Circular No. 02/2014/TT-BTC dated January 2, 2014 guiding fees and registration fees within the authority to decide of the People's Councils of provinces and centrally governed cities
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 and Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing some articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Registration Fees;

The Minister of Finance issues this Circular to amend and supplement Decision No. 59/2006/QĐ-BTC dated October 25, 2006 on the regulations regarding levels of collection, collection procedures, payment, management, and use of fees for examination, registration fees for permits to explore, extract, use water resources, discharge wastewater into water sources, and operate underground water drilling businesses; Circular No. 02/2014/TT-BTC dated January 2, 2014 guiding fees and registration fees within the authority to decide of the People's Councils of provinces and centrally governed cities, as follows:

Article 1. Amending and supplementing Decision No. 59/2006/QĐ-BTC dated October 25, 2006 of the Minister of Finance

2. Point b.8 of Clause 2 of Article 3 of Circular No. 02/2014/TT-BTC on registration fees for permits to explore, extract, use underground water shall be amended and supplemented as follows:

"The fee for issuing exploration, exploitation, and utilization permits for underground water is a charge levied on organizations and individuals who are granted such permits by competent state authorities in accordance with the law.
The maximum amount of the fee for issuing exploration, exploitation, and utilization permits for underground water shall not exceed 150,000 VND per permit. In cases of extension, modification of content, or reissuance of the permit, the maximum amount of the fee shall not exceed fifty percent (50%) of the initial issuance fee.
Point b.9, Clause 2, Article 3 of Circular No. 02/2014/TT-BTC on the fee for issuing exploitation and utilization permits for surface water shall be amended and supplemented as follows:
"The fee for issuing exploitation and utilization permits for surface water is a charge levied on organizations and individuals who are granted such permits by competent state authorities in accordance with the law.
The maximum amount of the fee for issuing exploitation and utilization permits for surface water shall not exceed 150,000 VND per permit. In cases of extension, modification of content, or reissuance of the permit, the maximum amount of the fee shall not exceed fifty percent (50%) of the initial issuance fee.
Point b.10, Clause 2, Article 3 of Circular No. 02/2014/TT-BTC on the fee for issuing discharge permits into water sources shall be amended and supplemented as follows:
"The fee for issuing discharge permits into water sources is a charge levied on organizations and individuals who are granted such permits by competent state authorities in accordance with the law.
The maximum amount of the fee for issuing discharge permits into water sources shall not exceed 150,000 VND per permit. In cases of extension, modification of content, or reissuance of the permit, the maximum amount of the fee shall not exceed fifty percent (50%) of the initial issuance fee."
Point b.11, Clause 2, Article 3 of Circular No. 02/2014/TT-BTC on the fee for issuing discharge permits into irrigation works shall be amended and supplemented as follows:
"The fee for issuing discharge permits into irrigation works is a charge levied on organizations and individuals who are granted such permits by competent state authorities in accordance with the law.
The maximum amount of the fee for issuing discharge permits into irrigation works shall not exceed 150,000 VND per permit. In cases of extension, modification of content, or reissuance of the permit, the maximum amount of the fee shall not exceed fifty percent (50%) of the initial issuance fee."
Article 3. Implementation Organization
This Circular takes effect from August 11, 2016.
Other contents related to examination fees, fees for issuing exploration, exploitation, and utilization permits for underground water; exploitation and utilization permits for surface water; discharge permits into water sources, and irrigation works not mentioned in this Circular shall continue to be implemented in accordance with the guidance provided in Decision No. 59/2006/QD-BTC dated October 25, 2006 on the determination of the amount of examination fees, fees for issuing exploration, exploitation, and utilization permits for water resources, discharge permits into water sources, and groundwater drilling services; and Circular No. 02/2014/TT-BTC dated January 2, 2014 issued by the Minister of Finance guiding fees and charges within the decision-making authority of the People's Councils of provinces and centrally-administered cities.
From the date this Circular takes effect, if the People's Councils of provinces have not yet issued new regulations, they shall continue to implement according to previously issued documents.
During the implementation process, if there are any difficulties, organizations and individuals are advised to promptly report to the Ministry of Finance for supplementary guidance./.
