CIRCULAR

DETAIL REGULATIONS ON CERTAIN PROVISIONS OF THE HOUSING LAW IN THE PEOPLE'S ARMED FORCES OF VIETNAM

Pursuant to the Housing Law No. 27/2023/QH15 dated November 27, 2023;

Pursuant to Law No. 43/2024/QH15 dated June 29, 2024 amending and supplementing certain provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Logistics Department;

The Minister of National Defense promulgates this Circular detailing certain provisions of the Housing Law in the People's Armed Forces of Vietnam.

Article 1. Scope of Regulation

This Circular details certain provisions of the Housing Law, including:

1. Clause 9, Article 78 regarding the model of proof documents for subjects specified in Clause 7, Article 76 of the Housing Law who are entitled to social housing support within the management scope of the Ministry of National Defense.

2. Clause 2, Article 101 regarding the model of proof documents for subjects entitled to housing support for armed forces within the management scope of the Ministry of National Defense.

3. Clause 2, Article 105 regarding requirements for projects investing in construction of housing for armed forces within the management scope of the Ministry of National Defense.

Article 2. Applicability

1. Officers, professional soldiers, civil servants, workers, and defense officials currently serving in active duty; personnel engaged in confidential work and other personnel working in confidential organizations receiving state budget salaries within the management scope of the Ministry of National Defense (hereinafter collectively referred to as cadres and staff).

2. Agencies, units, organizations, and individuals related to projects investing in construction of housing for the people's armed forces within the management scope of the Ministry of National Defense.

Article 3. Explanation of Terms

Housing as applied in this Circular shall be understood as housing for sale, lease purchase, and rental for the subjects specified in Clause 1, Article 2 of this Circular, including: Housing for the people's armed forces and other social housing.

Article 4. Proof Documents for Subjects Entitled to Housing Support as Specified in Clause 9, Article 78, and Clause 2, Article 101 of the Housing Law

1. Model proof documents for subjects entitled to housing support are issued together with this Circular.

2. Heads of agencies and units at the Brigade level and above, and the Government Confidential Service shall confirm the eligibility of subjects entitled to housing support according to the provisions of Clause 1 of this Article.

Article 5. Requirements for Projects Investing in Construction of Housing for the People's Armed Forces Within the Management Scope of the Ministry of National Defense

1. Projects investing in construction of housing for the people's armed forces within the management scope of the Ministry of National Defense must comply with the requirements stipulated in Article 33 of the Housing Law and requirements to ensure national security confidentiality in the field of national defense.

2. Functional agencies of the Ministry of National Defense shall implement the requirements of the Minister of National Defense, take the lead, and coordinate with relevant agencies, organizations, and individuals to carry out procedures related to land, investment, and construction of housing for the people's armed forces within the management scope of the Ministry of National Defense in accordance with the characteristics of the national defense sector.

Article 6. Implementation Organization

1. The General Staff directs:

a) The Operations Directorate shall take the lead in guiding agencies and units to review and inspect military land sites planned to be transferred to localities for development and construction of housing within the management scope of the Ministry of National Defense.

b) The Personnel Directorate shall cooperate with the Cadre Directorate under the Political Bureau to guide agencies and units to confirm and manage cadres and staff eligible for housing support policies.

2. The Political Bureau directs:

a) The Propaganda Directorate shall cooperate with the Legal Affairs Department of the Ministry of National Defense to organize the dissemination and popularization of housing laws for agencies and units to implement.

b) The Cadre Directorate: Shall take the lead and guide agencies and units to determine and manage subjects eligible for housing support policies within the management scope.

3. The General Logistics Department - Technical Services implements its function as a specialized agency and housing management agency of the Ministry of National Defense; directs the Barracks Directorate:

a) To guide and organize the implementation of housing laws and this Circular;

b) To take the lead and coordinate with functional agencies of the Ministry of National Defense to guide subordinate agencies and units to compile housing needs of cadres and staff, report to the Head of the Ministry of National Defense to submit to the Provincial People's Committees for consolidation in provincial housing development programs and plans;

c) To take the lead and coordinate with functional agencies to advise the Head of the Ministry of National Defense on investment policies and projects for constructing housing for the people's armed forces within the management scope of the Ministry of National Defense;

d) To take the lead in preparing the state budget estimate to ensure the implementation of tasks assigned by this Circular in accordance with the procedures and formalities for budget preparation and settlement within the Ministry of National Defense.

4. The Finance Department of the Ministry of National Defense

a) Shall take the lead and coordinate with functional agencies of the Ministry of National Defense to guide agencies and units to confirm income for purchasing and leasing housing.

b) To ensure funding for implementation according to the approved state budget estimate by the Minister of National Defense.

5. Subordinate agencies and units of the Ministry of National Defense

a) To direct, guide, inspect, and organize the implementation of proof document confirmation for subjects within the management scope as prescribed in this Circular for subordinate units.

b) To compile housing needs of cadres and staff within the management scope by province and city directly under the central government and send them to the General Logistics Department - Technical Services through the Barracks Directorate for consolidation and reporting.

6. Commanders of Military Regions direct Provincial Military Commands; Commanders of the Hanoi Capital Military Command shall cooperate with functional agencies of the General Staff and the General Logistics Department - Technical Services to work with provincial authorities to survey and identify suitable land locations, and issue documents requesting the Provincial People's Committees to develop housing projects in compliance with the law and this Circular.

7. Funding for the implementation of the contents of this Circular shall be guaranteed by the state budget in accordance with the law.

Article 7. Effective Date

1. This Circular takes effect from December 26, 2024.

2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the provisions of the corresponding amended, supplemented, or replacing documents.

3. The General Department of Logistics and the General Department of Engineering shall continue to perform their functions, duties, authorities, and working relationships as currently prescribed until a decision on merger and reorganization by the competent authority is issued.

4. In the course of implementation, if there are any difficulties, they are requested to report to the General Department of Logistics and Engineering through the Barracks Management Department for guidance within their jurisdiction./.
