Pursuant to Decree No. 60/2003/NĐ-CP dated June 10, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decision No. 79/2007/QĐ-TTg dated May 31, 2007 of the Prime Minister approving the "National Action Plan on Biodiversity up to 2010 and Orientation up to 2020 to Implement the Convention on Biological Diversity and the Cartagena Protocol on Biosafety"

Pursuant to Decision No. 102/2007/QĐ-TTg dated July 10, 2007 of the Prime Minister approving the "Comprehensive Program to Enhance Management Capacity for Biosafety of Genetically Modified Organisms and Products Derived from Genetically Modified Organisms from now until 2010 to Implement the Cartagena Protocol on Biosafety"

The Ministry of Finance issues guidelines for the preparation, management, and use of state budget funds for implementing the National Action Plan on Biodiversity up to 2010 and Orientation up to 2020 to Implement the Convention on Biological Diversity and the Cartagena Protocol on Biosafety (including the Comprehensive Program to Enhance Management Capacity for Biosafety of Genetically Modified Organisms and Products Derived from Genetically Modified Organisms from now until 2010 to Implement the Cartagena Protocol on Biosafety) as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. These Circulars guide the preparation, management, and use of state budget funds for implementing tasks, projects, and programs according to Decision No. 79/2007/QĐ-TTg dated May 31, 2007 of the Prime Minister approving the "National Action Plan on Biodiversity up to 2010 and Orientation up to 2020 to Implement the Convention on Biological Diversity and the Cartagena Protocol on Biosafety" and Decision No. 102/2007/QĐ-TTg dated July 10, 2007 of the Prime Minister approving the "Comprehensive Program to Enhance Management Capacity for Biosafety of Genetically Modified Organisms and Products Derived from Genetically Modified Organisms from now until 2010 to Implement the Cartagena Protocol on Biosafety"

2. Funds for implementing tasks, projects, and programs led by ministries, ministerial-level agencies, and government agencies (hereinafter referred to as ministries and central agencies) shall be guaranteed by the central budget; funds for implementing tasks, projects, and programs led by localities shall be guaranteed by the local budget according to the current budget decentralization.

3. Agencies, units, and individuals using funds for tasks, projects, and programs must comply with the approved project content, follow established regulations, operate economically and effectively, be subject to inspection and supervision by competent authorities, and settle accounts annually and upon completion of the project according to current regulations.

II. SPECIFIC PROVISIONS

1. Sources of funds and expenditure items for implementing tasks, projects, and programs.

a) Expenditure from development investment funds:

- Establishing a monitoring network for natural resources and biodiversity in important wetland and marine areas.

- Upgrading key national laboratories capable of analyzing, assessing risks, and accurately identifying genetically modified organisms and products derived from genetically modified organisms.

- Investing in enhancing technical infrastructure and equipment for the national focal point agency and functional units under ministries responsible for biosafety management.

- Restoring and developing wetland and marine ecosystems.

b) Expenditure from vocational training funds:

- Training human resources for scientific research in modern biotechnology and biosafety.

- Training professionals with sufficient qualifications and capabilities in testing, risk assessment, risk management, analysis, and identification of genetically modified organisms and products derived from genetically modified organisms.

c) Expenditure from scientific research funds:

- Basic research on biological resources: biological and ecological characteristics of endemic and rare species and special and sensitive ecosystems.

- Scientific research and technology transfer in the field of biosafety management; detecting and accurately identifying genetically modified organisms, products, and goods derived from genetically modified organisms; analyzing, assessing risks, and managing biosafety for genetically modified organisms.

- Research, application, and development of indigenous knowledge, particularly about medicinal plants and traditional non-timber forest product processing crafts.

- Strengthening technical infrastructure, organizing accreditation of laboratories under research institutes and schools with the capability to analyze, identify, and determine genetically modified organisms and products derived from genetically modified organisms; assess risks, manage, and monitor risks caused by genetically modified organisms and products derived from genetically modified organisms.

d) Expenditure from economic service funds:

- Developing integrated coastal zone management plans; conservation displacement system planning for eight territorial regions; wetland and marine conservation area planning.

- Developing models for testing, risk assessment, management, and monitoring of risks related to genetically modified crops.

- Surveying and evaluating crop, livestock, and agricultural microorganism genetic resources.

- Assessing the status, exploitation, and utilization of timber and non-timber forest products; developing and implementing sustainable forest product development models and comprehensive resource management models for wetlands and marine areas that align with local community practices.

- Surveying and evaluating the potential of the national ecotourism network.

- Surveying and evaluating the status of mangrove forests; surveying, compiling files, and proposing recognition of internationally significant wetland conservation areas; building and nominating natural reserves meeting criteria for World Natural Heritage Sites, Biosphere Reserves, and ASEAN Heritage Parks.

- Developing and implementing models for conserving and developing rare native plant and animal species.

d) Expenditure from the environmental public service fund:

- To monitor and prevent invasive alien species that cause adverse impacts on the environment.

- To enhance the state management capacity regarding biosafety for managers under ministries, sectors, and localities.

- To promote education and raise community awareness about biodiversity and biosafety, risks associated with modern biotechnology and the use of modern biotechnology products, especially genetically modified organisms, products, and goods derived from genetically modified organisms that may pose risks; to strengthen social monitoring capacity regarding biosafety for genetically modified organisms and products and goods derived from genetically modified organisms.

- To establish, operate, and unify the management of databases and information on biodiversity and biosafety.

- To develop action programs on biodiversity suitable for different regions: Northeast, Northwest, Red River Delta, North Central Coast, South Central Coast, Central Highlands, Southeast, and Southwest.

- International cooperation in the conservation of biodiversity and biosafety; to expand and strengthen bilateral and multilateral cooperation with countries worldwide to learn experiences, attract investment, and improve biosafety management capacity in our country.

- Activities of the National Biosafety Council and Sectoral Biosafety Councils.

e) Expenditure from administrative management funds:

- To build and perfect legal regulatory documents, mechanisms, and policies on biodiversity management; on biosafety management.

- Activities of the Office of Assistance and Inter-ministerial Steering Committee implementing the National Action Plan.

g) Expenditure from other investment sources through bilateral and multilateral international cooperation programs and projects; funds from domestic and foreign enterprises, organizations, and individuals for biosafety management according to the provisions of the law.

2. Expenditure levels:

The level of expenditure for national action plan tasks, projects, and programs on biodiversity; on biosafety shall be implemented according to current financial expenditure standards and norms.

Based on the objectives, contents, and nature of the project, the budget estimate is prepared based on technical design, economic and technical norms, and appropriate unit prices approved by the competent authority. For contents and tasks without economic and technical norms and budgeted unit prices, the budget estimate is based on specific workload and current financial regulations.

Some regulations for each source of funding are as follows:

- Scientific research funding as prescribed in Circular Joint No. 44/2007/TTLT-BTC-BKHCN dated May 7, 2007, of the Ministry of Finance and the Ministry of Science and Technology guiding the establishment and allocation of budgets for scientific and technological projects using state budget funds and other current documents.

- Environmental public service funding as prescribed in Circular Joint No. 114/2006/TTLT-BTC-BTNMT dated December 29, 2006, of the Ministry of Finance and the Ministry of Natural Resources and Environment guiding the management of environmental public service funding.

- Public service training funding: For short-term training as prescribed in Circular No. 79/2005/TT-BTC dated September 15, 2005, of the Ministry of Finance guiding the management and use of training and cadre development funding for state officials. For overseas training as per Decision No. 356/QĐ-TTg dated April 28, 2005, of the Prime Minister approving the plan to train cadres at foreign institutions using state budget funds.

- Economic public service funding: As prescribed in Circular No. 120/2007/TT-BTC dated October 15, 2007, of the Ministry of Finance guiding the management, use, and settlement of public service funding for surveys from state budget sources and related documents.

- Expenditure for drafting and promulgating legal regulatory documents on biodiversity and biosafety management as prescribed in Circular No. 100/2006/TT-BTC dated October 23, 2006, of the Ministry of Finance guiding the management and use of state budget funding to ensure the work of building legal regulatory documents.

- Travel and conference allowances as prescribed in Circular No. 23/2007/TT-BTC dated March 21, 2007, of the Ministry of Finance guiding travel and conference allowances for state agencies and public service units; Circular No. 127/2007/TT-BTC dated October 31, 2007, of the Ministry of Finance amending and supplementing Circular No. 23/2007/TT-BTC dated March 21, 2007, and Circular No. 57/2007/TT-BTC dated June 11, 2007, of the Ministry of Finance.

- For construction investment capital according to current regulations on construction investment expenditure.

3. Budget Preparation, Execution, and Settlement

The preparation, execution, and settlement of public service funding (scientific research public service, training public service, environmental public service, economic public service), administrative management expenditure, and development investment capital for implementing biodiversity and biosafety tasks, projects, and programs shall be carried out in accordance with the State Budget Law and current guiding documents. This circular specifically guides the following contents:

a) Budget estimates for tasks, projects, and programs funded by public service funding:

- For tasks, projects, and programs implemented by ministries and central agencies: Based on the tasks, projects, and programs approved by the competent authority, the implementing unit prepares the annual budget estimate within its annual state budget expenditure report, which is reported to the ministry or central agency responsible for the task, project, or program for review and consolidation into the ministry or central agency's annual state budget report submitted to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and reporting to the Government for approval by the National Assembly as stipulated.

- For tasks, projects, and programs implemented by localities: Based on the tasks, projects, and programs approved by the competent authority, the implementing unit prepares the annual budget estimate within its annual state budget expenditure report, which is submitted to the main managing department for review and consolidation, then sent to the Department of Finance for consolidation into the locality's annual budget report to be reported to the provincial People's Committee for submission to the Provincial People's Council for approval as stipulated.

As for tasks, projects, and programs allocated from the environmental public service fund, the procedures for preparation and budget allocation shall be carried out in accordance with point b, Clause 3, Section II of Circular Joint Circular No. 114/2006/TTLT-BTC-BTNMT dated December 29, 2006, issued by the Ministry of Finance and the Ministry of Natural Resources and Environment guiding the management of environmental public service funds.

b) For tasks, projects, and programs funded by development capital.

The establishment and use of funds shall comply with current regulations on the management of construction investment capital and relevant documents issued by the Ministry of Finance guiding the management and settlement of investment capital and public service capital with an investment nature from state budget funds; guiding the annual settlement of investment capital according to the fiscal year and the final settlement of completed projects from state budget funds.

4. Reporting and inspection work.

- Annually, ministries, central agencies, and localities assigned to implement tasks, projects, and programs shall be responsible for reporting the implementation status to the Ministry of Natural Resources and Environment, which will also send reports to the Ministry of Finance and the Ministry of Planning and Investment. Annually, the Ministry of Natural Resources and Environment will compile the implementation status of the National Action Plan, the program to enhance capacity for biosafety management of genetically modified organisms and products derived from genetically modified organisms, and report to the Prime Minister.

- Ministries, central agencies, and localities assigned to implement tasks, projects, and programs shall cooperate with related ministries and agencies to conduct regular or spot inspections to ensure that tasks, projects, and programs are implemented for their intended purposes and effectively.

III. IMPLEMENTATION

This Circular takes effect fifteen days after its publication in the Official Gazette.

During implementation, if there are any difficulties, ministries, central agencies, and localities are requested to reflect them to the Ministry of Finance for research and resolution./.
