DECREE
Regarding the organization and operation of the inspection within the Ministry of Home Affairs

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;
Based on the Inspection Law dated November 15, 2010;
At the request of the Minister of Home Affairs,
The Government issues a Decree on the organization and operation of the inspection within the Ministry of Home Affairs.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the organization and activities of agencies performing the function of inspection within the Ministry of Home Affairs; Inspectors of the Ministry of Home Affairs, persons assigned to perform specialized internal affairs inspection functions, and cooperative inspectors of the Ministry of Home Affairs; the responsibilities of agencies, organizations, and individuals in the inspection activities within the Ministry of Home Affairs.
Article 2. Inspection Objects
1. Agencies, organizations, and individuals under the management of the Ministry of Home Affairs, Department of Home Affairs.
2. Agencies, organizations, and individuals have the obligation to comply with legal regulations in fields under the state management of the Ministry of Home Affairs, Department of Home Affairs.
Chapter II
DUTIES AND POWERS OF AGENCIES PERFORMING THE FUNCTION OF INSPECTION WITHIN THE MINISTRY OF HOME AFFAIRS
Article 3. Agencies performing the function of inspection within the Ministry of Home Affairs
a) The Ministry of Labor - War Invalids and Social Affairs Inspection (hereinafter referred to as the Ministry Inspection);
a) Inspectorate of the Ministry of Home Affairs.
b) Inspectorate of the Department of Home Affairs.
b) Market Management Sub-Department under the Department of Industry and Trade (hereinafter referred to collectively as the Sub-Department).
a) Central Steering Committee for Commendation and Reward.
b) Government Committee for Religious Affairs.
Article 4. Duties and powers of the Inspectorate of the Ministry of Home Affairs
The Inspectorate of the Ministry of Home Affairs performs duties and powers prescribed in Article 18 of the Inspection Law and the following duties and powers:
1. Directing, inspecting, and urging the establishment and implementation of inspection programs and plans by agencies assigned to perform specialized inspection functions under the Ministry of Home Affairs.
2. Organizing training in specialized inspection business for Inspectors, persons assigned to perform specialized internal affairs inspection functions, and civil servants engaged in inspection work under the Ministry of Home Affairs.
3. Propagandizing, directing, inspecting, and urging agencies and units under the management of the Ministry of Home Affairs to implement legal provisions on inspection.
4. Summarizing and drawing lessons from inspection work within the scope of state management of the Ministry of Home Affairs.
Article 70. Responsibilities of the Ministry of Justice
Article 5. Duties and powers of the Chief Inspector of the Ministry of Home Affairs
The Chief Inspector of the Ministry of Home Affairs performs duties and powers prescribed in Article 19 of the Inspection Law and the following duties and powers:
1. Reporting to the Minister of Home Affairs and the Chief Inspector General about inspection work within the scope of their responsibility.
2. Advising and proposing to the Minister of Home Affairs the assignment of specialized inspection functions to the Central Steering Committee for Commendation and Reward and the Government Committee for Religious Affairs.
3. Inspecting the responsibility of heads of agencies and units under the management of the Ministry of Home Affairs in implementing laws on inspection.
4. Summoning civil servants and officials of related agencies and units to participate in inspection activities.
Article 70. Responsibilities of the Ministry of Justice
Article 6. Duties and powers of the Inspectorate of the Department of Home Affairs
The Inspectorate of the Department of Home Affairs performs duties and powers prescribed in Article 24 of the Inspection Law and the following duties and powers:
1. Organizing training in internal affairs inspection business for Inspectors and civil servants engaged in inspection work under the Department of Home Affairs.
2. Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on handling matters related to inspection by the Director of the Department of Home Affairs and the Inspectorate of the Department of Home Affairs.
3. Propagandizing, directing, inspecting, and urging agencies and units under the management of the Department of Home Affairs to implement laws on inspection.
4. Summarizing and drawing lessons from internal affairs inspection work within the scope of state management of the Department of Home Affairs.
Article 70. Responsibilities of the Ministry of Justice
Article 7. Duties and Authorities of the Inspector General of the Department of Home Affairs
The Inspector General of the Department of Home Affairs shall perform the duties and authorities stipulated in Article 25 of the Inspection Law and the following duties and authorities:
1. Report to the Director of the Department of Home Affairs, the Inspector General of the provincial inspection agency, and the Inspector General of the Ministry of Home Affairs on inspection work within their scope of responsibility.
2. Inspect the responsibilities of the heads of agencies and units under the management of the Department of Home Affairs in implementing laws on inspection.
3. Summon civil servants and officials of related agencies and units to participate in inspection activities.
4. Perform other duties and authorities as prescribed by law.
Article 8. Duties and Authorities of the Agency Assigned to Carry Out Specialized Inspection Functions in Home Affairs
1. Develop plans for specialized inspections in the fields of commendation, awards, and religion, submit them to the Ministry of Home Affairs' Inspection Agency for consolidation and submission to the Minister of Home Affairs for approval and implementation.
2. Conduct specialized inspections in the fields of commendation, awards, and religion.
3. Inspect cases with signs of law violations when assigned by the Minister of Home Affairs or the Inspector General of the Ministry of Home Affairs.
4. Supervise, urge, and inspect the implementation of conclusions, recommendations, and decisions on handling inspections in the fields of commendation, awards, and religion.
5. Consolidate and report to the Ministry of Home Affairs' Inspection Agency the results of specialized inspections.
6. Perform other tasks and authorities as prescribed by law.
Article 9. Duties and Authorities of the Head of the Agency Assigned to Carry Out Specialized Inspection Functions in Home Affairs
1. Lead, direct, and inspect specialized inspection work.
2. Decide to conduct inspections when signs of law violations are detected or upon request from the Minister of Home Affairs or the Inspector General of the Ministry of Home Affairs; assign civil servants to carry out specialized inspection tasks related to commendation, awards, and religion.
3. Recommend the Inspector General of the Ministry of Home Affairs to handle overlapping issues regarding the scope, subjects, content, and time of inspections within the agency's management.
4. Recommend state agencies with authority to amend, supplement, or issue regulations in accordance with management requirements; recommend suspension or revocation of unlawful regulations discovered through inspection work.
Article 70. Responsibilities of the Ministry of Justice
Article 10. Duties and Authorities of the Advisory Unit for Specialized Inspection Work
1. The advisory unit for specialized inspection work under the Central Commendation-Awards Board and the Government Religion Board shall be organized as a Department.
2. The advisory unit assisting the head of the agency assigned to carry out specialized inspection functions shall perform the following tasks:
a) Take the lead and coordinate with relevant units within the agency to develop programs and plans for inspections to be submitted to the head of the directly managing agency.
b) Conduct inspections according to plans, regular inspections, and spot inspections when assigned by the head of the agency.
c) Handle complaints and denunciations and prevent corruption in accordance with the law when assigned.
d) Consolidate, evaluate, and report on the results of specialized inspection work; work on resolving complaints and denunciations and preventing corruption.
đ) Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on handling inspections issued by the head of the agency assigned to carry out specialized inspection functions.
e) Handle within their authority or recommend competent state agencies to handle violations of the law discovered through inspection work.
g) Carry out other tasks assigned by the head of the agency and as prescribed by law.
3. The Minister of Home Affairs shall specify the duties and authorities of the advisory unit for specialized inspection work under the Central Commendation-Awards Board and the Government Religion Board.
Chapter III
INSPECTION ACTIVITIES IN THE HOME AFFAIRS SECTOR
Article 11. Content of Administrative Inspections
Inspect the compliance with policies, laws, and assigned tasks of agencies, organizations, and individuals specified in Clause 1, Article 2 of this Decree.
Article 12. Contents of specialized inspection in the field of administrative organization, public service organizations, and state civil servant establishment management
Inspect the implementation of legal provisions on the organizational structure of administrative bodies, public service organizations, and the management of civil servant quotas, positions, and the number of staff members in administrative agencies, public service units, and associations authorized to use civil servant quotas.
Article 13. Contents of specialized inspection in the field of local administration and administrative boundaries
1. Inspect the implementation of regulations concerning the system and policies for village-level cadres and civil servants.
2. Inspect the implementation of regulations on the management, division, adjustment of administrative boundaries; classification of village-level administrative units by provincial People's Committees.
Article 14. Contents of specialized inspection in the field of cadres, civil servants, and staff members
1. Inspect the implementation of legal provisions on cadres, including:
a) Training and capacity building for cadres.
b) Regulations on cadre titles and structures.
c) Management of cadre files.
d) Transfer, rotation, removal from duty, resignation, dismissal, retirement of cadres.
đ) Evaluation and classification of cadres.
e) Other legal provisions on cadres.
2. Inspect the implementation of legal provisions on civil servants, including:
a) Planning for civil servants and leadership and management positions.
b) Recruitment, employment, promotion, appointment, transfer, rotation, resignation, dismissal, secondment; commendation, discipline, termination, retirement, and other systems and policies for civil servants as prescribed by law.
c) Training and capacity building for civil servants.
d) Regulations on civil servant grades, titles, codes; standards for leadership and management civil servants; job descriptions, position regulations, and civil servant structures.
đ) Management of civil servant files.
e) Other legal provisions on civil servants.
3. Inspect the implementation of legal provisions on staff members, including:
a) Recruitment, employment, management, arrangement, and utilization of staff members.
b) Employment contracts and termination of work contracts for staff members.
c) Planning for staff members and leadership and management positions.
d) Appointment, change of occupational titles; change of job positions, secondment, resolution of termination benefits.
đ) Evaluation, commendation, and discipline of staff members.
e) Training and capacity building for staff members.
g) Retirement benefits for staff members.
h) Establishment and management of staff member files.
i) Other legal provisions on staff members.
Article 15. Contents of specialized inspection in the field of performance of duties and powers of cadres and civil servants; ethics and communication culture of cadres and civil servants; actions that cadres and civil servants are not allowed to perform; professional ethics rules for cadres, civil servants, and staff members
1. Inspect the performance of duties and powers of cadres and civil servants according to internal regulations and working rules of agencies and organizations or assigned by agencies, organizations, and competent authorities under the Civil Servant Law and related provisions.
2. Inspect the implementation of legal provisions on ethics and communication culture in the performance of official duties by cadres and civil servants; actions that cadres and civil servants are not allowed to perform according to the Civil Servant Law and related provisions.
3. Inspect the implementation of professional ethics rules for cadres, civil servants, and staff members.
Article 16. Contents of specialized inspection in the field of salary
1. Inspect the implementation of salary systems, policies, allowances, living expenses, and bonuses for state officials, civil servants, public employees, armed forces personnel, and contractual workers in administrative agencies and state-run organizations.
2. Inspect the promotion of salary grades for officials, civil servants, and public employees according to legal provisions.
3. Inspect the assignment of salary coefficients when recruiting, appointing positions, changing job positions, transferring positions, and promoting from specialist level and above for state officials, civil servants, and public employees.
4. Inspect the assignment of position and salary grades for management officials of state-owned enterprises, officers, professional military personnel, and armed forces soldiers when they are transferred or rotated to administrative agencies and state-run organizations.
5. Inspect the implementation of salary and wage systems in associations granted the use of civil servant quotas.
Article 17. Contents of specialized inspection in the field of associations and non-governmental organizations
1. Inspect the implementation of legal provisions regarding establishment; division, separation; merger; dissolution, suspension, temporary suspension of activities, permission to resume operations after temporary suspension; reissuance of establishment permits, revocation of establishment permits; name change, and approval of association and non-governmental organization charters.
2. Inspect the implementation of association and non-governmental organization charters.
Article 18. Contents of specialized inspection in the field of state archival work
Inspect the implementation of legal provisions on archival work, including:
1. Administrative document presentation format and techniques.
2. Management of documents generated during agency and organizational operations, including: outgoing documents; incoming documents; current record-keeping activities.
3. Preservation and use of seals in archival work.
4. Collection, arrangement, valuation determination, statistics, preservation, and utilization of archival materials.
5. Rights and obligations of agencies, organizations, and individuals in archival activities.
6. Implementation of other tasks as prescribed by law.
Article 19. Contents of specialized inspection in the field of state administrative reform
1. Inspect the responsibility for implementing administrative reform programs, plans, and tasks.
2. Inspect the responsibility for implementing the division of labor and decentralization of state management.
Article 20. Contents of specialized inspection in the implementation of the Grassroots Democracy Regulation
Inspect the implementation of the Grassroots Democracy Regulation at communes, wards, towns, administrative agencies, state-run organizations, and state-owned enterprises as stipulated by law.
Article 21. Contents of specialized inspection in the field of youth work
Inspect the implementation of legal provisions on youth work within the scope of state management by the Ministry of Home Affairs and Provincial Departments of Home Affairs.
Article 22. Contents of specialized inspection in the field of commendation and reward
Inspect the implementation of legal provisions on competition and commendation; forms, subjects, and criteria for rewards; authority to grant awards, procedures, and application files for commendations.
Article 23. Contents of specialized inspections in the religious field
1. Inspect the implementation of legal provisions on recognizing religious organizations; establishing, dividing, splitting, merging, and consolidating religious organizations; establishing, dissolving training schools, and holding classes to nurture those who specialize in religious activities.
2. Inspect the implementation of legal provisions on the responsibilities of state agencies in managing belief and religious activities.
Article 24. Inspection Authority
1. The Ministry of Home Affairs' Inspectorate inspects the implementation of provisions set forth in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21 of this Decree and re-inspects the provisions set forth in Clause 1, Article 30 of this Decree.
2. The Inspectorate of the Department of Home Affairs inspects the implementation of provisions set forth in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23 of this Decree.
3. The Central Steering Committee for Commendation and Reward inspects the implementation of provisions set forth in Article 22 of this Decree.
4. The Governmental Committee on Religion inspects the implementation of provisions set forth in Article 23 of this Decree.
Article 25. Building and Approving Annual Internal Inspection Plans
1. By no later than October 30 each year, the Inspectorate of the Ministry of Home Affairs guides agencies assigned to perform specialized internal inspection functions to build inspection programs and plans.
Agencies assigned to perform specialized internal inspection functions submit the inspection program and plan to the Inspectorate of the Ministry of Home Affairs by no later than November 5 each year.
2. By no later than November 15 each year, the Inspectorate of the Ministry of Home Affairs submits the internal inspection plan of the Ministry of Home Affairs to the Minister of Home Affairs for approval.
The Minister of Home Affairs is responsible for reviewing and approving the internal inspection plan by no later than November 25 each year.
3. By no later than December 5 each year, the Inspectorate of the Department of Home Affairs submits the internal inspection plan of the Department of Home Affairs to the Director of the Department of Home Affairs for approval.
The Director of the Department of Home Affairs is responsible for reviewing and approving the internal inspection plan by no later than December 15 each year.
4. An approved inspection plan that needs adjustment must be reported to the head of the competent authority for approval.
5. The inspection plans specified in Clauses 2, 3, and 4 of this Article shall be sent to the inspected entities and related agencies and organizations.
Article 26. Handling Overlapping Activities in Inspections
1. If the inspection plan of a subordinate agency overlaps with that of a superior agency, it shall be implemented according to the plan of the superior agency.
2. The Chief Inspector of the Ministry of Home Affairs is responsible for leading the handling of overlapping issues regarding scope, subjects, contents, and timeframes of inspections between the Inspectorate of the Ministry of Home Affairs and agencies assigned to perform specialized internal inspection functions; coordinating with provincial inspectors to resolve overlapping issues in internal affairs inspections with local inspection agencies, submitting to the Minister of Home Affairs for review when necessary.
3. The Chief Inspector of the Department of Home Affairs reports to the Chief Provincial Inspector to handle overlapping issues in inspections with local inspection agencies.
Article 27. Authority to Issue Inspection Decisions
1. The Chief Inspector of the Ministry of Home Affairs and the Chief Inspector of the Department of Home Affairs issue administrative inspection decisions, specialized inspection decisions, and establish inspection teams. When deemed necessary, the Minister of Home Affairs and the Director of the Department of Home Affairs may issue inspection decisions and establish inspection teams.
2. The head of the agency assigned to perform specialized inspection functions issues specialized inspection decisions according to the plan and establishes inspection teams.
For complex cases involving the management responsibility of multiple units, the Minister of Home Affairs issues specialized inspection decisions and establishes inspection teams.
Article 28. Inspection Period
1. The inspection conducted by the Inspectorate of the Ministry of Home Affairs or the agency entrusted with the specialized inspection function shall not exceed 45 days; in complex cases, it may be extended but not more than 70 days.
2. The inspection conducted by the Inspectorate of the Department of Home Affairs shall not exceed 30 days; in complex cases, it may be extended but not more than 45 days.
Article 29. Procedure and Formalities for Conducting Internal Affairs Sector Inspections
1. The inspection activities of the Inspectorate of the Ministry of Home Affairs and the Inspectorate of the Department of Home Affairs shall be carried out in accordance with the provisions of the Inspection Law; Decree No. 86/2011/ND-CP dated September 22, 2011 of the Government detailing and guiding the implementation of certain articles of the Inspection Law; Decree No. 07/2012/ND-CP dated February 9, 2012 of the Government on agencies entrusted with the specialized inspection function and specialized inspection activities.
2. The procedure and formalities for conducting specialized inspections by agencies entrusted with the specialized internal affairs inspection function shall be carried out in accordance with the provisions of the Inspection Law and Decree No. 07/2012/ND-CP.
Article 30. Re-inspection of Inspection Conclusions in the Internal Affairs Sector
1. The Chief Inspector of the Ministry of Home Affairs decides to re-inspect a case that has been concluded by the People's Committee Chairman at provincial level or the agency entrusted with the specialized internal affairs inspection function, but shows signs of violation of laws upon assignment by the Minister of Home Affairs.
2. The decision on re-inspection includes contents prescribed in Clause 1, Article 52 of the Inspection Law. Within the latest three working days from the date of signing the re-inspection decision, the person issuing the re-inspection decision must send the re-inspection decision to the person who signed the inspection conclusion and the subject of re-inspection.
3. The basis for re-inspection, the statute of limitations for re-inspection, the period for re-inspection, the duties and powers of the person issuing the re-inspection decision, the Head of the Re-inspection Team, members of the Re-inspection Team, and reporting the results of re-inspection shall be implemented in accordance with the provisions of the Inspection Law, Decree No. 86/2011/ND-CP, and Decree No. 07/2012/ND-CP.
4. The person issuing the re-inspection decision issues the re-inspection conclusion. The content of the re-inspection conclusion is regulated by the Inspection Law.
5. The re-inspection conclusion of the Chief Inspector of the Ministry of Home Affairs shall be sent to the Minister of Home Affairs and the General Inspector of the Government.
Article 31. Summary and Reporting of Inspection Work in the Internal Affairs Sector
1. The Chief Inspector of the Ministry of Home Affairs summarizes and reports to the Minister of Home Affairs and the General Inspector of the Government on inspection work, handling complaints and denunciations, and anti-corruption within his scope of responsibility.
2. The head of the agency entrusted with the specialized internal affairs inspection function summarizes and reports to the Inspectorate of the Ministry of Home Affairs on specialized inspection work, handling complaints and denunciations, and anti-corruption within his scope of responsibility.
3. The Chief Inspector of the Department of Home Affairs reports to the Chief Inspector of the province, the Director of the Department of Home Affairs, and the Chief Inspector of the Ministry of Home Affairs on inspection work, handling complaints and denunciations, and anti-corruption within his scope of responsibility.
Chapter IV
INSPECTORS OF THE INTERNAL AFFAIRS SECTOR, PERSONS ENTRUSTED WITH THE SPECIALIZED INTERNAL AFFAIRS INSPECTION FUNCTION, AND ASSISTANT INSPECTORS OF THE INTERNAL AFFAIRS SECTOR
Article 32. Civil Servants of the Ministry of Home Affairs' Inspectorate
1. Civil servants of the Ministry of Home Affairs' Inspectorate (hereinafter referred to as Inspectors) are civil servants of the Ministry of Home Affairs' Inspectorate and the Department of Home Affairs' Inspectorate appointed to the inspector rank to perform inspection tasks and other tasks assigned by the Head of the Ministry of Home Affairs' Inspectorate and the Head of the Department of Home Affairs' Inspectorate. Inspectors are provided with uniforms and inspection badges.
2. Inspectors must comply with the law, be responsible before the Head of the Ministry of Home Affairs' Inspectorate, the Head of the Department of Home Affairs' Inspectorate, and before the law for the performance of their assigned duties and powers.
3. The criteria for the inspector ranks; the appointment, removal of Inspectors, and conditions ensuring the operation of Inspectors shall be carried out in accordance with the provisions of the law.
Article 33. Persons Assigned to Perform Specialized Inspection Functions in the Field of Home Affairs
1. Persons assigned to perform specialized inspection functions in the field of home affairs are civil servants within the establishment of the Central Steering Committee for Competitions and Awards and the Government Office of Religion, assigned by the head of the direct management agency to carry out specialized inspection tasks.
2. The Minister of Home Affairs shall specify the specific criteria for persons assigned to perform specialized inspection functions in the field of home affairs, uniforms, and badges for specialized inspection civil servants in the field of home affairs.
Article 34. Collaborators of the Ministry of Home Affairs' Inspectorate
1. Collaborators of the Ministry of Home Affairs' Inspectorate are individuals with expertise and vocational qualifications suitable for inspection tasks, summoned by the Ministry of Home Affairs' Inspectorate and the Department of Home Affairs' Inspectorate to participate in inspection teams and not belonging to the establishment of state inspection agencies.
2. The standards, tasks, and powers of collaborators of the Ministry of Home Affairs' Inspectorate; the procedures and formalities for summoning collaborators of the Ministry of Home Affairs' Inspectorate; the treatment and policies for collaborators of the Ministry of Home Affairs' Inspectorate and the budget for summoning collaborators of the Ministry of Home Affairs' Inspectorate shall be implemented in accordance with the provisions of the law.
Chapter V
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS IN THE IMPLEMENTATION OF INSPECTION CONCLUSIONS
Article 35. Responsibilities of the Minister of Home Affairs
1. Leading and directing inspection activities within the scope of management of the Ministry of Home Affairs and ensuring the operating funds of the Ministry of Home Affairs' Inspectorate.
2. Equipping material and technical facilities, uniforms, and other conditions to serve inspection activities; supervising inspection activities.
3. Directing the handling and implementation of recommendations, conclusions, and decisions on internal inspections and being responsible under the law for his actions and decisions.
4. Performing other tasks as prescribed by law.
Article 36. Responsibilities of the Director of the Department of Home Affairs
1. Leading and directing inspection activities within the scope of management of the Department of Home Affairs and ensuring the operating funds of the Department of Home Affairs' Inspectorate.
2. Equipping material and technical facilities, uniforms, and other conditions to serve inspection activities; supervising inspection activities.
3. Directing the handling and implementation of recommendations, conclusions, and decisions on internal inspections and being responsible under the law for his actions and decisions.
4. Performing other tasks as prescribed by law.
Article 37. Responsibilities of Agencies, Organizations, and Individuals
1. The responsibilities and rights of agencies, organizations, and individuals subject to inspection and related agencies, organizations, and individuals shall be carried out in accordance with the provisions of Article 10 of the Inspection Law.
2. The Chairman of the People's Committee of the province has the responsibility to send inspection conclusions to the Ministry of Home Affairs within the prescribed time limit for inspections involving the functions of state management of the Ministry of Home Affairs.
3. Other agencies, organizations, and individuals, upon receiving requests, recommendations, and decisions on inspection from the Ministry of Home Affairs, the Ministry of Home Affairs' Inspectorate, the Central Steering Committee for Competitions and Awards, the Government Office of Religion, the Department of Home Affairs, and the Department of Home Affairs' Inspectorate, have the responsibility to implement them and respond in writing about the implementation of these requests, recommendations, and decisions.
Chapter VI
IMPLEMENTING PROVISIONS
Article 38. Effective Date
This Decree takes effect from January 1, 2013.
Article 39. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
