIME MINISTER
Pursuant to the Land Law dated July 14, 1993 and the Law Amending and Supplementing Certain Provisions of the Land Law dated December 2, 1998;
Considering the proposal of the People's Committee of Haiphong City (document number 38/TT-UB, February 3, 1999) and the report of the Land Administration General Department (report number 1265/TT-TCĐC, August 21, 1999).
DECISION:
Article 1. Recovering 35,377.7 square meters of land at Quan Toan Ward, Hong Bang District, Haiphong City to lease 34,367 square meters of land within the recovered area to Haiphong Steel Trading Joint Stock Company for the construction of the HPS Steel Rolling Mill;
The term of the land lease is thirty years from the date of issuance of the land lease decision;
The remaining 1,010.7 square meters of land allows the company to use for public sidewalks, greenery planting, and safety buffer zones along National Highway 5;
The location and boundaries of the land plot are determined according to the cadastral map (surveyed), scale 1/500 established by the Haiphong City Land Administration in April 1999.
Article 2. Pursuant to Article 1 of this Decision, the People's Committee of Haiphong City shall be responsible for:
1. Determining the specific boundary markers on the map and on-site, registering in the State cadastral record, signing the land lease contract, and issuing the certificate of land use rights for the area designated for the construction of the Steel Rolling Mill to Haiphong Steel Trading Joint Stock Company;
2. Guiding Haiphong Steel Trading Joint Stock Company in compensating losses of property and crops for landowners whose land has been recovered;
3. Directing the collection of land lease payments to the state budget;
4. Strictly supervising land use and environmental protection in accordance with current regulations.
Article 3. The Ministers of Planning and Investment, Finance, Construction, Industry, Science, Technology and Environment, the Director-General of the Land Administration General Department, the Chairman of the People's Committee of Haiphong City, the General Director of Haiphong Steel Trading Joint Stock Company, and the heads of relevant agencies are responsible for implementing this Decision./.
