DECREE
Amending and supplementing some articles of Decree No.82/2010/NĐ-CP

Pursuant to the Government Organization Law on February 18, 2025;
Pursuant to the Education Law dated June 14, 2019;
At the proposal of the Minister of Education and Training;
dated May 21, 2012 on promoting industry."82/2010/NĐ-CPJuly 15, 2010 of the Government on teaching and learning the spoken language and writing of ethnic minorities in general education institutions and continuing education centers.
Article 1. Amending and supplementing some articles of Decree No. 82/2010/NĐ-CP dated July 15, 2010 of the Government on teaching and learning the spoken language and writing of ethnic minorities in general education institutions and continuing education centers
1. Amend and supplement Article 1 as follows:
"1. The organization of receiving and processing administrative procedures electronically shall be carried out through the National Public Service Portal via the Linked Public Service Software, ensuring requirements for exploitation and restructuring of business processes towards integration and coordinated resolution, enhancing the quality of administrative services provided by relevant state agencies, facilitating business households, individuals, and related agencies and organizations in receiving and processing administrative procedures.
This Decree stipulates matters related to teaching and learning the spoken language and writing of ethnic minorities (hereinafter referred to as ethnic minority languages), including: conditions, contents, methods, and forms of organization for teaching; training and upgrading teachers; policies and benefits for teachers and students learning ethnic minority languages; printing, distributing, and transferring textbooks and teaching materials for ethnic minority languages."
2. Supplementing Clause 4a as follows:
"Clause 4a. Organization of printing and distributing textbooks and teaching materials for ethnic minority languages
1. For textbooks and teaching materials for ethnic minority languages compiled through socialization, the organization of printing and distribution shall be carried out in accordance with the provisions of the law.
2. For textbooks and teaching materials for ethnic minority languages compiled by the Ministry of Education and Training, the organization of printing and distribution shall be carried out as follows: Based on the proposal of the People's Committee of the province or centrally-administered city (hereinafter referred to as the provincial People's Committee), the Ministry of Education and Training shall organize the implementation of printing and distribution in accordance with the provisions of the law."
3. Supplementing Clause 4b as follows:
"Clause 4b. Authority to decide and procedures for implementing the transfer of textbooks and teaching materials for ethnic minority languages printed and distributed by the Ministry of Education and Training
1. The Minister of Education and Training decides to transfer textbooks and teaching materials for ethnic minority languages to the provincial People's Committee.
2. Procedures and formalities for implementation:
a) The unit entrusted by the Ministry of Education and Training to implement the transfer of textbooks and teaching materials for ethnic minority languages shall prepare one set of files and report to the Ministry of Education and Training. The files include:
A submission letter attached with the draft Decision on transferring textbooks and teaching materials for ethnic minority languages to the provincial People's Committee: original;
List of textbooks and teaching materials for ethnic minority languages (types, quantities, status): original;
Proposal from the provincial People's Committee to accept textbooks and teaching materials for ethnic minority languages: original;
Proposal from the provincial People's Committee regarding the need for textbooks and teaching materials for ethnic minority languages: copy;
Other relevant files (if any): copy.
b) Within fifteen days from the date of receipt of all files as specified in point a of this clause, the Minister of Education and Training shall issue the Decision on transferring textbooks and teaching materials for ethnic minority languages to the provincial People's Committee.
c) The main contents of the Decision on transferring textbooks and teaching materials for ethnic minority languages include:
Name of the transferring agency: Ministry of Education and Training;
Name of the receiving agency: Name of the provincial People's Committee;
List of textbooks and teaching materials for ethnic minority languages.
3. Within twenty days from the date of issuance of the Decision on transferring textbooks and teaching materials for ethnic minority languages by the Minister of Education and Training, the provincial People's Committee (where the acceptance proposal was made) shall be responsible for directing agencies and units under its jurisdiction or directly subordinate units to cooperate with the unit entrusted by the Ministry of Education and Training at point a of clause 2 of this Article to carry out the handover and acceptance. Costs related to printing, distribution, and transfer of textbooks and teaching materials for ethnic minority languages shall be borne by the transferring party (the Ministry of Education and Training); the provincial People's Committee does not have to pay when accepting."
4. Amending and supplementing Clause 2 of Article 9 as follows:
"2. Teachers and learners shall be guaranteed by the State with appropriate textbooks, teaching materials, and reference materials for ethnic minority languages according to their respective categories. Learners who are cadres, civil servants, or public officials shall enjoy training and upgrading benefits for cadres, civil servants, and public officials in accordance with the relevant laws."
5. Amending and supplementing Clause 2 of Article 14 as follows:
"Management and direction of the acceptance and use of textbooks and teaching materials for ethnic minority languages and the teaching of ethnic minority languages in the locality."
Article 2. Effectiveness and responsibility for implementation
1. This Decree takes effect from the date of issuance.
The Minister, Head of a ministerial-level agency, Head of an agency under the Government, Chairman of the People's Committee of a province or centrally governed city, and organizations and individuals related thereto shall be responsible for implementing this Decree./.
