Regarding the supplementation of Circular No. 48/2006/TT-BVHTT dated May 5, 2006, issued by the Ministry of Culture, Sports and Tourism guiding the implementation of Decree No. 12/2006/NĐ-CP dated January 23, 2006, of the Government detailing the implementation of the Trade Law on international goods trading activities and related agency, purchase, sale, processing, and transit activities with foreign countries.

Pursuant to Decree No. 63/2003/NĐ-CP dated June 11, 2003, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006, of the Government detailing the implementation of the Trade Law on international goods trading activities and related agency, purchase, sale, processing, and transit activities with foreign countries.

The Ministry of Culture, Sports and Tourism supplements Circular No. 48/2006/TT-BVHTT dated May 5, 2006, issued by the Ministry of Culture, Sports and Tourism guiding the implementation of Decree No. 12/2006/NĐ-CP dated January 23, 2006, of the Government detailing the implementation of the Trade Law on international goods trading activities and related agency, purchase, sale, processing, and transit activities with foreign countries (hereinafter referred to as Circular No. 48/2006/TT-BVHTT) as follows:

1. Supplement Point C to Clause 2.2 Section II Part C as follows.

c. For audiovisual products (recorded on any medium) containing the following contents:

- System software, which is an operating system program for computers or a program controlling hardware, equipment, machines; office application software, accounting software, architectural software, or general data processing programs: The competent state management body for culture and information shall not approve the content, enterprises importing such products shall directly handle customs procedures at the Customs Office.

- Software used for national defense and security purposes: Enterprises shall carry out importation in accordance with the regulations of the specialized management ministry.

- Software containing music, theatrical, or other cultural and information-related contents: The approval document for the first import content issued by the provincial Department of Culture and Information where the enterprise is registered for business shall serve as the basis for the enterprise to handle subsequent import procedures for batches of imported goods that conform to the approved product model.

 

2. Effective date.

This Circular shall take effect fifteen days from the date of publication in the Official Gazette.

During the implementation of this Circular, if any difficulties arise, relevant state management agencies and entities engaged in the specialized import and export of cultural and information goods shall promptly reflect them to the Ministry of Culture, Sports and Tourism for study and resolution./.
