Regarding the approval of investment for the Son La Hydropower Project
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 44/2001/QH10 of the 9th Session of the 10th National Assembly and Resolution No. 13/2002/QH11 of the 2nd Session of the 11th National Assembly on the Son La Hydropower Project;
Pursuant to the Investment and Construction Management Regulations issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government, which has been amended and supplemented by Decree No. 12/2000/NĐ-CP dated May 5, 2000 and Decree No. 07/2003/NĐ-CP dated January 30, 2003 of the Government;
Considering the proposal of Vietnam Electricity Corporation (document No. 2043 TTr-EVN-HĐQT-TĐ dated May 20, 2003); and the opinion of the State Appraisal Council for the Son La Hydropower Project (document No. 4870/HĐTĐSL dated August 11, 2003) proposing the Prime Minister approve the Feasibility Study Report of the Son La Hydropower Project.
DECISION:
Article 1. Approve the investment for the Son La Hydropower Project as follows:
1. Project name: Son La Hydropower Project.
2. The Son La Hydropower Project includes the following component projects:
a) The construction project of the Son La Hydropower Plant, with Vietnam Electricity Corporation as the investor, including:
- Main works: Main dam, spillway at the Pa Vinh II route, gravity concrete structure;
- Power transmission line: Water intake gate; pressurized water conveyance tunnel; hydropower plant downstream with 6 to 8 units; outdoor substation, power distribution station;
- Transmission line 220-500 kV connecting the plant to the national power grid;
- Operation management house; housing for plant operation staff;
b) The resettlement project (within the administrative area), with the People's Committees of Son La Province, Lai Chau Province, and Dien Bien Province as investors.
c) The road construction project to avoid flooding, with the Ministry of Transport as the investor.
3. Location: The main works are located in Iet Ong Commune, Muong La District, Son La Province. The reservoir covers several communes and districts in Son La, Lai Chau, and Dien Bien Provinces.
4. Objectives of the Son La Hydropower Project Investment:
- To provide electricity to support economic and social development, serving the industrialization and modernization of the country.
- To contribute to flood control during the rainy season and water supply during the dry season for the Red River Delta.
- To promote economic and social development in Northwest Vietnam.
5. Key parameters:
+ Watershed area: 43,760 km².
+ Total reservoir capacity: 9.26 billion m³.
+ Flood control capacity downstream: 7.0 billion m³ (including Hoa Binh Reservoir).
+ Useful capacity: 5.97 billion m³.
+ Normal water level (NWL): 215 m.
+ Flood control level: 218.45 m (corresponding to a 0.01% frequency flood).
+ Inspection level: 231.43 m (corresponding to the Probable Maximum Flood (PMF)).
+ Installed capacity: 2,400 MW.
+ Guaranteed capacity: 614 MW (including 107 MW increase for Hoa Binh).
+ Annual average power generation: 9.429 billion kWh.
+ Project grade: Special grade.
6. Major works and main structural solutions:
+ Main works include: Main dam, spillway at the Pa Vinh II route, gravity concrete structure.
+ Power transmission line includes: Water intake gate, pressurized water conveyance tunnel, hydropower plant downstream with 6 to 8 units; outdoor substation, power distribution station.
+ Control, protection, communication, fire prevention systems according to Vietnamese standards and referencing international standards.
+ Connecting to the national power grid via 220-500 kV transmission lines.
+ Operation management house.
+ Housing for plant operation staff.

7. Total investment: 369,330 billion VND (excluding interest during construction period, based on Q3 2002 prices, exchange rate 1 USD = 15,450 VND), including:

* The resettlement compensation cost will be officially determined after approving the overall resettlement plan but shall not exceed the approved amount in the Decision on Investment of the Son La Hydropower Project.
8. Financing and repayment scheme for the Son La Hydropower Project: as per Circular No. 5170/TTr/BCN-BTC dated November 14, 2003 of the Ministry of Industry and Finance.
9. Schedule:
+ In 2004-2005, prepare for construction; start main works at the end of 2005.
+ First unit commissioned in 2012.
+ Complete works in 2015.
Article 2. The Prime Minister assigns relevant ministries, sectors, and localities to organize the implementation of the following main tasks:
- Propose to the Prime Minister to supplement additional members to the Board of Directors of Vietnam Coal-Mineral Industries Group.
- Approve the first phase of the general layout (works for commencement).
- Approve the technical design and total estimate of the Son La Hydropower Project.
- Approve foreign capital contracts and procurement of foreign equipment for the Son La Hydropower Plant project.
- Lead and coordinate with the Ministry of Planning and Investment, the Ministry of Construction, the Ministry of Finance, the State Bank of Vietnam, and related agencies to propose management mechanisms and implementation of the Son La Hydropower Project, to be submitted to the Prime Minister for decision.
2. The Ministry of Construction is responsible for issuing technical design standards as a basis for preparing the technical design of the Son La Hydropower Plant; establish the State Acceptance Council and implement acceptance procedures to ensure quality and safety as required.
3. The Ministry of Transport: as the investor of the road construction project to avoid flooding, direct the implementation of the project to meet the schedule.
4. The Ministry of Agriculture and Rural Development is the lead agency coordinating with the People's Committees of provinces within the project area to organize the implementation of compensation and resettlement work according to requirements and schedules.
5. The Ministry of Fisheries coordinates with the People's Committees of provinces with the surface waters of the Son La Hydropower Reservoir to organize planning and plans for the use of surface water for aquaculture development.
6. The Ministry of Culture and Information coordinates with the People's Committees of Son La and Lai Chau Provinces to direct and organize the excavation, preservation of cultural heritage in the flooded area, and the preservation and promotion of traditional culture of ethnic communities when implementing the lake clearance and resettlement.
7. The Ministry of Finance shall undertake the guarantee for loans to enable the project investor to import domestic equipment and materials that have not yet been produced (or do not meet requirements) for the Son La Hydropower Project.
8. The Ministry of National Defense shall take the lead and coordinate with relevant ministries, sectors, and localities to study and adjust existing defense plans in the area, develop security and defense measures during the construction and operation of the Son La Hydropower Plant.
9. The Ministry of Public Security shall take the lead and coordinate with relevant ministries, sectors, and localities to develop and implement protection measures during the construction and operation of the Son La Hydropower Plant.
10. People's Committees of the provinces of Son La, Lai Chau, Dien Bien shall cooperate with the Ministry of Agriculture and Rural Development to implement compensation and resettlement work according to approved planning and plans; develop economic and social development planning and implement solutions to meet the required demands.
11. Vietnam Electricity Corporation shall base its actions on the resolutions of the National Assembly, the Government, and the Prime Minister’s Decision regarding the Son La Hydropower Project; incorporate the opinions of the State Appraisal Council for the Son La Hydropower Project and those of relevant ministries, sectors, and localities to prepare technical designs, total budgets, and submit them for approval as prescribed; prepare an environmental impact assessment project and submit it for approval by the competent authority; establish technical design standards to be issued by the Ministry of Construction; develop a scientific research program to support design work and future reservoir operation tasks; coordinate with contractors to promptly carry out preparatory work to start main construction in 2005.
Article 3. This Decision takes effect from the date of signature.
Article 4. The State Steering Committee for the Son La Hydropower Project; Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial people's committees under the central government, mass organizations; Boards of Directors and General Directors of Vietnam Electricity Corporation and Sông Đà Corporation shall be responsible for implementing this Decision.
