DECISION
Regarding the adjustment of the plan for restructuring and modernizing state-owned enterprises under the Vietnam Maritime Corporation in 2005-2006
under the Ministry of Transport for the period of 2005-2006
PRIME MINISTER
Pursuant to the Government Organization Law dated December 25, 2001;
Pursuant to Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises and independent accounting subsidiaries under state-owned corporations;
Considering the proposal of the Ministry of Transport,
DECISION:
Article 1. Adjust the form and time of restructuring state-owned enterprises under the Ministry of Transport as set out in the Appendix attached hereto.
Article 2. The Minister of Transport:
1. Direct the implementation of the restructuring and modernization of state-owned enterprises directly subordinate which have been approved by Decision No. 63/2003/QĐ-TTg dated April 21, 2003 and this Decision.
For those enterprises that cannot be listed, proactively transfer them to public auction, dissolution, or bankruptcy.
2. Direct the Vietnam Waterway Construction Corporation to develop a plan to reorganize into a parent company - subsidiary model, to be submitted to the Prime Minister by June 2005.
3. Pilot the conversion of five river management sections into joint-stock companies, draw lessons for wider application.
Article 3. Ministries: Finance, Planning and Investment, Labour - Invalids and Social Affairs, Home Affairs, and related agencies shall coordinate with the Ministry of Transport in implementing this plan.
The Steering Committee for Enterprise Reform and Development is responsible for supervising, guiding, and monitoring the implementation of this plan, and at the same time recommending solutions to the Prime Minister to address difficulties during the implementation process.
Article 4. This Decision takes effect 15 days after its registration in the Official Gazette.
The Minister of Transport and heads of relevant agencies are responsible for enforcing this Decision.
