Guidelines for implementing certain provisions on coordination of activities between the People's Militia and Forest Rangers in forest protection work pursuant to Decree No. 74/2010/NĐ-CP dated July 12, 2010 of the Government

On the basis of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

On the basis of Decree No. 74/2010/NĐ-CP dated July 12, 2010 of the Government stipulating the coordination of activities between the People's Militia and the Public Security Police at commune, ward, and town levels, Forest Rangers, and other forces in maintaining political security, social order, and safety, and in forest protection work;

On the basis of Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the organization and operation of Forest Rangers;

The Ministry of National Defense and the Ministry of Agriculture and Rural Development provide guidelines for certain provisions on coordination of activities between the People's Militia and Forest Rangers in forest protection work as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides guidance on building plans for coordinated activities; organizing meetings; conducting inspections; summarizing and concluding; propaganda, training, and instruction on forest protection; organizing drills and exercises on forest fire prevention and suppression; mobilizing the People's Militia to coordinate with Forest Rangers in forest protection work according to point c Clause 2, Clause 3 Article 3; point b Clause 4, point b Clause 5, point b Clause 6 Article 4; Clause 2 Article 24; point c Clause 1 Article 25 of Decree No. 74/2010/NĐ-CP dated July 12, 2010 of the Government stipulating the coordination of activities between the People's Militia and the Public Security Police at commune, ward, and town levels, Forest Rangers, and other forces in maintaining political security, social order, and safety, and in forest protection work (hereinafter referred to as Decree No. 74/2010/NĐ-CP).

Article 2. Applicability

1. Relevant agencies and units under the Ministry of National Defense and the Ministry of Agriculture and Rural Development; state agencies; political organizations, socio-political organizations, public service units, economic organizations (hereinafter collectively referred to as agencies and organizations) that organize self-defense forces; Military Command Departments of central ministries and sectors; Military Command Departments of communes, wards, and towns (hereinafter collectively referred to as commune level), Military Command Departments of agencies and organizations at the grassroots level.

2. Core People's Militia forces and Forest Rangers.

Chapter II

BUILDING PLANS FOR COORDINATED ACTIVITIES, MEETINGS, INSPECTIONS, SUMMARIZING AND CONCLUDING

Article 3. Building plans for coordinated forest protection activities

1. Content of the plan for coordinated activities

a) Assessment of the situation related to forest protection work;

b) Tasks for coordinated activities;

c) Forces and means participating;

d) Time for coordination;

đ) Assurance measures;

e) Implementation organization and command assignment.

2. Responsibility for building the plan

a) The Forest Ranger in charge of the area shall take the lead and coordinate with the Military Command Department at the commune level to build the plan for coordinated activities between the Forest Rangers and the People's Militia in forest protection work at the commune level;

b) The Military Command Department of the agency or organization at the grassroots level, the Self-Defense Unit Commander (in areas without a Military Command Department of the agency or organization at the grassroots level, collectively referred to as the Self-Defense Commander) shall take the lead and coordinate with the Forest Ranger in charge of the area to build the plan for coordinated activities between the Forest Rangers and the self-defense forces in forest protection work at the grassroots-level agency or organization located within the commune.

3. Method for building the plan

a) The Forest Ranger in charge of the area shall take the lead and coordinate with the Military Command Department at the commune level to survey, grasp the relevant situation, and implement the plan construction;

b) The Military Command Department of the agency or organization at the grassroots level, the Self-Defense Commander shall take the lead and coordinate with the Forest Ranger in charge of the area to survey, grasp the relevant situation, and implement the plan construction;

c) The Forest Ranger in charge of the area shall report in writing to the District Forest Ranger Office; the Military Command Department at the commune level, the Military Command Department of the agency or organization at the grassroots level, the Self-Defense Commander shall report in writing to the Military Command Department at the district level; when there are comments from the District Forest Ranger Office and the Military Command Department at the district level, the Forest Ranger in charge of the area, the Military Command Department at the commune level, the Military Command Department of the agency or organization at the grassroots level, the Self-Defense Commander shall complete the plan, sign and bear responsibility before submitting it for approval by the Chairman of the People's Committee at the commune level or the head of the grassroots-level agency or organization;

d) Based on consensus, the Military Command Department at the commune level, the Military Command Department of the agency or organization at the grassroots level, the Self-Defense Commander; the Forest Ranger in charge of the area shall take the lead in coordinating and proposing tasks for each force to carry out forest protection work;

đ) The Military Command Department at the commune level, the Military Command Department of the agency or organization at the grassroots level, the Self-Defense Commander shall directly assign forest protection tasks to the forces under their command.

Article 4. Coordination Meetings

1. Responsibilities for organizing coordination meetings

a) The main responsibility for organizing coordination meetings on directing and coordinating between the People's Militia Self-Defense Force and the Forest Rangers in forest protection work: at the Ministry level, it is the Forest Protection Department under the General Administration of Forestry - Ministry of Agriculture and Rural Development and the People's Militia Self-Defense Department under the General Staff Department - Ministry of National Defense; at the provincial level, it is the Department of Agriculture and Rural Development and the Provincial Military Command; at the district level, it is the District Forest Ranger Station, Special Purpose Forest Ranger Station, and the District Military Command taking turns to assume this responsibility;

b) Coordination meetings between the District Military Command, the Military Command of agencies and organizations at the grassroots level with the Forest Rangers in their respective areas in accordance with points b and c of Clause 1, Article 3 of Decree No. 74/2010/NĐ-CP.

2. Meeting schedules

c) The Forest Protection Department shall coordinate with the People's Militia Self-Defense Department; the Department of Agriculture and Rural Development shall coordinate with the Provincial Military Command to organize regular coordination meetings every six months once;

b) The District Forest Ranger Station shall take the lead in organizing regular coordination meetings every quarter once together with the Special Purpose Forest Ranger Station in their respective areas and the District Military Command;

c) The Forest Rangers shall take the lead in organizing regular coordination meetings every month once together with the District Military Command, the Military Command of agencies and organizations at the grassroots level, and the Militia Self-Defense Unit assisting the Chairman of the People’s Committee at the district level or the head of agencies and organizations at the grassroots level whose offices are located within their respective areas;

d) The Forest Protection Department, the Department of Agriculture and Rural Development, the District Forest Ranger Station, and the Forest Rangers shall take the lead in proposing emergency coordination meetings when there are complex situations regarding forest protection and firefighting;

3. Contents of coordination meetings

a) The situation of compliance with laws on forest protection and firefighting nationwide, at the provincial level, district level, commune level, and border regions related to these levels;

b) Directives from the Forest Ranger agencies, military agencies at higher levels, and the same-level Party committees and governments in forest protection and firefighting;

c) Results of cooperation between the Forest Ranger forces and the People's Militia Self-Defense forces and other forces in forest protection, firefighting, and handling violations of laws on forest protection and firefighting;

d) Tasks, contents, and measures to enhance the effectiveness of cooperation between the Forest Ranger forces and the People's Militia Self-Defense forces and other forces in the future;

e) Proposals and recommendations to the Government, Ministry of National Defense, Ministry of Agriculture and Rural Development; the Department of Agriculture and Rural Development, the District Forest Ranger Station, and the Provincial Military Command, the District Military Command, and the same-level Party committees and local governments; the Forest Ranger agencies, and the People's Militia Self-Defense agencies in forest protection and firefighting;

4. Methods of coordination meetings

a) Before coordination meetings

The unit responsible for organizing the meeting shall compile the relevant situation concerning forest protection and firefighting work in their respective areas, prepare the report content, determine the program, participants, location, time, and support work; report to the Chairman of the People’s Committee at the same level to convene or invite the meeting participants; the cooperating units shall be responsible for providing relevant information to prepare the report and assist in the preparation work;

b) During coordination meetings

The unit responsible for organizing the meeting shall present the report according to the content stipulated in Clause 3 of this Article; maintain discussions, conclusions, and answers to difficulties and recommendations of subordinate forces;

c) After coordination meetings

The unit responsible for organizing the meeting shall cooperate with related units to complete the report, submit it to the Chairman of the People’s Committee at the same level for approval, jointly bear responsibility with the cooperating units for reporting to the same-level Party committees and governments, the Department of Agriculture and Rural Development, the District Forest Ranger Station, and the Provincial Military Command, the District Military Command; inform the related forces in their respective areas; the People's Militia Self-Defense Department and the Forest Protection Department shall report to their immediate superiors.

Article 5. Inspection

1. Inspection System

The Forest Protection Department shall take the lead and coordinate with the Self-Defense Militia Department to advise the Ministry of Agriculture and Rural Development and the Ministry of National Defense on proposals to the Prime Minister according to the inter-ministerial cooperation agreement between the two Ministries; the Department of Agriculture and Rural Development shall take the lead and coordinate with the Military Command at the provincial level; the District Forest Protection Office shall take the lead and coordinate with the Military Committee at the district level to organize inspections of the coordination work between forest protection forces and self-defense militia forces in protecting, preventing, and extinguishing forest fires on a monthly, quarterly, semi-annual, annual basis, and ad hoc inspections. a) Provincial level: Provincial People's Committee, Department of Agriculture and Rural Development, Provincial Military Command;

2. Objects to be inspected

b) District level: District People's Committee, District Forest Protection Office, Specialized Forest Protection Office, District Military Committee, self-defense militia units;

c) Commune level: Commune People's Committee, Commune Military Committee, Forest Ranger Team, heads and Military Committees of agencies and organizations based in the commune; self-defense militia forces at the commune level; self-defense forces of agencies and organizations based in the commune.

a) Implementation of the Party's and State's policies and guidelines; resolutions and directives of various levels of Party committees and authorities regarding forest protection, fire prevention, and firefighting; issuance of leadership and guidance documents and organization of coordinated work between forest protection forces and self-defense militia forces in forest protection, fire prevention, and firefighting;

3. Content of inspection

b) Performance of the State management functions of the Provincial People's Committee, District People's Committee, and Commune People's Committee in forest protection, fire prevention, and firefighting;

c) Advisory and implementation functions of the Department of Agriculture and Rural Development, District Forest Protection Office, Specialized Forest Protection Office, Forest Ranger Team, Provincial Military Command, District Military Committee, Commune Military Committee, Military Committees of agencies and organizations, and Self-Defense Commanders in coordinating the work between forest protection forces and self-defense militia forces in fulfilling forest protection, fire prevention, and firefighting tasks;

d) Results of the joint activities of the two forces and other forces specified in Articles 3, 4, 5, 6, and from Article 22 to Article 26 of Decree No. 74/2010/NĐ-CP.

4. Inspection Plan

a) The inter-ministerial inspection plan of the Ministry of Agriculture and Rural Development - Ministry of National Defense shall be proposed by the Forest Protection Department taking the lead and coordinating with the Self-Defense Militia Department, submitted for signature and responsibility by the direct superiors of the two Departments;

b) The inter-ministerial inspection plan of the Department of Agriculture and Rural Development - Provincial Military Command shall be developed by the Forest Protection Service taking the lead and coordinating with relevant functional agencies of the Provincial Military Command, submitted for signature and responsibility by the Director of the Department of Agriculture and Rural Development and the Commander-in-Chief of the Provincial Military Command; the inter-ministerial inspection plan of the District Forest Protection Office - District Military Committee shall be developed by the District Forest Protection Office taking the lead and coordinating with the District Military Committee, jointly signed and responsible.

5. Inspection Team Organization

a) The inter-ministerial inspection team of the Ministry of Agriculture and Rural Development - Ministry of National Defense includes: leaders of both Ministries and related functional agency staff, representatives of the Military Region Command, the Capital Military Command, and other related agencies conducting inspections at the provincial, district, and commune levels, self-defense militia forces, and forest protection forces;

b) The inter-ministerial inspection team of the Department of Agriculture and Rural Development - Provincial Military Command includes: the Director of the Department of Agriculture and Rural Development and the Commander-in-Chief of the Provincial Military Command, representatives of related departments, sectors, and mass organizations at the same level conducting inspections at the district and commune levels, self-defense militia forces, and forest protection forces;

c) The inter-ministerial inspection team of the District Forest Protection Office - District Military Committee includes: the Head of the District Forest Protection Office and the Commander-in-Chief of the District Military Committee, representatives of related departments, sectors, and mass organizations at the same level conducting inspections at the commune level, self-defense militia forces, and forest protection forces.

c) The inter-sectoral inspection team of the Forest Protection Department at the district level - Military Command at the district level shall consist of: The Head of the Forest Protection Department at the district level and the Commander of the Military Command at the district level, representatives from relevant departments, sectors, and organizations at the same level to conduct inspections at the commune level, civilian self-defense forces, and forest protection forces.

Article 6. Preliminary Summary

1. Content

a) Evaluate the situation related to forest fire prevention and protection work; the results of advisory work for the same-level Party committees and administrative authorities of the Department of Agriculture and Rural Development and the Provincial Military Command; Forest Protection Stations at the district level, Specialized Forest Protection Stations, and District Military Commands; Forest Protection Officers and Village Military Commands; the results of advisory work for the heads of military commands and organizations at the grassroots level, and Self-Defense Force Commanders;

b) Assess the outcomes of organizing and coordinating activities between forest rangers, self-defense forces, and other forces in protecting, preventing, and extinguishing forest fires within their jurisdiction;

c) Identify the reasons for strengths and weaknesses in the coordination of tasks related to protecting, preventing, and extinguishing forest fires;

d) Determine directions, contents, and methods for organizing cooperative work between the Department of Agriculture and Rural Development and the Provincial Military Command; Forest Protection Stations at the district level, Specialized Forest Protection Stations, and District Military Commands; Forest Protection Officers and Village Military Commands, Military Commands of organizations at the grassroots level, and Self-Defense Force Commanders; forest ranger forces, self-defense forces, and other forces executing tasks related to protecting, preventing, and extinguishing forest fires;

đ) Propose and recommend policies, measures, and initiatives to higher authorities regarding cooperation in carrying out tasks related to protecting, preventing, and extinguishing forest fires.

2. Methods

a) The preliminary summary of the coordinated activities between the Department of Agriculture and Rural Development and the Provincial Military Command; Forest Protection Stations at the district level, Specialized Forest Protection Stations, and District Military Commands; Forest Protection Officers and Village Military Commands, Military Commands of organizations at the grassroots level, and Self-Defense Force Commanders; forest ranger forces, self-defense forces, and other forces executing tasks related to protecting, preventing, and extinguishing forest fires shall be organized as separate meetings or evaluated in local, grassroots, agency, and organization defense, military, and security reports;

b) The Department of Agriculture and Rural Development, Forest Protection Stations at the district level, and Forest Protection Officers shall take the lead, coordinating with the Provincial Military Command, District Military Commands, Village Military Commands, Military Commands of organizations at the grassroots level, and Self-Defense Force Commanders to prepare the preliminary summary content;

c) After the preliminary summary, the Director of the Department of Agriculture and Rural Development, the Heads of Forest Protection Stations at the district level, and Forest Protection Officers shall take the lead, coordinating with the Commanders of the Provincial Military Command, District Military Commands, Village Military Commands, Military Commands of organizations at the grassroots level to complete the report, jointly signing and assuming responsibility; reporting to the same-level Party committees and administrative authorities, heads of agencies and organizations, higher authorities of the two forces, and informing relevant forces within the jurisdiction, while also reporting to the Ministry of Agriculture and Rural Development (through the Forest Protection Bureau), the Regional Military Command (through the General Staff), and the Ministry of National Defense (through the Militia and Self-Defense Forces Bureau).

Article 7. Final Summary

1. The Forest Protection Bureau shall take the lead, coordinating with the Militia and Self-Defense Forces Bureau to propose organizing a final summary meeting at the ministry level on the guidance and coordination work between forest ranger forces and self-defense forces in protecting, preventing, and extinguishing forest fires according to Article 4 of Decree No. 74/2010/NĐ-CP.

2. The Department of Agriculture and Rural Development, Forest Protection Stations at the district level, and Forest Protection Officers shall take the lead, coordinating with the Provincial Military Command, District Military Commands, and Village Military Commands to advise the Chairperson of the People's Committee at the same level to organize a final summary meeting on the coordination work between forest ranger forces and self-defense forces in protecting, preventing, and extinguishing forest fires.

3. The content of the final summary meeting includes:

a) Evaluating the results of guidance and implementation coordination between forest ranger forces and self-defense forces in protecting, preventing, and extinguishing forest fires as stipulated in Clause 1, Article 6 of this Circular;

b) Awarding commendations to collectives and individuals who have achieved success in performing tasks related to protecting, preventing, and extinguishing forest fires.

4. After the final summary, implement Point c, Clause 2, Article 6 of this Circular.

Chapter III

PROPAGANDA, TRAINING, ORGANIZING DRILLS, SIMULATIONS, AND MOBILIZATION OF FORCES

Article 8. Coordination in Publicizing Work on Forest Protection, Fire Prevention and Fighting

1. Forest Rangers

a) Annually, based on directives and guidance from the Ministry of Agriculture and Rural Development, the Department of Agriculture and Rural Development shall determine the content and form of publicizing and disseminating knowledge of forest management laws, forest protection, fire prevention and fighting for civilian self-defense forces and the general public;

b) The Department of Agriculture and Rural Development, Forest Ranger Stations, and local Forest Rangers shall coordinate with relevant agencies to organize publicity through mass media and community activities in villages, hamlets, communes, wards, and other similar units (collectively referred to as villages) regarding forest protection, fire prevention and fighting;

c) Local Forest Rangers shall take the lead and coordinate with civilian self-defense forces and various sectoral, mass organizations at the commune level to conduct publicizing work to enhance the public's awareness of forest protection, fire prevention and fighting;

2. Civilian Self-Defense Forces

a) Annually, based on directives from the Ministry of National Defense and guidance from the Military Region Command, the Hanoi Military Command, and the Provincial Military Command, they shall cooperate with the Department of Agriculture and Rural Development to incorporate education and dissemination of knowledge of forest management laws, forest protection, fire prevention and fighting into the political and legal education programs for civilian self-defense forces;

b) The Commune People's Militia Command, the People's Militia Command of agencies and organizations, and the Self-Defense Command with headquarters within the area shall organize the civilian self-defense forces under their jurisdiction to coordinate with forest rangers and various sectoral, mass organizations at the commune level to conduct publicizing work on forest protection, fire prevention and fighting;

c) The civilian self-defense forces shall integrate the enhancement of public awareness on forest protection, fire prevention and fighting into their participation in civil mobilization activities.

Article 9. Training and Instruction

1. The organization of training for civilian self-defense force cadres and forest ranger officials on forest protection, fire prevention and fighting shall be led by the Department of Agriculture and Rural Development and Forest Ranger Stations, coordinating with the Provincial Military Command and the District People's Militia Command to develop plans, implement them, and ensure all aspects thereof;

2. Annually, the Provincial Military Command and the District People's Militia Command shall direct the Commune People's Militia Command, the People's Militia Command of agencies and organizations at the grassroots level, and the Self-Defense Command to organize training on forest protection, fire prevention and fighting for civilian self-defense forces during military training periods as stipulated in Clause 2, Article 34 of the Law on Civilian Self-Defense Forces and related implementing regulations;

3. Annually, based on requirements and actual circumstances of forest protection, fire prevention and fighting tasks, the Department of Agriculture and Rural Development and Forest Ranger Stations shall lead and coordinate with the Provincial Military Command and the District People's Militia Command to determine the content of training and instruction for forest ranger officials, command officers, and civilian self-defense forces under their jurisdiction;

4. The Forest Ranger General Department under the Forestry General Administration of the Ministry of Agriculture and Rural Development shall lead and coordinate with the Civilian Self-Defense Force General Department under the General Staff Department of the Ministry of National Defense to research and compile training materials for forest rangers and civilian self-defense forces on forest protection, fire prevention and fighting.

Article 10. Drills and Exercises on Forest Fire Prevention and Suppression

1. Regulations

a) Annually, before the critical period when forest fires are likely to occur within their jurisdiction, the Department of Agriculture and Rural Development and the Forest Protection Division shall take the lead, coordinating with the Military Command at the provincial level and the Military Command at the district level to advise the People's Committee at the same level to direct relevant organizations to organize drills for the coordination between civilian self-defense forces, forest protection forces, and other forces regarding forest fire prevention and suppression;

b) Based on the situation and requirements for forest fire prevention and suppression, the Department of Agriculture and Rural Development shall take the lead, coordinating with the Military Command at the provincial level to advise the People's Committee at the same level, directing localities within their jurisdiction to organize exercises on forest fire prevention and suppression.

2. Content

a) The guidance and management work of People's Committees at all levels, heads of agencies and organizations located within the jurisdiction;

b) The advisory and implementation functions of the Department of Agriculture and Rural Development, the Forest Protection Division, the Forest Protection Area, the Military Command at the provincial level, the Military Command at the district level, the Military Command at the commune level, the Military Command of agencies and organizations at the grassroots level in handling situations related to forest fire prevention and suppression, and mitigating the consequences of forest fires;

c) Mobilizing personnel, materials, and equipment to serve the tasks of forest fire prevention and suppression, mitigating the consequences of forest fires, and replanting forests in areas affected by fires;

d) The cooperation activities between civilian self-defense forces and forest protection forces and other forces in forest fire prevention and suppression, and mitigating the consequences of forest fires;

đ) The investigation and understanding of the causes when forest fires occur.

3. Methods

a) When conducting drills on forest fire prevention and suppression for civilian self-defense forces, forest protection forces, and other forces, the Forest Protection Area shall take the lead, coordinating with the Military Command at the commune level, the Military Command of agencies and organizations at the grassroots level, and the Self-Defense Commander to prepare the content, report to the Chairman of the Commune People's Committee, the head of the agency or organization for decision, and report to the superior bodies of each force and organization for implementation;

b) When organizing exercises on forest fire prevention and suppression, a Steering Committee, a directorate team, and an assistance team must be established; plans for the exercise and documents for participating components must be developed; training and drills on the contents must be organized; practical exercises must be conducted according to the plan approved by the competent authority.

4. The General Staff Department of the Ministry of National Defense shall take the lead, coordinating with the Forestry General Department of the Ministry of Agriculture and Rural Development to study and guide civilian self-defense forces, forest protection forces, and other forces in conducting exercises on forest fire prevention and suppression.

Article 11. Mobilization of Forces, Materials, and Equipment to Implement Tasks of Forest Protection, Fire Prevention, and Suppression

1. The Department of Agriculture and Rural Development, the Forest Protection Division, the Forest Protection Area

a) When forest fires occur or violations of forest protection laws happen in border areas between provinces, the Department of Agriculture and Rural Development shall report to the People's Committee at the same level to request the People's Committee, the Department of Agriculture and Rural Development, and the Military Command at the provincial level in adjacent areas to prepare mobilization of forces, materials, and equipment to participate in the tasks of forest protection, fire prevention, and suppression;

b) Based on the forest protection and fire prevention and suppression plan and the actual situation, the Director of the Department of Agriculture and Rural Development, the Head of the Forest Protection Division, and the Head of the Forest Protection Area shall coordinate with the Commander of the Military Command at the provincial level, the Commander of the Military Command at the district level, the Commander of the Military Command at the commune level, and relevant agencies regarding the mobilization of civilian self-defense forces' personnel, materials, and equipment;

c) Shall take the lead in reporting to the Chairman of the People's Committee at the same level to decide on the mobilization of civilian self-defense forces and various types of materials, equipment, and means to ensure the implementation of the task within their authority, while also reporting to the higher-level forest protection agency;

d) Shall coordinate with the Commander of the Military Command at the provincial level, the Commander of the Military Command at the district level, the Commander of the Military Command at the commune level to mobilize the civilian self-defense forces' personnel, materials, and equipment according to the decision of the Chairman of the People's Committee at the same level;

đ) Shall organize the deployment and utilization of personnel, materials, and equipment to practice handling situations according to the plan.

2. The Military Command at the provincial level, the Military Command at the district level, the Military Command at the commune level, the Military Command of agencies and organizations at the grassroots level, and the Self-Defense Commander with headquarters within the jurisdiction.

a) On the basis of coordination with the Director of the Department of Agriculture and Rural Development, the Head of the Forest Protection Division, and the Head of the Forest Protection Area regarding the need to mobilize civilian self-defense forces' personnel and equipment in handling situations related to forest protection, fire prevention, and suppression, the Commander of the Military Command at the provincial level, the Commander of the Military Command at the district level, the Commander of the Military Command at the commune level, the Military Command of agencies and organizations at the grassroots level, and the Self-Defense Commander with headquarters within the jurisdiction shall direct the review of civilian self-defense forces' personnel, materials, and equipment under their command to develop mobilization plans;

b) Shall report to the Chairman of the People's Committee at the same level to decide on the mobilization of personnel and various types of materials and equipment of civilian self-defense forces within their authority to implement the task, while also reporting to the Regional Military Command, the Military Command of Hanoi Capital, the Military Command at the provincial level, and the Military Command at the district level;

c) Shall organize the mobilization of civilian self-defense forces under their command and materials and equipment according to the decision of the Chairman of the People's Committee or the head of the agency or organization at the same level;

d) Shall organize the deployment and utilization of personnel and equipment to practice handling situations according to the plan.

Chapter IV

IMPLEMENTATION

Article 12. Effective Date

This Circular shall take effect 45 days from the date of signature, all previous regulations of the Ministry of Agriculture and Rural Development and the Ministry of National Defense that conflict with this Circular shall be abolished.

Article 13. Implementation Organization

The Minister, Heads of agencies at the level of ministries, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and Heads of related agencies shall be responsible for implementing this Circular. In the course of implementation, if there are any difficulties, they shall report to the Ministry of Agriculture and Rural Development and the Ministry of National Defense for study and resolution.
