Ordinance No. 01/2018/UBTVQH14 amending and supplementing certain articles related to planning in the Defense Industry Ordinance No. 02/2008/PL-UBTVQH12, Market Management Ordinance No. 11/2016/UBTVQH13, Library Ordinance No. 31/2000/PL-UBTVQH10, and Preferential Treatment for Persons Contributing to the Revolution Ordinance No. 26/2005/PL-UBTVQH11 which have been amended and supplemented according to Ordinance No. 04/2012/UBTVQH13.

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF FOUR ORDINANCES

RELATED TO PLANNING

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to Resolution No. 74/2018/QH14 dated November 20, 2018 of the National Assembly on the sixth session of the 14th National Assembly;

The Standing Committee of the National Assembly promulgates this Ordinance amending and supplementing certain articles related to planning of the Defense Industry Ordinance No. 02/2008/PL-UBTVQH12, Market Management Ordinance No. 11/2016/UBTVQH13, Library Ordinance No. 31/2000/PL-UBTVQH10, and Preferential Treatment for Persons with Meritorious Service in the Cause of National Liberation and Defense Ordinance No. 26/2005/PL-UBTVQH11 which have been amended and supplemented by Ordinance No. 04/2012/UBTVQH13.

Article 1. Amendments and supplements to certain articles of the Defense Industry Ordinance

1. Amending and supplementing Clause 1 of Article 6 as follows:

"1. Disclosing state secrets about construction and development of the defense industry in the planning system of defense works, military zones, ammunition depots, defense industries, plans for construction and development of the defense industry, results of science and technology related to the defense industry, production tasks serving national defense and security."

2. Amending and supplementing Chapter III as follows:

"Chapter III

PLAN FOR CONSTRUCTION AND DEVELOPMENT OF THE DEFENSE INDUSTRY

Article 12. Plan for construction and development of the defense industry

1. The plan for construction and development of the defense industry must comply with the principles stipulated in Article 4 of this Ordinance and meet the following requirements:

a) Exploiting and utilizing all potential and resources of the country effectively to build and develop the defense industry; ensuring that weapons and military technical equipment become increasingly modern and advanced;

b) Ensuring balance, synchronization, and reasonable scale, being appropriately arranged in strategic areas;

c) Being consistent with the national socio-economic development plan.

2. The basis for building the plan for construction and development of the defense industry includes:

a) National defense and security tasks and socio-economic development tasks of the country;

b) Strategy for ensuring weapons and military technical equipment for the people's armed forces;

c) Planning system of defense works, military zones, ammunition depots, defense industries;

d) National industrial development plan, ability to balance State investment resources for construction and development of the defense industry.

3. Contents of the plan for construction and development of the defense industry include:

a) Determining objectives, tasks, key programs, and projects;

b) Organizing the system of defense industry facilities;

c) Balancing resources, conditions for assurance, and implementation solutions.

Article 13. Authority to approve the plan for construction and development of the defense industry

1. The Prime Minister approves the plan for construction and development of the defense industry.

2. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant agencies to build the plan for construction and development of the defense industry to be submitted to the Prime Minister for approval.

Article 14. Building, approving, and implementing investment programs and projects on the defense industry

Based on the planning system of defense works, military zones, ammunition depots, defense industries, and the plan for construction and development of the defense industry approved by the Prime Minister, the Ministry of National Defense shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Industry and Trade, the Ministry of Finance, and relevant agencies to build investment programs and projects on the defense industry to be submitted to the Prime Minister for decision and implementation.

Article 15. Inspection and supervision of the implementation of plans, programs, and investment projects related to national defense industry

The Ministry of Planning and Investment, the Ministry of National Defense, the Ministry of Industry and Trade, the Ministry of Finance, and other relevant ministries and sectors shall organize inspections and supervisions within their respective duties and authorities on the implementation of construction and development of the national defense industry in the planning of national defense facilities systems, military zones, ammunition depots, national defense industries, plans, programs, and investment projects related to the national defense industry.

3. Amend and supplement Article 19 as follows:

"Article 19. Land for national defense industry

1. The Prime Minister shall approve the planning and utilization plan for national defense land, including land for the national defense industry.

2. The Ministry of National Defense shall take the lead and coordinate with competent state agencies to establish the planning and utilization plan for national defense land, including land for constructing and developing core national defense industry facilities, to be submitted to the Prime Minister for approval and implementation.

4. Amend and supplement Clause 2 of Article 24 as follows:

"2. Develop and implement policies, plans, and tasks related to the national defense industry, including the content of building and developing the national defense industry in the planning of national defense facilities systems, military zones, ammunition depots, and national defense industries."

Article 2. Amend and supplement Point a of Clause 1 of Article 4 of the Market Management Ordinance

Amend and supplement Point a of Clause 1 of Article 4 as follows:
"a) Develop and direct the implementation of strategies and plans for the development of market management forces;"

Article 3. Amend and supplement Clause 1 of Article 24 of the Library Ordinance

Amend and supplement Clause 1 of Article 24 as follows:
"1. Develop and direct the implementation of strategies and plans for the development of various types of libraries; organize the establishment of plans for developing library networks in cultural and sports facility network planning and other related planning;"

Article 4. Amend and supplement Clause 2 and Clause 3 of Article 34a of the Preferential Treatment for Persons with Meritorious Service in the Revolution Ordinance

Amend and supplement Clause 2 and Clause 3 of Article 34a as follows:
"2. Organize the establishment of planning for the system of social care and convalescent facilities for persons with meritorious service in the revolution and submit it to the Prime Minister for approval in accordance with the law on planning; organize the management of the system of social care and convalescent facilities for persons with meritorious service in the revolution;" 3. Coordinate with relevant agencies in the development of proposals for determining memorials to martyrs in related planning; regulations on the management of memorials to martyrs;"

This Ordinance shall take effect from January 1, 2019.

Article 5. Effective Date

This Ordinance takes effect from January 1, 2019.
