DECISION OF THE MINISTER OF FINANCE

OF THE MINISTER OF FINANCE NUMBER 90/2000/QD-BTC DATED JUNE 1, 2000 ISSUING THE SCALE OF FEES FOR MANAGEMENT OF QUALITY, SAFETY AND SANITATION OF AQUATIC PRODUCTS

THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Clause 3, Article 4 and Clause 2, Article 7 of Decree No. 86/CP dated December 8, 1995 of the Government stipulating the division of responsibilities for state management of product quality;
Pursuant to Clause 6 and Clause 7, Article 2 of Decree No. 50/CP dated June 21, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Fisheries;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget;
After receiving the opinion of the Ministry of Fisheries and at the proposal of the Director General of the General Tax Department,

DECISION:

Article 1: The attached Decision sets forth the scale of fees for management of aquatic product quality, safety, and sanitation.

The subjects required to pay the fee for management of aquatic product quality, safety, and sanitation according to the prescribed rates in this Article are organizations and individuals within the country and foreign organizations and individuals engaged in the production and business of aquatic products that are inspected for quality, safety, and sanitation by state agencies in accordance with the law.

Article 2: State agencies assigned the responsibility for state management of aquatic product quality, safety, and sanitation under Decree No. 86/CP dated December 8, 1995 of the Government shall be responsible for organizing the collection of such fees during the performance of their functions and duties (collectively referred to as the collecting agency). The collecting agency for fees for management of aquatic product quality, safety, and sanitation may temporarily retain 90% (ninety percent) of the actual collected fees before remitting them to the state budget to cover expenses for managing aquatic product quality, safety, and sanitation and organizing the collection of such fees; they must register, declare, and remit the fees to the local tax authority where the collecting unit is located in accordance with the provisions of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges belonging to the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of the aforementioned Decree.

Article 3: This Decision takes effect fifteen days from the date of signature. It abolishes all regulations on the collection, payment, and management of fees and charges related to the work of managing aquatic product quality, safety, and sanitation that conflict with this Decision.

Article 4: Organizations and individuals subject to the payment of fees for management of aquatic product quality, safety, and sanitation; units assigned the task of organizing the collection of such fees, and relevant agencies are responsible for implementing this Decision./.
