Guidelines for the installation, management, and use of postal mailboxes, fixed telephone cable systems, and television cable systems

 in multi-story buildings with multiple owners

Pursuant to the Construction Law dated November 26, 2003; Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on project management for construction works and Decree No. 112/2006/NĐ-CP dated September 29, 2006 amending and supplementing certain articles of Decree No. 16/2005/NĐ-CP;

Pursuant to the Housing Law dated November 29, 2005; Decree No. 90/2006/NĐ-CP dated September 6, 2006 of the Government detailing and guiding the implementation of the Housing Law;

Pursuant to the Posts and Telecommunications Ordinance dated May 25, 2002; Decree No. 157/2004/NĐ-CP dated August 18, 2004 of the Government detailing the implementation of certain provisions of the Posts and Telecommunications Ordinance regarding posts; Decree No. 160/2004/NĐ-CP dated September 3, 2004 of the Government detailing the implementation of the Posts and Telecommunications Ordinance regarding telecommunications;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

To ensure technical infrastructure synchronization and the interests of users in multi-story buildings with multiple owners, the Ministry of Information and Communications and the Ministry of Construction provide guidelines for the installation, management, and use of postal mailboxes, fixed telephone cable systems, and television cable systems in such buildings as follows:

I. SCOPE OF REGULATION AND APPLICABLE OBJECTS

1. Scope of Regulation:

This Circular guides the installation, management, and use of postal mailboxes, fixed telephone cable systems, and television cable systems used to receive terrestrial television signals in multi-story buildings with multiple owners funded by all sources (hereinafter referred to as the building).

This Circular applies to organizations and individuals related to the construction of the building, the installation, management, and use of postal mailboxes, fixed telephone cable systems, and television cable systems in the building.

II. GUIDELINES FOR INSTALLATION

1. Regarding the installation of postal mailboxes:

Multi-story buildings with independent postal addresses must be equipped with centralized postal mailboxes. The principles for installing centralized postal mailboxes are as follows:

1.1. Located on the first floor of the building, easily visible and accessible, convenient for service provision, management, and use;

1.2. Uniform in size, color, and made from durable materials, ensuring aesthetics and safety;

1.3. Ensuring sufficient number of mailboxes corresponding to the number of addresses according to the building design;

1.4. Mailboxes within the centralized postal mailbox must be numbered or marked to clearly identify the registered recipient's address; have a minimum size sufficient to accommodate currently circulating letter sizes, books, and documents; have a separate lock for the user and a horizontal slot large enough to insert letters, documents, and books; the slot position should be designed below the top of the mailbox, sloping outward to prevent water entry and theft.

2. Regarding the installation of fixed telephone cable systems:

Buildings must be equipped with fixed telephone cable systems. The principles for installing fixed telephone cable systems are as follows:

2.1. Easily accessible and convenient for installation, connection, maintenance, management, and use;

2.2. Ensuring aesthetics, safety within the building, and fire prevention regulations;

2.3. Adhering to relevant industry standards and specifications;

2.4. Ensuring technical conditions so that enterprises with permits to provide fixed telephone services can connect at the distribution panel or wiring rack of the building to provide fixed telephone services according to the needs of users in the building.

3. Regarding the installation of television cable systems:

Buildings must be equipped with television cable systems used to receive terrestrial television signals. The television cable system includes signal receiving equipment and transmission systems. The principles for installing television cable systems are as follows:

3.1. Easily accessible and convenient for installation, connection, maintenance, management, and use; ensuring that users in the building can receive main television channels (free-to-air channels) of the Central Television Station and local television stations;

3.2. Ensuring aesthetics, safety within the building, and fire prevention regulations;

3.3. Adhering to relevant industry standards and specifications.

4. Postal mailboxes, fixed telephone cable systems, and television cable systems must be installed simultaneously with common technical infrastructure systems during the construction of the building.

5. Organizations and individuals involved in the installation of fixed telephone cable systems and television cable systems must have the necessary capacity as prescribed by laws on construction to ensure quality installation.

III. GUIDELINES FOR MANAGEMENT AND USE

1. Users in the building have the right to choose enterprises providing postal, courier, and fixed telephone services according to their needs.

2. Vietnam Post, courier enterprises, and enterprises with permits to provide fixed telephone services have equal rights to provide services to users in the building.

3. Management and exploitation of postal mailboxes, fixed telephone cable systems, and television cable systems shall be carried out in accordance with the provisions of the law on management and exploitation of common technical infrastructure systems and the internal regulations of the building.

4. Warranty and maintenance of postal mailboxes, fixed telephone cable systems, and television cable systems shall be carried out in accordance with the provisions of the law on warranty and maintenance of common technical infrastructure systems of the building and detailed guidance provided in Section IV of this Circular.

IV. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS RELATED TO CONSTRUCTION, INSTALLATION, MANAGEMENT, AND USE

1. The investor of the construction project has the responsibility:

1.1 Ensure the construction of projects is synchronized with the installation of mailboxes, telephone cable systems, and television cable systems within buildings, including from the design phase to the construction of technical infrastructure both inside and outside the building, ensuring safety, without affecting the functionality, architecture, aesthetics, and quality of the project;

1.2 Create conditions for fixed-line telephone service providers to deploy their transmission systems during the construction of buildings.

2. Building management enterprises, building management boards shall be responsible for:

2.1 Receiving, organizing management, use, warranty, and maintenance of mailboxes, fixed-line telephone cable systems, and television cable systems from the building's main junction box to each apartment's junction box under their management (including the main junction box and television signal receiving equipment). Maintenance costs are deducted from the building's maintenance fund;

2.2 Creating conditions for Vietnam Post, courier enterprises, and fixed-line telephone service providers to provide services to users within the building.

3. Vietnam Post, courier enterprises, and fixed-line telephone service providers shall be responsible for:

3.1 Fixed-line telephone service providers shall be responsible for investing in, managing, and maintaining their transmission systems up to the building's main junction box. Maintenance costs are borne by the enterprise;

3.2 Cooperating with project owners when required in the design and installation of mailboxes, fixed-line telephone cable systems;

3.3 Cooperating with building management enterprises, building management boards, and users when required in the management, use, warranty, and maintenance of mailboxes, fixed-line telephone cable systems within the building;

3.4 Providing service quality assurance in accordance with state management agency regulations and commitments made in service provision contracts signed with customers.

4. Users shall be responsible for:

4.1 Signing service provision and usage contracts with fixed-line telephone service providers or cable television service providers that charge fees. Paying all charges stipulated in the contract signed between both parties;

4.2 Protecting and maintaining mailboxes, fixed-line telephone cable systems, and television cable systems that belong to themselves and the building. Self-maintaining equipment and transmission systems belonging to them within their apartments;

4.3 Compensating according to the law and internal regulations of the building when damaging mailboxes, fixed-line telephone cable systems, or television cable systems of the building;

4.4 Preventing and promptly reporting to the building management board or competent authorities when discovering violations related to the management and use of mailboxes, fixed-line telephone cable systems, or television cable systems in the building.

V. RESPONSIBILITIES OF STATE MANAGEMENT AUTHORITIES

1. The Ministry of Information and Communications, the Ministry of Construction shall be responsible for:

1.1 Guiding the implementation of the contents of this Circular;

1.2 Issuing relevant technical standards and specifications within their authority concerning the design and installation of mailboxes, fixed-line telephone cable systems, and television cable systems in buildings;

1.3 Organizing inspections, supervision, and handling violations in accordance with the law.

2. Provincial People's Committees directly under the Central Government shall be responsible for directing specialized agencies to perform state management functions on their territory in accordance with the guidance of this Circular.

3. Departments of Posts and Telecommunications, Construction Departments:

3.1 Promoting, disseminating, and guiding the implementation of the contents of this Circular;

3.2 Inspecting, supervising, and handling violations in accordance with the law.

VI. IMPLEMENTATION

1. This Circular shall take effect fifteen days after its publication in the Official Gazette.

2. Organizations and individuals involved in the investment, construction, installation, management, and use of mailboxes, fixed-line telephone cable systems, and television cable systems in buildings shall be responsible for implementing this Circular.

3. Encourage the installation of mailboxes, fixed-line telephone cable systems, and television cable systems in accordance with the guidelines set out in this Circular for multi-story building projects with multiple users that have been approved but not yet implemented or are still ongoing, buildings completed before the effective date of this Circular, and other types of buildings.

4. Encourage the synchronous installation of cable systems to receive cable television signals with charges in buildings to ensure that cable television service providers can connect to provide services according to user needs within the building.

5. In the course of implementation, if issues arise or difficulties occur, organizations and individuals concerned should promptly reflect these to the two Ministries for consideration, guidance, or appropriate amendments and supplements.
