Guidelines for adjusting the monthly allowance from January 1, 2015 for retired village cadres pursuant to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Clause 2, Article 4 of Decree No. 09/2015/NĐ-CP dated January 22, 2015 of the Government on adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres;
After receiving the opinion of the Minister of Finance in Circular No. 2441/BTC-NSNN dated February 13, 2015;
The Minister of Home Affairs issues this Circular to guide the implementation of adjustments to the monthly allowance for retired village cadres from January 1, 2015, according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
Article 1. Scope of application
The subjects to which this Circular applies are village, ward, and town cadres who have retired and are receiving monthly allowances under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired elderly village cadres).
Article 2. Adjustment of Monthly Allowance
From January 1, 2015, implement the adjustment of the monthly allowance for retired elderly village cadres according to Article 2 of Decree No. 09/2015/NĐ-CP dated January 22, 2015 of the Government on adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres (hereinafter referred to as Decree No. 09/2015/NĐ-CP), increasing the monthly allowance by 8% over the amount of the allowance received in December 2014, specifically as follows:
1. Formula for adjusting the monthly allowance from January 1, 2015:
The monthly allowance received from January 1, 2015 = The monthly allowance received at the time of December 2014 x 1.08
In which: The monthly allowance received at the time of December 2014 is the allowance stipulated in Clause 2, Article 2 of Joint Circular No. 03/2013/TTLT-BNV-BTC dated July 31, 2013 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of adjustments to the monthly allowance from July 1, 2013 for retired village cadres under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
2. The monthly allowance received from January 1, 2015 of retired elderly village cadres (rounded off according to the calculation formula in Clause 1 of this Article) is as follows:
a) For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of the village: VND 1,568,000/month.
b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Heads of Public Security Stations: VND 1,512,000/month.
c) For other positions: VND 1,388,000/month.
Article 3. Implementation Organization
1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from January 1, 2015 according to these guidelines for the subjects within their jurisdiction.
2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.
3. When retired elderly village cadres move to a new legal place of residence within the same district, they must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs of the province; the transfer certificate must be accompanied by the file and decision when retiring (in case of loss, there must be a confirmation letter from the competent authority at the same level). The place of issuance will continue to pay the allowance to the transferred cadre. Retired elderly village cadres who moved to a new legal place of residence before the effective date of Decree No. 09/2015/NĐ-CP shall continue to be paid by the current paying entity.
Article 4. Effective date
1. This Circular takes effect from April 1, 2015.
2. The provisions of this Circular shall be implemented from January 1, 2015.
3. The provisions of this Circular replace the provisions of Joint Circular No. 03/2013/TTLT-BNV-BTC dated July 31, 2013 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of adjustments to the monthly allowance from July 1, 2013 for retired village cadres under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
During the implementation process, if there are any difficulties, please report them to the Ministry of Home Affairs for study and resolution./.
