CIRCULAR

Repealing certain regulatory legal documents issued jointly by the Minister of Justice

Pursuant to the Law on Legislative Documents dated June 22, 2015;

Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated May 14, 2016 detailing certain provisions and measures for implementing the Law on Legislative Acts of Regulations;

Decree No. 96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Department for Legal Document Inspection;

After reaching consensus with the Minister of Home Affairs, the Minister of Finance, the Minister of Public Security, and the Minister of Foreign Affairs, the Minister of Justice issues this Circular to abolish certain regulatory legal documents issued by the Minister of Justice and jointly issued documents.

This Circular takes effect from January 25, 2026.

Abolish entirely the following legal normative documents issued by the Minister of Justice and jointly issued:

1. Circular No. 04/1999/TT-BTP dated January 11, 1999, issued by the Minister of Justice on the regulations for using telephones in people's courts and local civil enforcement agencies;

2. Circular No. 07/2002/TT-BTP dated December 16, 2002, issued by the Minister of Justice guiding the implementation of certain provisions of Decree No. 68/2002/NĐ-CP dated July 10, 2002, of the Government detailing the implementation of certain provisions of the Law on Marriage and Family regarding marital and family relations involving foreign elements;

3. Decision No. 1145/2005/QĐ-BTP dated May 18, 2005, issued by the Minister of Justice on the issuance of the Working Regulations of the Selection Council for Enforcement Officers of Civil Enforcement Agencies;

4. Circular No. 06/2005/TT-BTP dated June 24, 2005, issued by the Minister of Justice guiding the selection, appointment, removal, and dismissal of enforcement officers;

5. Joint Circular No. 08/2005/TTLT-BTP-BTC dated September 16, 2005, issued by the Minister of Justice and the Minister of Finance guiding the implementation of the management, allocation, and issuance of enforcement officer cards, uniforms, and insignias for civil servants engaged in civil enforcement work;

6. Joint Circular No. 01/2006/TTLT-BTP-BNV-BTC dated May 23, 2006, issued by the Minister of Justice, the Minister of Home Affairs, and the Minister of Finance guiding the implementation of Decision No. 233/2005/QĐ-TTg dated September 26, 2005, of the Prime Minister on the allowance for responsibility based on profession for Enforcement Officers and Notaries;

7. Joint Circular No. 05/2006/TTLT-BTP-BCA dated August 29, 2006, issued by the Minister of Justice and the Minister of Public Security guiding the provision, management, and use of support tools for civil enforcement agencies;

8. Joint Circular No. 01/2007/TTLT-BTP-BNV dated March 29, 2007, issued by the Minister of Justice and the Minister of Home Affairs guiding the organization and personnel of provincial and centrally-administered city civil enforcement agencies;

9. Joint Circular No. 09/2008/TTLT-BTP-BNV-BTC dated November 27, 2008, issued by the Minister of Justice, the Minister of Home Affairs, and the Minister of Finance guiding the implementation of Decision No. 86/2007/QĐ-TTg dated June 11, 2007, of the Prime Minister on the allowance for responsibility based on profession for civil enforcement examination officers;

10. Joint Circular No. 09/2010/TTLT-BTP-BTC-BNV dated May 4, 2010, issued by the Minister of Justice, the Minister of Finance, and the Minister of Home Affairs guiding the implementation of Decision No. 74/2009/QĐ-TTg dated May 7, 2009, of the Prime Minister stipulating the system of allowances for judicial appraisal;

11. Joint Circular No. 11/2010/TTLT-BTP-BNV dated June 17, 2010, issued by the Minister of Justice and the Minister of Home Affairs guiding the implementation of the right to self-management and self-responsibility for the performance of tasks, organizational structure, staffing, management, and use of civil servants for public institutions under the Ministry of Justice;

12. Circular No. 05/2014/TT-BTP dated February 7, 2014, issued by the Minister of Justice guiding the publication and posting of administrative procedures and reporting on the situation and results of administrative procedure control;

13. Circular No. 19/2014/TT-BTP dated September 15, 2014, issued by the Minister of Justice regulating the entry, uploading, exploitation of data on administrative procedures on the national database of administrative procedures and managing the Administrative Procedure Database;

14. Circular No. 25/2014/TT-BTP dated December 31, 2014, issued by the Minister of Justice guiding the inspection of the implementation of administrative procedure control activities.

Article 2. Repealing part of legal normative documents

1. Abolish part of Joint Circular No. 05/2010/TTLT-BTP-BNG-BCA dated March 1, 2010, issued by the Minister of Justice, the Minister of Foreign Affairs, and the Minister of Public Security guiding the implementation of Decree No. 78/2009/NĐ-CP dated September 22, 2009, of the Government detailing and guiding the implementation of certain provisions of the Law on Vietnamese Nationality as follows:

a) The content "granting Vietnamese nationality to stateless persons according to Article 22 of the Law on Vietnamese Nationality; registering to retain Vietnamese nationality" at Article 1;

b) Article 7;

c) The phrase "registering to retain Vietnamese nationality" at Article 8, Article 12.

2. Abolish part of Circular No. 07/2014/TT-BTP dated February 24, 2017, issued by the Minister of Justice guiding the assessment of impact and review of administrative procedures as follows:

a) The content "review and assess administrative procedures" at Article 1;

b) Clause 3, Clause 4 of Article 2; Clause 2, Clause 3 of Article 3;

b) The content "Administrative procedure control agency, including: the Department of Administrative Procedure Control under the Ministry of Justice" at Clause 2 of Article 4;

c) Chapter III (including the chapter name; Article 11; Article 12; Article 13; Article 14);

d) Article 15.

3. Abolish some forms attached to Circular No. 04/2016/TT-BTP dated March 3, 2016, issued by the Minister of Justice stipulating certain contents of statistical activities of the Ministry of Justice as follows:

a) Form 07a/BTP/KSTT/KTTH on the number of administrative procedures, regulatory legal documents containing administrative procedures that have been published and made public;

b) Form 07b/BTP/KSTT/RSĐGH on the results of reviewing and simplifying administrative procedures;

c) Form 08/BTP/KSTT/PAKN on the results of receiving and processing complaints and suggestions about administrative regulations.

Article 3. Implementation Organization

1. This Circular takes effect from March 20, 2018.

2. The Director of the Department of Legal Document Review, Heads of units under the Ministry of Justice, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
