DECREE
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE GOVERNMENTAL DECREE NO. 56/2015/NĐ-CP ON THE ASSESSMENT AND CLASSIFICATION OF CIVIL SERVANTS, PUBLIC OFFICIALS, AND CIVIL SERVICE MEMBERS DATED JUNE 9, 2015
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Civil Servants dated November 13, 2008;
Pursuant to the Law on Civil Service Members dated November 15, 2010;

The Government promulgates this Decree amending and supplementing certain provisions of the Governmental Decree No. 56/2015/NĐ-CP dated June 9, 2015 on the assessment and classification of civil servants, public officials, and civil service members.
Article 1. Amending and supplementing certain provisions of the Governmental Decree No. 56/2015/NĐ-CP dated June 9, 2015 on the assessment and classification of civil servants, public officials, and civil service members as follows:
1. Amend and supplement Clause 2 of Article 5 as follows:
"2. The time for assessing and classifying civil servants, public officials, and civil service members shall be conducted in December each year, prior to the annual commendation and award process.
For public service units operating in education, training, and other fields where the fiscal year ends before December each year, the time for assessing and classifying civil servants and civil service members shall be determined by the head of the unit."
2. Amending and supplementing Point d Clause 1 Article 24 as follows:
"d) The head of the agency or unit directly above shall consider the opinions provided at Points b and c of this Clause, and decide on the assessment and classification of the head. The head of the agency or unit shall consider the opinions provided at Points b and c of this Clause, and decide on the assessment and classification of deputy heads appointed by themselves; in cases where deputy heads are not appointed by themselves due to management levels, the head of the agency or unit shall consider the opinions provided at Points b and c of this Clause, and have the responsibility to provide written comments and propose that the head of the agency or unit directly above review and decide on the assessment and classification of their deputy heads."
3. Amending and supplementing Point b Clause 1 Article 26 as follows:
"b) The criteria specified in Points b, c, and d Clause 1 Article 25 of this Decree."
4. Amending and supplementing Point b Clause 1 Article 27 as follows:
"b) The criteria specified in Points b, c, and d Clause 1 Article 25 of this Decree."
5. Amending and supplementing Article 29 as follows:
"Article 29. Implementation Organization
1. Based on specific conditions of the agency, organization, or unit, the head of the agency, organization, or unit shall establish detailed criteria for assessing and classifying civil servants, public officials, and civil service members, taking into account the ratio of work volume completed by civil servants, public officials, and civil service members compared to the total work volume of the agency, organization, or unit when assessing and classifying them; at the same time, encourage the application of information technology to ensure compliance with the provisions of this Decree.
2. The head of the agency managing civil servants, public officials, and civil service members is responsible for organizing the annual assessment and classification of civil servants, public officials, and civil service members according to the provisions of this Decree and submitting the report on the results of the assessment and classification of civil servants, public officials, and civil service members under their management to the Ministry of Home Affairs for consolidation by March 1st each year.
3. The Ministry of Home Affairs is responsible for monitoring, inspecting, and consolidating reports to the Government, The Prime Minister shall be responsible for the results of the annual assessment and classification of civil servants, public officials, and civil service members from ministries, sectors, and localities, and publicly announcing the consolidated results of the annual assessment and classification of civil servants, public officials, and civil service members.”
Article 2. Effective Date
This Decree takes effect from September 15, 2017.
Article 3. Responsibility for Implementation
The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decree./.
