Article 1. Scope of Regulation
1. Funds for supporting revolutionary meritorious persons with housing must be managed and used for their intended purpose, for the correct beneficiaries, in accordance with policies and regulations, and ensure timely payment to the beneficiaries. Article 4. Scope of Application:
2. Management and implementation costs for the policy of supporting revolutionary meritorious persons with housing must be strictly controlled, spent according to regulations, and be economical and effective. THEDeputy ministers of ministerial-level agencies, Nationalớharged with the task of approving the Prime Minister's proposal regarding the appointment of Ministers for the term 2021 - 2026 for the following gentlemen:ug.
Article 3. Principles of Management
Article 4. Beneficiaries, support levels, and sources of funding
1. Beneficiaries of housing support for revolutionary meritorious persons as stipulated in Article 2 of Decision No. 22/2013/QĐ-TTg.
2. Housing support levels from the state budget (including both central and local budgets):
- VND 40 million per household for cases where existing houses are severely damaged and need to be demolished to build new ones
- VND 20 million per household for cases requiring major repairs to the frame, walls, and roof of existing houses.
3. Central government budget sources for supporting revolutionary meritorious persons with housing:
a) The central government will provide 100% support at the level specified in Clause 2 of this Article for localities receiving more than 70% of the central budget supplement for balancing the local budget in 2012;
b) The central government will provide 95% support for localities receiving between 50% and 70% of the central budget supplement for balancing the local budget in 2012;
c) The central government will provide 90% support for localities receiving less than 50% of the central budget supplement for balancing the local budget in 2012;
d) The central government will provide 80% support for localities with a rate of revenue sharing to the central budget.
4. Provincial People's Committees shall allocate local budgets together with central government support funds to provide support at the levels specified in Clause 2 of this Article and allocate management and implementation costs for the policy of supporting revolutionary meritorious persons with housing up to a maximum of 0.5% of the total state budget support funds for implementing the policy as prescribed.
5. In addition to the support levels specified in Clause 2 of this Article, localities may provide additional support from local budgets based on actual conditions to improve the quality of housing for supported households.
The preparation of budgets, allocation, settlement accounts, and disbursement of funds for supporting revolutionary meritorious persons with housing shall be carried out in accordance with current regulations on state budget management. This Circular provides specific guidance as follows:
1. Commune People's Committees are responsible for compiling lists of revolutionary meritorious persons eligible for housing support according to Decision No. 22/2013/QĐ-TTg, support levels per household, and consolidating the demand for housing support funds in their areas, which they submit to the Department of Labor, Invalids, and Social Affairs for review and consolidation, in collaboration with the Department of Finance and Planning and other relevant agencies, for approval by the District People's Committee.
Article 5. Budget preparation, allocation, payment, and settlement of expenses
2. Based on the approved decision of the District People's Committee regarding the list of revolutionary meritorious persons eligible for housing support, support levels, and housing support fund requirements, the Construction Department shall compile the list, support levels, and housing support fund requirements for revolutionary meritorious persons in their locality, which they submit to the Finance Department for verification and determination of the source of implementation funds (in detail according to the central budget support, local budget guarantee, and other legitimate sources of funding), report to the Provincial People's Committee for approval to organize implementation, and simultaneously report to the Ministry of Finance, the Ministry of Construction, and relevant ministries and sectors for consideration and supplementary funding approval.
3. Based on the funding requests of provincial and centrally-administered city people's committees and the approved decisions of the Provincial People's Committee (accompanied by lists of support recipients, support levels per recipient, and administrative units at the district and commune levels), the Ministry of Finance shall determine the portion of central budget support for localities according to regulations and consolidate reports for the Prime Minister's consideration and decision.
4. Based on the central budget support funds, local budget allocations, and contributions from other legitimate financial sources as prescribed by law, Provincial People's Committees shall decide to allocate budgets to District People's Committees for implementation (detailing the support from the state budget). District People's Committees shall allocate housing support funds and delegate budget authority to Commune People's Committees or allocate budgets to Commune People's Committees through targeted supplementary transfers from higher-level budgets to lower-level budgets (accompanied by lists of support recipients, support levels per household, and administrative units at the commune level).
Commune People's Committees shall withdraw budgets from the State Treasury to make initial advances or settle housing support funds for households. Initial advance application documents include lists of households requesting advances and the amounts requested. The maximum advance amount for beneficiaries shall not exceed 60% of the state budget support. Advances to households shall be based on individual household applications for advances (Annex 1 attached).
4. Based on the central budget support funds, local budget allocations, and contributions from other legitimate financial sources as prescribed by law, the People's Committees of provinces and centrally-administered cities shall decide to allocate the budget to the People's Committees of districts for implementation (including detailed information on state budget support). The People's Committees of districts shall implement the allocation of housing support funding for persons who have rendered meritorious service to the revolution, and delegate the funding to the People's Committees of communes or allocate the budget to the People's Committees of communes in the form of supplementary targeted funding from higher-level budgets to lower-level budgets (accompanied by a list of beneficiaries for housing support, the level of support for each household by commune).
The People's Committees of communes shall withdraw the budget at the State Treasury to make initial advances or pay the support funding to households. The initial advance application file includes a list of households requesting advances and the amount of capital requested for advances. The maximum advance amount for beneficiaries shall not exceed 60% of the state budget support. Advances to households shall be based on individual household applications according to the advance request form (Annex 1 attached).
After receiving the confirmation file on the completed volume (determining the completion of house construction or repair according to the regulations of the Ministry of Construction) from the People's Committee of the commune (accompanied by an itemized list and acknowledgment from the household that has received the advance payment, the remaining capital requested for settlement), the State Treasury shall continue to pay the remainder to the People's Committee at the commune level for disbursement to the households; simultaneously, it shall transfer from advance payment to actual budget expenditure. When disbursing the remaining amount to the households, the People's Committee of the commune shall prepare an itemized list with acknowledgment from the household that has received the housing support funds as the basis for finalizing the budget settlement in accordance with the regulations.
5. The housing support funds for those who have rendered meritorious service to the revolution shall be accounted for and consolidated into the budget settlement of the district (the district budget allocates the delegated funds to the commune budget) or the budget settlement of the commune (the district budget supplements targeted funds to the commune budget) in accordance with the budget classification decided by the People's Committee at the provincial level.
6. The State Treasury shall implement control over the payment of capital to ensure that the support funds are paid out strictly in accordance with the approved list by the People's Committee at the district level and the stipulated support levels.
Article 6. Implementation Organization
1. The People's Committees at all levels shall be responsible for directing and organizing the implementation of Decision No. 22/2013/QĐ-TTg of the Prime Minister, ensuring timely completion of the support work and submitting reports to competent authorities in accordance with the prescribed forms set forth in Appendices No. 2, No. 3, No. 4, and No. 5 issued together with this Circular.
2. The People's Committee at the commune level shall be responsible for monitoring to ensure that households use the housing support funds for their intended purpose, guaranteeing the quality of houses after construction or repair; concurrently, they shall cooperate with relevant agencies in the locality to publicly disclose the state support policy: lists of housing support, individual household support levels before and after the decision on support by the competent authority is made, through mass media, posted at the People's Committee office at the commune level and in villages and hamlets in accordance with Circular No. 54/2006/TT-BTC dated June 19, 2006, issued by the Ministry of Finance, guiding the implementation of the regulation on public disclosure of direct budget support to individuals and residents.
3. This Circular takes effect from September 10, 2013. The housing support policy for those who have rendered meritorious service to the revolution shall be implemented from June 15, 2013.
4. During the implementation process, if there are difficulties or obstacles, the provinces and centrally-administered cities are requested to report to the Ministry of Finance for consideration and resolution./.
