Ordinance No. 01/2018/UBTVQH14 Amending and supplementing some articles of four ordinances related to planning

ORDINANCE
 AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF FOUR LEGISLATIONS RELATED TO PLANNING Pursuant to Decision No. 74/2018/QH14 dated November 20, 2018 of the National Assembly at its sixth session, the 14th National Assembly term; 

On the basis of the Constitution of the Socialist Republic of Vietnam;

BASED ON THE DECREE NUMBER 05/2022/ND-CP dated January 7, 2022 amending and supplementing certain provisions of the Decree Number 53/2019/ND-CP dated June 17, 2019 of the Government; The Standing Committee of the National Assembly issues the Ordinance

amending and supplementing certain articles related to planning of the Defense Industry Ordinance number 02/2008/PL-UBTVQH12, Market Management Ordinance number 11/2016/UBTVQH13, qLibrary Ordinance number 31/2000/PL-UBTVQH10, Preferential Treatment for Persons with Meritorious Service in the Revolution Ordinance number 26/2005/PL-UBTVQH11 which have been amended and supplemented certain articles according to Ordinance No. 04/2012/UBTVQH13. Article 1. Amending and supplementing certain articles of the Defense Industry Ordinance

"1. Disclosing state secrets about the construction and development of the defense industry in the planning system of defense works, military zones, ammunition warehouses, defense industries, plans for building and developing the defense industry, scientific and technological results related to the defense industry, production tasks serving national defense and security."

PLAN FOR BUILDING AND DEVELOPING THE DEFENSE INDUSTRY

"Chapter III

Article 12. Plan for building and developing the defense industry

1. The plan for building and developing the defense industry must comply with the principles stipulated in Article 4 of this Ordinance and meet the following requirements:

a) Effectively exploiting and utilizing all potential and resources of the country to build and develop the defense industry; ensuring that weapons and military technical equipment become increasingly modern and advanced;

c) Consistent with the national socio-economic development plan.

b) Ensuring balance, synchronization, and reasonable scale, being appropriately arranged in strategic areas;

2. The basis for building the plan for building and developing the defense industry includes:

a) National defense and security tasks and socio-economic development tasks of the country;

b) Strategy for ensuring weapons and military technical equipment for the people's armed forces;

c) Planning system of defense works, military zones, ammunition warehouses, defense industries;

d) National industrial development plan, ability to balance State investment resources for building and developing the defense industry.

3. Contents of the plan for building and developing the defense industry include:

a) Determining objectives, tasks, key programs, and projects;

b) Organizing the defense industry system.

Article 13. Approval authority for the plan for building and developing the defense industry

c) Balancing resources, conditions for assurance, and implementation solutions.

1. The Prime Minister approves the plan for building and developing the defense industry.

2. The Ministry of National Defense takes the lead and coordinates with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant state agencies in drafting the plan for building and developing the defense industry to submit to the Prime Minister for approval.

Article 14. Drafting, approving, and implementing investment programs and projects on the defense industry

Based on the planning system of defense works, military zones, ammunition warehouses, defense industries, and the plan for building and developing the defense industry approved by the Prime Minister, the Ministry of National Defense leads and coordinates with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant state agencies in drafting investment programs and projects on the defense industry to submit to the Prime Minister for decision and implementation.

On the basis of the planning for the system of national defense works, military zones, ammunition depots, defense industry, and the construction and development plan for the defense industry which has been approved by the Prime Minister, the Ministry of National Defense shall take the lead, coordinate with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant state agencies to develop investment programs and projects for the defense industry, submit them to the Prime Minister for decision, and organize their implementation.

Article 15. Inspection and supervision of the implementation of plans, programs, and investment projects related to national defense industry

The Ministry of Planning and Investment, the Ministry of National Defense, the Ministry of Industry and Trade, the Ministry of Finance, and other relevant ministries and sectors shall organize inspections and supervisions within their respective duties and authorities on the implementation of construction and development of the national defense industry in the planning of national defense facilities, military zones, ammunition depots, national defense industry, plans, programs, and investment projects related to the national defense industry.

3. Amend and supplement Article 19 as follows:

"Article 19. Land for national defense industry

1. The Prime Minister shall approve the planning and land use plan for national defense, including land for the national defense industry.

2. The Ministry of National Defense shall take the lead and coordinate with competent state agencies to establish the planning and land use plan for national defense, including land for the construction and development of core national defense industrial bases, to be submitted to the Prime Minister for approval and implementation.

4. Amend and supplement Clause 2 of Article 24 as follows:

"2. Develop and implement policies, plans, and tasks related to the national defense industry, contents of construction and development of the national defense industry in the planning of national defense facilities, military zones, ammunition depots, and the national defense industry."

Article 2. Amend and supplement Point a of Clause 1 of Article 4 of the Market Management Ordinance

Amend and supplement Point a of Clause 1 of Article 4 as follows:

"a) Develop and direct the implementation of strategies and plans for the development of market management forces;"

Article 3. Amend and supplement Clause 1 of Article 24 of the Library Ordinance

Amend and supplement Clause 1 of Article 24 as follows:
"1. Develop and direct the implementation of strategies and plans for the development of various types of libraries; organize the establishment of plans for developing library networks in cultural and sports facility networks and other related plans;"

Article 4. Amend and supplement Clause 2 and Clause 3 of Article 34a of the Preferential Treatment for Persons with Meritorious Service in the Revolution Ordinance

Amend and supplement Clause 2 and Clause 3 of Article 34a as follows:
"2. Organize the establishment of planning for the system of social care and rehabilitation facilities for persons with meritorious service in the revolution, and submit it to the Prime Minister for approval in accordance with the law on planning; manage the system of social care and rehabilitation facilities for persons with meritorious service in the revolution;

3. Coordinate with relevant agencies in the development of plans to determine memorials for martyrs in related planning; regulations on the management of memorials for martyrs;"

Article 5. Effective Date

This Ordinance takes effect from January 1, 2019.
