RESOLUTION
Specifies the list of tasks, activities, and allocated budget limits
for each task and activity related to the examination and approval of legislative acts of the National Assembly and the Standing Committee of the National Assembly
and the examination, approval, and decision on joining international treaties and organizations within the jurisdiction of the National Assembly
Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13 amended and supplemented by Law No. 65/2020/QH14 and Law No. 62/2025/QH15;
Pursuant to the Law on Legislative Acts No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;
THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;
Pursuant to Resolution No. 197/2025/QH15 dated May 17, 2023 of the National Assembly on special mechanisms and policies to create breakthroughs in the construction and implementation of laws;
Based on the Report No. 657/TTr-UBPLTP15 dated July 11, 2025 and the Report No. 828/BC-UBPLTP15 dated August 12, 2025 of the Permanent Committee for Legal Affairs and Justice, and the Report on Opinions No. 828/BC-UBKTTC15 dated August 7, 2025 of the Permanent Committee for Economic and Financial Affairs;
1. This Resolution specifies the List of tasks, activities, and allocated budget limits for each task and activity related to the examination and approval of legislative acts of the National Assembly and the Standing Committee of the National Assembly and the examination, approval, and decision on joining international treaties and organizations within the jurisdiction of the National Assembly as stipulated in Section I and Section II.1 of Appendix II issued together with Resolution No. 197/2025/QH15 on special mechanisms and policies to create breakthroughs in the construction and implementation of laws (hereinafter referred to as Resolution No. 197/2025/QH15), including:
a) New Code; Code replacing the current Code;
RESOLUTION:
Article 1. Scope of Regulation
b) New Law; Law replacing the current Law;
c) Law amending and supplementing certain provisions of a Code (must follow the policy-making process);
d) Law amending and supplementing certain provisions of a Law that restricts citizens' rights according to the Constitution;
đ) Law amending and supplementing certain provisions of a Code (does not need to follow the policy-making process); current Law;
e) Pilot Resolution of the National Assembly;
g) Resolution of the National Assembly;
h) Resolution of the National Assembly amending and supplementing certain provisions of the current Resolution;
i) New Ordinance; Ordinance replacing the current Ordinance;
k) Ordinance amending and supplementing certain provisions of the current Ordinance;
l) Resolution of the Standing Committee of the National Assembly;
m) Joint Resolution between the Standing Committee of the National Assembly, the Government, and the Central Steering Committee of the Vietnam Fatherland Front;
n) International Treaty; joining an international organization that must be approved according to the Law on International Treaties.
2. This Resolution does not apply to:
a) The examination and approval of Resolutions of the National Assembly and the Standing Committee of the National Assembly that are not legislative acts; the examination of draft resolutions, projects, reports, and other documents submitted to the National Assembly and the Standing Committee of the National Assembly; tasks and activities to address issues arising from the operations of the National Assembly and the Standing Committee of the National Assembly, and other agencies of the National Assembly.
The implementation of funding for the tasks and activities specified herein shall be carried out in accordance with the State Budget Law and the regulations of the Standing Committee of the National Assembly. Funding for these activities and tasks will be allocated from the operational budget of the National Assembly;
b) The list of tasks, activities, and budget limits for legislative planning work during the term of the National Assembly, annual legislative programs; funding for monitoring legislative acts and supporting the enforcement of laws; funding for other tasks and activities subject to other special mechanisms and policies not covered under Clause 1 of this Article shall be implemented in accordance with the regulations of the Government.
1. Ensure compliance with the principle of applying special mechanisms and policies as stipulated in Article 3 of Resolution No. 197/2025/QH15.
2. The implementation of funding for tasks and activities related to the examination and approval of legislative acts of the National Assembly and the Standing Committee of the National Assembly and the examination, approval, and decision on joining international treaties and organizations within the jurisdiction of the National Assembly must comply with the regulations, budget limits, and objects as prescribed in this Resolution, the State Budget Law, and other relevant laws.
Article 2. General Principles
3. The National Ethnic Council, Committees of the National Assembly, the Office of the National Assembly, and Delegations of National Assembly Members are responsible for managing and using the allocated funds, ensuring economy, efficiency, transparency, and clarity. The head of the agency assigned to perform the task and activity has the authority to decide on the content of expenditure and change the content of expenditure in accordance with the principle stipulated in Article 3 of Resolution No. 197/2025/QH15.
Based on the regulations of the State Budget Law, the expenditure system stipulated in this Resolution, and the assigned tasks, the Office of the National Assembly is responsible for timely allocation and transfer of sufficient funds to the National Ethnic Council, Committees of the National Assembly, and Delegations of National Assembly Members.
3. The National Ethnic Council, the Committees of the National Assembly, the Office of the National Assembly, and the Delegations of National Assembly members are responsible for managing and using the allocated budget funds, ensuring economy, efficiency, transparency, and clarity. The head of the agency assigned to perform tasks and activities has the authority to independently decide on expenditure items and change expenditure items in accordance with the principles set forth in Article 3 of Resolution No. 197/2025/QH15.
Based on the provisions of the State budget law, the expenditure regulations stipulated in this Resolution, and the assigned tasks, the Office of the National Assembly is responsible for timely allocation and transfer of sufficient budget funds to the National Ethnic Council, the Committees of the National Assembly, and the Delegations of National Assembly members.
Article 3. List of tasks, activities, and budget allocation limits
1. The list of tasks, activities, and budget allocation limits for each task and activity serving the work of reviewing and passing normative legal documents of the National Assembly, the Standing Committee of the National Assembly, and reviewing, approving, and deciding on joining international treaties and organizations within the authority of the National Assembly shall be implemented according to specific provisions in Appendices 1, 2, and 3 issued together with this Resolution.
Expenses for organizing meetings of the National Ethnic Council, Committees of the National Assembly, conferences, seminars, roundtable discussions, surveys, ensuring material infrastructure, equipment for working conditions, and other necessary conditions shall be carried out by the Office of the National Assembly in accordance with other regulations of the Standing Committee of the National Assembly, relevant laws, and from the operational budget of the National Assembly.
Expenses for the activities of agencies and organizations submitting draft projects and proposals during the process of reviewing and passing normative legal documents of the National Assembly, the Standing Committee of the National Assembly, and reviewing, approving, and deciding on joining international treaties and organizations within the authority of the National Assembly shall be implemented according to the regulations of the Government.
2. Payment of expenses under the allocated budget shall be based on the results of each task and activity but not exceeding the total review and passage expense limit for normative legal documents of the National Assembly, the Standing Committee of the National Assembly, approval documents, and decisions on joining international treaties and organizations within the authority of the National Assembly as stipulated in Appendix II issued together with Resolution No. 197/2025/QH15. In cases where the competent authority decides to change, suspend, or terminate legislative tasks, the content of completed tasks and activities in accordance with the regulations before the decision of the competent authority is made shall still be settled and finalized according to the product results of the completed tasks and activities, corresponding to the expenditure content and budget limits specified in Appendices 1, 2, and 3 issued together with this Resolution.
3. Annually, based on the Legislative Program, the division of labor of the Standing Committee of the National Assembly, and the budget allocation list for reviewing and passing normative legal documents of the National Assembly, the Standing Committee of the National Assembly, and reviewing, approving, and deciding on joining international treaties and organizations as stipulated in Appendices 4 and 5 issued together with this Resolution, relevant agencies shall submit their budgets to the Office of the National Assembly for consolidation. The establishment, allocation, and payment of the budget according to the allocated budget method shall be carried out according to the regulations of the Government's Decree guiding certain provisions of Resolution No. 197/2025/QH15.
In cases where a law project, ordinance, or resolution is added to the Legislative Program or the session program of the National Assembly, the Secretary-General of the National Assembly - Chairman of the Office of the National Assembly shall direct the supplementary budget preparation and allocation to relevant agencies for implementation in accordance with the State Budget Law.
Article 4. Organization of Implementation
1. The Chairperson of the National Ethnic Council and the Chairman of the Committees of the National Assembly assigned to implement the tasks and activities specified in the Appendices issued together with this Resolution shall have the following responsibilities:
a) Decide on expenditure content; be responsible for managing, using, and ensuring appropriate budget allocation corresponding to the importance and complexity of the tasks and activities and meeting actual requirements in implementing the tasks and activities;
b) Adhere to supervision, inspection, and audit regulations; ensure democracy, transparency, and accountability; be responsible for evaluating and deciding on completed products within the scope of assigned tasks and activities;
c) When necessary, consider and decide on issuing guidelines for implementing the expenditure system in the agency in accordance with this Resolution and other relevant laws;
d) Decide on the use of remaining funds after spending on tasks and activities according to the budget limits specified in the Appendices issued together with this Resolution to allocate to other review and passage tasks and activities where the allocated budget does not meet the requirements of the tasks.
2. The Secretary-General of the National Assembly - Chairman of the Office of the National Assembly shall be responsible for organizing the implementation of the provisions of Clause 1 of this Article for the tasks and activities of leadership, guidance, advisory agencies, the Office of the National Assembly, and advisory agencies assisting the National Assembly Party Committee.
3. The Head of the Delegation of National Assembly Deputies shall be responsible for organizing the implementation of the provisions of Clause 1 of this Article for the tasks and activities of the Delegation of National Assembly Deputies (Deputies performing non-professional duties) and civil servants and workers serving the activities of the Delegation of National Assembly Deputies of the Office of the Delegation of National Assembly Deputies and People's Councils.
Article 5. Implementation Provisions
1. This Resolution shall take effect from the date of its adoption.
2. Expenditure for the work of reviewing and amending law projects, ordinances, resolutions, soliciting opinions on law projects, ordinances, resolutions, supporting National Assembly Deputies to independently study and provide opinions on projects, and supporting the construction of laws for officials, civil servants, and workers of the Office of the National Assembly, the Office of the Delegation of National Assembly Deputies, and People's Councils (directly assisting the Delegation of National Assembly Deputies), and expenditure standards for overcoming tasks related to the work of reviewing and passing normative legal documents of the National Assembly, the Standing Committee of the National Assembly, reviewing, approving, and deciding on joining international treaties and organizations within the authority of the National Assembly shall be implemented according to the provisions of this Resolution starting from July 1, 2025.
3. In cases where the Government adjusts or supplements the provisions in Appendix II issued together with Resolution No. 197/2025/QH15, it shall instruct the Office of the National Assembly to review the list of tasks, activities, and budget allocation limits stipulated in this Resolution, report to seek opinions from the Standing Committee of the National Assembly before making adjustments.
4. The Office of the National Assembly shall guide the implementation of this Resolution.
Article 6. Transitional provisions
In the case where tasks and activities related to reviewing, passing normative legal documents of the National Assembly, the Standing Committee of the National Assembly, and reviewing, approving, deciding on joining international treaties and organizations within the jurisdiction of the National Assembly are assigned before July 1, 2025 according to programs and plans that have been decided and approved, but the implementation of these tasks and activities occurs after July 1, 2025, they shall be supplemented with the budget and paid according to the quota rates as stipulated in Resolution No. 197/2025/QH15 and this Resolution.
This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, Session 48, on August 13, 2025.
