Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, the first session of the 11th term, which stipulates the list of ministries and ministerial-level agencies under the Government;

명 정

조 1. 위치와 기능

The Ministry of Planning and Investment is an agency of the Government, performing state management functions on planning and investment, including: providing comprehensive advice on strategies, master plans, development plans for the national economy and society, on economic management mechanisms and policies in general and some specific fields, on domestic and foreign investment, industrial zones, export processing zones, on managing official development assistance (hereinafter referred to as ODA), bidding, enterprises, business registration throughout the country; state management of public services in areas within the scope of management of the Ministry as prescribed by law.

조 제2항. 임무와 권한

The Ministry of Planning and Investment shall be responsible for performing tasks and powers as prescribed in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:

1. Submit draft laws, decrees, and other draft normative legal documents on planning and investment within the scope of state management of the Ministry to the Government and the Prime Minister;

2. Submit to the Government and the Prime Minister strategic plans, overall master plans, development plans for the national economy and society, regional territories, long-term plans, five-year plans, and annual plans, and major balances of the national economy, including financial, monetary, and basic construction investment balances, as the basis for building financial-budgetary plans; organize the publication of strategic plans and overall master plans for the development of the national economy and society after approval according to regulations;

3. Issue decisions, directives, and circulars in the field of planning and investment within the scope of state management of the Ministry;

4. Direct, guide, inspect, and be responsible for implementing normative legal documents; strategies, master plans, and plans after approval, and other legal documents within the scope of management of the Ministry; provide information, propaganda, dissemination, and education on laws in areas within the scope of management of the Ministry;

5. On planning and planning:

a) Submit to the Government the action program to implement the socio-economic development plan approved by the National Assembly, monitor and compile monthly and quarterly implementation reports of the plan to report to the Government, coordinate and harmonize the implementation of major balances of the national economy. Be responsible for directing the implementation of the plan in certain fields assigned by the Government;

b) Guide ministries, ministerial-level agencies, government agencies, provincial people's committees, and centrally governed city people's committees in building plans that are consistent with the national and territorial development strategies, master plans, and plans approved;

c) Compile plans for development and capital allocation for various sectors of ministries, industries, and provinces and centrally governed cities; review development plans of ministries, ministerial-level agencies, government agencies, and provinces and centrally governed cities to submit to the Prime Minister for approval or the Ministry for approval according to the Government's classification;

d) Compile major balances of the national economy: accumulation and consumption balance, total means of payment, international balance of payments, state budget, development investment capital, state reserves. Coordinate with the Ministry of Finance to prepare the state budget estimate;

6. On domestic and foreign investment:

a) Submit to the Government planning, programs, and lists of domestic investment projects, foreign direct investment projects, and adjustments when necessary;

b) Submit to the Government the total investment capital plan for the whole society, the total amount and structure by industry and sector of state budget investment capital, additional state reserve capital, state credit support capital, state shareholding and joint venture capital, loss compensation, price supplementation, working capital replenishment, and import and export rewards. Take the lead and coordinate with the Ministry of Finance to prepare the central budget allocation plan for basic construction investment, additional state reserve capital, state credit support capital, state shareholding and joint venture capital, and consolidate the capital of the national target program;

c) Summarize comprehensively on domestic and foreign investment; coordinate with the Ministry of Finance and related ministries and sectors to inspect and evaluate the effectiveness of investment capital for basic construction projects;

d) Review investment projects within the authority of the Government and the Prime Minister to decide; issue investment permits for projects within their authority; implement the delegation of investment permit issuance according to the Prime Minister's regulations; unify the management of investment project permits for foreign investment in Vietnam and Vietnamese investment abroad;

đ) Serve as the focal point to assist the Government in managing domestic investment activities and foreign direct investment in Vietnam and Vietnamese investment abroad; organize investment promotion activities, guide investment procedures;

e) Guide, monitor, inspect, and handle issues arising during the formation, implementation, and execution of investment projects within their authority. Evaluate the results and economic-social effects of domestic and foreign investment activities. Serve as the focal point to organize meetings between the Prime Minister and investors both domestically and internationally;

7. On ODA management:

a) Serve as the focal point for attracting, coordinating, and managing ODA; take the lead in drafting strategies and plans for attracting and using ODA; guide the competent authorities in compiling priority programs and projects for ODA mobilization; compile the list of programs and projects using ODA to submit to the Prime Minister for approval;

b) Take the lead in preparing, organizing, and coordinating ODA sources in accordance with the strategy and plan for attracting and using ODA and the list of priority programs and projects for ODA mobilization;

c) 조건 외국원조협정 프레임워크를 준비하고 협상하며, 정부를 대표하여 외국원조협정 프레임워크를 체결함;

d) 관련 단위 및 기관이 외국원조 프로그램 및 사업을 준비하도록 지도하며, 재정부와 협력하여 정부 예산으로 배분되거나 다시 대출되는 외국원조 자금 사용 방식을 결정하고, 총리의 승인 권한에 속하는 외국원조 프로그램 및 사업 문서를 심사하여 총리에게 제출함;

đ) 외국 원조자들과 구체적인 외국원조 조약을 협상하고 지원함;

e) 재정부와 협력하여 정부 예산으로 배분되는 외국원조 자금 해외송금 계획을 작성하고 연간 대응 자금 계획을 세움; 재정부와 함께 외국원조 자금 해외송금, 상환 메커니즘, 외국원조 대출 회수에 참여함;

f) 외국원조 프로그램 및 사업을 모니터링하고 평가하며, 다수 부처와 관련된 문제를 처리하거나 총리에게 처리를 건의함; 외국원조 유치 및 사용 상황과 효과에 대한 정기 보고서를 작성함;

8. 입찰 관리에 관한 사항;

a) 정부 또는 총리의 권한에 속하는 프로젝트 입찰 계획 및 결과를 정부 또는 총리에게 보고하며, 정부가 승인한 입찰 프로젝트의 수행 상황을 모니터링함;

b) 입찰 관련 법률 규정의 이행을 지도하고 감사하며, 통합하고 입찰 시스템 정보를 관리함;

9. 산업단지 및 수출공단 관리에 관한 사항;

a) 전국 범위 내 산업단지, 수출공단 및 유사 경제지구의 계획 및 발전 계획을 정부에 제출함;

b) 산업단지 및 수출공단의 종합 계획, 설립, 운영에 대한 심사를 거쳐 총리에게 승인을 요청하며, 승인된 산업단지 및 수출공단 계획 및 발전 계획을 지침하고 지도함;

c) 산업단지 및 수출공단 투자 및 운영 상황을 모니터링하고 보고하며, 관련 기관과 협력하여 산업단지 및 수출공단 관리 모델 및 메커니즘에 대한 제안을 주도함;

10. 기업 및 사업 등록에 관한 사항;

a) 정부 또는 총리의 권한에 속하는 국유기업 개혁 및 발전 전략, 계획, 프로그램, 소규모 및 중소기업 지원 정책을 주도하고 관련 부처와 협력하며, 국내 투자를 장려하는 국가 관리 역할을 수행함;

b) 정부 지시에 따라 국유기업 설립, 개편, 재조직 계획을 심사하며, 국유기업 개혁 및 발전 상황과 다른 경제 성분의 기업 발전 상황을 종합하고 보고하며, 중소기업 발전을 장려하기 위한 위원회 상근 임원을 맡음;

c) 전국 범위 내 기업 등록 상황을 통합적으로 관리하며, 등록 절차를 지침하고, 등록 및 등록 후 상황을 모니터링하며, 등록 관련 위반사항을 처리하며, 전국 범위 내 등록 정보를 수집하고 저장하며 처리함;

11. 부처 관리 권한 내 연구개발, 과학기술 진보 적용 계획을 조직하고 지시함;

12. 부처 관리 권한 내 계획 및 투자 분야 국제 협력을 수행함;

13. 법령에 따라 부처 관리 권한 내 계획 및 투자 분야 공공 서비스를 관리하며, 부처 소속 비영리 기관 활동을 지휘함;

14. 법령에 따라 부처 관리 권한 내 계획 및 투자 분야 민간단체 활동을 관리함;

15. 부처 관리 권한 내 계획 및 투자 분야의 불법 행위를 감사하고 조사하며, 민원 및 고발 사건을 처리하고 부패를 방지하며, 법 위반을 처리함;

16. 총리가 승인한 행정개혁 목표 및 내용에 따라 부처 행정개혁 프로그램을 결정하고 지시함;

17. 조직 및 인력 배치를 관리하며, 부처 관리 권한 내 공무원의 급여 및 보상, 포상, 징계 제도를 지시하고, 부처 관리 권한 내 분야의 전문 교육 및 훈련을 실시함;

18. 법률 규정에 따라 배정받은 재정 및 자산을 관리하며, 예산을 분배하고 이를 실행한다.

조 3. 교육부 조직구조

a) 부 장관이 국가 행정 관리를 수행하기 위해 지원하는 조직들:

1. 국민경제 총괄과;

2. 지역경제 및 영토과;

3. 재정 및 화폐과;

4. 산업경제과;

5. 농업경제과;

6. 무역 및 서비스과;

7. 기반시설 및 도시계획과;

8. 산업단지 및 수출공단 관리과;

9. 투자 감독과;

10. 입찰 관리과;

11. 국제경제과;

12. 국방-안보과;

13. 법제과;

14. 인사과;

15. 과학, 교육, 자원 및 환경과;

16. 노동, 문화, 사회과;

17. 외국인 투자국;

18. 중소기업 발전국;

19. 감사국;

20. 비서실;

국제경제과, 국민경제 총괄과, 지역경제 및 영토과, 비서실은 중앙계획투자부 장관이 중앙인사관리부 장관과 협의 후 결정함;

b) 부 소속의 공익기관들:

1. 발전전략연구원;

2. 중앙경제관리연구원;

3. 국가사회경제정보센터;

4. 정보기술센터;

5. 투자신문;

6. 경제예측저널;

중앙계획투자부 장관은 총리에게 발전전략연구원 및 중앙경제관리연구원의 기능, 역할, 권한 및 조직 구조를 결정하도록 제안함;

조 4. 효력 발생

본 명령은 공보에 게재된 날로부터 15일 후 효력이 발생하며, 1995년 11월 1일 정부가 발표한 제75/CP 호 "투자계획부의 기능, 임무, 권한 및 조직구성에 관한 규정"과 이 명령과 충돌하는 이전의 법률 규정을 대체한다.

조 5. 집행 책임

투자계획부 장관, 각 부 장관, 정부 직속 기관 수장, 정부 소속 기관 수장 및 중앙 직할 시·도 인민위원회 주석은 본 명령을 집행하는 책임을 진다.
